AN ORDINANCE AMENDING THE FRANCHISE GRANTED
TO BEAUMONT CABLEVISION, INC. PREDECESSOR
OF LIBERTY T. V. CABLE, INC. ON NOVEMBER 25,
1975, BY INCREASING THE PAYMENTS TO BE
MADE THEREUNDER AND BY EXTENDING THE TERM
THEREOF.
WHEREAS, by ordinance adopted on third and final reading on
November 25, 1975, said ordinance becoming effective April 1 , 1976 ,
the City of Beaumont ( the "City" ) granted Beaumont Cablevision,
Inc. , the predecessor of Liberty T. V. Cable, Inc. ( the "Company" ) ,
the franchise ( the "franchise" ) to conduct within the City a cable
television business and to use the streets, alleys and public ways
of the City for the purpose of conducting such business; and,
WHEREAS, the franchise is for a term of fifteen ( 15) years
commencing on April 1 , 1976; and,
WHEREAS, as compensation for the use of the streets, alleys
and public ways of the City, the franchise required the Company to
pay the City each year an annual payment equal to three percent
( 30 ) of gross annual basic subscriber revenues received for cable
television operations in the City for the preceding calendar year;
and,
WHEREAS, City and Company desire to amend the franchise by
extending the term thereof and by increasing the annual payment
made by Company to City as compensation for the use of streets,
alleys and public ways of the City;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF B EAUMO NT:

Section 1 .
That Section II( 4 ) be, and the same is hereby , repealed and
removed from the franchise.
Section 2 .
That Section III(l ) be, and the same is hereby, amended to
read as follows:
"Upon the filing with the City by Company of the
acceptance required hereunder, the franchise, as
amended by this ordinance, shall be in full force
and effect for a term and period of fifteen ( 15)
years from and after April 1 , 1984, or until
March 31, 1999, unless sooner terminated as
provided herein. "
Section 3 .
That Section IX( 1 ) of the franchise be, and the same is
hereby, amended to read as follows:
"Section IX( 1 ) . The Company shall pay to the City
on or before March 31 of each year, a three
percent ( 30 ) franchise fee based on the gross
receipts of the Company from all sources from its
operations within the corporate limits of the City
for the preceding calendar year. No other fee,
charge or consideration, shall be imposed. Sales
taxes or other taxes levied directly on
subscription basis and collected by the Company
shall be deducted from the gross receipts before

computation of sums due the City is made. The
company shall provide an annual summary report
showing the gross receipts of the Company from
all sources from its operations within the
corporate limits of the City during the
preceding calendar year. "
Section 4 .
That all provisions of the franchise adopted on third and
final reading on November 25, 1975, except those sections amended
herein which are hereby adopted as amended, shall remain in full
force and effect and shall not be affected by passage of this
ordinance.
Section 5 .
Company shall, within thirty ( 30) days from the date of the
:Final passage of this ordinance by the City Council of the City of
Beaumont, file with the City Clerk of the City of Beaumont, a
written statement signed in its name and behalf in the following
form:
"To the Honorable Mayor and the City Council
of the City of Beaumont:
Liberty T. V. Cable, Inc. , for itself , its
successors and asigns, hereby accepts the attached
ordinance finally passed by the City Council of the
City of Beaumont, the day of

1984, and agrees to be bound by all of its terms
and provisions.

Section 6 .
The full text of this ordinance shall, after final passage
by the City Council of the City of Beaumont, be published once each
week for four (4 ) consecutive weeks in a newspaper of general
circulation published in the City of Beaumont, and the expense of
such publication shall be borne by Company. Upon said publication
being completed and the acceptance of this ordinance by Company is
;herein provided, this ordinance shall take effect sixty-one ( 61 )
days after its adoption on third and final reading by the City
Council of the City of Beaumont.

