10-2 OF THE CODE OF ORDINANCES OF THE CITY OF
BEAUMONT TO AMEND THE FIRE CODE TO PROVIDE
REGULATIONS FOR UNATTENDED SELF-SERVICE FUELING
STATIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL; AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1,
THAT Chapter 10, Section 10-2 of the Code of Ordinances of the City of Beaumont be and
the same is hereby amended as follows:
Section 907.4.3 of the 1997 Standard Fire Prevention Code is hereby repealed and
a new section 907.4.3 is hereby adopted to read as follows:
Section 907.4.3 Supervision
907.4.3.1 Unattended self-service stations shall be permitted, subject to the
approval of the authority having jurisdiction.
907.4.3.2 Listed dispensing devices shall be used. Coin and currency type
devices shall only be permitted with the approval of the authority having jurisdiction.
907.4.3.3 Emergency controls specified in 4-1.2 of the 1996 edition of N.F.P.A. 30A
shall be installed at a location acceptable to the authority having jurisdiction, but the
controls shall be more than 20 ft. but less than 100 ft. from the dispensers. Additional
emergency controls shall be installed on each group of dispensers or the outdoor
equipment used to control the dispensers. Emergency controls shall shut off power to all
dispensing devices at the station. Controls shall be manually reset only in a manner
approved by the authority having jurisdiction.

907.4.3.4 Operating instructions shall be conspicuously posted in the dispensing
area and shall include location of emergency controls. Nozzles will require that the
operator manually dispense the gas and automatic lever locks will be prohibited.
907.4.3.5 In addition to those warning signs specified in Section 9-9 of the 1996
edition of N.F.P.A. 30A, emergency instructions shall be conspicuously posted in the
dispenser area incorporating the following or equivalent wordings:
EMERGENCY INSTRUCTIONS
IN CASE OF FIRE OR SPILL
1. Use emergency stop button
2. Report accident by calling 911 emergency response number
907.4.3.6. The emergency stop button will be connected to an approved alarm
system which will automatically transfer the alarm to a U.L. listed monitoring company.
907.4.3.7. Maximum gallonage per transaction will not exceed 40 gallons.
907.4.3.8. Unattended self service stations shall be subject to an annual operating
permit fee.
Section 2.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.

Section 3.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished as provided in Section 1-8 of the Code of Ordinances of the City of
Beaumont, Texas.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
