BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute a contract, substantially
in the form attached hereto as Exhibit 'A," with the owner of a home flooded during
Hurricane Ike forthe provision of relocation assistance through the Hazard Mitigation Grant
Program's Acquisition and Demolition Program as described below:

OWNER.RELOCATION AGREEMENT
THIS AGR EMENU"r is made and entered into this- day of 2010, by and
between the City of Beaumont, Texas, hereinafter to as -CTMI and Ehorn WiWs4eubert,
h ebmfter referred to as the"RECJ?1T N7."
WTT_NESSETH:
The CITY is acting under a federal grant from the Tatas Deparhneut of Public Safety, Cravmor-s
Diwtou of Emergency Management(OVEK to purchase certain property in.Beaumont, Texas in which the
SET.r ER owns a parcel of land k aovm by the physical address, 3105 TWWerro and described as Dart of Mt
Olive Lot 16 and Lot 17,Block 3 Abstract 045250,(the"Properry'�in which the RECIPIENT asides.
THAT,the State and FEMA have allocated additional grant funds to assist the RECLKENT in finding
and aftding a decent,safe,and sanitary replacement home,outside of the Iloodplain,
THAT,the RECIPIENT was the Owner of the above-referenced Property and entered into a voluntary
agreerrrent to sell the abovo-referenced Property to CITY.
,HAT, the RECIPIENT represents that she resided m the above-referenced residence and that the
RECIPIENT meets the qualification requirements for Environmental Justice Relocation Assistance.
NOW,T.ITEREFORE,CITE'and the RECM"7r�NT(collectively,the"Parties' agree as follows:
1. CITY agrees to pay the RECIPIENT the sum of Twenty Two Thousand Five hundred and N01100
($22,500.00)payable upon acceptance of this Agreement by both patties and after the RECIPIENT
has vacated the above-referenced Property.
2. The amount to be paid was determined in accordance with applicable procedures as follow s:

3. The RECIPIENT acknowledges that this payment will satisfy any and all obligations of the CITY
as to this transaction and agrees to accept this payment as oomplcte and full compensation.
4. The RECIPMNT acknowledges that he has had an opportunity to review this Agreement and that
he has had an opportunity, if he so chooses, to contact an attomey of his clwice to review this
Agreement and the REC1PMN7 enters into this Agreement fully understanding the=ure thereof and
saves and holds bazm' the CITY as a result of tis Agreement or anything incidrut to the purchase
of the above-referenced Property.
This Agreement is binding upon the heirs,executors,successors,and assigns of the Parties.
