REQUESTED ACTION: Council approval of a resolution authorizing the City
Manager to increase the Sanitary Sewer Rehabilitation of
Small Diameter Mains Contract-XIII Project for"extra
work".
RECOMMENDATION
Administration recommends approval of increasing the Sanitary Sewer Rehabilitation of Small
Diameter Mains Contract-XIII Project amount by $15,409.68. The proposed changes to the
contract will rehabilitate approximately 384 linear feet of 8-inch sanitary sewer lines, remove and
replace one manhole, clean and televise 384 linear feet of existing lines, post televise 384 linear
feet of rehabilitated lines, replace one short side service connection, and increase the contract time
by 20 calendar days to a total of 295 calendar days. The proposed extra work will represent an
increase of 3.59%, bringing the total contract amount increase to 20.25%. The proposed extra
work is for the area between West Caldwood and Central Caldwood.
BACKGROUND
The existing sewer lines built in the 1950's have deteriorated and require major rehabilitation. The
primary goals of the project are to restore the integrity of the sanitary sewer lines, restore the
carrying capacity, provide customers with uninterrupted and adequate service and meet the
Sanitary Sewer Overflow Initiative agreement requirements with the State.
Previous actions include:
Resolution 07-304 in the amount of$429,796.02 was passed by City Council on October 2, 2007.
Resolution 09-107 in the amount of$71,612.80 was passed by City Council on April 21, 2009.
This Change Order is recommended for approval by the City Manager and the Water Utilities
Director.

all previous Change Orders. Acceptance of this waver constitutes an agreement between Owner and
Contractor that the Change Order represents an all inclusive, mutually agreed upon adjustment to the
Contract,and that Contractor will waive all rights to file a claim on this Change Order after it is properly
executed."

RESOLUTION NO.
WHEREAS, on October 2, 2007, the City Council of the City of Beaumont, Texas,
passed Resolution No. 07-304 awarding a contract in the amount of$429,796.02 to Allco,
Ltd., Beaumont, Texas, for the Sanitary Sewer Rehabilitation of Small Diameter Mains
Contract - XIII Project; and,
WHEREAS, Change Order No. 1 in the amount of $71,612.80 was required for
"extra work"to rehabilitate approximately 240 linear feet of 6-inch and 1,150 linear feet of
8-inch sanitary sewer lines, remove and replace four manholes, clean and televise 1,390
linear feet of existing lines, post televise 1,390 linear feet of rehabilitated lines, furnish and
install two end of line cleanouts, replace 30 short side service connections and increase
the contract time by 155 calendar days for the area between Fieldwood and Ebonwood
Lane from Edson Drive to Bandera Drive, thereby increasing the contract amount to
$501,408.82; and
WHEREAS, Change Order No. 2 in the amount of$15,409.68 is required for"extra
work" to rehabilitate approximately 384 linear feet of 8-inch sanitary sewer lines, remove
and replace one manhole, clean and televise 384 linear feet of existing lines, post televise
384 linear feet of rehabilitated lines, replace one short side service connection, and
increase the contract time by 20 calendar days to a total of 295 calendar days, thereby
increasing the contract amount to $516,818.50.
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager is hereby authorized to execute Change Order No. 2 for
"extra work"described above in the amount of$15,409.68, thereby increasing the contract

The attached Memorandum of Agreement between the Beaumont Police Department and the
ATF Task Force is for the purpose of reimbursement of overtime salary costs and other costs,
including but not limited to travel, fuel, training, and equipment, incurred by the Beaumont Police
Department in providing resources to assist Bureau of Alcohol, Tobacco, Firearms and
Explosives Task Force.

THAT the City Manager and Chief of Police be and they are hereby authorized to execute
a Memorandum of Agreement between the Beaumont Police Department and the ATF
Task Force for reimbursement of costs incurred by the Beaumont Police Department in
providing assistance to the ATF Task Force. Said Memorandum of Agreement is
substantially in the form attached hereto as Exhibit "A" and made a part hereof for all
purposes.

This Memorandum of Agreement(MO*
MOA)is entered into by_the Bureau of Alcohol,Tobacco,
Firearms and Explosives (ATF) and-the Beaumont Police Department for the.purpose of
reimburserent of overtime salary costs and other costs,with prior ATF approval,including but not
limited to travel, fuel,training,and equipment, incurred by the Beaumont police Department in
providing resources to assist ATF.
Payments maybe made to'the extent they are included in ATF's Distal'Year.plan and the momes are
available to satisfy the requests(s)'for reimbursable overtime expenses.

