The City Council of the City of Beaumont, Texas, met in a special emergency session on
September 16, 2008, at the Emergency Operations Center, 700 Orleans, Beaumont, Texas, at
10:00 a.m. to consider the following:

Mayor Ames called the meeting to order at 10:00 a.m.
Roll call was made by Stephanie Gandy, Deputy City Clerk.
Present at the meeting were Mayor Ames, Mayor Pro Tern Samuel, Councilmembers Coleman,
Pate and Smith. Absent: Councilmembers Beaulieu and Wright. Also present were Kyle Hayes,
City Manager; Tyrone Cooper, City Attorney; Stephanie Gandy, Deputy City Clerk.
REPORTS
Mayor Ames complimented the departments from the City, the public information officers
and commented on their efficiency.
City Manager, Kyle Hayes, reported that the water plant is on power, though a boil water
notice will remain in effect for at least 5 days. The sewer plant is running at 90% capacity
on generators. Nearly all of the city roadways are driveable.
Due to the power lines that are down on Lafin Road, the City Landfill will not open at this
time, however Entergy is working on clearing Lafin Road of downed lines. As soon as that
occurs, the landfill will open.
The curfew is still in effect.
Restaurants and food establishments wishing to reopen must be inspected by the Health
Department before opening.
Entergy has stated that Beaumont should have power by September 30th

EMERGENCY BUSINESS
1. Consider approval of declaration of emergency; extending and renewing the authorities,
rules, regulations until the state of disaster is terminated.
Administration recommended approval of an ordinance declaring an emergencyforthe City
of Beaumont
Mayor Pro Tern Samuel moved to ADOPTAN ORDINANCE ENTITLED AN ORDINANCE DECLARING
AN EMERGENCY; EXTENDING AND RENEWING THE AUTHORITIES, RULES, REGULATIONS AND ALL
OTHER PROVISIONS OF THE EMERGENCY POWERS ORDINANCE UNTIL THE STATE OF DISASTER IS
TERMINATED; PROVIDING NOTICE; PROVIDING A PENALTY; PROVIDING SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE. Councilmember Smith seconded the motion.

2. Consider approval of removing the operations of the competitive bidding requirements.
Administration recommended approval of an ordinance removing the operations of the
competitive bidding requirements.
Councilmember Smith made a motion to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE
DECLARING AN EMERGENCY; REMOVING THE OPERATION OF THE COMPETITIVE BIDDING
REQUIREMENTS OF THE APPLICABLE COMPETITIVE BIDDING PROVISIONS OF THE CITY CHARTER AND
CODE OF ORDINANCE PURSUANT TO SECTION 252.022 OF THE TEXAS LOCAL GOVERNMENT CODE
WITH RESPECT TO CONTRACTS FOR PROCUREMENTS MADE BECAUSE OF THE PUBLIC CALAMITY
RESULTING FROM HURRICANE IKE, FOR A PERIOD OF AT LEAST 90 DAYS FROM AND AFTER
SEPTEMBER 11, 2008. Mayor Pro Tern Samuel seconded the motion.

OCNASHECK FOR AN OUTSTANDING JOB, THANKED THE
CITIZENS HELPING TO CLEAN UP, ALSO THANKED
CONSTABLE STEPHENS AND DANIELS
MAYOR PRO TEM SAMUEL - THANKED EVERYONE INVOLVED, COMMENDED FEMA,
STATE DEPARTMENTS AND THE GOVERNOR'S OFFICE FOR
WORKING WITH THE CITY, THANKED THE CITY EMPLOYEES
FOR ALL OF THEIR HARD WORK,FEELS THAT BEAUMONT HAS
THE BEST FIRST RESPONDERS IN THE COUNTRY, THANKED
THE MEDIA FOR KEEPING THE PUBLIC INFORMED, ENTERGY,
THE PORT OF BEAUMONT AND NOVROSKI'S FOR ALL THAT
THEY ARE DOING, BELIEVES TIM OCNASCHECK IS THE BEST
EMERGENCY MANAGEMENT COORDINATOR IN THE
