Barbara White would be appointed to the Parks and Recreation Advisory Committee. The term
would commence August 7, 2007 and expire August 6, 2009. (Councilmember Jamie D. Smith)
Pat Avery would be appointed as Chairman of the Board of Adjustment (Zoning). The term
would commence August 7, 2007 and expire August 6, 2008. (Mayor Becky Ames)
Joey Hilliard would be reappointed to the Board of Adjustment (Zoning). The current term
would expire February 17, 2009. (Mayor Becky Ames)
Pat Avery would be reappointed to the Board of Adjustment(Zoning). The current term would

REQUESTED ACTION: Council consider a resolution authorizing the granting
of a License to Encroach to Raymond L. and Jo
Theresa Audilet for a pool and garage encroaching
onto the utility easement at 6870 Glen Willow.
RECOMMENDATION
Administration recommends authorization to execute the License to Encroach.
BACKGROUND
Raymond L. and Jo Theresa Audilet, owners of the property at 6870 Glen Willow Drive, have
submitted an application for a License to Encroach for a pool and garage encroaching onto the utility
easement at that location. An in ground swimming pool is encroaching 7 feet for a distance of 18
feet and a brick garage is encroaching 3.3 feet for a distance of 11 feet into the City's twenty(20)
foot utility easement across the rear of said lot[Lot 12,Block 14,Dowlen West Unit XVII Addition].
The License to Encroach protects the City from liability and provides a thirty(30) day cancellation
clause.
BUDGETARY IMPACT
There is a one time fee of$500 for the License to Encroach.

within the vicinity of this property. According to the sanitary sewer maps, we have an eight(8)
inch sanitary sewer main in the 20' utility easement.located on the east side of Lot 12, Block 14,
Dowlen West Unit XVII Addition. The following statement will need to be added to the
encroachment agreement: "Licensor, and any franchised entity of Licensor,reserves the right to
make improvements, perform maintenance and construction to the sanitary sewer main covered
by this license where such is deemed necessary for the health, welfare and safety of the
community. In doing so, Licensor and any franchised entity of Licensor shall not be liable to
Licensee for any damage occasioned thereby and Licensee shall not be entitled to prosecute or
maintain a claim against such parties for any such damage sustained by Licensor to said sanitary
sewer main or related items."

RESOLUTION NO.
WHEREAS, Raymond L. and Jo Theresa Audilet have requested that the City of
Beaumont grant a License to Encroach onto the twenty (20) foot utility easement at 6870
Glen Willow, which is described as being out of Lot 12, Block 14, Dowlen West Unit XVII
Addition, to the City of Beaumont, Jefferson County, Texas, as shown in Exhibits "A" and
"B" attached hereto and made a part hereof for all purposes;
WHEREAS, City staff has expended considerable time and effort in investigating
the effect of such encroachments upon the City and utilities serving the same; and,
WHEREAS, it appears that it would be equitable to allow such encroachment at this
time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute a License to Encroach
to Raymond L. and Jo Theresa Audilet, regarding the encroachment of a pool and garage
onto the twenty(20)foot utility easement at 6870 Glen Willow,which is described as.being
out of Lot 12, Block 14, Dowlen West Unit XVII Addition,to the City of Beaumont, Jefferson
County, Texas, as shown in Exhibits "A" and "B" attached hereto and made a part hereof
for all purposes for a one-time fee of Five Hundred Dollars ($500.00) for the License to
Encroach.