Subject: Willow Bend Drive Participation III
Kohler and Kohler, acting as consulting engineer for Beaumont Willow Creek
Development Company, has requested the City's participation in the cost of
paving a portion of Willow Bend Drive in accordance with the City's Partici-
pation Policy.
Based on this policy, the City' s participation in this project will consist
of paying for the extra width and thickness required on Willow Bend Drive
from Brooks Road north to the existing portion of Willow Bend Drive, a dis-
tance of 1,650 feet. This street is designated as a 37-foot residential
collector street in lieu of a 27-foot residential street.
The total estimated City cost, including engineering fees, is $55,572.76.
Money for these types of participation efforts are available within the 1984
Street System Improvement Fund. The estimated cost of the entire project is
$158,925.69. The City will administer this construction contract.
It is recommended that this resolution be approved.

Company, has requested the City' s participation in the cost of paving a por-
tion of Crow Road in accordance with the City's Participation Policy.
Eased on this policy, the City's participation in this project will consist
of paying for the extra width and thickness required on Crow Road from 1,320
feet north of Delaware to approximately 1,230 feet south of Folsom, a distance
of 1,350 feet. This street is designated as a 37-foot residential collector
street in lieu of a 27-foot residential street.
The total estimated City cost, including engineering fees, is $45,640.65.
Monies for these types of participation efforts are available within the 1984
Street System Improvement Fund. The estimated cost of the entire project is
$130,591.50. The City will administer this construction contract.

Subject: Cartwright-Corley Drainage Relief Project
In June of 1982, the City Manager was authorized by Council to execute a con-
tract with Drainage District 6 for construction of the Cartwright-Corley
Drainage Relief Project. The City' s portion of the project consisted of
drainage structures under Eleventh Street, Washington Boulevard, and Eighth
Street. The City's responsibility also included a channel from the east
right-of-way line of the Santa Fe Railroad track to the west right-of-way of
Seventh Street.
On March 29, 1983, a contract was awarded
by Drainage District 6 in the
mount
of $997,840 to Baytown Construction Company. The contract amount was
increased to $1,027,324.38 by Change Order No. 1. The implementation of
Change Order No. l was the result of extra work which was required at the
Eighth Street, Eleventh Street and Washington Boulevard crossings.
The project has been completed at a total cost of $1,141,763.38 ($14,439.00
over the contract amount) within the authorized time. The increase is due
to overrun on some of the items, especially concrete riprap. The City's
share of the project cost is $764,974.38, with the rest of the project cost
being paid by Drainage District 6. Previous payments have been made to
Drainage District 6 in the amount of $727,096.16. This project was funded
out of the 1984 Drainage System Improvement Fund.
It is recommended that final payment of $37,878.22 be made to Drainage Dis-
trict 6.
It is recommended that this resolution be approved.

WHEREAS, by Resolution 82-213, the City Manager was
authorized to execute a contract with Drainage District 6 for
construction of the Cartwright-Corley Drainage Relief Project; and,
WHEREAS, on March 29 , 1983, a contract was awarded to
Baytown Construction Company in the amount of $997,840 which was
increased to $1 ,027 ,324. 38 by Change Order No. 1 ; and,
WHEREAS, the project has been completed according to the
plans and specifications;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the Cartwright-Corley Drainage Relief Project is hereby accepted
by the City of Beaumont and that the City Manager be, and he is

Subject: Annual Contract for Reinforced Concrete Pipe
Bids have been received and reviewed for reinforced concrete pipe from
National Concrete Products, Gifford Hill and Pyramid Concrete Pipe for use
in installation and replacement of drainage systems.
Bids were taken delivered to the south service center and obtained at the
supplier yard. Since most pipe is purchased for a specific job, it is more
convenient and cost-effective to acquire the pipe at the vendor, rather than
stock-piling it at the service center. Thus, it is recommended that the bids
at the supplier yard be considered. The bids by each company are listed be-

All items are per foot, except the box culvert, which is per item. Since
Gifford Hill 's yard is in Houston, it is not feasible to consider their bid
as lowest and best. Monies for this material are available in the line item
budget of the Drainage Divison of the Urban Transportation Department.

through No. 9; and the bid of Pyramid Concrete Pipe for Items No. 1 and No. 10
be accepted as the lowest and best bid meeting specifications.

