HomeMy WebLinkAboutORD 10-093 ORDINANCE NO.10-093 ENTITLED AN ORDINANCE OVERTURNING THE DECISION OF THE HISTORIC LANDMARK COMMISSION TO DENY AN APPLICATION FOR A CERTIFICATE OF APPROPRIATENESS TO DEMOLISH THE PROPERTY LOCATED AT 1315 CALDER AVENUE, BEAUMONT, TEXAS, AND APPROVING SAID APPLICATION. WHEREAS, the City of Beaumont Building Codes Division tagged 1315 Calder as a substandard structure on May 5, 2006; and, WHEREAS, on February 12,2008, Greg Riley,the property owner,was granted a HC-L (Historical-Cultural Landmark Preservation) designation by City Council allowing an additional two years to bring the structure up to minimum building standards; and, WHEREAS, Mr. Riley failed to bring the house into compliance and desires to see the house demolished; and, WHEREAS,on February 9,2010,the City of Beaumont Building Codes Division applied to the Historic Landmark Commission for a Certificate of Appropriateness to demolish the house at 1315 Calder Avenue; and, WHEREAS, on July 12, 2010, the Historic Landmark Commission conducted a public hearing to consider the application for the Certificate of Appropriateness, and, WHEREAS, at the conclusion of the public hearing,the Historic Landmark Commission voted 6:1 to deny the request for demolition of the house at 1315 Calder Avenue; and, WHEREAS,Section 30-21(h)6 of the Code or Ordinances of the City of Beaumont gives the applicant the right to appeal a decision of the Historic Landmark Commission to deny a Certificate of Appropriateness to the City Council; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, That after considering the evidence and testimony of the witnesses, the City Council hereby finds and declares that the decision of the Historic Landmark Commission to deny the application of Greg Riley for a Certificate of Appropriateness to demolish the property at 2185 South Street, Beaumont, Texas, should be overturned. That the application of Greg Riley for a Certificate of Appropriateness to demolish the property at 1315 Calder Avenue, Beaumont, Texas is hereby approved.
