REQUESTED ACTION: Consider authorizing the City Manager to enter into a contract for
the provision of relocation assistance for the owner of a house
flooded during Hurricane Ike in conjunction with the approved
Hazard Mitigation Grant Program's Acquisition and Demolition
Program.
RECOMMENDATION
The Administration recommends approval.
BACKGROUND:
As a result of Hurricane Ike, some homes located within the floodplain, east of Pine Street,
received flood damage. Because the City's floodplain land use ordinance requires that homes in
the floodplain that are substantially damaged be elevated prior to repair, many residents have
found elevating their homes and repairing them difficult if not impossible.
In order to provide relief to the residents and avoid future, repetitive flooding of these homes, the
City applied for Hazard Mitigation funds to acquire and demolish these homes. The City was
successfully awarded this grant for acquisition and removal of sixteen(16) homes. To date, we
have inspected and secured appraisals for each of the sixteen(16) homes and made purchase and
relocation offers. The amount of relocation assistance is based on the grant formula and differs,
depending upon the resident's desire to secure rental housing or purchase a new home.

This grant provides seventy-five percent(75%) of the costs, with a required twenty-five percent
(25%) local match, which will be paid through a reallocation of 2008 Program Year CDBG
demolition funds. It is expected that additional purchase contracts will be forthcoming as offers
are accepted by the homeowners. Once these properties are acquired, the City will demolish
these homes and deed restrict the properties, to prevent future flooding losses. These costs will
also be covered by the grant.
BUDGETARYIMPACT
Funds for this local match are available through the 2008 Program Year CDBG Budget.

REQUESTED ACTION: Council consider authorizing the City Manager to renew an
agreement for the use of the stables at Tyrrell Park.
RECOMMENDATION
The Administration recommends approval.
BACKGROUND
On December 22, 2009, the City Manager was authorized to renew a six-month agreement with
Danielle Sams for the use of the Tyrrell Park Stables property. This agreement required Mrs.
Sams to clean, improve, and maintain the barn property and its associated grounds and pastures
located north of the stables road. The Parks and Recreation Department has responsibility for all
of the property south of the stables road and has an office there.
Mrs. Sams is continuing to meet her obligations under the agreement and has put substantial
work into the property which is noticeably more attractive and well kept. Mrs. Sams will
continue making improvements to the property to support a sustainable stables operation there.
The updated agreement provides for annual renewals by agreement of the parties and contains a
30 day cancellation clause.
Based on satisfactory performance, Mrs. Sams is requesting that the agreement be renewed.
The riding trails will continue to remain open to the general public.
BUDGETARYIMPACT
Mrs. Sams will pay for her utilities and $350 per month for rent.

Agreement between the City of Beaumont and Danielle Sams
for the use of Tyrrell Park Stables Property
In order to allow and support equestrian and stables related activities, the City agrees to
allow Danielle Sams access to the Tyrrell Park Stables property subject to the conditions detailed
below.
Property Description
Barn Property - Mrs. Sams will control the barn and its associated pastures north of the stables
road to Downs Road extended.
Term
This agreement will have a term of twelve months, beginning July 1, 2010, and may be extended
for additional twelve month periods by agreement of the parties.
Insurance
Mrs. Sams will maintain $1,000,000 in liability insurance with the city named as an Additional
Insured.
Clean Up and Maintenance
Barn Property and Pastures - Mrs. Sams will clean and maintain the grounds, structures, and
fences. Structural elements which are added will be similarly well maintained. The mowing
schedule will be coordinated with the City, so that the grounds complement the surrounding park
property.
Payment
Mrs. Sams will pay the City $350 per month for rent and be responsible for the utilities for the
Barn Property. The rent is due at the first of the month and late on the 10`h. Utility payments
will be invoiced and paid with the next rental payment. The City's Cash Management Office will
issue payment instructions.
Cancellation
This agreement may be cancelled by either party with 30 days written notice delivered in person
or by certified mail, return receipt requested, to the addresses listed below.

The Administration recommends the establishment of a 10' x 134' General Utility Easement
adjacent to the existing west right of way line of Pearl near College Street.
BACKGROUND
The City of Beaumont is requesting a General Utility Easement be established adjacent to the
existing west right of way line of Pearl near College Street (out of Lots 172 and 183, Block 38
of the Beaumont Townsite Subdivision). Utilities already exist at this location. An easement
would allow for Entergy to remove two (2) existing power poles and for Time Warner Cable to
relocate their fiber optic cable.

