Subject: Major Drive/Westhaven Terrace Rezoning Study.
GENERAL INFORMATION
The study area exhibits original R-3 zoning from 1955. One princi-
ple property in the study exhibits apartments. Surrounding land
use abutting the study property is generally single family resi-
dential. A single family addition is located on the immediate
northwest corner outside of the study area. The comprehensive
plan designates the area as a Neighborhood Growth Unit.

THE ZONING DISTRICTS AS INDICATED UPON THE
ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING
THE ZONING FROM R-3 (MODIFIED TWO FAMILY
AND MULTIPLE DWELLING DISTRICT) TO RM-H
(RESIDENTIAL MULTIPLE FAMILY-HIGH DENSITY
DISTRICT) ON PROPERTY LOCATED AT 3875
MAJOR DRIVE; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL AND PROVIDING A
PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
THAT Chapter 30 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts as
indicated upon the Zoning Map of the City of Beaumont, referred to
in Section 30-5B thereof , is hereby amended by changing the zoning
classification from R-3 (Modified Two Family and Multiple Dwelling
District) to RM-H ( Residential Multiple Family - High Density
District) for property located at 3875 Major Drive, as shown on
Exhibit "A" attached hereto and made a part hereof for all
purposes, and the official zoning map of the City of Beaumont is
hereby amended to reflect such changes.
Section 2.
That in all other respects the use of the property
hereinabove described shall be subject to all of the applicable
regulations contained in Chapter 30 of the Code of Ordinances of
Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 4 .
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
Section 5.
That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.

ANALYSIS i
The pattern of single family development in the area indicates the
stable nature of the area. One vacant tract in the study remains
as the largest undeveloped parcel of land in the vicinity. A
former nursery on Long Street, which was destroyed by fire, is
also presently vacant.
PLANNING STAFF RECOMMENDATION
I
Based on exhibited land use, staff recommended RM,H (Residential
Multiple Family - High Density) zoning for all of the property in
the study.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission recommended approval of RCR zoning for
the subject property by a vote of 6 to 1. Staff supports the
Commission' s recommendation for RCR.

If granted, the request will generate future rezoning requests
in order to establish a compatible development P pattern.
Approval of the zone change will constitute "spot" zoning. spot
zoning is defined as the singling out of a parcel of land for
preferential treatment (zone change) which is not extended to
other properties in the same vicinity,

compatible properties.

CRITERIA FOR HISTORICAL-CULTURAL LANDMARK DESIGNATION
The Historical Landmark Commission , the Planning Commission, and
the City Council shall consider, but not be limited to, one or more
of the following criteria in establishing an H-C, Historical-Cultural
Landmark Preservation District:
a. Existing or proposed recognition as a National Historic Landmark,
or Texas Historic Landmark, or entry or proposed entry into
the National Register of Historic Places ;
b. Existence of distinguishing characteristics of an archi=ectural
type or specimen, or of the social, economic, or political
heritage of the City;
C. Identification as the work of a designer, architect, or builder
whose work has influenced the growth or development of the City;
d. Embodiment of elements of architectural design, detail , materials,
or craftmanship which represent a significant architectural
innovation or an outstanding example of a particular historical,
architectural or other cultural style or period;
e. Relationship to other buildings , structures , or places which are
eligible for preservation as historic places;
f. Exemplification of the cultural, economic, social, ethnic, or
historical heritage of the City, County, State, or Nation;
g. Location as the site of a significant historical event;
h. Listing in the S.P.A.R.E. Beaumont Survey;
i. Identification with a person or persons who significantly
contributed to the culture or development of the City, County,
State or Nation; and

has become of historic or cultural value to a neighborhood or
community.

King Edward Hotel
The King Edward Hotel, formerly the La Salle, was built
in 1927 for $1, 000, 000. It was a duplicate of the Ben
Milam Hotel in Houston, but had 12 stories instead of 10,
with 237 rooms, each with individual baths . The woodwork
is largely Texas gum. The building was extensively re-
modeled and modernized in 1956 when P. E. Dumas Milner
purchased it for $300, 000. The architects on the remodeling
project were Biggs, Wier & Chandler with the firm of Stone
& Pitts of Beaumont. The name was later changed to the
King Edward Towers when the building was converted into
a residential hotel.

Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 4.
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only..