This MOA is effective with the signatures of all parties and terminates at the close of business
On September 30,2013,subject to Section'V]I of the MOA:

Appropriations Bill,which provides for the reimburserrlent of overtime salary costs of
local, county,or State law enforcement agencies incurred while assisting ATF in joint law
enforcement operations.
I Title 31 U.S.C.„Section 9703, the Treasury Forfeiture Fund Act of 1992,which
provides for the reimbursement of certain expenses of local,county, or State law
enforcement agencies incurred as participants in joint operations/task forces with a
Federal law enforcement agency.
If available,the finding for fiscal year 2009,2010,241 1.,2012 and 2013 is contingent upon
annual appropriation laws, Title 28,U.S.C., Section 524(c),.annual appropriations, and Title.
31,U.S.C.,Section 332,
If available, funding allocations for reimbursement of expenses will be transmitted through,a
separate document.
This Memorandum of Agreement(MOA)is not a funding allocation document.
JIT. PURPOSE OF THIS MEMORANDUM OF AGREEMENT
This MOA establishes the procedures and responsibilities of both the Beaumont Police
Department and ATF for the reimbursement of certain overtime and'other pre-approved
expenses incurred pursuant to the authority.in Section 11,
TV. NAriiE OF JOINT OPEItATIONlTASk FORCE (if applicable)
The name of this joint operation/task force:ATF TASK FORCE
V. • CONDITIONS AND PROCEDURIES
A. The Beaumont Police]Department shall assign officer(s)to assist ATF in
investigations of Federal,state, and local laws. To the maximum extent possible, the
Officer(s)will be assigned on a dedicated,rather than rotational basis. The Beaumont
Police Department shall provide ATF with the name(s),title(s),and employee
identification number(s) of the officers) assigned to the investigation.
B The Beaumont Police Department shall provide ATF,within 10 days of the signing
of this MOA,with a contact•name, title,telephone number and address, The
Beaumont Police Departm=t shall also provide the name of the official responsible
for providing audit information under paragraph VI of this MOA, and the name of
the official authorized to submit an invoice to ATF under E.

C. The'Beaumont Police Department shall provide ATF,.within ten (10) calendar days
of the signing of this agreement,with the financial institution where the law
enforcement agency wants,the Electronic Funds Tr4a sfer(EFT)payment deposited
for reimbursement. The mechanism for this is the SF 3881,ACH
Vendor/Miscellaneous Payment Enrollment Form,which is Attachmmt A. When
completed,forward this*form to.the ATTN: Special Agcnt in Charge,Asset
Forfeiture&Seized Property Branch,Bureau of Alcohol,Tobacco,Firearms and
Explosives,Mail Stop 3N-600,99 New York Ave,NE,Washington, DC 20226.
D. The Beaumonnt Police Department may request reimbursement for payment of
overtime expenses and other costs with prior ATF approval,-including but not limited
to travel,fuel,t raining, a:ad equipment, directly related to work performed by its
officer(s)assigned as members of a joint operation/task force with ATF for the
purpose of conducting an official investigation.
E. Invoices submitted to ATF for the payment of expenses must be submitted on the
appropriate forms as provided by ATF. The invoice shall be signed by.an authorized
representative of the Beaumont Police Department and submitted to ATF field office
for signature and verification of the'invoice.
F. The$eatnnonfPolice Department will submit all requests for reimbursable
payments,together with the appropriate documentation to ATF by..the 1 0th day of
each subsequent month that the agency is seeking reimbursement..
(1) If the reimbursement request is not received by the ATF field office by the
10th of the subsequent month,the ATF field office will advise the agency, in
writing, that the reimbursement request is latc, and if the reimbursement
request is not received within the next 10 working days,the overtime costs
will not be reimbursed.
?) No waivers or extensions will be granted or honored: The Beaumont Police
Department will submit the request for reimbursement to ATF, ATT14: Im7
Sanders, 2615 Calder Avenue, Suite 300,'Beaumont,TX 77702.
G. The ATF Supervisor shall be'responsible for certifying that the.request is for
overtime expenses incurred by the Beaumont Police Department for participation
with ATF during the joint operation/task force. The responsible State or local
official shall also certify that requests for reimbursement of expenses have not been
made to other Federal law enforcement agencies.
R. The Beaumont Police Department acknowledges that they remain fully responsible
for their obligations as the employer of the officer(s) assigned to the joint
operation/task force and are responsible for the.payment of the overtime earnings,
withholdings,insurance coverage, and all other requirements by law,regulations;
ordinance or contract regardless of the reimbursable overtime charges incurred.