RESOLUTION NO.
WHEREAS, the City of Beaumont owns property described as Lots 172 and 183,
Block 38, of the Beaumont Townsite Subdivision, Jefferson County, Texas; and
WHEREAS, the City wishes to establish a 10' x 134' general utility easement on
said property adjacent to the existing west right-of-way line of Pearl near College Street,
as described in Exhibit "A" and shown on Exhibits "B" and "C" attached hereto, for the

Conduct an election of Mayor Pro Tempore
According to the City Charter, the City Council shall elect one of its members as Mayor Pro
Tempore for a one(1)year term. The Mayor Pro Tempore shall perform the duties of the Mayor in
case of the absence or inability of the Mayor to perform the duties of the office, and, if a vacancy
occurs, shall become Mayor for the unexpired term. If the Mayor Pro Tempore is unwilling to
assume the duties of Mayor in the event of a vacancy in that office, then the City Council shall
appoint a Mayor Pro Tempore from its membership.

REQUESTED ACTION: Council consider a request for a zone change from NC

of Highland and Pipkin.
RECOMMENDATION
The Administration recommends approval of the zone change and the specific use permit subject
to the following conditions:
• Install a sidewalk along the Highland and Pipkin street frontages
• Redesign the driveway on Pipkin to allow one lane for ingress and one lane for
egress.
• Install an 8' tall wood screening fence along the west property line.
BACKGROUND
Bob Gage for GBT Realty Corporation has applied for a zone change and specific use permit.
The applicant states that the reason for the zone change is to allow a 9,000 sq. ft. Dollar General
Discount Store to be built. Under the current NC zoning, only a 4,000 sq. ft. structure could be
built. This size restriction would be impractical for the type of store that Dollar General builds.
This rezoning could be considered spot zoning. Property to the north, south and east is zoned
NC. To the west and east is zoned RS (Residential Single Family Dwelling) District.
Issues to consider when determining if a request is spot zoning includes the following:
1. The law demands that the approved zoning plan should be respected and not altered for
the special benefit of the landowner when the change will cause substantial detriment to
the surrounding land or serve no substantial public purpose.
The Comprehensive Plan designates this area as "Conservation and Revitalization". As
such, the Plan recognizes that there is an immediate need to prevent further deterioration
of the neighborhood. The South Park Neighborhood Plan identifies this part of Highland
Avenue as "General Commercial". This designation suggests commercial development
that would allow for buildings that exceed 4,000 sq. ft.
This area has seen very little commercial development in the past several years. In 2002,
City Council approved a zone change from RCR to GC-MD-2 for 0.90 acres of property
located at 4825 Highland to allow the construction of an 8,000 sq. ft. Family Dollar Store.
While the current zoning suggests limiting building size to 4,000 sq. ft., the factors must
be weighed against each other as to whether this development will be detrimental to the
surrounding area or whether this development will serve substantial public purpose. The
Planning Manager believes that the proposed use will not be detrimental to the
surrounding area and will serve a strong public need as a viable retail establishment in the
South Park area. This business will serve the South Park and Charlton-Pollard
neighborhoods.
2. Will the change adversely impact the surrounding properties?
Again, the Planning Manager does not feel that the proposed change will adversely
impact the surrounding properties. There are other commercial properties in the
immediate area, some vacant and dilapidated. The subject property itself was once the
site of the South Park Theater. The Dollar General will generate much less traffic than
the theater.
3. Is the tract of land suitable or unsuitable for use as presently zoned?
As presently zoned, a variety of commercial uses would be allowed. However, any
building would be limited to 4,000 sq. ft. GC-MD-2 zoning is the most restrictive zoning
district that would require a specific use permit for the proposed use and allow a building
larger than 4,000 sq. ft.
4. Does the proposed zone change bear a substantial relationship to the public health, safety,
morals or general welfare or protect and preserve historical and cultural places and areas?
The proposed retail store will provide a safe, clean environment to meet the shopping
needs of the residents living in the surrounding neighborhoods. In addition, it will
hopefully encourage more commercial uses along Highland Avenue which has
historically been one of the commercial arteries of the South Park neighborhood.
At a Joint Public Hearing held June 21, 2010, the Planning Commission voted 8:0 to approve a
zone change from NC to GC-MD-2 District and a specific use permit to allow a retail store in a
GC-MD-2 (General Commercial-Multiple Family Dwelling-2) District on property located on the
southwest corner of Highland and Pipkin subject to the following conditions:
• Install a sidewalk along the Highland and Pipkin street frontages
• Redesign the driveway on Pipkin to allow one lane for ingress and one lane for
egress.
• Install an 8'tall wood screening fence along the west property line.
BUDGETARY IMPACT

ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE
PERMIT TO ALLOW A RETAIL STORE IN A GC-MD-2
(GENERAL COMMERCIAL-MULTIPLE FAMILY DWELLING-
2)DISTRICT LOCATED ON THE SOUTHWEST CORNER OF
HIGHLAND AND PIPKIN IN THE CITY OF BEAUMONT,
JEFFERSON COUNTY, TEXAS.
WHEREAS, the City Council forthe City of Beaumont desires to issue a specific use
permit to GBT Realty Corporation to allow a retail store in a GC-MD-2 (General
Commercial-Multiple Family Dwelling)District located on the southwest corner of Highland
and Pipkin, being Lots 10-15, Block 50, Jef Chaison 2nd Addition, City of Beaumont,
Jefferson County, Texas, containing 1.03 acres, more or less, as shown on Exhibit "A"
attached hereto; and, I
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens, subject to the
hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That a specific use permit to allow a retail store in a GC-MD-2 (General Commercial-
Multiple Family Dwelling) District located on the southwest corner of Highland and Pipkin,
being Lots 10-15, Block 50, Jef Chaison 2nd Addition, City of Beaumont, Jefferson County,
Texas, containing 1.03 acres, more or less, is hereby granted to GBT Realty Corporation,
its legal representatives, successors and assigns, as shown on Exhibit"A,"attached hereto
and made a part hereof for all purposes, subject to the following conditions:
• Install a sidewalk along the Highland and Pipkin street frontages
• Redesign the driveway on Pipkin to allow one lane for ingress and one lane for
egress.
• Install an 8' tall wood screening fence along the west property line.
Section 2.
That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as Exhibit "B"
and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein above
described shall be in all other respects subject to all of the applicable regulations contained
in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended, as well as
comply with any and all federal, state and local statutes, regulations or ordinances which
may apply.

regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as
amended.
Section 3.
That if any section, subsection, sentence, clause of phrase of this ordinance, or the

RECOMMENDATION

BACKGROUND
Calvary Tabernacle has applied for a specific use permit.
Calvary Tabernacle currently has a church at 1135 Chamberlin. It has been there for more than
30 years. With the selection of a new pastor in 2007, the church has grown to where it now
needs to expand its facilities. The Chamberlin location does not allow for the needed expansion.
Therefore, the church would like to purchase the subject 4.1 acres on the south side of
Washington, approximately 140' east of Blossom Drive.
The proposed facility will include a 17,000 sq. ft. sanctuary and classrooms building, an 8,000
sq. ft. Family Life Center, a 2,600 covered pavilion, a 5,400 sq. ft. play ground area and related
parking.
After hearing public comments at the May 24, 2010 hearing, Rev. Vickery sent a letter stating
that the church would provide an 8'tall wood screening fence and a 15'wide landscape strip
along the south and west sides of the property as well as provide underground drainage,
landscape islands in the parking lot and a sidewalk along Washington.
At a Joint Public Hearing held June 21, 2010, the Planning Commission voted 4:4 on a motion to
approve a specific use permit to allow a church in an RS (Residential Single Family Dwelling)
District on property located on Washington Boulevard, east of Blossom Drive.
The Planning Commission forwarded this item with no recommendation.

