REQUESTED ACTION: Council consider a resolution authorizing the

BACKGROUND
Council discussed the settlement of this claim in Executive Session on April 29, 2008.
Recommended by City Manager and City Attorney.
BUDGETARYIMPACT
There are sufficient funds in the Liability Trust Fund to pay the amount as shown:

WHEREAS, the claim of William Gardiner has been discussed in an Executive
Session properly called and held Tuesday, April 29, 2008; and,
WHEREAS, the Council desires to authorize the settlement of the claim;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Attorney be and he is hereby authorized to settle the claim of William
Gardiner in the amount of Sixty-Seven Thousand ($67,000) Dollars.

MEETING DATE: May 6, 2008
REQUESTED ACTION: Council consider authorizing the City Manager to enter into
a contract with AT&T for the upgrade of the City Hall
telephone system.
RECOMMENDATION
Administration recommends the purchase and installation of equipment and software necessary
to upgrade the City Hall telephone system in the amount of$44,443.39.
BACKGROUND
The Nortel telephone system (PBX) located at City Hall was installed in 2005 to provide phone
services to City Hall and link with other Nortel PBX systems at Police, Public Health and Fire
headquarters. Having these systems linked provides for four digit dialing between Sites and one
standard voicemail system. The link also allows the remote sites to make use of less expensive
long distance rates by using the outgoing AT&T lines from City Hall.
This upgrade will allow the connection of additional City facilities to the main No el PBX to
make use of the features outlined above and is also necessary to accomodate water customer
service personnel when they move into City Hall. Over the next twelve months m st of the
downtown City facilities will either make direct use of the City Hall PBX or have heir phone
system tied into it, allowing us to leverage the investment in the City Hall PBX to he greatest
degree possible.
BUDGETARYIMPACT
Funding in the amount of$44,443.39 is available in the FY2008 Communications budget.

BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute a contract in the
amount of $44,443.39 with AT&T for the purchase and installation of equipment and
software to upgrade the City Hall telephone system.

in the Metropolitan Park Subdivision, Phase II have been completed; and,
WHEREAS, the developers desire to have these improvements accepted and
maintained by the City; and,
WHEREAS, the director of the Public Works and Engineering Department have
determined that said improvements meet city standards and qualify for acceptance for
permanent maintenance, and the City Council is of the opinion that said improvements
should be accepted and maintained by the City of Beaumont;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the water and sanitary sewer improvements in the Metropolitan Park Subdivision,
Phase II are hereby accepted by the City of Beaumont and shall be continuously
maintained by the City contingent upon filing of the final plat.

RECOMMENDATION
The Administration recommends approval of the request.
BACKGROUND
Kerry Moncla has applied for the zone change.
Mr. Moncla states that the subject property is more conducive to commercial uses than
residential. The Comprehensive Plan designates this area as a Neighborhood Gr wth Unit. As
such, commercial uses should be located near major street intersections. An 0.8 acre portion of
the subject property is currently zoned GC-MD. The subject property has 660' of frontage on
Phelan Boulevard. Phelan is classified as a major arterial and is currently being improved to 4
lanes with a left turn lane.
At a Joint Public Hearing held April 21, 2008, the Planning Commission recomm nded approval
8:1 of a request for a zone change from RS (Residential Single Family Dwelling) istrict to GC-
MD (General Commercial-Multiple Family Dwelling) District on property locatec approximately
400'west of the intersection of Phelan and Major.

BACKGROUND
Leonard Kirtman, representing Global Ventures, has applied for the zone change.
Global Ventures has plans to develop the approximately 264 acres into a mixed residential and
light commercial development.
Before, any development can occur, the PUD zoning district requires that a general land use and
density plan be submitted to the Planning Commission and City Council. The plaa shall include
a schematic land use plan identifying proposed general uses, densities, major oper.spaces,
circulation and access features and a statement indicating proposed phasing of de elopment and
the projected timing of each phase.

BACKGROUND
Sheri Arnold, representing TCRE, LLC, has applied for the zone change.
The purpose of the zone change is to allow the construction of a new 63,355 sq. ft Walgreens
Pharmacy on the subject property. GC-MD zoning abuts the subject property tot the north and
east. The subject property will be combined with the property to the north to allow adequate
room for construction.
The proposed pharmacy is the first of its kind in this neighborhood in many years. The
pharmacy's market area is currently underserved and will be a welcome addition t the
neighborhood.
At a Joint Public Hearing held April 21, 2008, the Planning Commission recommended approval

MD (General Commercial-Multiple Family Dwelling)District at 554-598 Euclid.

BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas, an J in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 30-513 thereof, is hereby amended by changing the
zoning of property presently zoned RS (Residential Single Family Dwelling) District to GC-
MD(General Commercial-Multiple Family Dwelling)District for property located at 554-598
Euclid, being Lots 18-22, Block 2, Arlington Addition, City of Beaumont, Jefferson County,
Texas, containing 0.73 acres, more or less, as shown on Exhibit"A,"and the fficial zoning
map of the City of Beaumont is hereby amended to reflect such changes.
Section 2.
That, in all other respects, the use of the property herein above desc-ibed shall be
subject to all of the applicable regulations of the underlying zoning district as well as those
regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as
amended.
Section 3.
That if any section, subsection, sentence, clause or phrase of this ord nance, or the
application of same to a particular set of persons or circumstances, should f r any reason
be held to be invalid, such invalidity shall not affect the remaining po ions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That all ordinances or P arts of ordinances in conflict herewith are repealed to the
extent of the conflict only.

The purpose of the zone change is to allow the construction of single family residences for low to
moderate income families. A preliminary plat of Phase I of this development is on the April 21 s`
agenda, as well. Jehovah Jireh Village CDC, Inc. is associated with Antioch Baptist Church. In
addition to this property, the church is developing a subdivision on Sarah Street, viest of the
Melton YMCA.
This zone change will help address the continuing need for affordable housing for low to
moderate income families.

BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 30-513 thereof, is hereby amended by changing the
zoning of property presently zoned GC-MD(General Commercial-Multiple Farnily Dwelling)
District and LI (Light Industrial) District to RS (Residential Single Family Dwelling) District
for property located north of Fannett Road and west of 11th Street, as described in Exhibit
"A"and shown on Exhibit"B,"and the official zoning map of the City of Beaumont is hereby
amended to reflect such changes.
Section 2.
That, in all other respects, the use of the property herein above desc-ibed shall be
subject to all of the applicable regulations of the underlying zoning district as well as those
regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as
amended.
Section 3.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining potions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are re ealed to the
extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.

RECOMMENDATION
The Administration recommends approval of the request subject to the following ondition:
• Provide an 8'tall wood screening fence along the north property lir e for the length
of the addition to the existing building.
BACKGROUND
Gospel Center Church has applied for the amended specific use permit.
In June, 2005, City Council approved a specific use permit to allow the church. The church
currently occupies two existing buildings on the subject property. The purpose of the amended
specific use permit is to allow an additional 8,960 sq. ft. of area to the existing buildings.
Reverend Donny Flippo states that the church holds Sunday morning and evening and
Wednesday night services. The size of the congregation is approximately 150 per on.
At a Joint Public Hearing held April 21, 2008, the Planning Commission recommended approval
9:0 of a request for an amended specific use permit to allow the expansion of an existing church
in an RM-H (Residential Multiple Family Dwelling-Highest Density)District at 7 595 Highway
105 subject to the following condition:
• Provide an 8' tall wood screening fence along the north property lire for the length
of the addition to the existing building.

ENTITLED AN ORDINANCE ISSUING AN AMENDED
SPECIFIC USE PERMIT TO GOSPEL CENTER CHURCH
LOCATED AT 7575 AND 7595 HIGHWAY 105 TO EXPAND
THE EXISTING BUILDINGS.
WHEREAS, on June 7, 2005, City Council approved Ordinance No. 05-049 issuing
a Specific Use Permit to Gospel Center Church to allow a church in an RM- (Residential
Multiple Family Dwelling-Highest Density) District located at 7575 and 7595 Highway 105,
being Lots 11-13, Neches Terrace Addition, City of Beaumont, Jefferson County, Texas,
containing 2.25 acres, more or less, as described on Exhibit "A" attached I ereto; and,
WHEREAS, the applicant, Gospel Center Church, wishes to expand an additional
8,960 sq. ft. of area to the existing buildings; and,
WHEREAS, the Planning a nd Zoning Commission of the City of Beaumont
considered the request to amend the Specific Use Permit to allow further expansion of the
existing church buildings; and,
WHEREAS, the City Council is of the opinion that the amendment of such specific
use permit is in the best interest of the City of Beaumont and its citizens, subject to the
hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
THAT Ordinance 05-049 be amended by amending the Specific Use Permit to allow further
expansion of the existing church buildings located at 7575 and 7595 Highway 105, is
hereby granted to Gospel Center Church, its legal representatives, successors, and
assigns for that certain tract shown on Exhibit"A" attached hereto and made a part hereof
for all purposes subject to the following conditions:
o Provide an 8'tall wood screening fence along the north property line
for the length of the addition to the existing building.
Section 2.
Notwithstanding the site plan attached hereto as Exhibit"B", the use of the property
hereinabove described shall be in all other respects, subject to all of the applicable
regulations contained in Ordinance 93-24 and the regulations contained in hapter 30 of
the Code of Ordinances of the City of Beaumont, Texas, as amended.