ATTACHMENT FOR CONDITION 1
Businesses engaged in the on-premise consumption of alcoholic
beverages have established use patterns. Based on previous
specific use permit a-plications of this type, these patterns
typically include late night hours, occasionally live or
programmed music, strewn trash, and unsupervised parking
areas . Four previously approved permits of this type
indicate that these characteristics generally create
incompatibility in locations abutting residential uses
and do not contribute to improved property values .
The current proposal abuts residentially developed properties
on the west. An effective means of buffering erin either
or a her sound
parking lot trash is the installation of an 8-foot priacy
fence. Since the establishment will be in use after 6 p.m.
some of the environmental nuisances described in Condition S
may directly affect abutting residential properties.

Subject: Amendment to Section 30-4.B. 24) (Home Occupation) of the
City Code
At the present time, the definition of home occupation in the zoning
ordinance eliminates any type of published or printed advertising
in conjunction with the operation of the home occupation. This
means that a potential business in a home is prohibited from placing
advertisement in different types of publications circulated within
the city. These can include handbills , flyers, neighborhood news-
papers, the Beaumont Enterprise, and the Yellow Pages.
The amended definition would make it legal for a home occupation
to use various types of published matter to advertise the business .
By the same amendment, however, the owner of the business would be
prohibited from any on-premise identification of the business or
other type of display which would identify the business or from
having materials stored on the premises or from creating an exterior
identification of the business and also from creating any variation
from the residential character of the residence or any accessory
buildings on the property with the residence.
The amendment would read as follows:
(e) There is no on-premise advertising or any other display
or storage of materials or exterior identification
of the home occupation or variation from the residential
character of the main building or any accessory buildings .
The Planning staff recommends approval of the amendment. The
Planning Commission recommends approval of the amendment by a vote
of 7 to 0.

hereby , amended to read as follows:

Section 2.

:Subject: Amendments to Fiscal Year 1983-1984 Budget
'The budget presented to Council on August 10th of this year included esti-
mates of expenditures by all departments for fiscal year 1983-1984, as well
as estimates for 1984-1985.
It is a proper part of any budgetary process to formally adopt at sometime
a final expenditure number for the current fiscal year, with a final opport-
unity for amendments available preceding the adoption.
We recommend that the "Aid to Other Agencies" line item which funds the fol-
lowing activities: Convention and Visitors Bureau, Economic Development
Foundation and the South East Texas Arts Council and Museums be increased by
some $25,600 to $597,100. This increase is necessary to accommodate certain
expenditures associated with promotional activities connected with Economic
Development that have been approved by Council and that were not anticipated
when the budget was compiled.
It is recommended that the ordinance be adopted.

expenses of conducting the affairs thereof for such fiscal year;
and,
WHEREAS, the City Council desires to revise the budget of
the City of Beaumont as recommended by the City Manager;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:

That the budget of the City of Beaumont for the fiscal

Subject: Adoption of the Tax Roll and Establishing a Tax Rate
A necessary part of the budget process required by law involves the adoption
of the correct tax roll for this year and the setting of a tax rate.
The current tax roll , as certified by the Jefferson County Tax Appraisal
District, is $2,587,500,000. As has been discussed in budget Work Sessions,
-the roll shows a 2.5 percent increase over 1983. This trend, if continued,
will be of great concern in future budget years.
The tax rate proposed for this year is 78 cents per $100 of valuation, This
rate incorporates 51 cents for general operations, the same as last year, and
27 cents for debt service, a two-cent increase over last year. This increase
was approved in the March, 1983 vote on the issuance of $16 million for
drainage improvements in the City.
It is recommended that the ordinance be adopted.

LEVYING, ASSESSING AND COLLECTING OF AD VALOREM
TAXES FOR THE TAX YEAR 1984 TO PROVIDE A GENERAL

ALL BONDED INDEBTEDNESS OF THE CITY OF BEAUMONT
AND THE PAYMENT OF INTEREST THEREON; PROVIDING
FOR SEVERABILITY AND PROVIDING FOR REPEAL.
WHEREAS, the Jefferson County Appraisal District has
:Furnished to the City of Beaumont a tax roll for the City of
Beaumont for the tax year 1984 ; and,
WHEREAS, the net taxable assessed value of all property
within the City has been determined by the Jefferson County
Appraisal District to be $2 ,587,515,009; and,
WHEREAS, the City Council finds that the tax roll
submitted by the Jefferson County Appraisal District should be
approved and that a tax rate in the amount of Seventy-Eight Cents
($0.78) per each One Hundred Dollars ( $100. 00) of value for the tax
year 1984 should be established based upon said tax roll;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1 .
That the tax roll submitted to the City Council by the
Jefferson County Appraisal District, a summary of which is attached
as Exhibit "A" and showing the total net taxable assessed value of
all property within the City to be $2 ,587,515,009, is hereby
approved and adopted by the City of Beaumont.
Section 2.
That there shall be and is hereby levied and shall be
assessed and collected for the tax year 1984, for municipal
purposes only, an ad valorem tax of Seventy-Eight Cents ( $0.78) on
each One Hundred Dollars ( $100. 00) worth of property located within
the present city limits of the City of Beaumont made taxable by
law, which said taxes when collected shall be for the purposes
hereinafter set forth as follows:

