Subject: Third and Final Reading of Franchise Ordinance with Liberty
Tele-Communications, Inc.
The agreement reached between the City and Liberty Tele-Communications, Inc. ,
with respect to a rate revision, included as a part of the overall package
an extension of the term of the franchise until 1999. In addition, as per the
agreement, the franchise now includes the language that will cause the company
to pay a 3 percent fee, based on the gross receipts from all sources within
its operation. This contrasts with the present practice of a payment based
solely on receipts from basic subscription services.
This is the third and final reading, as required by law.
It is recommended that this ordinance be adopted.

AN ORDINANCE AMENDING THE FRANCHISE GRANTED
TO BEAUMONT CABLEVISION, INC . PREDECESSOR
OF LIBERTY T.V. CABLE, INC. ON NOVEMBER 25,
1975, BY INCREASING THE PAYMENTS TO BE
MADE THEREUNDER AND BY EXTENDING THE TERM
THEREOF.
WHEREAS, by ordinance adopted on third and final reading on
November 25, 1975, said ordinance becoming effective April 1 , 1976,
the City of Beaumont ( the "City" ) granted Beaumont Cablevision,
Inc. , the predecessor of Liberty T. V. Cable, Inc. ( the "Company" ) ,
the franchise ( the "franchise" ) to conduct within the City a cable
television business and to use the streets, alleys and public ways
of the City for the purpose of conducting such business; and,
WHEREAS, the franchise is for a term of fifteen ( 15) years
commencing on April 1 , 1976; and,
WHEREAS, as compensation for the use of the streets, alleys
and public ways of the* City, the franchise required the Company to
pay the City each year an annual payment equal to three percent
( 3% ) of gross annual basic subscriber revenues received for cable
television operations in the City for the preceding calendar year;
and,
WHEREAS, City and Company desire to amend the franchise by
extending the term thereof and by increasing the annual payment

made by Company to City as compensation
for the use of streets,
alleys and public ways of the City;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1 .
That Section II(4) be, and the same is hereby , repealed and
removed from the franchise.
Section 2.
That Section III(l ) be, and the same is hereby, amended to
read as follows:
"Upon the filing with the City by Company of the
acceptance required hereunder, the franchise, as
amended by this ordinance, shall be in full force
and effect for a term and period of fifteen ( 15)
years from and after April 1 , 1984, or until
March 31, 1999, unless sooner terminated as
provided herein. "
Section 3 .
That Section IX( 1 ) of the franchise be, and the same is
hereby, amended to read as follows:
"Section IX( 1 ) : The Company shall pay to the City
on or before March 31 of each year, a three
percent ( 3% ) franchise fee based on the gross
receipts of the Company from all sources from its
operations within the corporate limits of the City
for the preceding calendar year. No other fee,
charge or consideration, shall be imposed. Sales
taxes or other taxes levied directly on
subscription basis and collected by the Company
shall be deducted from the gross receipts before

computation of sums due the City is made. The
company shall provide an annual summary report
showing the gross receipts of the Company from
all sources from its operations within the
corporate limits of the City during the
preceding calendar year. "
Section 4 .
That all provisions of the franchise adopted on third and
final reading on November 25, 1975, except those sections amended
herein which are hereby adopted as amended, shall remain in full
force and effect and shall not be affected by passage of this
ordinance.
Section 5 .
Company shall, within thirty ( 30) days from the date of the
final passage of this ordinance by the City Council of the City of
Beaumont, file with the City Clerk of the City of Beaumont, a
written statement signed in its name and behalf in the following
form:
"To the Honorable Mayor and the City Council
of the City of Beaumont:
Liberty T. V. Cable, Inc. , for itself , its
successors and asigns, hereby accepts the attached
ordinance finally passed by the City Council of the
City of Beaumont, the day of

1984, and agrees to be bound by all of its terms
and provisions.

Section 6 .
The full text of this ordinance shall, after final passage
by the City Council of the City of Beaumont, be published once each
week for four ( 4 ) consecutive weeks in a newspaper of general
circulation published in the City of Beaumont, and the expense of
such publication shall be borne by Company. Upon said publication
being completed and the acceptance of this ordinance by Company is
herein provided, this ordinance shall take effect sixty-one ( 61 )
days after its adoption on third and final reading by the City
Council of the City of Beaumont.

Subject: Adoption of 1984-1985 Sanitation Rates and Other Fees
The 1984-1985 budget approved by Council on September 25th contained adjust-
ments in the monthly sanitation charges, as well as other fees necessary to
accomplish the closure of the old landfill and the acceleration of the con-
tinuing effort in making this a cleaner community.
The ordinance attached includes the following provisions and changes:
1. Definitions - Language has been included which accurately
describes current City practice relating to the collection
of trash and waste or refuse.
In the area of trash, the re-definition allows City crews
to pick up all materials placed on the curb, with the ex-
ception of old machinery, large parts of automobiles,
shingles and materials resulting from demolition activities.
A section is included which speaks to the issue of fran-
chises being
g for the hauling of garbage, trash
waste or refuse in the City. The provision calls for the
issuance of franchises where appropriate by March, 1985.
We will be addressing the issue in a Work Session later
this fall .
In order to accommodate federal regulations, a section is
added to explain how infectious and pathological wastes
are to be bagged and collected.
Other language changes incorporated in the ordinance fall
under the "housecleaning" catagory, i .e. , definition of a
landfill division.
2. Rates. The ordinance establishes the following fee
schedule:

* As was discussed last week, the closure charge of 31 cents
per customer will be deferred until January 1, 1985, in
order to allow commercial franchise holders in the City some

time to change their internal billing and contractural pro-
cedures, The ordinance includes language that will accom-
plish the placement of the charge at the appropriate time.
As a part of our billing process this year, we have programmed in an across-
the-board charge for trash collection, closure and clean community to those
residential customers that are collected by private haulers. There are some
2,300 accounts in our system that fall in this catagory.

** It will be necessary before January 1st to revise these rates in
order to accommodate the imposition of the closure fee on our
commercial franchise holders. We are currently preparing the re-
vised rate structure and will present it later this fall .
It is recommended that this ordinance be adopted.

