ENTITLED AN ORDINANCE DECLARING A SIXTY (60) DAY
MORATORIUM ON THE ISSUANCE OF PERMITS FOR THE
CONSTRUCTION AND/OR ERECTION OF ANY INDUSTRIALIZED
(MODULAR) SINGLE-FAMILY OR AND/OR TWO-FAMILY DWELLINGS
WITHIN THE CITY LIMITS OF BEAUMONT, JEFFERSON COUNTY,
TEXAS.
WHEREAS, the City Council has determined that industrialized (modular) housing
is significantly different from site-built structures such that the State of Texas allows cities
to regulate them; and,
WHEREAS, the City Council recognizes the need to ensure that industrialized
(modular)housing should be compatible with surrounding residences with regard to value,
design and foundation construction; and,
WHEREAS,Section 1202.253 of the Texas Occupations Code allows municipalities
to regulate industrialized (modular) housing in this manner; and,
WHEREAS, the City Council and Planning Commission seek to consider the
enactment of such regulations on industrialized (modular)houses in the City of Beaumont
within the next sixty (60) days; and,
WHEREAS, in order to preserve the status quo pending further investigation of the
possible regulation of industrialized (modular) housing, the City Council has determined
that a moratorium should be imposed upon the issuance of permits for the construction
and/or erection of single-family and two-family industrialized (modular) dwellings.
NOW, THEREFORE, BE IT ORDAINED BY
THE CITY COUNCIL OF THE CITY OF BEAUMONT:
Section 1.
That there be and is hereby imposed for a period of sixty (60) days from the
effective date of this ordinance a moratorium upon the issuance of permits for the erection
and/or construction of any single-family or two-family industrialized (modular) dwelling in
the City of Beaumont.
Section 2.
That during said sixty (60) day period, the City Administration and Planning
Commission shall work to develop and present to the City Council a proposed ordinance
regulating such industrialized (modular) housing, which shall be presented to the City
Council in sufficient time that said ordinance, if adopted, may take effect prior to the
expiration of said sixty (60) day period.
Section 3.
That all permits for industrialized (modular) housing issued by the City before the effective
date of this ordinance shall be valid throughout the moratorium period.
