Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on November 13, 2007 at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m.to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor James Blackwell of South Park Baptist Church gave the invocation. Arnesha O'Brien of Dunbar Elementary School led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Samuel, Councilmembers Coleman, Beaulieu,Wright, Pate and Smith. Also present were Kyle Hayes,City Manager;Tyrone Cooper,City Attorney; Tina Broussard, City Clerk. Proclamations, Presentations, Recognitions "Professor Gilbert Balibaseka Bukenya"-Presentation read by Mayor Pro Tem, Samuel; accepted by His Excellency the Vice President of the Republic of Uganda and his delegation. The Mayor also presented his Excellency with a key to the City of Beaumont. A Proclamation was also presented by Kristin Barrs, Eastern District Director for U.S. Representative Judge Ted Poe "Texas Recycles Day"-November 15,2007,Accepting:Jennifer Walsh, Public Information Officer, Texas Department of Transportation, Beaumont District 20 "Great American Smokeout Day" - November 15, 2007, Accepting: Judy Cornelius, Tobacco Prevention Specialist, Beaumont Public Health Department Minutes-November 13,2007 Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda. None Mayor Ames read the announcement regarding the Executive Session to be held at the conclusion of the General Business portion of the meeting. CONSENT AGENDA Approval of minutes - November 6, 2007 Confirmation of committee appointments - None A) Authorize the City Manager to execute all documents necessary for the Beaumont Public Health Department to continue to provide Tuberculosis (TB) services to Jefferson County Correctional Facilities - Resolution 07- 370 B) Approve the purchase of natural gas-fired boilers for installation at the Police building - Resolution 07- 371 C) Authorize the acceptance of an exclusive water line easement for fire hydrants across Residence Inn property located off Clearwater Court - Resolution 07- 372 D) Approve Change Order No. 2 for renovations to City Hall - Resolution 07- 373 Councilmember Beaulieu made a motion to approve the Consent Agenda. Councilmember Coleman seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM SAMUEL, COUNCILMEMBERS COLEMAN, BEAULIEU, WRIGHT, PATE AND SMITH NAYS: NONE MOTION PASSED [MAYOR PRO TEM SAMUEL LEFT THE MEETING AT 1:55 P.M.] GENERAL BUSINESS 1. Consider approving a contract with the Beaumont Community Housing Development Organization (BCHDO). Administration recommended City Council authorize the City Manager to execute a contract with the Beaumont Community Housing Development Organization(BCHDO)in the amount of$100,000 for the purchase of one pre-existing scattered-site home that will be retained as lease property for no more than thirty-six months and sold to an eligible low/moderate income family. Page 2 of 7 Minutes-November 13,2007 The City of Beaumont receives an annual allocation of HOME Investments Partnership funds from the U. S. Department of Housing and Urban Development (HUD) and has previously awarded contracts to the Beaumont Community Housing Development Organization (BCHDO)for acquisition of housing to be sold to eligible low/moderate income families under lease-purchase agreements. Federal regulations require that a minimum of$113,282 of the $755,215 total allocation be contracted to Community Housing Development Organizations (CHDOs) for eligible CHDO activities, including acquisition of housing, new housing construction and related project delivery costs. Such costs may include site preparation, acquisition, home buyer assistance and other related soft costs. Acquired properties must meet the City's Affordable Housing Program requirements. Upon execution of a contract,The CHDO will identify properties currently on the market and submit them for the Administration's review process which includes satisfying the program's lot specifications, environmental review, and code compliance. City Council approval prior to identifying the property will allow the CHDO to purchase a property in a timely manner. Funding is available from the 2007 HOME Program. Councilmember Smith made a motion to APPROVE A RESOLUTION THATTHE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH THE BEAUMONT COMMUNITY HOUSING DEVELOPMENT ORGANIZATION (BCHDO) IN THE AMOUNT OF$100,000 TO BE FUNDED FROM THE 2007 HOME PROGRAM FOR THE PURCHASE OF ONE PRE-EXISTING SCATTERED-SITE HOME, THE LOCATION OF WHICH WILL BE DETERMINED AND REVIEWED AT A LATER DATE,TO BE RETAINED AS LEASE PROPERTY FOR NO MORE THAN THIRTY-SIX(36) MONTHS AND SOLD TO AN ELIGIBLE LOW/MODERATE INCOME FAMILY. Councilmember Pate seconded the motion. AYES: MAYORAMES,COUNCILMEMBERS COLEMAN,BEAULIEU,WRIGHT,PATE AND SMITH NAYS: NONE MOTION PASSED Resolution 07- 374 2. Consider approving a contract for the purchase of fire hydrants. Administration recommended award of an annual contract to purchase fire hydrants at a unit costs from H. D. Supply Waterworks of Lufkin. The estimated total annual expenditure is $129,657.80. Bids were solicited for an annual contract supply American Flo Control fire hydrants to be installed by the Water Utilities Department throughout the City as needed. Sixteen (16) vendors were notified, with three (3) responding. Specifications required vendors to maintain firm pricing for the entire contract period. Due to price fluctuations in the cost of raw materials used in the production of various contract items, particularly brass, some vendors are wary of guaranteeing prices for a full year. Conditional bids that included escalation clauses were not considered. Page 3 of 7 Minutes-November 13,2007 H. D. Supply Waterworks of Lufkin submitted the lowest qualified bid. The apparent bidder withdrew their bid prior to contract award. Funds are available for this expenditure in the Water Utilities department's operating budget. Councilmember Beaulieu made a motion to APPROVE A RESOLUTION THAT THE BID SUBMITTED BY H. D.SUPPLY WATERWORKS OF LUFKIN,TEXAS, FOR THE PURCHASE OF FIRE HYDRANTS FOR AN ESTIMATED TOTAL EXPENDITURES OF$129,657.80 BE ACCEPTED BY THE CITY OF BEAUMONT. Councilmember Wright seconded the motion. AYES: MAYOR AMES,COUNCILMEMBERS COLEMAN,BEAULIEU,WRIGHT,PATE,AND SMITH NAYS: NONE MOTION PASSED Resolution 07- 375 3. Consider approving a request for a historic preservation loan for repairs to a house at 2629 North Street. Administration recommended approval of the request for a historic preservation loan for repairs to a house at 2629 North. Jessie Haynes is requesting historic preservation loan monies in the amount of$25,795.00. Work to be done to the house includes a new roof and windows, painting and general repairs to exterior of the house. The terms of the loan will be $537.50 per month for 48 months. The Historic Preservation Loan Program was created to assist property owners of historic structures with renovations to those structures. The loans are interest free and must be used only for renovations done to the exterior of the building. The Historic Preservation Loan program is funded with CDBG money. Currently, there is $119,000 in the Preservation Loan Account. Councilmember Wright made a motion to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO APPROVE AN HISTORIC PRESERVATION LOAN REQUEST FOR $25,795.00 FROM THE HISTORIC PRESERVATION LOAN FUND FOR THE EXTERIOR RENOVATION OF THE RESIDENCE AT 2629 NORTH,BEAUMONT,TEXAS,TO INCLUDE A NEW ROOF AND WINDOWS, PAINTING AND GENERAL REPAIRS TO THE EXTERIOR OF THE HOUSE.