Section 3 .
That if any section, subsection, sentence, clause or
phrase of this ordinance or the application of same to a

remaining portions of this ordinance, and to such end the
;provisions of this ordinance are declared to be severable.
Section 4 .
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.

Subject: Summary of Ordinances Pertaining to Adoption of 1984-1985 Budget
A. An ordinance adopting the fiscal year 1984-1985 budget and
appropriating monies.
It is standard practice for the City to appropriate expendi-
tures by a fund breakdown within this comprehensive ordinance.
This breakout is detailed in the "All Funds Budget Summary"
found in our budget udget package. A copy of this All Funds
Budget Summary" is attached for your information. The ap-
propriations
by funds are as follows:
1. General Fund - $43,320,820. This appropriation is reduced
by some 42,900 to reflect those changes agreed upon by
Council with respect to reduction in the sweeper program.
It also accommodates a slight addition to the "Aid to
Other Agencies" budget, in that a slightly higher revenue
for 1984 allowed us to lessen the charge made with re-
spect to a payback from the South East Texas Arts Council
and Museum line item budget within the "Aid to Other
Agencies". In addition, the budget will reflect a re-
duction of $15,840 in General Revenue revenues resulting from
an adjustment in fees for services to be adopted by the
Health Department.
2. Water Utilities Fund - $14,846,210. There is no change in
this appropriation from the preliminary document submitted
to you.
3. Fleet Fund - $5,109,530. This amount shows a reduction
of T23,500 which were equipment purchases that had been
agreed to earlier in the internal budget hearings that
were held prior to submission to Council . The $23,500
was an oversight and this reduction will correct it.
4. Geneeal 'Debt"Service' Fund $10,5.150000. Only change in
this appropriation from the earlier submission is related
to delayed issuance of bonds for landfill , as explained in
Sanitary Landfill Fund.
5. -Municipal -Transit Fund - $1,635,200. No change is recom-
mended in this fund.

6. Revenue Sharing Fund - $1,770,000. No change recom-
mended.
7. Central Stores Fund - $213,980. No change from the
earlier recommendations.
8. Sanitary Landfill Fund -_$1,599,980. This figure shows
a reduction in expenditure of some $215,000 in fiscal
year 1985. Continuing discussions with our commercial
franchise holders have convinced us that it would be
appropriate to defer the collection of the closure fee
for both residential and commercial customers until
January 1, 1985. In light of this fact, we will not
issue bonds until the charge is instituted, which will
cause a reduction in our payment of principal and in-
terest in fiscal year 1985 of $215,000. The later
issue date will require only an interest payment in
fiscal year 1985, as opposed to two interest payments
and a principal payment. On the revenue side, it
will cause a reduction of $72,500, which is directly
related to the fact that we will collect the fee from
all parties for nine months instead of twelve months.
We will completely review this situation on October 2nd
upon the adoption of the ordinance amending sanitation
rates for fiscal year 1985.
9. Capital Improvement Fund ,- $12,095,414. This figure
shows a reduction of some $319,000 resulting from
Council action in transferring some $419,000 to the
Sanitation Fund to be applied against our deficit
position in that fund. In addition, the Council agreed
to an addition of $100,000 as an expenditure for horse
stalls at the Fair Park Coliseum.
10. Insurance 'Fund - $5,378,810. No change from our original
submission.
The sum of this budget totals $100,705,284.
B. Ordinance establishing water and sewer rates. The ordinance attached
for adoption by Council proposes an increase of 19 percent in the
basic water rate. This recommendation includes the establishment of
a service charge to be implemented in place of the minimum charge
currently in effect. The current $2.50 minimum would be reduced
to a $1. 13 service fee with the use of the first gallon of water
being charged to the customers. For the smallest user, this would
result in less than a - 19 percent increase in water bills, while all

customers above 1,500 gallons of consumption per month would
receive the 19 percent increase, It also recommends the de-
letion of the reduction for those users over 400,000 gallons
as currently contained in our rate ordinance.
C. Ordinance regulating burglar alarms. Attached for your in-
formation is an ordinance that regulates and, hopefully, will
help control the high incidence of false alarms currently
being generated within the system. The provisions of this
ordinance, as well as its potential impact on all users, have
been extensively discussed over the past several months.
It is recommended that the ordinances, as briefly summarized above, be adopted.