BACKGROUND
Jim Ishee, Chairman of the Jim Gilligan Way Support Committee, has applied for a request for a
name change to Jim Gilligan Way for that portion of E. Florida Avenue located between Martin
Luther King, Jr. Parkway and University Drive.
Mr. Ishee states that the purpose of this request is to honor Lamar University's Baseball Coach
Jim Gilligan who has given 33 years to working with young men.
Mr. Gilligan's head-coaching tenure at Lamar is split into two different periods. In his first stint,
he tutored the Cardinals for fourteen seasons (1973-1986) and guided LU to seven Southland
Conference championships, six NCAA Regional appearances and two zone titles. His teams
played twice in NCAA regional semifinals, one step away from a shot at the College World
Series. He garnered his 5001h victory in 1986, becoming the youngest head coach to do so at the
time.
Following a five-year foray into professional baseball, Gilligan returned to Lamar for the 1992
season. Wasting little time in rebuilding the program, the Cardinals won the 1993 Sun Belt
Championship and advanced to the NCAA Central I Regional. Since his return, Lamar has won
four conference championships, four conference tournament championships and appeared in four
NCAA Regionals.
Mr. Gilligan's trademark is getting the most out of his players. Some of his players have go on
to careers in major league sports, but more importantly, he has encouraged his players to attain
greater heights in life.

BACKGROUND
In May, an application was made to allow an existing child care facility to continue operation at
2410 Louisiana. The application included a request for a zone change from RS (Residential
Single Family Dwelling) District to RM-M (Residential Multiple Family Dwelling-Medium
Density) District and a specific use permit. The zone change was necessary since the Zoning
Ordinance does not permit child care facilities with more than eight children in an RS District.
At the May meeting, staff asked that the item be deferred indefinitely.
Rather than create a situation where spot zoning would likely occur, the Planning Staff is
recommending an amendment to the Zoning Ordinance that would allow child care facilities in
all residential districts subject to the granting of a specific use permit and within all commercial
and industrial districts by right.

addressing when sidewalks will be required.
RECOMMENDATION
The Administration recommends approval of the amendments.
BACKGROUND
Section 30-35 of the Zoning Ordinance states that no building permit shall be issued, or public
utilities extended or connected to a building or structure unless the application for the building
permit provides for compliance with the building code, fire code, zoning code, subdivision code
and other applicable codes of the City of Beaumont.
Section 24-15 of the Subdivision Regulations states that sidewalks are only required on all "safe
school routes"and on all arterial and collector streets. The sidewalks shall be installed prior to
the issuance of a Certificate of Occupancy and compliance of a lot. Normally, sidewalks are
constructed during the development of a subdivision. However, properties subdivided prior to
adoption of the Subdivision Regulations on January 22, 1980 were not required to install
sidewalks. This leaves many developable properties without sidewalks.
The Planning Manager recommends the following:
Sec. 24-15. Sidewalks
1. A Certificate of Occupancy and/or compliance for a lot shall not be
issued until the sidewalk requirements for that lot are met. When
platting, sidewalks shall be installed before the final plat may be
filed or a bond or cash payment as allowed by Section 24-26 (a) or
(b)may be provided that guarantees the sidewalk will be installed
within two (2)years of the final plat. A building permit includes
the construction of any sidewalk that may be required for that lot.

minimum width of four(4) feet shall be instailed by the subdivider

Ordinances of Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause of phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.

BACKGROUND
Two sections of Chapter 30, Sec. 30-28, Sign Regulations, need to be amended to reflect current
permitting and bonding requirements.
The recommended changes are as follows:

RECOMMENDATION
The administration recommends the award of a contract to Reytec Construction Resource Inc.
of Houston in the amount of$9,879,522.19.
BACKGROUND
On June 17, 2010 the City of Beaumont received eight (5) bids for the Calder Avenue
Drainage and Pavement Improvement Project (Phase III). The lowest bid was submitted by
Reytec Construction Resources, Inc. in the amount of$9,879,522.19. The Engineer's estimate
for the project before receipt of bid was $12,000,000.00.
The official total bid amount is determined by the summation of the contract amount "A" and
the time element "B". The City uses the following formula to make the calculation:
A + B = total bid amount for award consideration
The contract price, equal to A in the formula, is determined by the summation of the products
of the approximate quantities shown in the proposal and the unit prices bid, and; The time
element B of the bid is determined by multiplying the bid time proposed by the contractor to
complete the work of Item 462 (Concrete Box Culvert) by the daily road user cost of
$1,200/Calendar Day.

