RECOMMENDATION Administration recommends approval of the License Agreement. BACKGROUND The City of Beaumont continues in its campaign to promote business development in the downtown area and provide an aesthetically-pleasing environment for patrons from the community. The City of Beaumont and Crockett Street Development participated in a private/public partnership to develop Crockett Street. The City was responsible for paving,sidewalk and lighting improvements on Crockett Street. In June 2003, the City entered into a License Agreement with Crockett Street Development. The agreement provided exclusive use of the Crockett Street right-of-way from Main to Pearl Streets. Under the terms of the proposed license, Crockett Street Development may limit vehicular and pedestrian traffic to this section of Crockett Street. In return for this exclusive license, Crockett Street Development agrees to provide the City with written notice thirty(30)days in advance of any planned entertainment event, in order to limit pedestrian access. The license requires a payment to City of ten percent (10%) of gross receipts for admission for all "for profit" events. There is not a required fee for"non-profit" events; however, the notifications requirements are the same. Additionally, the maintenance of the infrastructure on Crockett Street from Main to Pearl Streets will be the responsibility of Crockett Street Development. Also included in the license is an Crockett Street District License Agreement Renewal August 23, 2007 Page 2 indemnification clause and the requirements for insurance with the City as a name insured. Should the one (1)year term expire, the license will continue from month-to-month until such date as it is renewed by City Council. A copy of the License Agreement in its substantial form is attached for your review. BUDGETARY IMPACT The City has received $35,227.80 since June 2003 as a result of the 10% fee. i RESOLUTION NO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be and he is hereby authorized to execute a License Agreement with Crockett Street Development dba Crockett Street District for a one(1)year term. The agreement is substantially in the form attached hereto as Exhibit "A" and made a part hereof for all purposes. PASSED BY THE CITY COUNCIL of the City of Beaumont this the 28th day of August, 2007. - Mayor Becky Ames - LICENSE STATE OF TEXAS § ALL MEN BY THESE PRESENTS: COUNTY OF JEFFERSON § On the date last indicated below, the City of Beaumont, a municipal corporation of Beaumont, Jefferson County, Texas, (hereinafter called "Licensor"), and Crockett Street Development, by and through Crockett Street District, (hereinafter called "Licensee"), contract and agree as set forth herein. Licensee desires an exclusive license from Licensor to use the real property the subject of this License Agreement described as follows: Crockett Street right-of-way between Main and Pearl Streets(herein"Licensed Premises"). Licensee may limit vehicular access to the Licensed Premises, but may not limit pedestrian access at any time except as follows: Should Licensee desire to limit pedestrian access to the Licensed Premises, they must first provide Licensor with thirty (30) days advance written notice of its intention to do so. If an admission charge is assessed or compensation is paid for use of the Licensed Premises and the event is a "for profit"event, Licensee shall pay to Licensor a fee of ten percent(10%)of the gross receipts for admission to the event. There shall be no fee for"non-profit' events, but Licensor shall still be given at least thirty (30) days notice as set out above. "Non-profit' event, as used in this License, means that 100% of the admission fee for the event is received by the organization for which the event is held and the organization is a charitable organization as defined by the Tax Code of the State of Texas, or the Internal Revenue Code of the United States. Licensee is to provide Licensor with thirty(30)days advance written notice of the events planned for the Licensed Page 1 of 7 EXHIBIT "A" Premises. Should Licensee fail to comply with the notice and fee provisions of this paragraph,this License may be terminated immediately. Licensor shall be allowed to audit the financial records of"for profit"events to verify payment accuracy. Such audit will occur during normal business hours. Truck deliveries to the Crockett Street District will be limited to the Licensed Premises. No truck delivery will be made on either Main or Pearl Streets. Licensed Premises may continue to be occupied and used by Licensee solely in connection with the Crockett Street District and for incidental purposes related thereto during the term of this License or until termination thereof. Said License shall be for a term of one (1) year from and after the date of its approval by the City Council of Licensor. Should the one (1) year term expire, the license will continue from month to month until such date as it is renewed by the City Council. No permanent improvements shall be made upon the Licensed Premises without first obtaining the written consent of Licensor by and through its City Manager or his designee and providing a copy of the