ORDINANCE
ENTITLED AN ORDINANCE AMENDING CHAPTER 28
OF THE CODE OF ORDINANCES OF THE CITY OF
BEAUMONT TO PROVIDE SANITATION FEES AND
REGULATIONS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL AND PROVIDING A
PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
That Chapter 28 , Section 28-20 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:
Section 28-20:
Trash. The term shall mean a normal accumulation of
rubbish such as tin cans, papers, rags, boxes,
glass, household furnishings, applicances, small
automobile parts, yard clippings, leaves, brush,
bulky waste or refuse discarded by residents and
commercial establishments ( specifically excluding
old machinery , large parts of automobiles) , scrap
iron of all kinds, lumber, furniture and residue
of building materials as a result of remodeling
with the exception of old shingles or roofing
materials.
Waste or Refuse. All rubbish, waste or refuse
other than that defined "
as trash above,
including old machinery, large parts of automobiles,
any substance or material which has been discarded
or is the waste product of any manufacturing or
other establishment or results from the demolition
of any structure or building and including
further any other objects, substances or things
of whatever kind or character which for any
reason may be or may have been thrown away ,
discarded or abandoned that in the discretion
of the Director of Sanitation may constitute
objects of waste or refuse.
Private Hauler. Any person, partnership,
association or corporation that will provide
commercial or residential garbage collection
services in the City of Beaumont under a valid
franchise issued -by the City of Beaumont.
Landfill Division. - A division of the City of Beaumont
designated to perform sanitary landfill disposal
services for the public.
Sanitation Department. The department of the City of
Beaumont designated to perform garbage and trash
collection services for the city.
Section 2 .
That Chapter 28 , Section 28-21 of the Code of Ordinances
of the City of Beaumont be, and the same is hereby, repealed.
Section 3.
That Chapter 28 , Section 28-22( b) and (c) of the Code of
Ordinances of the City of Beaumont be amended to read as follows:
Section 28-22(b) :
Such containers shall be not less than ten ( 10)
nor more than forty-five ( 45) gallon capacity,
constructed of metal or plastic, with a
tight-fitting lid or cover that is not attached
and with handles sufficiently strong for workmen
to empty conveniently; provided that nothing
herein shall prohibit the use of plastic bags as
garbage containers so long as said plastic bags

are at least 1 .5 mils in thickness, have a
capacity of not more than forty-five ( 45)
gallons, and are tied or closed securely. The
city shall not be responsible for damage to
containers. The top of such containers shall be
larger in diameter than the bottom to prevent
garbage from sticking to the sides. Every such
owner or occupant shall place all garbage which
has accumulated on his premises in such
container.
Section 28-22( c) :
Such containers shall not weigh over forty ( 40)
pounds or have a gross weight in excess of eighty
(80) pounds when full.

Section 4 .
That Chapter 28 , Sections 28-23( a) and (d) of the Code of
Ordinances of the City of Beaumont be, and .the same are hereby
repealed, and that Section 28-23(g) be amended to read as follows:
Section 28-23(g) :
The Sanitation Department will pick up lumber,
ashes, scrap iron, building or construction
material not to exceed a quantity of four ( 4 )
cubic yards. Such materials that exceed four (4 )
cubic yards shall be removed by the owner thereof
and failure to remove such material shall be
unlawful .
Section 5 .
That Chapter 28 , Section 28-25( a) of the Code of
Ordinances of the City of Beaumont be amended to read as follows:
Section 28-25( a) :
Every owner or occupant described in Section 28-22
shall place trash, garbage containers and trash
receptacles for collection in a convenient place
adjacent to the street abutting their respective
premises or at such other place designated by the
Sanitation Department, so as to be easily
accessible to employees of the department.
Section 6 .
That Chapter 28 , Section 27( a) (1 ) and (b) of the Code of
Ordinances of the City of Beaumont be amended to read as follows:
Section 28-27( a) (1 ) :
Residences from which the owners or occupants
are serviced by a private hauler as defined
in this article.
Section 28-27( b) :
Garbage and trash rates. No rate adjustment
will be made for temporary nonuse of service
unless the water meter is disconnected.
Nonpayment of the garbage collection fee shall

be sufficient grounds for discontinuance of
city water service. The rate for collection
outside the city limits shall be one hundred
twenty-five percent ( 125% ) of the rate
established for Service inside the city limits.
No type of service will be offered residences
exempted under Section 28-27( a) or for vacant
lots. The following monthly rates shall be
collected for removal of garbage and trash:
( 1 ) The monthly rate for removal of garbage and
trash per household unit shall be Ten
Dollars and Seventy-Five Cents ( $10. 75) and
shall consist of the following elements:

Effective January 1 , 1985, a landfill
closure fee of Thirty-One Cents ( $0. 31 )
shall be added and the monthly rate for
garbage and trash per household unit shall
be Eleven Dollars and Six Cents ( $11. 06) .
These rates shall apply to each household
unit not withstanding that such unit is
in a multi-family structure or that
garbage and trash containers are placed
at one location.
(2 ) The monthly rate for removal of trash for
household units which do not use city
garbage collection shall be Three Dollars
and Thirty Cents ($3. 30) consisting of
the following elements:

Effective January 1 , 1985, a monthly
landfill closure fee of Thirty-One Cents
($0. 31) shall be added and the monthly
rate for trash per household unit shall be
Three Dollars and Sixty-One Cents ( $3. 61 ) .
( 3 ) The monthly rate for single family or
multi-family residences which receive
garbage and trash pickup service from
private haulers shall be Fifty Cents
($0. 50 ) consisting of the Clean Community
fee only.

Effective January 1 , 1985, a monthly
landfill closure fee of Thirty-One Cents
($0. 31 ) shall be added and the monthly rate
for single family or multi-family
residences shall be Eighty-Orie Cents
($0. 81 ) .
( 4 ) The monthly rate for senior citizens shall
be Eight Dollars and Fifty Cents ( $8. 50)
and shall consist of the following
elements:

Effective January 1 , 1985, a monthly
landfill closure fee of Thirty-One Cents
($0. 31 ) shall be added and the monthly
rate for senior citizens shall be
Eight Dollars and Eighty-One Cents ( $8. 81 ) .
The "senior citizen income discount rate" shall
apply to customers residing in single-family
residences who are over the age of sixty-five
(65) years whose total annual income, when
combined with the total annual income of all
persons residing in the residence, does not
exceed eleven thousand five hundred dollars
($11,500) . To obtain the senior citizen income
discount rate, persons eligible must file a
sworn application, on a form provided therefor,
with the central collections division. Upon
approval of the application, the senior citizen
income discount rate shall be applicable for a
period of twelve ( 12) months. The rate may be
continued for additional twelve-month periods
upon application as provided above for the
initial twelve-month period and upon
satisfaction of eligibility requirements as may
be in effect at the time of the application.
Section 7 .
That Section 28-28( a) (1 ) , 28-28( a) (2 ) and 28-28( b) of
the Code of Ordinances of the City of Beaumont be amended to read
as follows:

Institutions that have a private hauler.

