WHEREAS, an agreement has been negotiated for the acquisition of property
described below and in Exhibit"A"and shown on Exhibits"B"and "C,"attached hereto,for
the Concord Road Pavement Widening Project:

Owners: Ashley Barry, Lindsay(Barry)Bolser, and Lynea
Minton Barry, Individuallyand as Administrator of
the Estate of Richard Wallace Barry, Deceased
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the purchase of the above described property be, and the same is, hereby
approved.

PROPERTY DESCRIPTION FOR PARCEL 33
Being a 0.0376 acre (1637 square feet) of land, situated in the F. Bigner Survey,
Abstract No. 1, said tract being out of and part of that certain called 0.806 acre tract
having been conveyed to Ashley Barry and Lindsay Barry from The Estate of Richard
Barry, by deed dated July 18, 2007, and being recorded under Clerk's File No.
2007027869 of the Real Property records of Jefferson County, Texas, said 0.0376 acre
of land being more particularly described as follows;
COMMENCING at an 1" iron pipe found for the most Northerly comer of the said
Barry tract and being the most Easterly corner of Concord Place Townhomes
recorded in Volume 2 page 116 and 117 of the Condominium Records of Jefferson
County Texas;
THENCE, SOUTH 32°09'43" WEST along the boundary line between the said Barry
tract and the said Concord Place Townhomes for a distance of 225.56 feet to a 5/8"
iron rod with cap stamped "City of Beaumont ROW Monument" set for corner in the
proposed Northeast right-of-way line of Concord Road, said point being the POINT
OF BEGINNING of the parcel herein described and said corner also being the
beginning of a curve turning to the right having a radius of 1270.00 feet and being
subtended by a chord bearing SOUTH 61'16'29" EAST having a chord length of
38.77 feet;
1) THENCE SOUTHEASTERLY, along and with said curve, for an arc length of 38.77
feet to a 5/8" iron rod with cap stamped "City of Beaumont ROW Monument" set for
comer, said corner being in the proposed Northeast right-of-way line of Concord
Road;
2) THENCE, SOUTH 60°23'58" EAST, along the proposed Northeast right-of-way line
of Concord Road for a distance of 111.09 feet to a 5/8" iron rod with cap stamped
"City of Beaumont ROW Monument" set for corner, said corner being in the
Southeasterly line of the said Barry tract and in the Northwesterly line of a 40 foot
Marginal Access Road out of Hawthorn Addition, Unit One, recorded in Volume 7
page 165 of the Map Records of Jefferson County, Texas;

3) THENCE, SOUTH 32 021'36" WEST, along the proposed boundary line between the
said Barry tract and the said 40 foot Marginal Access Road for a distance of 8.98
feet to a point for corner, said point being the South corner of the said Barry tract
and said point also being the West corner of the said 40 foot Marginal Access Road,
said point also being in the existing Northeasterly right-of-way of Concord Road,
from said point a 1" iron pipe (bent) bears SOUTH 04°27'00" EAST 0.73', said
corner also being the beginning of a curve turning to the left having a radius of
2894.79 feet and being subtended by a chord bearing NORTH 61050,07" WEST
having a chord length of 12.20 feet;
4) THENCE NORTHWESTERLY, along and with said curve and the existing right-of-
way of Concord Road, for an arc length of 12.20 feet to a point for corner;
5) THENCE, NORTH 61'57'21" WEST, along the existing right-of-way of Concord
Road for a distance of 137.84 feet to a point for corner, said point being the West
corner of the said Barry tract and the most Southeasterly comer of the said Concord
Place Townhomes, and from said point a 1/2" iron rod bears SOUTH 32 009'43"
WEST 1.23 ;
6) THENCE NORTH 32 009'43" EAST, along the boundary line between the said Barry
tract and the said Concord Place Townhomes for a distance of 12.44 feet to the
POINT OF BEGINNING and containing 0.0376 acre (1637 square feet) of land.