L All reimbursable hours of overtime work covered under this MOA must be approved
in advance by the ATF supervisor.
T. The ATP supervisor will forward all approved reimbursement requests to the Special
Agent in Charge,Asset Forfeiture and'Seized Property Bxanch,for payment-
K. This document does aat obligate funds. Funding authority,with maximum
reimbursement costs to any one law enforcement officer during the fiscal year
(October l ,.September 30),will be provided through other documents.
VI. . LROGRAM AUDIT
This MOA and its procedures are subject to audit by ATF,the.Department of Justice, Office
Of Inspector General, the Government.Accouhtabihty.Office,and other auditors authorized
by the Federal government. The Beaumont police Department agrees to permit such audits
and agrees.to maintain all records relating to these transactions for a'period of not less than,
three Years;,and-in the event of an on-going audit,until such tune as the audit Is completed.
These audits include reviews of any and all records, documents,reports, accounts,invoices,
receipts,.or expenditures reliting to this agreement; as well as,the interview of Any and all
personnel involved in these transactions.
V.I.I. REVISIONS
The teams of this MOA''may be amended upon written approval by the original parties,or their
designated representatives. Any amendment to this MOA becomes effective upon the date of
approval as stated in the amendment. Either party can cancel this MOA upon 60-calendar days
written notice to the other party. The ATF will only process requed for overtime for overtime
incurred before the date of cancellation,absent a specific written agreement to the contrary. .
VIII. NG PRIVATE RIGHT CREATED
This is an internal government agreement between ATF and the Beaumont police
Department and is not intended to confer any right or benefit to'any private person,or party.

RECOMMENDATION
The Administration recommends acceptance of water line easements to provide access for fire
protection services at the new Dollar General Store located at 10 N. 1 Ph Street.
BACKGROUND
Houma Dollar Partners, L.L.C. has agreed to convey a water line easement to the City of
Beaumont. The Water Line Easement [0.0017 acre out of Noah Tevis Survey], will provide
mandatory access to the water lines and fire hydrants for the new Dollar General Store located
at 10 N. 11t` Street (at Cedar), and would also allow for the construction, alteration, operation
and maintenance of the said water line and appurtenances.

RESOLUTION NO.
WHEREAS, Houma Dollar Partners, L.L.C., has offered to convey a 15' x 5' water
line easement for property located at 10 N. 11th Street, being 0.0017 acres out of the Noah
Tevis Survey, as described in Exhibit"A" attached hereto, to the City of Beaumont for the
purpose of providing mandatory access to the water lines and fire hydrants for said
property and allowing for the construction, alteration, operation and maintenance of the
said water lines and appurtenances; and,
WHEREAS, the City Council has considered the purpose of said conveyance and
is of the opinion that the acceptance of said conveyance is necessary and desirable and
that same should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the easement conveyed by Houma Dollar Partners, L.L.C., as described in Exhibit

REQUESTED ACTION: Council consider authorizing the acceptance of a water
line easement for the Social Security Administration.
RECOMMENDATION
The Administration recommends acceptance of water line easements to provide access for fire
protection services at the new Social Security Administration building located at 8455 Dishman
Road.
BACKGROUND
Rocky Bluff, LLC has agreed to convey a water line easement to the City of Beaumont. The
ten foot (10') wide Water Line Easement [out of A. Huston Survey], will provide mandatory
access to the water lines and fire hydrants for the new Social Security Administration building
located at 8455 Dishman Road, and would also allow for the construction, alteration, operation
and maintenance of the said water line and appurtenances.

RESOLUTION NO.
WHEREAS, Rocky Bluff, L.L.C., has o ff e r ed to convey a ten foot (10) wide
water line easement for property located at 8455 Dishman Road, out of the A. Huston
Survey,Abstract 33, Jefferson County, Texas, as described in Exhibit"A"attached hereto,
to the City of Beaumont for the purpose of providing mandatory access to the water lines
and fire hydrants for the Social Security Administration building located on said property
and allowing for the construction, alteration, operation and maintenance of the said water
lines and appurtenances; and,
WHEREAS, the City Council has considered the purpose of said conveyance and
is of the opinion that the acceptance of said conveyance is necessary and desirable and
that same should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the easement conveyed by Rocky Bluff, L.L.C., as described in Exhibit"A", be and
the same is hereby, in all things, accepted.