notice to Licensor in writing of how,when and to what extent such improvements are to be made. A copy of this License shall be attached to such notice. In the event Licensor, by Resolution of the City Council, determines there is a public need of the subject property or any part thereof, for the benefit of the Licensor or to protect the health, safety or welfare of the public, and it terminates this License or any part thereof, Licensee shall not receive any compensation and the Licensor shall not be liable therefor Page 2 of 7 whether for the value of the property taken, damage to the abutting or remaining property or improvements, loss of business or profit, loss of access, or otherwise. Licensee shall, at all times of use under this License, be liable for all liability and/or damage claims for injury or death of persons or property from any cause whatsoever relating to the occupancy of the premises by Licensee, including those arising out of damages or losses occurring on sidewalks and other areas adjacent to the Licensed Premises, during the term of this License or any extension thereof. Licensee agrees to indemnify and save harmless Licensorfrom anyand all claims,causes of action,and damages of every kind for injury to or death of any person and damages to property arising out of the occupancy and use of Licensed Premises or the operations embraced by this License and including acts or omissions of Licensorin connection therewith. Licensee shall carry public liability and property damage insurance covering operations hazards, and including Licensee's obligations under the indemnification provision contained in this License (with a company acceptable to Licensor)with Licensor as a named insured in the sum of$1 million in the aggregate. Should Licensor determine at any time during the term of this License Agreement that the above coverage is inadequate, it shall notice Licensee in writing to increase the amount of such insurance so the same shall be adequate. The failure of Licensee to obtain said additional insurance within thirty (30) days of Licensor's request shall constitute a breach of this License. A copy of the original policy shall be filed with the City Clerk. Page 3 of 7 As part of the consideration for this License Agreement, Licensee shall pay to Licensor the sum of$10.00 (Ten and No/100 Dollars), said sum being non-refundable. Licensee recognizes that this License does not affect the use of the Licensed Premises by Licensor or any entity with a franchise to use City rights-of-way. This Agreement is terminable by either party by giving written notice to the other specifying the date of termination. Said notice shall be given not less than thirty (30)days prior to the termination date therein specified. This License is neither assignable nor transferrable except (1) in conjunction with and as part of Licensee's conveyance of all the abutting property and (2) occupancy and use of the Licensed Premises by a lessee leasing abutting property from Licensee(in which case Licensee is not relieved from its obligations owed to Licensor hereunder). This License survives through probate or warranty deed or lease. In any such event, other than lease of abutting property, Licensor shall be notified of such occurrence by being delivered a copy of the document or documents conveying the abutting property. This License shall include the right of Licensee to have balcony structures which extend into the Licensed Premises. Licensee shall be responsible for all maintenance, repair and upkeep of the Licensed Premises, including, but not limited to, brick pavers, decorative lighting, arches and lighting on arches and curbs. Any notice to Licensor shall be sufficient if it is mailed or hand-delivered to the Office of the City Manager, City of Beaumont, P. O. Box 3827, Beaumont, Texas, 77704. Any Page 4 of 7 notice to Licensee shall be sufficient if mailed or hand-delivered to Licensee at 555 Main Street, Beaumont, Texas, 77701. BACKGROUND In September of 2005,when Hurricane Rita was threatening the area, provisions were made for the sheltering of emergency services personnel and response equipment within the City of Beaumont. It was determined after this event, that this was not the best course of action for future disasters. Subsequently, as part of the emergency planning process, a decision was made that in addition to those emergency response personnel and equipment sheltered within the City, that some of these resources should be dispersed and sheltered at locations more remote from the City. This action would take place in the final moments, in advance of a hurricane landfall, after all citizen evacuation and storm preparations had been completed and these resources will return immediately when it is safe to do so. This agreement will provide one such remote sheltering location for a portion of the City of Beaumont's emergency response personnel and equipment. BUDGETARY IMPACT None. BACKGROUND Lionel Arsement has applied for a zone change from RM-H(Residential Multiple Family Dwelling- Highest Density) District to GC-MD (General Commercial-Multiple Family Dwelling) District or more restrictive district. The property is located