Subject: Lease Space at Kyle Plaza
One of the items included on the September 4th agenda is the leasing of space
by the City of Beaumont of the new Kyle Plaza Development Project. The City
Councilmembers are aware the City has had a long-standing commitment to the
development of the Kyle Project. The Kyle Project includes retail space de-
velopment of approximately 40,000 square feet in the old Kyle building across
from the Federal Courthouse, and construction of a 160,000 square feet of ad
ditional office space immediately behind the retail . The office space would
built atop a parking garage of six stories which would house in excess of 400
vehicles. The City has already made commitments to the Project through the
issuance of Industrial Development Bonds in the amount of $10 million and the
acquiring of an Urban Development Action Grant (UDAG) of $5 million which will
be loaned to the Project at favorable repayment terms. It should be noted
that the UDAG grant is a "site specific" and will not be paid to the City
unless this Project takes place.
In order to provide the necessary commitments to the bank to allow this Project
to get under construction, it is proposed that the City of Beaumont have a
lease agreement for the Kyle Tower which would provide the guarantee of rental
flow into the Project. With that guarantee, the bank will approve the Project
to move forward. It is proposed that the developer would have to first find
third-party leases in the amount of 25 percent of the rental space in the Pro-
ject. The City would then lease 300 parking spaces in the garage at $80 per
month and 32,330 square feet of office space at $1 per month. The parking
space rentals would amount to $288,000 per year, while the office space rental
would amount to $387,960 a year, for a total potential liability of $675,960.
As the developer leases space in excess of the 25 percent minimum third-party
requirement, the City's obligation to rent the parking spaces and office
space, respectively, would be bought out by the developer. The buy-out is cal-
culated so that, by the time 50 percent of the project is leased, the City
would have no rental in the Project. It is anticipated that the City will
have no actual financial obligation by the time the Project is actually open
for occupancy.
However, in the event the City does end up having to actually provide lease
payments to the Project, an option has been provided for the City to acquire
the Project 18 months after its initial lease payments. After the initial
lease payments, the City has the right to put the developer on notice of its
intent to exercise its option to purchase the building for the remaining

balance of the Industrial Development Revenue Bond. The total Project con-
struction is in the neighborhood of $20 to $22 million with the Industrial
Revenue Bond being approximately $10 million. The City's option will be to
acquire the building for the remaining balance on the Industrial Revenue Bond
which is about $.45 on the dollar for actual construction. The developer
would have 60 days from the time of the City's notice to exercise its option
to repay the City all of its lease payments and interest on those lease pay-
ments at prime rate. It is anticipated that the developer would never allow
such an option to take place, due to the obviously favorable terms to the
City.
The City's role in revitalization of the downtown area makes the Project, as
we have just described, a valuable asset to downtown Beaumont. This Project,
in conjunction with the Waterford Hotel , would show significant commitment
by developers to the vitality of our downtown area. The risk factor which is
incurred is more than offset by the potential benefits.
It is recommended that City Council adopt the resolution which would approve
a lease agreement in substantial form as the one attached to the Council Let-
ter.

ENTITLED AN ORDINANCE AUTHORIZING THE
EXECUTION OF A LEASE WITH KYLE TOWER, LTD.
FOR OFFICE AND PARKING SPACE; PROVIDING FOR
THE LEVYING AND COLLECTING OF A SUFFICIENT
TAX TO PAY THE INTEREST THEREON AND PROVIDE
A SINKING FUND; PROVIDING FOR SEVERABILITY
AND PROVIDING FOR REPEAL.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
That the City Manager be, and he is hereby , authorized
to execute a lease agreement with Kyle Plaza, Ltd. substantially in
the form attached hereto as Exhibit "A" .
Section 2.
During each year while there is any liability by
reason of the lease agreement authorized herein, including the
present fiscal year, the City Council of the City of Beaumont shall
compute and ascertain the rate and amount of ad valorem tax, based
on the latest approved tax roles of said city, with full allowance
being made for tax delinquencies and cost of tax collection, which
will be sufficient to raise and produce the money required to pay
any sums which may be or become due during any such year, in no
instance to be less than two percent ( 2% ) of such obligation,
together with all of the interest thereon, because of the
obligation herein assumed. Said rate and amount of ad valorem tax
is hereby ordered to be levied and is hereby levied against all
taxable property in said city for each year while any liability
exists by reason of the obligation undertaken by this subsection of
this ordinance, and said ad valorem tax shall be assessed and
collected each year until all of the obligations herein incurred
shall have been discharged and all liability herein discharged.
Section 3 .
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid , such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
;severable.
Section 4 .
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.