An 1,800 sq. ft. addition will be constructed on the south side of the existing church building.
Reverend von Gyllenband states that the addition will serve the young people oft the church.
In August, 2000, City Council approved a specific use permit for Unity Church.

of land out of and a part of Block 37 of the Cartwright and Roberts Subdivision "A", as
described in Exhibit "A" attached hereto; and,
WHEREAS, the applicant, Unity Church of Beaumont, wishes to expand 1,800 sq.
ft. to the south side of the existing church building; and,
WHEREAS, the Planning and Zoning Commission of the City of Beaumont
considered the request to amend the Specific Use Permit to allow further expansion of the
existing church building; and,
WHEREAS, the City Council is of the opinion that the amendment of such specific

REQUESTED ACTION: Council consider a request for a specific use permit to

RECOMMENDATION
The Administration recommends approval of the request.
BACKGROUND
ACT Pipe and Supply has applied for the specific use permit.
Randall Hyatt, Area Manager for ACT, states that his company specializes in supl lying products
for underground utilities,plumbing, fire protection and fabrication sales. Custom rs include
cities, contractors and schools located all over Texas.
Business hours will be Monday- Friday, 7 a.m. - 5 p.m. Mr. Hyatt states that the inventory will
be kept in an orderly fashion so as to not impact surrounding properties in a negative way.
At a Joint Public Hearing held April 21, 2008, the Planning Commission recommended approval
9:0 of a request for a specific use permit to allow a pipe and supply company in a C-MD
(General Commercial-Multiple Family Dwelling)District at 1405 Ashley.

CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS.
WHEREAS, the City Council for the City of Beaumont desires to issue a specific use
permit to ACT Pipe and Supply to allow a pipe and supply company in a GC MD (General
Commercial-Multiple Family Dwelling)District located at 1405 Ashley,being Lots 1-6, Block
21,Jirou Addition, City of Beaumont, Jefferson County,Texas,containing 0.95 acres,more
or less, as shown on Exhibit "A" attached hereto; and,
WHEREAS, the City Council is of the opinion that the issuance of suc I specific use
permit is in the best interest of the City of Beaumont and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That a specific use permit to allow a pipe and supply company in a GC-MD

acres, more or less, as shown on Exhibit"A" attached hereto and made a r art hereof for

successors and assigns.
Section 2.
That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as Exhibit "B"
and made a part hereof for all purposes.
Section 3.

RECOMMENDATION
The Administration recommends approval of the request subject to the following condition:
• The mother-in-law quarters shall not be rented and shall not have a separate
electrical meter.
BACKGROUND
Wesley Faul has applied for the specific use permit.
Mr. Faul states that he would like to convert an existing 528 sq. ft. garage into living quarters for
his aging mother. The converted garage will consist of a bedroom, living area, kit hen/dining
area and a bath. The existing garage doors will be removed and exterior siding th t is
complimentary to the existing siding will be added. The floor of the garage will e raised four
inches to make sure water does not penetrate the structure. The entrance to the stricture will be
on the east side of the building.
At a Joint Public Hearing held April 21, 2008, the Planning Commission recommended approval
9:0 of a request for a specific use permit to allow a mother-in-law quarters in an RS (Residential
Single Family Dwelling)District at 5110 Forsythe, subject to the following condition:

Revitalization) District for the property at 203 North
Street.
RECOMMENDATION
The Administration recommends approval of the request.
BACKGROUND
Micah Cooksey, representing Eastex Sleep Solutions, has applied for the specific se permit.
Mr. Cooksey states that the 1,800 sq. ft. sleep lab will consist of two bedrooms, a reception area,
work room, kitchen and a restroom downstairs. The upstairs area will not be utilized. Hours of
operation will be 6 p.m. - 6 a.m.
Eastex Sleep Solutions is a sleep lab that monitors people while they sleep. Mr. ooksey states
that the company's procedures are non-invasive. No fluids are drawn. No harmful chemicals are
stored on-site. 2633 North will be leased as a second Beaumont location for Eastex Sleep
Solutions.
In January, 2006, City Council approved a specific use permit to allow an insurance office on the
subject property. That insurance office no longer occupies the structure.
At a Joint Public Hearing held April 21, 2008, the Planning Commission recommended approval
9:0 of a request for a specific use permit to allow a sleep lab in an RCR(Residenti 1