on the west side of Warren Street, approximately 467'north of W. Cardinal Drive. Mr. Arsement owns and operates the Rockin' A Caf6 at 3520 W. Cardinal Drive. He is currently expanding his business to include an additional 11,900 sq. ft. of open and enclosed structures. To accommodate this expansion,he is wishing to construct additional parking. The vast majority of the parking will be located north of the existing restaurant. The Planning Manager spoke with Mr. Arsement to explain that his recommendation is based upon the need to buffer the residences to the east of the proposed rezoning. The subject property is currently zoned RM-H to act as a buffer to the residences along the east side of Warren. To grant GC-MD zoning would prohibit the City Council from requiring any special conditions that could allow Mr. Arsement his parking lot but with adequate buffering for his neighbors to the east. With the granting of GC-MD-2 zoning, Mr. Arsement would then ask for a specific use permit in September. Mr. Arsement is in agreement with this recommendation. At a Joint Public Hearing held August 20, 2007, the Planning Commission voted 8:0 to approve a request for a zone change from RM-H (Residential Multiple Family Dwelling-Highest Density) District to GC-MD-2 (General Commercial-Multiple Family Dwelling-2) District for property located on the west side of Warren Street, approximately 467'north of W. BACKGROUND Daron Etie has applied for a specific use permit to allow a dental office in a GC-MD-2 (General Commercial-Multiple Family Dwelling-2)District. The property is located on the east side of the Delaware Extension, approximately 106'northeast of Wilcox Lane. In June,2005,City Council approved a zone change to GC-MD-2 and a specific use permit to allow medical offices and a day care center. The Zoning Ordinance states that construction must commence and be substantially underway within a two year time period or the specific use permit will become null and void. Construction has not begun so the specific use permit expired in June of this year. The original specific use permit included 8,000 sq. ft. of medical offices in two buildings and an 8,000 sq. ft. day care center. The new specific use permit request is for a 2,475 sq. ft. dentist office in a single building. At a Joint Public Hearing held August 20, 2007, the Planning Commission voted 8:0 to approve a request for a specific use permit to allow a dental office in a GC-MD-2 (General Commercial- Multiple Family Dwelling-2) District on property located on the east side of Delaware Extension, approximately 106'northeast of Wilcox Lane subject to the following condition: • Provide an 8'tall wood screening fence and 10'wide landscape strip along the east and south property lines. WHEREAS,the City Council for the City of Beaumont desires to issue a specific use permit to Daron Etie, to allow a dental office in a GC-MD-2 (General Commercial-Multiple Family Dwelling-2) located on the east side of Delaware Extension, approximately 106' northeast of Wilcox Lane, as described in Exhibit "A" attached hereto; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described condition; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. BACKGROUND Charles and Beth Boren have applied for a specific use permit to allow a recreational vehicle park in an RM-H (Residential Multiple Family Dwelling-Highest Density) District. The property is located at 5775 Erie Street. The Borens have the subject property under contract to purchase. Their plans are to build a 73 space recreational vehicle park on 3.49 acres. In addition to the pad sites, there will be a 1,600 sq. ft. structure that will contain the main office, a storage room, a storage garage, laundry room and four shower rooms. The Borens state that noise will be controlled through a strictly enforced 10 p.m. to 6 a.m. curfew by the on-site manager. The property will be surrounded by an 8' tall wood screening fence. The pad sites will be accessed by a one way street and one access/egress point onto Erie Street. This access/egress point will be gated. At a Joint Public Hearing held August 20, 2007, the Planning Commission voted 9:0 to deny a request for a specific use permit to allow recreational vehicle park in an RM-H(Residential Multiple Family Dwelling-Highest Density) District at 5775 Erie Street. BACKGROUND Dave Petrakovitz,representing T-Mobile West Corporation,has applied for a specific use permit to allow the construction of a 1.00' tall cellular telephone transmission tower in a GC-MD (General Commercial-Multiple Family Dwelling)District. The property is located at Beaumont Community Players new theater at 4155 Laurel. Mr.Petrakovitz states that due to a large increase in cell phone traffic in the vicinity of the proposed site, T-Mobile has identified a need for enhanced coverage in this part of Beaumont. After considering several alternative sites in the vicinity,the proposed location was chosen by T-Mobile's design team as the most suitable for the desired radio signal coverage area. T-Mobile proposes erecting what is referred to in the cellular industry vernacular as a "unipole". With this type of pole,there are no visible external