WHEREAS, the City Manager of the City of Beaumont submitted
to the City Council a budget estimate of the revenues of said City
and expenses of conducting the affairs thereof for the ensuing fiscal
year beginning October 1 , 1984, and ending September 30, 1985; and,
WHEREAS, after notices and public hearings held in
accordance with the requirements of the charter of the City of
Beaumont, the City Council is of the opinion that the budget, as
attached hereto as Exhibit "A" , should be adopted;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
THAT the budget attached hereto as Exhibit "A" and made a
part hereof for all purposes is hereby adopted and approved. Exhibit
"A" is hereby adopted and approved as the budget of all the correct
expenses as well as the fixed charges against City for the fiscal
period beginning the 1st day of October, 1984, and ending the 30th
day of September, 1985, and the several amounts stated in Exhibit "A"
as proposed expenditures shall be and become appropriated to the
several objects and purposes therein named. Notices given as
required for the adoption of said budget are hereby ratified.
Section 2.
THAT there is hereby appropriated out of the General Fund
the sum of $43, 320,820.
Section 3 .
THAT there is hereby appropriated out of the Water
Utilities Fund the sum of 14 84

That Chapter 28 , Sections 28-50( a) , 28-50(g) ,
28-51( 2 ) , 28-53( a) , 28-53(c) , and 28-54( 2 ) of the Code of
Ordinances of the City of Beaumont, be and the same are hereby ,

Section 28-50(g) :
Where water service is used by more than one
dwelling unit by a single meter, or where
dwelling units are not served by separate
meters, a minimum charge of One Dollar and
Thirteen Cents ( $1 . 13 ) will be made for each
dwelling unit served, and water used will be
billed at the rate of One Dollar and Twenty-
Three Cents ( $1 . 23) per one thousand ( 1 ,000)
gallons for all usage.
Section 28-51( 2 ) :
Water services to customers outside the city
limits shall be rendered at a rate that is
.equal to one hundred twenty-five percent
( 125% ) of the rate established inside the
city limits. A minimum charge of Two Dollars
and Twenty-One Cents ( $2 . 21 ) per month shall
be made.
Section 28-53( a) :
The following metered rates based upon water
measured through meters approved by the Water
Utilities Department shall be effective inside
the city: There shall be a minimum monthly
charge to all persons who have a sewer
connection of Three Dollars ( $3.00) . A charge
of One Dollar and Five Cents ( $1 . 05) per one
thousand ( 1 ,000) gallons of water usage shall
be made thereafter from zero gallons to
maximum monthly usage.
Section 28-53(c) :
Where a building containing more than one
dwelling unit is served by a single meter or
where there is not a separate water meter for
each dwelling unit, each unit shall be charged
a minimum base charge of Three Dollars ( $3 . 00)
and sewer service shall be charged based on
water usage at the rate of One Dollar and Five
Cents ($1 . 05) per one thousand ( 1 ,000) gallons
of water usage from zero gallons to maximum
monthly usage.
Section 28-54( 2 ) :
Sewer service to customers outside the city
limits shall be rendered at a rate of one
hundred twenty five percent ( 1250 ) of the rate
established inside the city limits. The
minimum monthly charge shall be Five Dollars
and Forty Cents ( $ 5. 40) per month.
Section 2.
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason

be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 3.
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.

That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.

ENTITLED AN ORDINANCE AMENDING CHAPTER 2-1/2
OF THE CODE OF ORDINANCES OF THE CITY OF
BEAUMONT TO PROVIDE FOR THE PAYMENT OF FEES
BY ALARM USERS FOR EXCESS ALARMS; PROVIDING
FOR SEVERABILITY; PROVIDING FOR REPEAL AND
PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
That Chapter 2-1/2 , of the Code of Ordinances of the
City of Beaumont is hereby amended to read as follows:
Section 2 1/2-11. Definitions.
As used in this chapter, the following words
and phrases shall have the meanings
respectively ascribed to them by this
section:
Alarm system shall mean any device designed
and manufactured for the detection of an
unauthorized entry on premises or for alerting
others of the commission of an unlawful act,
or both, and which, when actuated, transmits a
signal or message remotely to an answering
service or other similar monitoring station,
but shall not include privately owned alarms
operated and monitored solely by the owner
thereof or his designee.
Alarm business shall mean any person, firm,
corporation, or other entity in the business
of leasing, maintaining, servicing, repairing,
altering, replacing, moving, or installing,
any alarm system or causing to be maintained,
serviced, repaired, altered, replaced, moved,
or installed any alarm system in or on any
building, place or premises.
Alarm agent shall mean any person who is
employed by an alarm business, either directly
or indirectly , including the owner, or in the
case of a corporation, the officers whose
duties include any of the following: Selling,
maintaining, leasing, servicing, repairing,

