HomeMy WebLinkAboutRES 08 197 RESOLUTION NO. 08-197 WHEREAS, The Catholic Diocese of Beaumont, has agreed to convey a ten-foot (10')wide Water Line Easement for property located at 3390Sarah Street, being out of the J. W. Bullock Survey, as described in Exhibit "A," and shown on Exhibit "B, attached hereto, to the City of Beaumont to provide water services for the new building being constructed at Our Mother of Mercy School located at 3390 Sarah Street; and, WHEREAS, the City Council has considered the purpose of said conveyance and is of the opinion that the acceptance of said conveyance is necessary and desirable and that same should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the easement conveyed by The Catholic Diocese of Beaumont, as described in Exhibit 'A" and shown on Exhibit "B," be and the same is hereby accepted. Bullock Survey, Abstract No. 7 Beaumont, Jefferson County, Texas BEING a 0.1084 acre water line easement situated in the J.W. Bullock Survey, Abstract No. 7, Jefferson County, Texas and being out of and part of that certain called 4.325 acre tract of land as described in a "Deed of Gift" from J.E. Broussard, Jr., et al. to Bernard J. Ganter, Resident Bishop of the Catholic Diocese of Beaumont, Texas as recorded in Volume 2357, Page 380, Deed Records, Jefferson County, Texas, said 0.1084 acre water line easement being more particularly described as follows: NOTE: All bearings are based on the East line of that certain called I -213'd acre tract of land as described in Volume 1102, Page 65, Deed Records, Jefferson County, Texas as SOUTH 00°026'00" WEST. COMMENCING at a 1" iron pipe found for the most Northerly Northeast corner of the said 4.325 acre Catholic Diocese of Beaumont tract, said corner also being an interior ell corner of that certain called 28.22 acre tract of land as described in a "General Warranty Deed" from Beaumont Independent School District to Beaumont I.S.D. Public Facility Corporation as recorded in Clerk's File No. 2000032471, Official Public Records of Real Property, Jefferson County, Texas; THENCE NORTH 89 016'54" WEST, for the boundary between the said 4.325 acre Catholic Diocese of Beaumont tract and the said 28.22 acre Beaumont I.S.D. Public Facility Corporation tract, for a distance of 19.63 feet to a point for corner, said corner being the Northwest corner of the said 4.325 acre Catholic Diocese of Beaumont tract and the Northeast corner of that certain called 1 -2/3`d acre tract of land as described in a deed from Mary Belle Broussard, et al. to W. J.