RECOMMENDATION
Administration recommends the award of a contract to C. F. Jordan Construction, L.L.C. of
Houston, Texas in the amount of$3,844,851.18.
BACKGROUND
Six bids were received on May 27, 2010 for the Event Center Area Paving and Drainage
Improvement project. This project includes rebuilding Crockett Street from Neches to M.L.K.
Parkway, constructing Jefferson St. from Laurel to Crockett, constructing sidewalks and paved
walkways at intersections and between the new Event Center and Lawn area. The following bids
were received:

for the construction of the event center, lake and lawn. The company plans to subcontract
approximately 47.5% or $1,830,000 of the paving and drainage project to certified MBE's and
HUB vendors.
A tabulation of unit prices is attached. The project will begin in July and be completed in 335 days.
BUDGETARY IMPACT
Funds for this project are available in the Capital Program.

WHEREAS, bids were solicited for a contract for the Event Center Area Paving and
Drainage Improvements Project; and,
WHEREAS, C. F. Jordan Construction, L.L.C., of Houston, Texas, submitted a bid
in the amount of $3,844,851.18; and,
WHEREAS, City Council is of the opinion that the bid submitted by C. F. Jordan
Construction, L.L.C., should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the bid submitted by C. F. Jordan Construction, L.L.C., of Houston, Texas, in the
amount of $3,844,851.18 for a contract for the Event Center Area Paving and Drainage
Improvements Project be accepted by the City of Beaumont.

REQUESTED ACTION: Council consider a resolution accepting the Calder Avenue
Project Phase I and approval of Change Order No. 5 &
Final Payment.
RECOMMENDATION
The Administration recommends acceptance of the Calder Avenue Project Phase I, approval of
Change Order No. 5 in the amount of$256,829.70 and final payment in the amount of
$1,232,143.82 to Reytec Construction Resource Inc.
BACKGROUND
On June 10, 2008, City Council awarded Reytec Construction Resources, Inc. the contract for the
Calder Avenue Drainage Project Phase I in the amount of$23,733,567.95.
Change Order No.l in the amount of($59,762.39) was approved by City Council on December 8,
2008, decreasing the contract amount to $23,673,805.56.
Change Order No.2 in the amount of$45,620.40 was approved by City Council on April 7, 2009,
increasing the contract amount to $23,719,425.96.
Change Order No. 3 in the amount of$11,091.00 was approved by City Council on April 2, 2009,
increasing the contract amount to $23,730,516.96.
Change Order No.4 in the amount of$216,283.10 was approved by City Council on August 4,2009,
increasing the contract amount to $23,946,800.06.
Change Order No. 5 in the amount of$256,829.70 is required to adjust the quantities actually
used during the performance of the project, increasing the contract amount to $24,203,629.76.

The MBE participation will not be required because the general contractor has been certified as a
Minority Business Enterprise. The project has been inspected by the Engineering Division and
found to be complete in accordance with the provisions and terms set out in the contract.
BUDGETARY IMPACT
Funds are available through the Capital Program.

and delete construction item quantities for roadway and water system improvements to the
contract, thereby decreasing the contract amount to $23,673,805.56; and
WHEREAS, Change Order No. 2 in the amount of$45,620.40 was required to add
and delete construction item quantities for roadway and drainage system improvements
to the contract, thereby increasing the contract amount to $23,719,425.96; and,
WHEREAS, Change Order No. 3 in the amount of$11,091.00 was required to add
construction item quantities for roadway and water system improvements to the contract
thereby increasing the contract amount to $23,730,516.96; and
WHEREAS, Change Order No.4 in the amount of$216,283.10 was required to add
and delete construction item quantities for roadway and water and sewer system
improvements and the resurfacing of the Fire Museum parking lot, thereby increasing the
contract amount to $23,946,800.06; and
WHEREAS, Change Order No. 5 in the amount of$256,829.70 is required to adjust
quantities actually used during the performance of the project, thereby increasing the
contract amount to $24,203,629.76; and
WHEREAS, the project has been inspected and completed in accordance with the
terms and conditions of the contract and should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute Change Order No. 5
in the amount of$256,829.70, thereby increasing the contract amount to $24,203,629.76.
BE IT FURTHER RESOLVED THAT the Calder Avenue Drainage Diversion and
Pavement Improvement Project Phase I be and the same is hereby accepted.
BE IT ALSO RESOLVED THAT the City Manager is hereby authorized to make final
payment in the amount of $1,232,143.82 to Reytec Construction Resources, Inc.