altering, replacing, moving, or installing on
any building., place or premises any alarm
system.
Alarm user shall mean any person, firm,
corporation or other entity which owns,
possesses, or leases an alarm system.
Excess alarms signaling a burglary or
unauthorized entry shall mean those alarms in
excess of three ( 3 ) signaled from the same
user' s premises by the same alarm system
within any calendar quarter; but not including
( 1 ) such alarms signaled within the first
fifteen ( 15 ) days after an original
installation of said system or a major
component thereof , and ( 2 ) those alarms in
which an unauthorized entry has been verified
by the alarm user or alarm agent before the
police are summoned to the premises.
Excess alarms signaling a robbery or the
commission of an unlawful act shall mean those
alarms in excess of two ( 2 ) signaled from
the same user' s premises by the same alarm
system within any calendar quarter, but not
including ( 1 ) such alarms signaled within the
f irst f ive ( 5 ) days after an original
installation of said system or a major
component thereof , and ( 2 ) those alarms in
which a robbery or attempted robbery has
occurred.
Person shall mean any individual,
partnership, corporation, or other entity.
Calendar quarter shall mean either January
through March, April through June, July
through September, or October through December
of any calendar year.
Section 2 1/2-12. Reporting Servicin Information
Each alarm business shall maintain a current
information card with the police department
containing its name, address and telephone
number, a list of its alarm users, a name and
address for each alarm user, and the name,
address and telephone number of a person or
persons who can render service to its
equipment at any hour of the day or night.
Each alarm business or alarm agent shall

immediately inform the chief_ of police of any
and all changes in the information on f ile
with the police department.
Section 2 1/2-13. Prohibitions
( a) It shall be unlawful for any person to
intentionally or knowingly activate or cause
to be activated any alarm system for the
ultimate purpose of summoning police except in
the event of what is reasonably believed to be
an unlawful act and/or an unauthorized entry
on premises which the alarm system is designed
to detect. Whenever an alarm system has been
designed and commonly understood to alert
others of the commission of a particular
crime, it shall be unlawful for anyone to
activate such alarm system for the purpose of
summoning police except in the event of what
is reasonably believed to be such particular
crime.
( b) It shall be unlawful for any alarm
business to use, operate, maintain, or repair
an alarm system which, upon activation, emits
a sound similar to sirens in use on emergency
vehicles or currently used by civil defense
authorities for disaster alert purposes, after
fifteen ( 15) days' notice to such business
that such alarm system has been disapproved by
the chief of police.
(c) It shall be unlawful for an alarm user
to become more than sixty ( 60) days delinquent
in the payment of any service charges due and
payable under section 2 1/2-14 hereof. Each
day of such delinquency shall constitute a
separate of fense.
(d ) It shall be unlawful for any person
owning, possessing, or operating an audible
alarm system, which, when actuated, sounds a
bell, whistle, siren, horn, or other similar
sound, to permit or allow said alarm to emit
such sound for a period in excess of twenty
( 20) continuous minutes.
Section 2 1/2-14. Service Charges
Each alarm user shall pay to the City of
Beaumont a penalty for excess alarms from the
same user' s premises to which police respond,
according to the following schedule:

Section 2.
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set
of persons or circumstances, should for any reason be held to be
invalid, such invalidity shall not affect the remaining portions of
this ordinance, and to such end the various portions and provisions
of this ordinance are declared to be severable.
Section 3.
All ordinances or parts of ordinances in conflict herewith
are repealed to the extent of the conflict only.
Section 4 .
Any person who violates any provision of this ordinance
shall, upon conviction, be punished as provided in Section 1-8 of
the Code of Ordinances of Beaumont, Texas.