antennas. It is a modified flagpole design which utilizes fiberglass shrouds or housings on the top of the tower painted to match the tower itself. Behind these shrouds are mounted the necessary broadcast and reception antennas. Mr.Petrakovitz states that while this design is a technological compromise from a broadcast and signal coverage perspective, T-Mobile feels it is a better design fit for the neighborhood. After considering several alternative sites in the vicinity the proposed location was chosen by T-Mobile's design team as one which most closely met the community design and zoning standards while still providing a close enough proximity to the desired radio signal coverage area so as to be able to provide the required service. T-Mobile proposes erecting what is referred to in the cellular industry vernacular as a `unipole'. As can be seen from the accompanying photos this site has no visible external antennas. It is a modified flagpole design which utilizes fiberglass shrouds or housings on the top of the tower painted to match the tower itself behind which are mounted the necessary broadcast and reception antennas. While this is a technological compromise from a broadcast and signal coverage perspective T-Mobile feels it is a better design fit for the neighborhood. This type of site design is being used with increasing community request and approval in many local cities including Houston, Sugarland, Clear Lake, and The Woodlands to name a few. It is T-Mobile's belief, after consultation with City Planning staff and review of City zoning requirements that the proposed site location is compatible with and not injurious to the use and enjoyment of other property owners in the vicinity of this site nor would this site impede the normal and orderly development of surrounding vacant property. The site location exceeds City requirements from residential uses, does not impact the parking needs of the theatre, is set back beyond requisite building lines from Laurel Street, is shielded at street level from two sides -by the theatre building on the south and by thick tree coverage on the west - and is surrounded by commercial uses on all four sides. Experience has shown that a site design such as the one proposed has no significant affect on property values in the immediate vicinity of similarly designed sites. T-Mobile has already met with local utility providers and ascertained that there is more than sufficient current service availability for the needs of this site. No water or sewer is required. Furthermore, as this site is already a paved parking lot there would be no change to rain water drainage off the property caused by the construction of this site. As an unmanned site there would be no adverse affects to vehicular or pedestrian traffic. The site would generate on average two to three single-vehicle trips to the site per month by a service van or pickup truck for routine site maintenance. Other than during normal construction noise and dust(the bulk of which process runs about a week) as an unmanned facility there is no noise, fumes, vibration, or odors created by this site other than that which might be occasioned by the use of an emergency generator. Due to the demonstrated emergency communication needs provided for by cellular phones within the Beaumont area this site is being designed with an emergency backup generator on site. This generator is only designed to be used in the event of a loss of power to the site and is not used for normal operations. The noise of this generator might be heard within a short distance of the site but with the shielding afforded by the thick trees to the west and the theatre building to the south the residential neighborhood to the south would be very well protected from objectionable generator noise. There is no lighting of this site other than a pole mounted floodlight which is provided for a service technician's use while on site and is angle downward onto the radio equipment and ground. T-Mobile believes there is good natural landscaping and screening of the site from the north, south and west as will be noted on the attached site plan. While the current site plan as noted does not call for further landscaping along the eastern fence line due to the use of the immediate area being a paved parking lot, T-Mobile is agreeable to placing landscaping along the eastern fence line should the Commission and/or Council so desire. The compound would be surrounded by a solid screened wooden fence. T-Mobile accordingly request approval of a Specific Use Permit for the construction and operation of wireless antenna facility/tower at the requested location. Thank you. BACKGROUND In December, 2006, the Beaumont Housing Authority requested the abandonment of a number of streets and alleys located within the former Fair Park property. The purpose of these abandonments is to facilitate the development of housing by the Housing Authority. City Council approved the abandonments in January, 2007. It was recently discovered that an additional 60' x 500' portion of Averill Street needs to be abandoned. The purpose of this request is to abandon that portion of Averill Street which will allow the Housing