REQUESTED ACTION: Council approval of a resolution authorizing the City
Manager to execute a contract for the Waterline Installation
of Large Diameter Main Bores Contract I.
RECOMMENDATION
Administration recommends approval of a contract with Allco, Ltd., Beaumont, Texas, in the
amount of$636,301.00 to install three 16 inch C905 PVC waterline bores. The first bore is
approximately 400 linear feet along Keith Road, crossing Union Pacific Railroad and US Highway
90. The second bore is approximately 200 linear feet along US Highway 90, crossing Lower
Neches Valley Authority Canal. The third bore is approximately 240 linear feet along Keith Road,
crossing BNSF Railroad and Phelan Boulevard.
The MBE participation will be with Rural Pipe and Supply of Jasper, Texas and is listed by Allco,
Ltd. as their material supplier. The amount of the subcontract is for $160,000 which represents
25.15 percent of the total bid.
BACKGROUND
The primary goals of the project are to supply adequate fire protection to the Municipal Airport
located on Keith Road and loop the water system to provide high quality uninterrupted water
service to the customers.
This Contract is recommended for approval by the City Manager and the Water Utilities Director.
BUDGETARY IMPACT
Funds for the project are available in the Capital Program.

RECOMMENDATION
Administration recommends amending Section 21-75 of the Code of Ordinances to reduce the
number of Grade III Lieutenant positions by one, resulting in a total of 15 Lieutenants.
BACKGROUND
Lieutenant Dave Sample recently retired from the Police Department resulting in a vacancy. By
deleting this position, the total number of authorized positions in the Police Department would be
264.
BUDGETARY IMPACT
There would be an annual savings of approximately $100,000 if this position is not replaced.

Section 1.
That Chapter 21, Section 21-75, of the Code of Ordinances of the City of Beaumont
be and the same is hereby amended to read as follows:

of Ordinances to allow for towing of uninsured vehicles.
RECOMMENDATION
Administration recommends the Council amend Section 26-41 of the Code of Ordinances to
allow for the towing and impounding of a vehicle that is not insured or otherwise covered for
financial responsibility in accordance with state law. The amendment will be effective July 15,
2009.
BACKGROUND
On May 12, 2009, a work session was held to discuss guidelines for the towing of motor vehicles
being operated without proof of financial responsibility. In January 2009, the Texas Department
of Public Safety implemented a state-wide database through which the status of whether a
motorist has insurance for his or her vehicle can be verified. The database can be accessed
twenty-four (24) hours a day seven (7) days a week. This tool is the backbone of the program to
tow uninsured motor vehicles.
Upon adoption of the amended ordinance, the Purchasing Division will post a request for
proposal for Contract Towing Services for Impounding of Vehicles. In order to effectively
implement this program, the City will enter into a management agreement with a local towing
company whereby the towing company will be notified by Police Officers when it is determined
that a vehicle is to be towed due to lack of insurance. The towing company will be responsible
for towing he vehicle storing he vehicle, collecting the fees, releasing the vehicle once the

owner has shown proof of financial responsibility, and submitting monthly reports required by
the City for monitoring the program. The fees charged by the towing company will be based on
the adopted rates in Chapter 29 of the Code of Ordinances. If a vehicle owner or designee is able
to provide proof of insurance coverage being in effect at the time the vehicle was towed, and
provides that proof within one (1) business day (defined as Monday thru Friday) of vehicle
impoundment, then the towing company may charge for the towing but must waive all storage
fees accrued for that vehicle. Towing companies responding to the request for proposal will be
evaluated based on a criteria which includes relevant experience, storage capacity, adequacy and
availability of equipment, personnel, and data collection and reporting capabilities.