Ordinance states that once a business in an RCR District has been closed down for a period of a
year or more, a new specific use permit is required.
Ms. James states that she will be the only beautician. Hours of operation will be 8 a.m. - 6 p.m.,

Street.
RECOMMENDATION
The Administration recommends approval of the request subject to the following conditions:
• The structural support of the sign must be located at least 5' from the public right-
of-way. The sign shall not exceed 6' in height and shall not be illuminated.
• The attorney shall live in the house and be the only attorney practicing at this
address.
BACKGROUND
Carolyn Wiedenfeld has applied for the specific use permit.
Ms. Wiedenfeld states that she is under contract to buy the house on North. She will live in the
house and intends to use a room that was added earlier to the rear of the house as her office.
This room has its own outdoor entrance. Ms. Wiedenfeld is a solo practitioner wi h one full-time
employee and one part-time employee. A 2' x 3' sign will be placed next to the d fiveway on 6`h
Street. She states that she would typically see clients between 2 p.m and 5 p.m.
Limited professional practices such as a lawyer, engineer, accountant or architect are permitted in
residential districts as a home occupation as long as no clients or customers are p itted on the
premises. Because Ms. Wiedenfeld expects clients, a specific use permit is requir d.

RECOMMENDATION
Administration recommends approval of a contract with Allco, Ltd., Beaumont, T xas, in the
amount of$8,041,191.50 to complete the mechanical/electrical rehabilitation oft (3)pulsator
clarifiers, furnish and install the peristatic chemical feed pumps as obtained from the equipment
vendor, install two (2) Owner-furnished packaged engine generators, metal-clad paralleling
switchgear, and associated appurtenances, repair structural cracks and patch areas f spalled
concrete in the three(3) pulsator clarifiers, and construct and complete the new chlorine and
chemical feed facilities. The amount also includes alternative bid items for the removal and
replacement of two (2) existing 48-inch flow meters and one(1) 30-inch flow meter within
existing meter vaults, demolition and disposal of the existing wood/steel walkway bridge and
replacement of the existing 30-inch ductile iron raw water inlet pipe in three(3)existing pulsator
clarifiers.
The participating certified MBE firms are: Chris Gobert Trucking of Beaumont, T xas for
$43,000, James Kaufman of Port Arthur, Texas for$26,000, Reyes Contracting o Houston,
Texas for$31,250, McCaulay Controls Company of Houston, Texas for$152,931 and Medcalf
Fabrication, Inc. of Houston, Texas for$193,953. The total amount of subcontracts with certified
MBE firms is $447,134, which represents 5.56 percent of the total bid.
BACKGROUND
This project is the construction phase of the improvements at the Water Treatment Plant including
renovating the pulsators, and building new chlorine and chemical feed facilities. Th pulsators
were originally sedimentation basins constructed in 1948. During the 1980's, the basins were
converted into the pulsators. The project will repair the numerous cracks on the walls and floors.
The existing chemical feed facility was constructed in the 1980's and is in need of s6bstantial
renovation. Advancements in chlorine containment and usage will provide a safe environment and

more efficient operation. The project will include miscellaneous mechanical and electrical
improvements including a building with provisions for two (2) 150OKW Caterpillar generators.
The generators were pre-purchased by the City due to the long lead time and are scheduled for
delivery in June 2008. The changes will improve the future operation, provide emergency backup
power, increase the efficiency of the Water Treatment Plant, and help the City meet required State
and Federal regulations.
This Contract is recommended for approval by the City Manager and the Water Utilities Director.
BUDGETARY IMPACT
Funds for the project are available in the Capital Program.

RECOMMENDATION
Administration recommends the approval to renew the fire, extended coverage, flood and quake
property insurance policy effective May 1, 2008 to McGriff, Seibels&Williams of Dallas, Texas
in the amount of$1,110,366.61.
BACKGROUND
The current property insurance policy awarded in 2007 included a three(3)year renewal clause
on the primary property insurance. Last year's policy did not provide full windstorm coverage on
all City properties. Windstorm coverage was provided by the Texas Windstorm Insurance
Association (TWIA)but only on a portion of the properties. Those excluded were properties still
under construction or renovation from Hurricane Rita damage and did not meet current
windstorm certification requirements.
Since Hurricane Rita, staff has diligently worked with the insurance carrier to settle all claims and
make the appropriate repairs to damaged structures. All structures damaged have been repaired
or reconstructed to meet all windstorm codes.
The carrier was provided with a schedule of values of all City properties that reflect current
building values and windstorm certifications. Fortunately, this year's policy will include
windstorm coverage for all structures and does not require the City to bind separatle coverage
through TWIA.
Additional endorsements provided in this year's policy renewal include $5M for Electronic Data
Processing equipment coverage, $1M for unscheduled locations, $5M for newly acquired
locations, $1M for extra expenses coverage, and $250,000 for Traffic Lights and Signals.
The cost of the policy for this year is$1,110,366.61. Last year's policy premium providing
limited windstorm coverage was $737,905. The renewal policy is a rate reduction of 17.34%.
The value per$100 coverage last year was$0.0070 and this year's renewal is$0.008.