Authority to develop its property as planned. At a Regular Meeting held August 20, 2007, the Planning Commission voted 9:0 to approve a request to abandon a portion of Averill Street from Maime to the dead end of Averill Street. Recommended by Planning Commission, City Manager, Public Works Director and the Planning Manager. RECOMMENDATION Administration recommends approval of a contract with Insituform Technologies, Inc., Houston, Texas through the Texas Association of School Boards (TASB)Buyboard cooperative purchasing program. The Texas Local Government Purchasing Cooperative Buyboard,administered by TASB, complies with all State bidding statutes. Membership with Buyboard allows municipalities to purchase items from their contracted vendors. The contract amount is for $349,620.00 to rehabilitate approximately 1,817 linear feet of 18-inch water mains. The amount includes the repair and rehabilitation of asphalt and reinforced concrete pavement, curbs, sidewalks and driveways, sodding as needed and traffic control. The project time is 150 calendar days. The MBE goal will be met through a subcontract with the certified MBE firm Briones Construction & Supply, Ltd. of San Antonio, Texas for$84,500.00. The amount represents 24.17 percent of the total bid. BACKGROUND The existing water main was installed in the 1940's and supplies Saint Elizabeth Hospital from the West Elevated Storage Tank. The line has had numerous breaks in the past few years. The rehabilitation of the line will provide a reliable water supply and improve water quality in the area. A previous design of directional drilling with High Density Polyethylene Pressure Pipe of the same Oaks Historic District Water Main Rehabilitation Project July 17, 2007 Page 2 line was competitively bid in April 2007. The lowest bid on the project was$581, 648.00. Based on the bid results, Water Utilities researched alternative methods to rehabilitate the water line and determined contracting through Buyboard would be the most economical approach. This Project is recommended for approval by the City Manager and the Water Utilities Director. BUDGETARY IMPACT Funds for the project are available in the Capital Program. BACKGROUND On December 5, 2006, City Council awarded the Main Street (Calder to Blanchette) Brick Paved Sidewalk and Roadway Reconstruction Project, in the amount of $6,377,885.59, to Brystar Contracting. This change order includes the installation of a 3-inch conduit and fiber optic cable on Main Street from College to Forsythe, Forsythe from Main to Park, Park from Forsythe to College and College from Park to Main. High speed data circuits are required between Police Headquarters and the Municipal Court building to connect the Primary and Secondary Public Safety servers. Constant updates are sent between the Primary and Secondary systems so that in the event of a failure, the Secondary Server is up to date. The approximate cost to lease two(2) lines from AT&T to support this connection is approximately $5,800 per month. In order to eliminate this high monthly cost, the fiber optic loop would be installed connecting the two (2) buildings. Additionally, by running fiber in a loop through downtown, connections will also be made to City Hall, the Main Library, Julie Rogers Theater, Tyrrell Historical Library and the new Police Property Building (former Goodwill Building). This will allow the cancellation of existing AT&T T 1 lines that currently connect these buildings and will eliminate the need to order additional lines. This will reduce an additional $1,100 per month in AT&T costs while greatly increasing the speed of the connection to the City network. This work is recommended for inclusion in the Main Street Project since sections of Main, Forsythe and College are scheduled for replacement as part of the project. Also, a conduit run currently exists on College between Park and Pearl. BUDGETARY IMPACT The funds for this additional work are available in the Capital Program. BACKGROUND This contract will provide for the implementation of a consolidated radio dispatch system in the 911 Operations Center with uninterrupted service to dispatch operations. In an effort to minimize cost, Motorola will reuse as much of the City's existing infrastructure as possible. All of the existing radio equipment will be moved to the new center with the exception of the antenna networks at the two current dispatch centers. The current Police Dispatch will be the backup location for the new center and to support that functionality two radio consolettes will be installed to provide VHF (Very High Frequency) and UHF (Ultra High Frequency) capabilities. Control stations to support 800 Mhz communications will be brought into the backup center as needed when it is activated. To support the new Emergency Operations Center(EOC)that will be housed at the 911 Operations Center, additional radio equipment will be installed to support 800 Nlhz, UHF and VHF radio communications. BUDGETARY IMPACT The City is applying for a Port Security Grant for this project. If awarded, a 25% match will be required by the City which amounts to $146,527.95. RECOMMENDATION Administration recommends approval of a