Subject:Towing Uninsured Motor Vehicles

Purpose: To establish guidelines and procedures for the towing of motor vehicles being operated without
proper proof of financial responsibility. The safety of the driver and/or vehicle occupants is a
primary concern when towing uninsured vehicles.
I. Towing Guidelines
A. Vehicles may be towed for no proof of financial responsibility as a result of:
1. Traffic stops when other violations, such as no driver's license,expired MVI,or expired
registration are involved;or
2. Motor vehicle crash investigations;or
3. Other circumstances approved by a supervisor, if the driver does not have proof of financial
responsibility as required by the Texas Transportation Code.
B. Officers will make a reasonable effort to determine whether financial responsibility exists prior to
towing a vehicle.
C. Prior to towing a vehicle under this policy,officers should consider the circumstances surrounding
the situation,including:
1. Time of day
2. Location
3. Physical condition of the driver(elderly,sick,disabled,etc.)
4. Age of driver/occupants
5. Availability of other units to assist with the safe removal of occupants
6. Call demand
7. Weather conditions
8. Lighting conditions
9. Traffic volume and speed
10.Presence of pets/animals in the vehicle
11.Contents of the vehicle(potential financial loss,perishable items,etc.)
D. Vehicles driven or occupied exclusively by minors under the age of 18 should not be towed.
E. Officers shall be required to issue a Failure to Maintain Financial Responsibility citation to the
driver if a vehicle is towed under this policy. A vehicle operator who does not exhibit evidence of
financial responsibility is presumed to have operated the vehicle in violation of the law.
F. All vehicles towed under this policy require prior supervisor approval,as is now the practice for
traffic offense arrests.
G. Per the impounding of Motor Vehicles policy,the proper sections of the vehicle impound form shall
be completed on all vehicle impounds.
II. Driver/Occupant Safety
A. An officer impounding a vehicle under this policy will make a reasonable effort to provide for the
safety of the driver and any occupants. Examples of a reasonable effort include,but are not
limited to,transportation of the driver and occupants to a safe location or tailing a friend or relative
for transportation.
B. If there are no reasonable means to avoid placing the driver and occupants in an unsafe situation,
the officer should not tow the vehicle.

C. Should the driver/occupants arrange for private transportation from the scene,the transport must
be accomplished within the 30 minute time frame allowed for tow truck arrival.
! D. All interactions with vehicle drivers and/or occupants regarding transportation or transportation
refusal shall be recorded with the officer's in-car mobile video system. The driver/occupants who
refuse transportation will be required to sign off on the refusal on the appropriate towing form.
Ill. Traffic Crash Investigations
A. if conditions at the crash scene permit,and prior to calling for tow trucks,officers should determine
the insured status of all vehicles involved in the crash. Uninsured vehicles involved should be
towed by the contract towing company in accordance with this policy.
B. At crash scenes requiring emergency tows,the emergency tow should be used whether financial
responsibility can be determined or not. In this circumstance,the vehicle would not be impounded

under this policy.
C. At crash scenes involving vehicles driven or occupied exclusively by minors under the age of 18, if
financial responsibility cannot be determined and the vehicle will be towed due to damage caused
by the crash anyway,the vehicle should be towed by the contract towing company in accordance
with this policy.
IV, Vehicle Release

A. Vehicles will be released by the contract towing company.
B. Requirements for vehicle release are:

1. Payment of the posted rates;
2. The vehicle owner/driver is required to show current proof of financial responsibility;and
3. The vehicle owner/driver is required to show a government issued photo identification.
V. Defense
A. The vehicle operator is afforded the opportunity to contest the charges pursuant to the Motor
Vehicle Safety Responsibility Act.
11. Evaluation Criteria.
Respondent shall provide all additional information upon demand by the City of Beaumont.
Evaluation of this response shall be based upon the items stated in the following table,as
evaluated by the City of Beaumont. Space to provide information is available on the Bid Sheet.

financial responsibility established for that vehicle.
(2) Acting under a policy established by the police chief, a police
officer is authorized to order the towing and impounding of a vehicle that is
not insured or otherwise covered for financial responsibility in accordance
with state law.
(3) The streets, alleys, or other public places of the city are not
intended for storage of vehicles; therefore, any vehicle standing, parked or
remaining unattended within the same two (2) blocks of any public street,
alley, sidewalk, parkway or upon any property of the city for forty-eight (48)
or more continuous hours, even though the vehicle is moved from one place
to another within such blocks or city property, is hereby declared to be
illegally parked. If the vehicle remains within the same two (2) blocks of any
public street, alley, sidewalk, parkway or upon any property of the city for an
additional forty-eight (48) continuous hours, it is hereby declared to be a
