WHEREAS, C. Michael Berryhill and Linh T. Berryhill, owners of the Texas Karate
Academy, have offered to convey a ten foot (10') wide Sanitary Sewer Easement for
property located at 7310 State Highway 105, being out of the W. B. Dyches Survey,
Abstract 17, as described in Exhibit "A," Page 1 and shown on Exhibit "A," Page 2,
attached hereto, to the City of Beaumont to provide sewer services to the new Texas
Karate Academy and allow for the construction, alteration, operation and maintenance of
the said sanitary sewer line and appurtenances; and,
WHEREAS, the City Council has considered the purpose of said conveyance and
is of the opinion that the acceptance of said conveyance is necessary and desirable and
that same should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the easement conveyed by C. Michael Berryhill and Linh T. Berryhill, owners of the
Texas Karate Academy, as described in Exhibit "A," Page 1 and shown on Exhibit "A,"
Page 2, be and the same is hereby, in all things, accepted.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 29th day of July,
2008.

W. B. DYCHES SURVEY, ABSTRACT 17

That certain centerline description for a 10' wide exclusive sanitary sewer easement out of the
W. B. Dyches Survey, Abstract 17, Jefferson County, Texas, being out of a called 1.004 acre
tract conveyed to Michael C. Berryhill and Linh T. Berryhill as recorded in Clerks File No.
2004011490 of the Official Public Records of Jefferson County, Texas, said centerline
description being more particularly described as follows:
Note: The Basis of Bearing is the west line of the said 1.004 acre tract having been called
North 435.68 feet.
COMMENCING at a 5/8" iron rod found in the north right-of-way line of Texas State Highway
105 for the southeast comer of a 40' x 40' Southwestern Bell Telephone easement and the
southwest corner of the said 1.004 acre tract;
THENCE North along the east line of the said SWBT easement and the west line of the said
1.004 acre tract a distance of 5.00 feet (called North) to a point for the POINT OF BEGINNING
of the said centerline from which a W iron rod found for the northwest comer of the said 1.004
acre tract bears North 430.70 feet (called North);
THENCE North 89°11'42" East a distance of 100.11 feet to a point in the west line of a called
13.984 acre tract conveyed to Billy B. Ballard and Diane Ballard as recorded in Clerks File No.
9825812 of the Official Public Records of Jefferson County, Texas and the east line of the said
1.004 acre tract for the POINT OF TERMINATION of the said centerline from which a %2' iron
rod found in the said north right-of-way line of Texas State Highway 105 for the southwest
corner of the said 13.984 and the southeast corner of the said 1.004 acre tract bears South
00 001'28" East 5.00 feet (called South 00 001'51" East).
This Centerline Description is based on a survey performed by Fittz& Shipman, Inc. during April
2008.