Schedules: The rates set out in the following
schedule are monthly charges for sanitation
service based on the number of containers as

period of October 1 , 1984 through December 31 ,

Section 8 .
That Chapter 28 , Section 28-31 of the Code of Ordinances
of the City of Beaumont be, and the same is hereby , repealed.
Section 9 .
That Chapter 28 , Section 28-32 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:

Section 28-32:
The charges fixed herein for the removal and
disposal of all garbage and trash shall be entered
by the city against the owner or occupant using or
occupying any building or structure receiving such
service. To avoid duplication in billing and as a
convenience to the public, the Department of Public
Utilities shall include such charges on the monthly
water bills. Any person who shall fail or refuse
to pay the charge herein specified within fifteen
( 15) days from the date of the bill shall have his
garbage service suspended and the Director of the
Sanitation Department shall be notified
immediately for appropriate action in accordance
with the provisions of this article.
Section 10.
That Chapter 28 , Section 28-33 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:
Section 28-33:
Collection of items such as brick , dirt, plaster,
sand, gravel, large automobile parts, scrap metal,
wire, ashes, dead animals and other bulky or heavy
material shall not be included in the regular
garbage and trash collection service furnished by
the Sanitation Department. The owner shall
have such debris removed at his own expense.
Section 11.
That Chapter 28 , Section 28-34 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:
Section 28-34:
It shall be unlawful for any person, who is the
owner or keeper of any animal to permit the
accumulation of manure or excrement of such
animal upon any premises of any public
right-of-way provided, however, where such animal
excrement is used as fertilizer upon any
premises, it may be stored for a period not
exceeding five ( 5 ) days, and any of such animal
excrement not used for fertilizer must be
immediately removed and disposed of. The removal
of such excrement shall not be included in the
regular collection services furnished by the
Sanitation Department.

Section 12.
That Chapter 28 , .Section 28-35 of the Code of Ordinances
of the City of Beaumont be. amended to read -as follows:
Section 28-35:
It shall be unlawful for any person to deposit or
cause to be deposited or permit to remain upon any
premises owned or occupied by him, or on premises
adjacent thereto or in or upon any of the streets,
sidewalks, alleys or other public highways or
places in the city, the carcass or parts thereof
of any dead animal or fowl owned by him or under
his control. All such carcasses or parts thereof
shall be removed by such person to the city
landfill, or otherwise disposed of as may be
directed by the superintendent of the landfill
division or the same may be removed by the city
and the costs paid by such person. If the owner
of such dead animal or fowl be unknown, or the
owner refuses or fails to remove the same, the
city shall, nevertheless, remove any such carcass
or parts thereof, and the city shall have the
right to collect the costs of such service from
the owner, if known, by suit.
Section 13.
That Chapter 28 , Section 28-36 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:
Section 28-36: Private transportation of refuse; franchise required
From and after April 1 , 1985, it shall be unlawful
for any person except the duly authorized agents or
employees of the city to convey or transport
garbage, trash, waste or refuse on the streets,
alleys or public thoroughfares of the city for a
fee without a valid franchise granted and issued by
the City of Beaumont. However, this provision
shall not be held to apply to an individual person
conveying trash, waste or refuse which has
accumulated on premises owned or occupied by him so
long as such person is in compliance with Section
28-39 hereof.

Section 14.
That Chapter 28 , _Section 28-37 of the Code of Ordinances
of the City of Beaumont be,. and the same is- hereby , repealed.
Section 15.
That Chapter 28 , Section 28-38 of the Code of Ordinances
of the City of Beaumont be, and the same is hereby repealed and a
new Section 28-38 enacted in its place to read as follows:
Infectious and pathological wastes from
laboratories, research facilities, and health
and veterinary facilities may be accepted for
collection if the wastes are double-bagged in
plastic bags not less than 1 . 5 mils thick each
and conspicuously marked. The waste shall not
be comingled with routine solid waste, but shall
be segregated for special collection and
transportation.
Section 16.
That Chapter 28 , Section 28-39 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:
( a) Applicability: All persons, businesses,
commercial institutions, public agencies are
required to pay a sanitary landfill disposal fee
except:
1 ) Any resident of the City of Beaumont with
a copy of his most recent utility bill
showing a paid garbage fee for the
residence from which the refuse was
accumulated;
2 ) Nonprofit, charitable organizations who
operate, as a necessary part of their
day-to-day business, vehicles owned or
leased by them for the transport of waste
or refuse resulting from collection for
the purpose of renovation or repair of
donated used material shall be exempt
from the fee requirement of this
section.

(c) Any individual, firm or publi c s agency desiring
to obtain a permit to pay on a monthly basis
shall make application to the superintendent of
the landfill division. A service fee of Ten
Dollars ( $10) per vehicle shall be charged for
processing the application as required by Section
28-40.
(d) Failure or refusal by any customer to pay any
landfill disposal charges to the landfill
division or its authorized representatives within
fifteen ( 15) days shall have water and sewer
services discontinued to the customer until such
time the customer has paid all delinquent
landfill disposal bills.
Section 17 .
That Chapter 28 , Section 28-40 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:

Section 28-40. Disposal permit; condition for issuance of permit
Upon filing of the application described in
Section 28-39 , the superintendent of the landfill
division shall grant such permit if the following
conditions have been met:
1 ) Provision is available to lawfully dispose ose of
the arba e trash
g g waste or refuse within the
city landfill;
2) The provisions of this article have been met;
3 ) The proposed removal and disposition of such
garbage, trash, waste or refuse will not
create a public nuisance; and
4 ) The vehicle for conveyance has been inspected
and measured by the landfill division;
5 ) Applicant has been current in payment for
previous disposal services.
Section 18 .
That Chapter 28 , Section 28-41 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:
Section 28-41:
The permit herein authorized to be issued may be
revoked by the superintendent of the landfill
division at any time for the violation of or
noncompliance with any of the provisions of this
article or the conditions under which it was
issued, and immediately upon such revocation, the
permit issued thereunder shall be surrendered to
the landfill division through any of its duly
authorized representatives; however, any person
feeling aggrieved by such revocation shall have
the right to appeal to the director of urban
transportation for redress, and such appeal shall
be made either by personal appearance on the part
of the aggrieved party or by written communica-
tion addressed to the director of urban
transportation setting forth the cause of
complaint.

Section 19 .
That Chapter 28 , .Section 28-42 of the Code of Ordinances
of the City of Beaumont be- amended to read -as follows:
Section 28-42:
All persons or businesses hauling into the city
landfill shall deposit such material only in the
place designated by a landfill attendant. Such
dumping shall only be from Monday through
Saturday during the hours of operation as
determined by the City Manager.
Section 20.
That Chapter 28 , Section 28-44 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:

Section 22.
That the Department of Water Utilities shall be
authorized to include the clean community fee, the landfill closure

fee and the trash collection charges as established in Section
28-27 on the monthly water -utility bills. To avoid duplication in
billing and as a convenience to the public,- the clean community
fee, the landfill closure fee and the trash collection charges are
to be included in the bill under the "garbage" heading until such
time as they can be billed separately. These revenues will not be
a part of the Water Fund. The clean community fee will be
appropriated to the General Fund, the landfill closure fee to the
Landfill Fund and the trash collection fee to the Sanitation Fund.
Section 23.
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 24.
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
Section 25.
That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.