Administration recommends the award of a bid to McInnis Construction of Silsbee, Texas in the
amount of$1,523,000 plus $1.25 per square foot for soil stabilization and executing Change
Order No. 1 reducing the base bid by$57,262.50.
BACKGROUND
Bids were received on Thursday, April 10, 2008 for improvements to Rogers Park.. These
improvements include a new community center, walking trail, landscaping, a new restroom
facility, new basketball court, and an expanded parking lot with area lighting. In addition to the
improvements, this contract includes the demolition of the existing community center, basketball
court and cover and repairs to the fence between Miller Library and the park.
The new 3,500 sq. ft. community center, designed by Architectural Alliance, Inc., will be the same
floor plan as the recently completed community center at Central Park. Variations in exterior and
interior colors will give each community center its own identity. Both Central Park and the
proposed community center at Rogers Park have a maximum capacity of 200. The new brick
structure will have a metal roof with double door front and rear entrances and a catering door
entrance.
The existing community center at Rogers Park has a maximum capacity of 36. Due to its limited
capacity, it is not rented as frequently as Central Park and Alice Keith Community Centers. The
restrooms located at the rear of the building's exterior, service both the community;center guests
and park visitors. In the proposed improvements, a separate restroom facility will be constructed
west of the parking lot on Dowlen Road and south of the playground. This location will provide
families and visitors to the park and playground area a convenient restroom facility, The new
restroom design and style will be similar to the community center.

Other improvements include the construction of a new basketball court. The existing court and
cover will be demolished and a new uncovered court constructed south of the tennis courts on
Gladys. The existing metal structure covering the court was damaged during Hurricane Rita and
due to its age and the deteriorated condition of the steel supports, it must be removed. The
construction of a new basketball court near the tennis courts contains all court activities in one
location.
The proposed concrete parking lot will have a separate drive for entering and exiting from Gladys
Avenue and will provide more than 80 parking spaces. Appropriate area pole fighting will be
installed throughout the parking lot.
The proposed site improvements include new play mounds to enhance the playground activity and
a new five(5)foot wide concrete walking trail. The trail is approximately 1,961 feet in length and
winds throughout the tree shaded area of the park. The base bid also includes repairing the fence
separating Miller Library and the park and sidewalk replacement from Miller Library to the
parking lot on Dowlen Road.
Attached is the site plan for the scheduled improvements. Improvements were designed and
located on the park to minimize the loss of trees.
The eight(8)bids received ranged in price from$1,523,000 to $2,340,000. The low bidder is
McInnis Construction in the amount of$1,523,000. McInnis recently completed the Central Park
Community Center located at 2925 Fannin. They plan to subcontract approximately 7% of the
project to three(3) certified MBE or HUB companies. McInnis is aware of the City's goal to
have 20%MBE participation. They used the state HUB and the City's MBE list of vendors to
solicit bids for subcontracting. Scheduled completion time is 220 days. A tabulation of all bids is
attached for your review. The price per square foot for soil stabilization will only be incurred
should there be silty soil conditions.
Change Order No. 1 reflects a deduction in the base bid to reduce the cost and bring the net cost
more in line with the original budget. When budgets were prepared, staff nor anyone else could
have predicted the rising cost of fuel and how it would affect prices. Construction costs are
increasing due to the cost of materials and transportation. Two areas of work to be removed
from the project are a portion of the walking trail and resurfacing the asphalt parking lot on
Dowlen Road. In the original site plan the walking trail encircled the open fields on the west side
of the park. Many local youth sports league groups use this area of the park as a practice field,
therefore, it was decided that deleting the walking trail from this area would not only reduce the
cost but limit interference between players and walkers using the fields and trails. Removal of
6,905 feet of trail reduces the cost by$17,262.50. The asphalt parking lot on Dowlen Road was
scheduled to be resurfaced. Deleting this work from the project results in a deduction of$40,000.

Funds for this project are available in the Capital Reserve Fund. The net cost after'Change Order
No. 1 is $1,465,737.50. Change Order No. 1 reflects a 4%reduction in the contract cost.