On November 22, 1983, City Council passed resolutions authorizing the City
Manager to enter into agreements with Vayla Kojak and Kojak Homes , Inc. ,
developer, and Mark W. Whitely and Associates , Inc. , Consulting Engineer, to
participate in the paving of Shelby Drive from 135 feet south of Doty Drive
a distance of 300 feet to a point 140 feet north of Gross and storm drainage
along Riggs Street from Calhoun to Drainage District 6's drainage ditch.
Bids were received on July 23, 1984. Of the twelve bids received, the lowest
was submitted by Russ Miller Construction Company in the amount of $204,798.41,
which is $71,751.49 less than the $276,549.90 estimated cost. In accordance
with the City's Participation Policy, the City's share will be $169,405.72,
-including engineering fees. The contract is for sixty working days (an es-

The project provides for the construction of a 37-foot residential collector
street with concrete curb and gutter in lieu of a 27-foot residential street
and storm drainage along Riggs Street from Calhoun to Drainage District 6's
drainage ditch. The City's participation will be for the extra width and
thickness of the pavement and for the difference in the cost of storm sewer
required to serve the subdivision and the cost of a larger size storm sewer
for proper drainage of the area.

Subject: Change Order No. 1 to the Contract for the Longfellow Interceptor
Project
At last week's meeting, Council awarded a contract to John Bankston Construc-
tion and Equipment Rental for $2,086,966 for replacement of the existing
33-inch sewer that is located underneath I-10 Freeway from Kenwood Street
south to Laurel Street. At that time, it was noted that the low bid was some
$136,966 over the original preliminary estimate of $1,950,000. In an effort
to reduce the cost of the project, our engineers, Schaumburg and Polk, Inc. ,
at the request of the City, have analyzed costs associated with the project
and have prepared the following contract changes which result in a net re-
duction of $64,760. These changes are as follows:
1. Open cutting in lieu of tunneling of some
240 feet of work at street intersections
at a net reduction of: -$88,760
2. Replacement of concrete surface on Laurel
Street 300 feet west of 18th Street. This
is at an additional cost of: + 24,000
This work was inadvertently left out of
the original contract.

It is recommended that Change Order No. 1 be approved.

Bids were opened on September 10, 1984, for equipment necessary for use in the
operation of the Municipal Landfill . Quotes were received on a track-type
excavator as well as a track-type bulldozer, Because of the complexity of
the bids received on the excavator, we are deferring purchase of the excavator
in order to allow time for demonstrations to be provided on some of these
excavators that were bid. A recommendation on purchases for the excavator will
be made at a future date. With respect to the track-type bulldozer, we are
prepared to recommend the bid of Mustang Tractor as the best and lowest quote
on this piece of equipment. The bids on this equipment are as follows:

Subject: Bids for Rental of Dozer
On September 10, 1984, bids were opened for the rental of a dozer to be used
at the Municipal Landfill on an "as needed basis". The rental dozer will be
used in case of equipment failure and/or some other type of emergency in
order to stay in compliance with the Texas Department of Health's landfill
standards. Specifications were met by all bidders except Tex-Trac, Inc.
Their exception to specifications is Item #3, responsibility on breakdowns.
They would reserve the right to charge "abuse" to the City. All other bid-
ders accepting the City position of no responsibility for breakdown. The

Subject: Purchase of Personal Computer
For the past few months, the City Clerk's Office, in conjunction with the
Data Processing Division, has been reviewing the need for a computer in the
Clerk's Office. The City's Data Processing Committee, established for com-
puter user applications, met and agreed that the Clerk's Office is one of
the functions of the City that has no need to tie into the main frame com-
puter. Due to the types of records kept for the City by the City Clerk' s
Office, there is no need for interaction to the main computer either from
the Clerk's Office or to the Clerk's Office; therefore, a stand-alone system
is the most desirable for records management. While it is always possible to
develop a program to be used on the large central mainframe in Data Proces-
sing, the initial expense associated with Program Development and the ongoing
costs of providing data storage make a stand-alone unit preferable for this
specialized application.
The computer will be used for a Records Management System, a Minute Minder
and a Retrieval System. This means indexing all documents for fast retrieval .
Much time is spent in the Clerk's Office retrieving data for citizens and
other departments. A very good system currently is established for filing
and storage of records, but retrieval of those records is very time-consuming
because indexing is manual . Computerizing indexes will result in speed and a
higher level of efficiency. We plan to start on a current basis and, as time
allows, work back to include indexes on old records.
Software for our needs is packaged and sold by the International City
Management Association, designed by them for Clerk's Offices. Software is
not included in the price of this computer. Cost of software will be $900.
The necessary funds are in the 1984 City Clerk's budget to allow for this
purchase, as well as software,

