WHEREAS, Delaware Extension Development, Ltd., has offered to convey one
Water Line Easement and three (3) Sanitary Sewer Easements, for property located near
Major Drive and Westfield Avenue, as shown below, as described in Exhibits"A,""C,""E,"
and "G" and shown on Exhibits "B," "D," "F," and "H" attached hereto, to the City of
Beaumont for the purpose of access for fire protection and sewer services:
• One (1) thirty-seven foot (37') wide Sanitary Sewer Easement—
0.4392 acre tract out of the Hezekiah Williams Survey,Abstract No.
56; located off Major Drive, south of Westfield Avenue;
• One (1) thirty-seven foot (37') wide Sanitary Sewer Easement—
0.5495 acre tract out of the Hezekiah Williams Survey,Abstract No.
56; located off Major Drive, north of Westfield Avenue;
• One (1) ten foot (10') wide Sanitary Sewer Easement—
0.0138 acre tract out of the Hezekiah Williams Survey,Abstract No.
56; located off Folsom Drive, east of Major Drive;
• One (1) ten foot (10') wide Water Line Easement —
0.0.1828 acre tract out of the Hezekiah Williams Survey, Abstract
No. 56; located off Folsom Drive, east of Major Drive.
and,
WHEREAS, the City Council has considered the purpose of said conveyance and
is of the opinion that the acceptance of said conveyance is necessary and desirable and
that same should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the Water Line Easement and three (3) Sanitary Sewer Easements conveyed by
Delaware Extension Development, Ltd., as described in Exhibits"A," "C," "E,"and "G"and
shown on Exhibits "B," "D," "F," and "H" attached hereto, be and the same are hereby, in
all things accepted.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 24th day of
June, 2008.

BEING a 0.4392 acre sanitary sewer easement situated in the Hezekiah Williams Survey, Abstract No.
56, Jefferson County, Texas and being out of and part of the remainder of that certain called 209.2045
acre tract of land as described in a "Special Warranty Deed" from Amoco Production Company to

COMMENCING at an iron rod with a cap stamped "Carroll & Blackmon" found for the intersection of

THENCE SOUTH 02°52'17" EAST, along and with the East right-of-way line of F.M. Highway 364, for

No. 56, Jefferson County, Texas and being out of and part of the remainder of that certain called
209.2045 acre tract of land as described in a "Special Warranty Deed" from Amoco Production
Company to Delaware Extension Development, Ltd. as recorded in Clerk's File No. 2000047669,
Official Public Records of Real Property, Jefferson County, Texas, said 0.1828 acre tract being
more particularly described as follows:
NOTE:All bearings are based on the East right-of-way line of F.M. Highway 364