Subject: Repairs to Tyrrell Historical Library
Bids were opened recently for renovation work at the Tyrrell Historical Library.
This work involves the repair of two of the three large stained glass windows
and the installation of protective overglazing in a metal frame over the win-
dows. The remaining large windows, as well as several smaller ones, will be
renovated and protected in the next phase of this extensive restoration pro-
J ect.
This entire restoration/preservation effort is being done under a plan de-
veloped several years ago for the Tyrrell Library, at a cost of some $2,100,000.
Our most recent estimate of cost for the work remaining is $1,700,000.
The money for this particular phase came from a $69,211 appropriation from
Community Development Block Grant funds. Some $6,900 has been expended in
architect fees involving the preparation of the bid specifications. The em-
ployment of the architectural firm was authorized by Council in February of
this year.
The bids on the work are:

Some $62,290 of Community Development Block Grant funds remain for allocation
to this project. The additional $9,110 necessary for the project is available
within the 1984 budget of the Library Department.
This work is absolutely essential if we are to preserve these priceless stained
glass windows. This particular project phase, while it is over our original
cost estimate of $55,000, certainly merits the expenditure of the additional
monies necessary for completion.
It is recommended that this resolution be approved.

submitted by Saucier and Sons is the lowest and best bid and should
be accepted;

The structure at 1985 Astor has been condemned by the City Council and the
owner ordered to either repair or raze the structure within a specified time
frame. Reinspection of this structure has revealed non-compliance with the
Council 's order.
The Building and Housing Services Department is requesting authorization from
the City Council to demolish this structure in accordance with the City Codes
and charge the property owner with the cost of the demolition.

Section 1 .
That the City Council of the City of Beaumont hereby
finds and declares the buildings located at:

Section 2.
In accordance with Article XVII, Section 2 of the
Charter of the City of Beaumont, Sections 10-2 and 14-52 of the
Code of Ordinances of Beaumont, Texas, and Section 103. 4 of the
Standard Building Code, it is hereby ordered that the owner or
owners of the following buildings either repair or demolish and
remove said structures within thirty ( 30) days of the date of the
passage of this ordinance:

shall be foreclosed and said expense be recovered by the City of

Section 4 .

demolished and removed by the City of Beaumont on the account of
the owners thereof and such expense of demolition and removal shall
be assessed as a special tax against the property upon which the
building is situated. The following structure was theretofore
declared to be a public nuisance in violation of Chapter 14 ,
Section 14-50 of the Code of Ordinances of the City:

That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid , such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various

severable.
Section 6 .
That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.

Subject: Lease Agreement
For more than ten years, the Beaumont Municipal Employees' Credit Union has
operated under a lease agreement with the City of Beaumont. The terms of
the lease agreement is for $1 per year for the land that the Credit Union' s
building stands on. The building is located at 1810 Pine. The current
agreement contract expired in March of 1983, and we failed to note its ex-
piration at that time.
A five-year contract has been proposed and agreed upon by the City of
Beaumont and the Beaumont Employee's Credit Union. It will begin on
October 1, 1984 and extend to 1989.
It is recommended that this resolution be approved.