Subject: First Stop Business Center
A discussion has been scheduled at the September 25th Council meeting Work
Session on the First Stop Business Center. The First Stop Business Center
has been an effort initiated by the City Council which has been reviewed
and analyzed by a joint City/Chamber Task Force. The report which is at-
tached to this Council Letter is the final report made back from the Com-
mittee. In addition, a copy of the report which will go to the Chamber
Board of Directors late in the afternoon of September 25th is also enclosed.
The budget implications for the First Stop Business Center in the 1985
fiscal year is one which will cost the City approximately $20,000. In addi-
tion, the City would be responsible for finding a location for the Center
and potential clerical staff. The location is, at this point, undetermined.
The Industrial Development Commission of the City of Beaumont, of which
the Councilmembers serve as Board of Directors, has a source of funds approxi-
mating $35,000, which has been raised through the imposition of the fee on
the issuance of Industrial Development Revenue Bonds. It is suggested that
$20,000 be contributed from that fund to the Chamber of Commerce for the
first-year cost of the First Stop Business Center. In the event the Center
proves successful , it would be necessary for the City to continue budgeting
it on an annualized basis.
In addition to your consideration of the First Stop Business Center, the
City staff is continuing its examination of the potentials of a One Stop
Inspection Center to be located within the City organization for City per-
mitting processes only. We anticipate further investigating that issue and
responding to the Council in the near future.

recommending establishment of a First Stop Business Center. The Task Force met on
July 5, 12, 26, August 9, and 23, 1984. Based on our discussion of the issues,
opportunities for Beaumont, and experience in other cities, we recommend a joint
public/private effort to assist business and industry, both new and existing, to flourish
in the Beaumont area. We believe both the city and the chamber should act promptly.
To implement this report will require authorization and budget allocation. We
envision that the City can assume the lead in funding suitable office space and the
Chamber can lead the personnel recruitment. Both City and Chamber should appoint
members of the Advisory Board.

FIRST STOP BUSINESS CENTER
JOINT CITY/CHAMBER TASK FORCE
I. Concept
A joint City and Chamber of Commerce of Beaumont Task Force was appointed
and asked to examine the creation of a first stop information service to assist
the expansion and establishment of new business in Beaumont, and to make
recommendations to both organizations. Experience in other cities has
apparently assisted business by providing centralized information and referrer
and sometimes centralized permitting and licensing. The need is for timely
information, easily available to new or expanding businesses as well as busine--
prospects considering relocation to the Beaumont area.
The advantages to Beaumont appear to be:
1. Contribute to economic development of the community by providing vita'_
information to prospective employers considering a Beaumont location.
2. Save time of area business persons establishing or expanding businesses and
industry in Beaumont.
3. Coordinate responses to business inquiries of various city and chamber
activities with net gain in efficiency.
4. Reinforce Beaumont's combined efforts to encourage economic
development.
R. Review of Experience in Other Cities
To determine the feasibility of a first stop business center for Beaumont,
discussions were held with staff members of established centers in three
southern cities - San Antonio, Nashville, and Atlanta. Each differed in their
scope and purpose, and are summarized as follows:
A. San Antonio, Texas
Established in 1980 under the direction of Mayor Henry Cisneros, the "One
Stop Business Center" operates within the city's Department of Economic
and Employment Development. It serves as a central information source
for the industrial-commercial incentives offered by the city of San
Antonio. Director Trini Lara heads a staff of four which services from
100-125 inquiries a month. Though an arm of the city, the center works
closely with the private sector economic development foundation, local
trade and minority associations, and area government agencies. Services
include information on licensing and compliance, assistance in government
procurement, job skills training for industry, business loan assistance,
import/export assistance, site and commercial inventories, liaison with
municipal services and more. The center is located in a ground floor
location in the Plaza de Armas directly across from City Hall with hours of
operation of 7:45 a.m. - 6:00 p.m., Monday through Thursday, and
7:45 a.m. - 4:30 p.m. on Friday.
B. Nashville, Tennessee
The focus of this two-year old effort is to consolidate the permitting
process of city government as an incentive to economic development. This
center was brought to the attention of the Task Force by a local
businessman's experience in establishing an outlet in Nashville. According
to the Economic Development Office of the city of Nashville, a new Codes
Department was created within city government that physically located
the planning and zoning process, fire codes, building inspection, health
regulation and other licensing departments in one location. They have also
begun to automate the permitting process through the use of a computer
for use by business inquiries...and to develop an on-site method to rule on
minor variances to zoning regulations.
C. Atlanta, Georgia
This community's effort centers around the revamping of their building
permit process begun in early 1983. With the purpose of speeding up the
permit issuance process, the components include: the adoption of a
standard regional building code, computerization of permit issuance and
plans logging, the creation of a plan coordinator position, installation of a
hot-line telephone system, in-house training programs for inspectors and
permitters, and seminars for community builders, architects, and
developers. Full implementation of the program will include the
centralization of seven permit divisions in one location.
After reviewing these three centers, the Task Force identified the San Antonio model
as possessing the characteristics and purpose which most closely meet the needs of the
Beaumont community.
III. Findings of the Task Force
A. Need for Services in Beaumont
Increase in jobs and diversification of the local economy are established
goals. It is recognized that growth of new, small businesses of many kinds
is a promising means to achieve this goal. Relocation of employers to this
area is also welcome. Both local and relocating businesses have benefited
from assistance in the cities of San Antonio and Nashville.
We concluded that such services can be helpful in Beaumont. However, it
is difficult to measure the amount of use or likely benefit. Currently
inquiries are directed to many offices and there appears to be some
overlap and duplication in servicing these questions. We believe the
evidence is clearly sufficient to offer the services listed for a period of a
year to best determine the scope and level of effort as well as the benefit.
It is our expectation that the Center will succeed and continue, but that
the menu of services will evolve. An important responsibility of the
Center Director will be to identify the most effective services to assist
economic development.
We discussed a concern about favoritism in the operation of the Center.
We believe this can be completely avoided by providing directories of all
firms offering relevant services have equal access to potential new clients.
B. Availability of Information
Appropriate information for the business person can be provided directly,
or by referral to the best source. The Center will have in its offices such
information and application forms as are easily obtained in printed form
and which generally will have a long shelf life. Much of the information
sought by the clients, however, will be available by referral to other
offices or individuals in the Beaumont area. It may be useful to set up
appointments for the client. It is anticipated that referral of clients to
appropriate sources of data will be essential for many inquiries because
centralizing data for the broad array of questions envisioned is neither
practical nor cost effective. It is important in carrying out the purpose of
the Center that it provide helpful service as distinguished from promotion
or sales.