Subject: Health Department Fee Ordinance
The attached fee ordinance for public health services at the Health Depart-
ment will implement the fees discussed at previous Council Work Sessions.
This ordinance covers the new fees that are being established in most of the
program areas. In those cases where fee increases have been proposed, they
will be presented in the form of amendments to existing ordinances. A pro-
vision has been included to charge certain fees (immunizations, maternal
and child health screenings, and adult health screenings) on a three-tiered
basis to reflect different income levels. Another provision has been in-
cluded to provide for administrative procedures to consider a request for
waiver of fees in certain cases.
It is recommended that this ordinance be adopted.

The following information and recommendations for new fees or fee increases
at the Health Department is submitted at Council 's request following a
previous workshop on July 31 , 1984 on these fee requests. The original
proposals are in Council Letter 655, attached.
It should be noted that the proposed city budget is based in part on the
$202,530 in additional revenue to be generated by the Health Department through
these fees.
At Council ' s direction, an effort has been made to establish levels of
flat-rate fees for different family income amounts to lessen any possible
impact on the truly indigent. It is important to maintain the flat rate
structure to avoid the need to institute income-screening measures (which would
require additional staff over that requested) similar to that employed at
Beaumont Community Health Clinic. It is recommended that an appeals process
be written into the fee ordinance to provide for screening of requests to be
considered for exemption of such fees.

The Health Director has expressed a preference for a single flat-rate fee for
each service, with an appeals procedure in place for the truly indigent who
could be appropriately screened for total family income (as is currently done
at Beaumont Community Health Clinic) and if qualified could be granted a
waiver of fees. However, the three tiered rate approach of charging is presently
contained in this proposal . It should be noted that any reduction in revenue
items in the 1985 budget will impact on an already small projected balance of
$72,310.00 in the 1985 General Fund.

budget on September 4 at the work session.

That Chapter 13, Section 17 of the Code of Ordinances

Section 13-17:
The fees established in Section 13-16 herein
may be waived by the Director of the
Department of Health upon proof by the
patient that such patient is unable to pay
such fee. Such proof may be provided by
execution of a sworn statement containing
facts sufficient to establish that such
patient is unable to pay such fee.
Section 3.
That Chapter 11, Section 11-3 of the Code of Ordinances
of the City of Beaumont be, and the same is hereby, amended to read
as follows:
Section 11-3 ;
A health registration card shall not be required
for persons engaged in serving or handling of
food intended or suited for human consumption.
Any person may obtain a health registration card
from the health department of the city on a
voluntary basis after examination by a physician
licensed to practice in this state. The
applicant shall submit to such examinations
laboratory tests and X-rays as may be necessary
to determine if the individual examined is free
of any transmissible condition of any contagious

or communicable disease. This shall include but
is not necessarily limited to a standard
serological test for syphilis, performed in a
laboratory approved by the State Depazrtment of
Health and an X-ray for tuberculosis of the
chest or standard skin test for tuberculosis,
followed by an X-ray , if positive, both to be
performed within thirty ( 30) days of the
application. However, said X-rays as provided
for herein shall not be required in any instance
in which the health authority or any licensed
physician believes said X-ray is not necessary
or is dangerous to the health and safety of the
applicant. If such person examined is found to
be free of any transmissible condition of any
contagious or communicable disease, such
individual shall be issued a health registration
card. If it is necessary for the applicant to
have a chest X-ray done by the Health
Department, a charge for said X-ray shall be
made in accordance with the charges established
by Section 13-16 of the Code of Ordinances of
the City of Beaumont. If it is not necessary
for the individual to have a chest X-ray, or if
an X-ray is done by someone other than the
health department, a charge for a health card as
established by Section 13-16 of the Code of
Ordinances of the City of Beaumont shall be
made. A duplicate of the health registration
card shall be placed in the files of the city
health department bearing the same number as the
health registration card issued to such
individuals. ' This card may be revoked when, in
the opinion of the health authority, the holder
is suspected of having a contagious or
communicable disease or of being a carier of
such; and the health authority reserves the
right to make such other examination and tests
at any time that may be necessary at the sole
direction of the health authority. This
registration card and health certificate shall
be valid for a period of twelve ( 12) months
unless canceled by the health authority as
provided by this chapter. A duplicate health
card may be obtained by the payment of the fee
for a duplicate health card set out in Section
13-16 of the Code of Ordinances of the City of
Beaumont.

Subject: Amendment of the 1984-1985 Budget
It will be necessary to amend the 1984/85 budget in order to accommodate the
collective bargaining agreement with the International Association of Fire
Fighters. The amendment will involve an increase of $152,000 to the Fire De-
partment.
The 1984/85 budget contains a General Fund balance of $99,370. However, we
had included in the 1984/85 budget a 25 percent across-the-board increase to
cover increased electricity rates. Based on the actual filing by Gulf States,
which occurred after our compilation of the budget, we now estimate that the
actual increase in the street lighting electricity cost will be in the neigh-
borhood of 18 to 20 percent. Because of this, we can safely reduce our esti-
mated expenditure in the Traffic and Street Light Division by $70,000 (from
$1,566,000 to $1,496,000).

Subject: Execution of Contract with International Association of Fire
Fighters
We have successfully concluded negotiations with the Fire Fighters Union
for a contract covering a one-year period. The principal provisions are as
follows:
1. A 4-1/2 percent increase effective October 1, 1984.
2. Premium pay of $100 per month for arson investigators.
3. Adjustment in car allowance to $250 per month.
4. Stand-by pay for arson investigators.
5. Pilot program for voluntary full shift overtime to cover
manpower level deficiencies as determined by the Fire Chief.
6. A stipulation that the contract will remain in place beyond
its term for one year until replaced by a successor agree-
ment.
In addition, we have mutually agreed to the establishment of a task force to
study the following areas:
1. Apprenticeship Program including hiring and promotional
criteria and systems.
2. Private sector survey techniques.
3. Manning.
4. Management rights including, but not limited to, management
rights, Civil Service, seniority, selection, promotionals,
prevailing rights, maintenance of standards, successors and
assigns, residency, job descriptions and the bargaining unit.
5. Salary differentials between pay grades.
This contract is the result of long and ardour discussions between staff and
union representatives during which "collective" bargaining truly occurred.
It is recommended that authorization be given to execute this contract.