:Subject: Approval of Contracts for Library
The State Library System of Texas has, for several years, allocated Federal
funds to local libraries for the purchase of books and associated materials.
Our library this year will receive some $2,751 of these funds. No local
monies for match are necessary.
In addition, the local library system has, for some time, been testing the
use of a Library Computer Network tie-in with the Houston Public Library.
This system can be used for circulation needs within our system, printing
overdue notices, book reservations, keeping track of individuals who owe
fines and borrowing of books from other systems. It will be necessary for
the City to enter into a yearly Memorandum of Understanding with the Houston
Area Library System. City staff feel strongly that this type of networking
with a large computer will be of great assistance in improving service and
operations.
The necessary monies for this agreement, some $6,000 yearly, is contained in
the budget of the City Library.
It is recommended that the resolution authorizing exectuion of these agree-
ments/contracts be approved.

Subject: Ordinance Amending School Zone Time Changes
On August 24, 1984, the Beaumont Independent School District changed the
school hours at the Junior and Senior High Schools from 8:00 a.m. to 3:00 p.m.
to 8:30 a.m. to 3:30 p.m. Elementary school hours will remain at 8:00 a.m.
to 3:00 p.m. As a result of these changes, it is recommended that Section
26-24 of the Code of Ordinances be amended to establish four time schedules
for reduced school speed zones. These schedules are based on the District's
newly-established starting and ending times and are as follows:
Schedule A 7: 15 a.m. - 8: 15 a.m.
2:45 p.m. - 3:30 p.m.
Schedule B 7:45 a.m. - 8:45 a.m.
3:15 p.m. - 4:00 p.m.
Schedule C 7: 15 a.m. - 8:45 a.m.
2:45 p.m. - 4:00 p.m.
Schedule D 7: 15 a.m. - 8:15 a.m.
2:00 p.m. - 3:45 p.m.
This proposed amendment will establish the four time schedules for school
speed zones and designates zones to be included in each schedule.

It is hereby determined upon the basis of an engineering and
traffic investigation, that the speed permitted by state law upon
those streets, or portions of streets described in the schedule
below is greater than is reasonable or safe under the conditions
found to exist upon such streets and it is hereby declared that the
prima facie speed limit upon those streets or portions thereof
described in the schedule below shall be decreased as therein stated
and the limits so delcared shall be effective at the times specified
therein when signs are erected giving notice thereof.

Subject: Execution of Release of Repurchase Agreement
On May 29, 1984, City Council passed a resolution authorizing the City Manager
to execute a deed selling a tract of surplus land originally acquired for the
Phelan Boulevard Project to the adjacent property owner. It has been requested
that we release the alley portion of this property from a stipulation in the
deed so that an office building can be constructed.
Because of reservations about future need for street right-of-way, the sti-
pulation was added to the deed that in the event this property is needed by
the City, the purchaser would sell the property back to the City for the pur-
chase price originally paid. This property has been subsequently leased with
option to purchase together with an adjacent property. The Lessee has obtained
a Building Permit to construct an office building that will connect to an
existing building he owns on the adjacent lot. The 12-foot vacated alley was
abandoned in 1983. The Lessee was not aware that the half of the vacated
alley sold by the City was included in the 10-year buy-back stipulation.
The office building is designed and awaiting construction; however, the pro-
posed building extends over that part of the property which is covered by
the City's 10-year buy-back stipulation. This causes a problem with finan-
ing the project in that this extension is considered to be an encroachment by
the financing institution.
This agreement would release from the 10-year buy back stipulation that portion
of the property which is the north half of the vacated 12-foot alley south
of Lots 4 and 5 in Block 24 of the Jarrette Addition.
It is recommended that this resolution be approved.

Boulevard Project to the Adjacent property owner; and,
WHEREAS, the subject property has been leased with an
option to buy pending partial release of a stipulation in the deed
:requiring that the purchaser would sell the property back to the
city for the purchase price originally paid for it if a future need
for the property developed;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be, authorized to execute an agreement
releasing that portion of the property which is the north half of
the vacated 12 foot alley south of Lots 4 and 5 in Block 24 of the
jarrette Addition to the City of Beaumont from the ten ( 10) year
buy back stipulation.
PASSED BY THE CITY COUNCIL of the City of Beaumont this