CONDITIONS FOR APPROVAL: A Specific Use Permit shall be issued only if
all of the following conditions have been found:
1) That the specific use will be compatible with and not injurious to the
use and enjoyment of other property, nor significantly diminish or
impair property values within the immediate vicinity;
Garage apartments are normally accepted uses in single
family areas. Applicant states that proposed apartment will
be used by family members on a limited basis.
2) That the establishment of the specific use will not impede the normal
and orderly development and improvement of surrounding vacant property;
Surrounding lots are developed with single family residences.
3) That adequate utilities, access road, drainage and other necessary
supporting facilities have been or will be provided;
Existing drainage and utilities are present and adequate.
4) The design, location and arrangement of all driveways and parking spaces
provides for the safe and convenient movement of vehicular and pedestrian
traffic without adversely affecting the general public or adjacent
developments;
Parking and driveway are in place.
5) That adequate nu4sance prevention measures have been or will be taken
to prevent or control offensive odor, fumes , dust, noise and vibration;
Proposed use will generate none of the five environmental
nuisances.
6) That directional lighting will be provided so as not to disturb or
versely affect neighboring properties; ad-

ENTITLED AN ORDINANCE ISSUING A SPECIFIC
USE PERMIT FOR A GARAGE APARTMENT ON
PROPERTY LOCATED AT 490 NORVE LL.
WHEREAS, the Planning and Zoning Commission of the City of
Beaumont considered the issuance of a specific use permit for a
garage apartment on property located at 490 Norvell, Beaumont,
Jefferson County, Texas, to Felipe Iglesias, property owner; his
legal representatives, successors, and assigns for that certain
property hereinafter described; and,
WHEREAS, the City Council is of the opinion that the
issuance of such specific use permit is in the best interest of the
City of Beaumont and its citizens, subject to the hereinafter
described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That all conditions necessary for issuance of a specific
use permit have been met and a specific use permit for a garage
apartment on property located at 490 Norvell, Beaumont, Jefferson
County , Texas, in accordance with Section 30-26 and Section 30-40 of
the Code of Ordinances of the City of Beaumont, as amended, is hereby
granted to Felipe Iglesias, his legal representatives, successors and
assigns for that certain tract described on Exhibit "A" attached
hereto and made a part hereof for all purposes.
Section 2.
That the specific use permit herein granted is expressly
issued for and in accordance with each particular and detail of the
site plan attached hereto as Exhibit "B" and made a part hereof for
all purposes.