Recently, the Beaumont Municipal Library has experienced drainage problems
in the below-grade loading area on the east side of the building. The En-
gineering Division completed a design for drainage improvements to alleviate
this problem. Approximately $15,000 in funds was allocated to the Beaumont
Public Library for improvements to be made.
On Monday, September 24, 1984, bids for this project were received. A total
of nine bids were submitted with the lowest bid in the amount of $10,677.20
from Jim Walters Construction, with a total of 30 working days, which puts
the date of completion approximately November 30, 1984. The highest bid
was $23,868. Below is a summary of the individual firms and their bids:

AMENDMENT TO LEASE
THE STATE OF TEXAS §
COUNTY OF JEFFERSON §
WHEREAS, on the 22nd day of November, 1983, the City of
Beaumont ("City") and Beaumont Riverboat Company ("BRC")
entered into a lease (the "Original Lease") ; and,
WHEREAS, City and BRC desire to amend such lease to
provide for the leasing of additional property by BRC, the
sale of alcoholic beverages and an amendment to the rental
terms and providing for free parking for customers of BRC;
NOW, THEREFORE, this Amendment to the Original Lease
is entered into by and between City, acting by and through
its duly authorized City Manager, and BRC, acting by and
through J. Hoke Peacock II, its President, duly authorized;
and City and BRC hereby agree as follows:
W I T N E S S E T H:
I.
City does hereby lease unto BRC the premises outlined
in red on Exhibit A to this Amendment, which is attached
hereto and made a part hereof for all purposes, in addition
to the premises outlined in red on Exhibit A to the
Original Lease. The premises outlined in red on Exhibit A
to this Amendment and hereby added to the premises leased
are sometimes hereinafter referred to as the "Pavilion
Area".
II.
Paragraph 3 of the Original lease concerning rental is
hereby deleted, and the following is substituted therefor:
"BRC shall pay rentals to the City at the
rate of $2,856.00 per year for the term of this
Lease and any extension thereof, subject to
,
adjustment as provided in Section 20. below. Rent
shall be due and payable in advance in monthly
installments of $238.00 each, on or before the
15th day of each month in the term hereof or any
extension thereof."
BRC has heretofore paid the City the sum of $3,585.51
as rental and percentages under the Original Lease, and
shall be entitled to credit for such payment against the
$238.00 per month payments due under this amended Para-
graph 3. Consequently, the rental hereunder will next be
payable on March 15, 1985 and the rental due on that date
shall be $222.49. The $238.00 per month payment shall
resume on April 15, 1985 and continue on the 15th day of
each month thereafter during the term hereof or any exten-
sion thereof, subject always to adjustment as provided in
Section 20. of the Original Lease as amended hereby.
III.
Paragraph 4. of the Original Lease is hereby amended to
add a new sentence at the end thereof, to read as follows:
"City will execute all documents necessary to
assist BRC in obtaining an alcoholic beverage
permit for the Pavilion Area and specifically
will allow the sale of alcoholic beverages within
such area."
IV.
Paragraph 7. of the Original lease is hereby amended to
add a new concession percentage subcategory 3. to read as
follows:
"3. Alcoholic beverages sold in the Pavilion Area -
ten percent (107) of gross sales."
V.
Pargaraph 8. of the Original lease is hereby amended to
add a sentence to the end thereof, to read as follows:

"The City shall provide free parking to customers
of BRC on an "as available" basis, in the parking
lots belonging to the City which are located
South of the City Hall Building and North of the
railroad tracks."
VI.
Paragraph 20. of the Original Lease is hereby deleted
and the following is substituted therefor:
"20. Adjustments to Rentals.
The rentals payable under Paragraph 3. above are in-
tended as minimum payments to the City for the use of the
premises, including the Pavilion Area and shall be paid
each month unless BRC is entitled to credit for same
hereunder. In the event that the percentages to be paid by
BRC under Section 7. above are less than $238.00 for any
month, such lesser percentages will not be paid by BRC but
will be reported by BRC to City. In the event that the per-
centages to be paid by BRC under Section 7. above are more
than $238.00 for any month, the amount of such excess over
$238.00 will be paid by BRC to City on or before the 10th
day of each month for sales made the previous month.
The rentals and percentages will also be adjusted on
an annual basis as follows. The annual period for adjust-
ments hereunder will be the City's fiscal year, which
begins on October 1 and ends on September 30. Annual
adjustments will commence in the year beginning October 1,
1984. If the aggregate of the sums paid to City by BRC
under Paragraphs 3. and 7. above during such year are
greater than the sums that would have been due to City
under Paragraph 7. alone, then BRC will be entitled to
credit for the amount of such excess against the first
payments due for the next ensuing year under Paragraphs 3.

and 7. If the aggregate sums to be paid by BRC to City
under Paragraph 7, alone are less than Twenty-eight Hundred
Fifty-Six Dollars ($2,856) , BRC will not be entitled to any
credit."
VII.
A new Paragraph 22. shall be added, as follows:
"22. City's Right to Terminate as to Pavilion Area.
City will have the right to terminate this Lease as to

Bids were received from three vendors for computer equipment for the Beaumont
Public Library. The bids are as follows:

These bids are for two 4-channel multiplexors, one 8-channel multiplexor,
two CRT terminals, two optical scanner wands, one terminal printer, cables ,
freight and installation.
This is for use with the library circulation system as part of the Houston
Area Library System. The equipment bid by the DataPhase Corporation meets the
requirements that we agreed to in our memorandum of understanding with the
Houston Public Library approved by the City Council on September 4, 1984.
The equipment will do two things: reduce our telecommunications costs for the
system and extend the system to the Miller Branch. $17,210 was budgeted in
the 1983-1984 budget for this purchase. Funds are available for the additional
cost. The maintenance cost is budgeted for in the 1984-1985 budget.
It is recommended that this resolution be approved.

The "senior citizen income discount rate" shall
apply to customers residing in single-family
residences who are over the age of sixty-five
(65) years whose total annual income, when
combined with the total annual income of all
persons residing in the residence, does not
exceed eleven thousand five hundred dollars
($11,500) . To obtain the senior citizen income
discount rate, persons eligible must file a
sworn application, on a form provided therefor,
with the central collections division. Upon
approval of the application, the senior citizen
income discount rate shall be applicable for a
period of twelve ( 12) months. The rate may be
continued for additional twelve-month periods
upon application as provided above for the
initial twelve-month period and upon
satisfaction of eligibility requirements as may
be in effect at the time of the application.
Section 7 .
That Section 28-28( a) (1 ) , 28-28( a) (2 ) and 28-28( b) of
the Code of Ordinances of the City of Beaumont be amended to read
as follows:

Section 8 .
That Chapter 28 , Section 28-31 of the Code of Ordinances
of the City of Beaumont be, and the same is hereby , repealed.
Section 9 .
That Chapter 28 , Section 28-32 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:

Section 28-32:
The charges fixed herein for the removal and
disposal of all garbage and trash shall be entered
by the city against the owner or occupant using or
occupying any building or structure receiving such
service. To avoid duplication in billing and as a
convenience to the public, the Department of Public
Utilities shall include such charges on the monthly
water bills. Any person who shall fail or refuse
to pay the charge herein specified within fifteen
( 15) days from the date of the bill shall have his
garbage service suspended and the Director of the
Sanitation Department shall be notified
immediately for appropriate action in accordance
with the provisions of this article.
Section 10.
That Chapter 28 , Section 28-33 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:
Section 28-33:
Collection of items such as brick , dirt, plaster,
sand, gravel, large automobile parts, scrap metal,
wire, ashes, dead animals and other bulky or heavy
material shall not be included in the regular
garbage and trash collection service furnished by
the Sanitation Department. The owner shall
have such debris removed at his own expense.
Section 11.
That Chapter 28 , Section 28-34 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:
Section 28-34:
It shall be unlawful for any person, who is the
owner or keeper of any animal to permit the
accumulation of manure or excrement of such
animal upon any premises of any public
right-of-way provided, however, where such animal
excrement is used as fertilizer upon any
premises, it may be stored for a period not
exceeding five ( 5 ) days, and any of such animal
excrement not used for fertilizer must be
immediately removed and disposed of. The removal
of such excrement shall not be included in the
regular collection services furnished by the
Sanitation Department.

Section 12.
That Chapter 28 , .Section 28-35 of the Code of Ordinances
of the City of Beaumont be. amended to read -as follows:
Section 28-35:
It shall be unlawful for any person to deposit or
cause to be deposited or permit to remain upon any
premises owned or occupied by him, or on premises
adjacent thereto or in or upon any of the streets,
sidewalks, alleys or other public highways or
places in the city, the carcass or parts thereof
of any dead animal or fowl owned by him or under
his control. All such carcasses or parts thereof
shall be removed by such person to the city
landfill, or otherwise disposed of as may be
directed by the superintendent of the landfill
division or the same may be removed by the city
and the costs paid by such person. If the owner
of such dead animal or fowl be unknown, or the
owner refuses or fails to remove the same, the
city shall, nevertheless, remove any such carcass
or parts thereof, and the city shall have the
right to collect the costs of such service from
the owner, if known, by suit.
Section 13.
That Chapter 28 , Section 28-36 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:
Section 28-36: Private transportation of refuse; franchise required
From and after April 1 , 1985, it shall be unlawful
for any person except the duly authorized agents or
employees of the city to convey or transport
garbage, trash, waste or refuse on the streets,
alleys or public thoroughfares of the city for a
fee without a valid franchise granted and issued by
the City of Beaumont. However, this provision
shall not be held to apply to an individual person
conveying trash, waste or refuse which has
accumulated on premises owned or occupied by him so
long as such person is in compliance with Section
28-39 hereof.

Section 14.
That Chapter 28 , _Section 28-37 of the Code of Ordinances
of the City of Beaumont be,. and the same is- hereby , repealed.
Section 15.
That Chapter 28 , Section 28-38 of the Code of Ordinances
of the City of Beaumont be, and the same is hereby repealed and a
new Section 28-38 enacted in its place to read as follows:
Infectious and pathological wastes from
laboratories, research facilities, and health
and veterinary facilities may be accepted for
collection if the wastes are double-bagged in
plastic bags not less than 1 . 5 mils thick each
and conspicuously marked. The waste shall not
be comingled with routine solid waste, but shall
be segregated for special collection and
transportation.
Section 16.
That Chapter 28 , Section 28-39 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:
( a) Applicability: All persons, businesses,
commercial institutions, public agencies are
required to pay a sanitary landfill disposal fee
except:
1 ) Any resident of the City of Beaumont with
a copy of his most recent utility bill
showing a paid garbage fee for the
residence from which the refuse was
accumulated;
2 ) Nonprofit, charitable organizations who
operate, as a necessary part of their
day-to-day business, vehicles owned or
leased by them for the transport of waste
or refuse resulting from collection for
the purpose of renovation or repair of
donated used material shall be exempt
from the fee requirement of this
section.

shall make application to the superintendent of
the landfill division. A service fee of Ten
Dollars ( $10) per vehicle shall be charged for
processing the application as required by Section
28-40.
(d) Failure or refusal by any customer to pay any
landfill disposal charges to the landfill
division or its authorized representatives within
fifteen ( 15) days shall have water and sewer
services discontinued to the customer until such
time the customer has paid all delinquent
landfill disposal bills.
Section 17 .
That Chapter 28 , Section 28-40 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:

Section 28-40. Disposal permit; condition for issuance of permit
Upon filing of the application described in
Section 28-39 , the superintendent of the landfill
division shall grant such permit if the following
conditions have been met:
1 ) Provision is available to lawfully dispose ose of
the arba e trash

city landfill;
2) The provisions of this article have been met;
3 ) The proposed removal and disposition of such
garbage, trash, waste or refuse will not
create a public nuisance; and
4 ) The vehicle for conveyance has been inspected
and measured by the landfill division;
5 ) Applicant has been current in payment for
previous disposal services.
Section 18 .
That Chapter 28 , Section 28-41 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:
Section 28-41:
The permit herein authorized to be issued may be
revoked by the superintendent of the landfill
division at any time for the violation of or
noncompliance with any of the provisions of this
article or the conditions under which it was
issued, and immediately upon such revocation, the
permit issued thereunder shall be surrendered to
the landfill division through any of its duly
authorized representatives; however, any person
feeling aggrieved by such revocation shall have
the right to appeal to the director of urban
transportation for redress, and such appeal shall
be made either by personal appearance on the part
of the aggrieved party or by written communica-
tion addressed to the director of urban
transportation setting forth the cause of
complaint.

Section 19 .
That Chapter 28 , .Section 28-42 of the Code of Ordinances
of the City of Beaumont be- amended to read -as follows:
Section 28-42:
All persons or businesses hauling into the city
landfill shall deposit such material only in the
place designated by a landfill attendant. Such
dumping shall only be from Monday through
Saturday during the hours of operation as
determined by the City Manager.
Section 20.
That Chapter 28 , Section 28-44 of the Code of Ordinances
of the City of Beaumont be amended to read as follows:
Section 28-44:
Entrance to and dumping of the following at the city
landfill shall not be allowed with r
out prio.. approval
of the landfill Superintendent:
1 ) Junk automobiles;
2 ) Human excrement;
3 ) Inflammable liquids ;
4 ) Dangerous chemicals;
5 ) Insecticides;
6 ) Industrial chemicals or industrial solid waste;
7 ) Waste oil or grease.
Section 21.
That Chapter 28 , Section 28-45( 2 ) of the Code of
Ordinances of the City of Beaumont be amended to read as follows:
Section 28-45( 2 ) :
Completely covered with a tarp if loose materials
extend above the side boards.
Section 22.
That the Department of Water Utilities shall be
authorized to include the clean community fee, the landfill closure

fee and the trash collection charges as established in Section
28-27 on the monthly water -utility bills. To avoid duplication in
billing and as a convenience to the public,- the clean community
fee, the landfill closure fee and the trash collection charges are
to be included in the bill under the "garbage" heading until such
time as they can be billed separately. These revenues will not be
a part of the Water Fund. The clean community fee will be
appropriated to the General Fund, the landfill closure fee to the
Landfill Fund and the trash collection fee to the Sanitation Fund.
Section 23.
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 24.
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
Section 25.
That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.