five (5) year contract for photographic traffic signal enforcement services with American Traffic Solutions, Inc. of Scottsdale, Arizona through the Houston-Galveston Area Council(H-GAC).This contract is a cost neutral arrangement resulting in no expense to the City. BACKGROUND State statute allows municipalities to implement a civil penalty by ordinance for anyone who disobeys a red light and is caught by a photographic traffic signal enforcement system. The goal of these systems is to save lives and reduce collisions. State law allows the presumption that the registered owner of a vehicle is responsible for the penalty. A penalty of$75 will be charged per offense. There is also a$25 penalty for late payment. Cameras are triggered by sensors which are activated when a vehicle enters the intersection after the light turns red. The cameras take digital photos of the vehicle and the license plate. The system is designed to operate 24 hours a day in all weather conditions.Intersections with red light cameras will be clearly marked. The system is operated by a contracted vendor who installs and maintains the camera equipment.The company evaluates each photographed incident for accuracy, identifies the registered owner of the vehicle photographed, and presents the information to the Police Department for review. After the Department approves a file, a citation is then sent by the vendor to the registered owner. The violation notice includes a picture of the license plate.The vendor maintains a secure website for the violator to review the images and to pay the fine. Contract for photographic traffic signal enforcement services August 20, 2007 Page 2 Fees are collected from violators by the vendor through both secure online payments and a mail-in check service. Each month, the fees collected from the violators in excess of the monthly fees charged by the contracted vendor are transmitted to the City. Should fees owed to the vendor ever exceed those collected from violators, the City pays no more than the fees collected during that month.The difference would be paid in future months when collections exceed monthly fees owed. Any operating expenses the City incurs related to this program can be paid for by the fees collected from the violators. These expenses can include electricity to run the cameras, labor to review and approve citations,or costs associated with an administrative adjudication and appeal process which is expected to be established through the Traffic Division. This process results in a cost neutral arrangement whereby the City has no cash outlay. In accordance with State statue, excess fees received by the City beyond the costs associated with this program are divided equally with the State. The State deposits these funds into regional trauma center accounts. The portion retained by the City may be used only to fund traffic safety programs, including pedestrian safety programs,public safetyprograms,intersection improvements,and traffic enforcement. The Police Department Traffic Division reviewed a variety of companies offering photographic traffic signal enforcement services. Information was gathered pertaining to issues such as the type of equipment utilized,picture resolution,as well as installation and maintenance arrangements.The Traffic Division presented their findings to an evaluation committee consisting of staff members from the Police, Public Works, Legal, and Finance Departments. The evaluation committee invited three (3) leading providers to make a presentation about the products and services they offer. These companies each have contracts with H-GAC, a cooperative purchasing association providing cities and political subdivisions with the means to purchase specialized equipment at volume pricing and to participate in competitively bid service contracts. H-GAC complies with all State of Texas procurement statutes. Redflex Traffic Systems, Inc. and American Traffic Solutions, Inc. (ATS), both headquartered in Scottsdale, Arizona participated in the presentation. The equipment was evaluated on issues such as their suitability to the local traffic environment which includes a substantial number of large trucks. ATS operates equipment from a higher pole position which aids visibility in this environment.While the services offered by each company were similar,ATS currentlyhas a stronger presence in the southeast Texas area,including the City of Houston,which allows them to keep more personnel and equipment in the area for a potentially faster response in the event of a malfunction. Beginning on the second anniversary of the initial term, the monthly fee per intersection approach shall increase by the percentage increase in the Consumer Price Index as published by the U.S. Department of Labor. Initially,the City expects to install cameras at approximately ten(10)intersection approaches.Most intersections have four(4) traffic approaches while some intersections that include frontage roads along freeways may have as many as six (6) traffic approaches. The City will determine the most advantageous intersections in which to install cameras to enhance safety based on information such as previous accident statistics.