Subject: Health Department Fee Ordinance
The attached fee ordinance for public health services at the Health Depart-
ment will implement the fees discussed at previous Council Work Sessions.
This ordinance covers the new fees that are being established in most of the
program areas. In those cases where fee increases have been proposed, they
will be presented in the form of amendments to existing ordinances. A pro-
vision has been included to charge certain fees (immunizations, maternal
and child health screenings, and adult health screenings) on a three-tiered
basis to reflect different income levels. Another provision has been in-
cluded to provide for administrative procedures to consider a request for
waiver of fees in certain cases.
It is recommended that this ordinance be adopted.

The following information and recommendations for new fees or fee increases
at the Health Department is submitted at Council 's request following a
previous workshop on July 31 , 1984 on these fee requests. The original
proposals are in Council Letter 655, attached.
It should be noted that the proposed city budget is based in part on the
$202,530 in additional revenue to be generated by the Health Department through
these fees.
At Council ' s direction, an effort has been made to establish levels of
flat-rate fees for different family income amounts to lessen any possible
impact on the truly indigent. It is important to maintain the flat rate
structure to avoid the need to institute income-screening measures (which would
require additional staff over that requested) similar to that employed at
Beaumont Community Health Clinic. It is recommended that an appeals process
be written into the fee ordinance to provide for screening of requests to be
considered for exemption of such fees.

The Health Director has expressed a preference for a single flat-rate fee for
each service, with an appeals procedure in place for the truly indigent who
could be appropriately screened for total family income (as is currently done
at Beaumont Community Health Clinic) and if qualified could be granted a
waiver of fees. However, the three tiered rate approach of charging is presently
contained in this proposal . It should be noted that any reduction in revenue
items in the 1985 budget will impact on an already small projected balance of
$72,310.00 in the 1985 General Fund.
'We anticipate reviewing these fees during the discussion of the Health Department
budget on September 4 at the work session.

HEALTH SERVICE FEES; PROVIDING FOR
SEVERABILITY; PROVIDING AN EFFECTIVE DATE
AND PROVIDING FOR REPEAL.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
That Chapter 13, Section 16 of the Code of Ordinances of
the City of Beaumont is hereby amended to read as follows:

Section 2.
That Chapter 13, Section 17 of the Code of Ordinances
of the City of Beaumont is hereby enacted to read as follows:
Section 13-17:
The fees established in Section 13-16 herein
may be waived by the Director of the
Department of Health upon proof by the
patient that such patient is unable to pay
such fee. Such proof may be provided by
execution of a sworn statement containing
facts sufficient to establish that such
patient is unable to pay such fee.
Section 3.
That Chapter 11, Section 11-3 of the Code of Ordinances
of the City of Beaumont be, and the same is hereby, amended to read
as follows:
Section 11-3 ;
A health registration card shall not be required
for persons engaged in serving or handling of
food intended or suited for human consumption.
Any person may obtain a health registration card
from the health department of the city on a
voluntary basis after examination by a physician
licensed to practice in this state. The
applicant shall submit to such examinations
laboratory tests and X-rays as may be necessary
to determine if the individual examined is free
of any transmissible condition of any contagious

or communicable disease. This shall include but
is not necessarily limited to a standard
serological test for syphilis, performed in a
laboratory approved by the State Depazrtment of
Health and an X-ray for tuberculosis of the
chest or standard skin test for tuberculosis,
followed by an X-ray , if positive, both to be
performed within thirty ( 30) days of the
application. However, said X-rays as provided
for herein shall not be required in any instance
in which the health authority or any licensed
physician believes said X-ray is not necessary
or is dangerous to the health and safety of the
applicant. If such person examined is found to
be free of any transmissible condition of any
contagious or communicable disease, such
individual shall be issued a health registration
card. If it is necessary for the applicant to
have a chest X-ray done by the Health
Department, a charge for said X-ray shall be
made in accordance with the charges established
by Section 13-16 of the Code of Ordinances of
the City of Beaumont. If it is not necessary
for the individual to have a chest X-ray, or if
an X-ray is done by someone other than the
health department, a charge for a health card as
established by Section 13-16 of the Code of
Ordinances of the City of Beaumont shall be
made. A duplicate of the health registration
card shall be placed in the files of the city
health department bearing the same number as the
health registration card issued to such
individuals. ' This card may be revoked when, in
the opinion of the health authority, the holder
is suspected of having a contagious or
communicable disease or of being a carier of
such; and the health authority reserves the
right to make such other examination and tests
at any time that may be necessary at the sole
direction of the health authority. This
registration card and health certificate shall
be valid for a period of twelve ( 12) months
unless canceled by the health authority as
provided by this chapter. A duplicate health
card may be obtained by the payment of the fee
for a duplicate health card set out in Section
13-16 of the Code of Ordinances of the City of
Beaumont.

Section 4.
This ordinance shall be and become effective on
November 1 , 1984.
Section 5 .
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 3 .
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.

Subject: Amendment of the 1984-1985 Budget
It will be necessary to amend the 1984/85 budget in order to accommodate the
collective bargaining agreement with the International Association of Fire
Fighters. The amendment will involve an increase of $152,000 to the Fire De-
partment.
The 1984/85 budget contains a General Fund balance of $99,370. However, we
had included in the 1984/85 budget a 25 percent across-the-board increase to
cover increased electricity rates. Based on the actual filing by Gulf States,
which occurred after our compilation of the budget, we now estimate that the
actual increase in the street lighting electricity cost will be in the neigh-
borhood of 18 to 20 percent. Because of this, we can safely reduce our esti-
mated expenditure in the Traffic and Street Light Division by $70,000 (from
$1,566,000 to $1,496,000).

Subject: Execution of Contract with International Association of Fire
Fighters
We have successfully concluded negotiations with the Fire Fighters Union
for a contract covering a one-year period. The principal provisions are as
follows:
1. A 4-1/2 percent increase effective October 1, 1984.
2. Premium pay of $100 per month for arson investigators.
3. Adjustment in car allowance to $250 per month.
4. Stand-by pay for arson investigators.
5. Pilot program for voluntary full shift overtime to cover
manpower level deficiencies as determined by the Fire Chief.
6. A stipulation that the contract will remain in place beyond
its term for one year until replaced by a successor agree-
ment.
In addition, we have mutually agreed to the establishment of a task force to
study the following areas:
1. Apprenticeship Program including hiring and promotional
criteria and systems.
2. Private sector survey techniques.
3. Manning.
4. Management rights including, but not limited to, management
rights, Civil Service, seniority, selection, promotionals,
prevailing rights, maintenance of standards, successors and
assigns, residency, job descriptions and the bargaining unit.
5. Salary differentials between pay grades.
This contract is the result of long and ardour discussions between staff and
union representatives during which "collective" bargaining truly occurred.
It is recommended that authorization be given to execute this contract.

Subject: Drainage Improvements at Beaumont Public Library
Recently, the Beaumont Municipal Library has experienced drainage problems
in the below-grade loading area on the east side of the building. The En-
gineering Division completed a design for drainage improvements to alleviate
this problem. Approximately $15,000 in funds was allocated to the Beaumont
Public Library for improvements to be made.
On Monday, September 24, 1984, bids for this project were received. A total
of nine bids were submitted with the lowest bid in the amount of $10,677.20
from Jim Walters Construction, with a total of 30 working days, which puts
the date of completion approximately November 30, 1984. The highest bid
was $23,868. Below is a summary of the individual firms and their bids:

AMENDMENT TO LEASE
THE STATE OF TEXAS §
COUNTY OF JEFFERSON §
WHEREAS, on the 22nd day of November, 1983, the City of
Beaumont ("City") and Beaumont Riverboat Company ("BRC")
entered into a lease (the "Original Lease") ; and,
WHEREAS, City and BRC desire to amend such lease to
provide for the leasing of additional property by BRC, the
sale of alcoholic beverages and an amendment to the rental
terms and providing for free parking for customers of BRC;
NOW, THEREFORE, this Amendment to the Original Lease
is entered into by and between City, acting by and through
its duly authorized City Manager, and BRC, acting by and
through J. Hoke Peacock II, its President, duly authorized;
and City and BRC hereby agree as follows:
W I T N E S S E T H:
I.
City does hereby lease unto BRC the premises outlined
in red on Exhibit A to this Amendment, which is attached
hereto and made a part hereof for all purposes, in addition
to the premises outlined in red on Exhibit A to the
Original Lease. The premises outlined in red on Exhibit A
to this Amendment and hereby added to the premises leased
are sometimes hereinafter referred to as the "Pavilion
Area".
II.
Paragraph 3 of the Original lease concerning rental is
hereby deleted, and the following is substituted therefor:
"BRC shall pay rentals to the City at the
rate of $2,856.00 per year for the term of this
Lease and any extension thereof, subject to
,
adjustment as provided in Section 20. below. Rent
shall be due and payable in advance in monthly
installments of $238.00 each, on or before the
15th day of each month in the term hereof or any
extension thereof."
BRC has heretofore paid the City the sum of $3,585.51
as rental and percentages under the Original Lease, and
shall be entitled to credit for such payment against the
$238.00 per month payments due under this amended Para-
graph 3. Consequently, the rental hereunder will next be
payable on March 15, 1985 and the rental due on that date
shall be $222.49. The $238.00 per month payment shall
resume on April 15, 1985 and continue on the 15th day of
each month thereafter during the term hereof or any exten-
sion thereof, subject always to adjustment as provided in
Section 20. of the Original Lease as amended hereby.
III.
Paragraph 4. of the Original Lease is hereby amended to
add a new sentence at the end thereof, to read as follows:
"City will execute all documents necessary to
assist BRC in obtaining an alcoholic beverage
permit for the Pavilion Area and specifically
will allow the sale of alcoholic beverages within
such area."
IV.
Paragraph 7. of the Original lease is hereby amended to
add a new concession percentage subcategory 3. to read as
follows:
"3. Alcoholic beverages sold in the Pavilion Area -
ten percent (107) of gross sales."
V.
Pargaraph 8. of the Original lease is hereby amended to
add a sentence to the end thereof, to read as follows:

"The City shall provide free parking to customers
of BRC on an "as available" basis, in the parking
lots belonging to the City which are located
South of the City Hall Building and North of the
railroad tracks."
VI.
Paragraph 20. of the Original Lease is hereby deleted
and the following is substituted therefor:
"20. Adjustments to Rentals.
The rentals payable under Paragraph 3. above are in-
tended as minimum payments to the City for the use of the
premises, including the Pavilion Area and shall be paid
each month unless BRC is entitled to credit for same
hereunder. In the event that the percentages to be paid by
BRC under Section 7. above are less than $238.00 for any
month, such lesser percentages will not be paid by BRC but
will be reported by BRC to City. In the event that the per-
centages to be paid by BRC under Section 7. above are more
than $238.00 for any month, the amount of such excess over
$238.00 will be paid by BRC to City on or before the 10th
day of each month for sales made the previous month.
The rentals and percentages will also be adjusted on
an annual basis as follows. The annual period for adjust-
ments hereunder will be the City's fiscal year, which
begins on October 1 and ends on September 30. Annual
adjustments will commence in the year beginning October 1,
1984. If the aggregate of the sums paid to City by BRC
under Paragraphs 3. and 7. above during such year are
greater than the sums that would have been due to City
under Paragraph 7. alone, then BRC will be entitled to
credit for the amount of such excess against the first
payments due for the next ensuing year under Paragraphs 3.

and 7. If the aggregate sums to be paid by BRC to City
under Paragraph 7, alone are less than Twenty-eight Hundred
Fifty-Six Dollars ($2,856) , BRC will not be entitled to any
credit."
VII.
A new Paragraph 22. shall be added, as follows:
"22. City's Right to Terminate as to Pavilion Area.
City will have the right to terminate this Lease as to
the Pavilion Area at any time, with or without cause, upon
thirty (30) days' prior written notice to BRC.
VIII.
All the other provisions of the Original Lease are
hereby reaffirmed by the parties and shall continue in full
force and effect.
IN WITNESS WHEREOF, the parties hereto have executed
this Amendment to Lease on the 2nd day of October, 1984.

Bids were received from three vendors for computer equipment for the Beaumont
Public Library. The bids are as follows:

These bids are for two 4-channel multiplexors, one 8-channel multiplexor,
two CRT terminals, two optical scanner wands, one terminal printer, cables ,
freight and installation.
This is for use with the library circulation system as part of the Houston
Area Library System. The equipment bid by the DataPhase Corporation meets the
requirements that we agreed to in our memorandum of understanding with the
Houston Public Library approved by the City Council on September 4, 1984.
The equipment will do two things: reduce our telecommunications costs for the
system and extend the system to the Miller Branch. $17,210 was budgeted in
the 1983-1984 budget for this purchase. Funds are available for the additional
cost. The maintenance cost is budgeted for in the 1984-1985 budget.
It is recommended that this resolution be approved.
