Subject: Gladys Avenue/7th Street-Rezoning Study
GENERAL INFORMATION
Subject properties are between Gladys and Louisiana on the he west
side cf Seventh Street. Existin R-3 zoning is original from 1955 .
The study area includes four lots : the northern pair is a drive-
in grocery, the southern pair is a residence and artists studio.
The northern lots face into GC-I%D zoning; southern lots face into
RS zoning. The comprehensive plan designates the area in the
study as a Stable Area.

ENTITLED AN ORDINANCE AMENDING CHAPTER 30
OF THE CODE OF ORDINANCES OF BEAUMONT,
TEXAS, AND IN PARTICULAR THE BOUNDARIES OF
THE ZONING DISTRICTS AS INDICATED UPON THE
ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING
THE ZONING FROM R-3 (MODIFIED TWO FAMILY
AND MULTIPLE DWELLING DISTRICT) TO NC
( NEIGHBORHOOD COMMERCIAL DISTRICT) ON
PROPERTY LOCATED ON THE WEST SIDE OF 7TH
STREET AT GLADYS AVENUE; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL AND
PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
THAT Chapter 30 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts as
indicated upon the Zoning Map of the City of Beaumont, referred to
in Section 30-5B thereof, is hereby amended by changing the zoning
classification from R-3 (Modified Two Family and Multiple Dwelling
District) to NC ( Neighborhood Commercial District) for property
located on the west side of 7th Street at Gladys Avenue, as shown
on Exhibit "A" attached hereto and made a part hereof for all
purposes, and the official zoning map of the City of Beaumont is
hereby amended to reflect such changes.
Section 2.
That in all other respects the use of the property
hereinabove described shall be subject to all of the applicable
regulations contained in Chapter 30 of the Code of Ordinances of
Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 4 .
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
Section S.
That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.

Subject: Eastex Freeway/Treadway Rezoning Study.
GENERAL INFORMATION
This R-3 rezoning study begins generally on the northeast corner
of Singleton Road and the Eastex Freeway. It involves a distance
of approximately 1500 feet of Eastex frontage . The existing R-3
zoning was established in 1955. Land uses within the study area
vary from co..mmercial retail to medical to church property. The
only street affected to some degree by the proposed rezoning is
Treadway Road. The R-3 district extends approximately 125 feet into
Treadway. The Comprehensive Plan designates this area as an
Activity Corridor.

ANALYSIS

Five of these are in use as retail property. ~

ANALYSIS (cont 'd)
- The existing GC-MD zoning to the north continues north to Dowlen
Road. Singleton Road to the south is a local residential street.
- The staff feels that a transition of districts in this location
would be appropriate in order to promote implementation of the
comprehensive plan.
STAFF RECOMMENDATION
Based on exhibited land uses the staff recommends the following:
- AREA 1: Proposed for RS (Residential Single Family) . These
properties demonstrate low density residential type land use.
One is a vacant lot; the other is church property.
- AREA 2 : Proposed for NC (Neighborhood Commercial) . These
properties exhibit retail stores and medical commercial uses .

ANALYSIS
- Subject property was rezoned from R-3 to RS in January , 1982 .
- As a result of the rezoning study, the GC-MD district presently
extends a distance of 1075 feet north from the Concord Road/
Lucas intersection.
- It was noted during the R-3 studies that strip zoning along
arterials produces adverse conditions for development. The
following harmful effects of strip zoning are listed for con-
sideration:
- The accident potential of the street system is at a maximum.
The likelihood of an automobile accident is five times greater
for, strip commercial than it is for a comparable area of
planned shopping center development.
- Strip or ribbon development produces a maximum amount of
conflict area between different types of uses.
- Strip/ribbon development is geared to the automobile and has
poor accessibility for pedestrian or public transportation
facilities.
- Appearance and other aesthetic factors in strip development
are usually marginally unsatisfactory with little or no land-
scaping considerations and frequently non-existent.
- The traffic-carrying capacity and the efficiency of the
arterial street system is adversely affected.
- Traffic congestion is increased with strip or ribbon commer-
cial development.
- The mixture of homes and commercial uses that normally ac-
companies strip and ribbon commercial development depreciates
the land for both purposes.

ANALYSIS (cont ' d)
- Strip commercial development limits appreciation and often
displaces existing lower-cost housing which contributes to
reducing the availability of local moderately-priced housing.
- Speculation and inflated land values result in a large amount
of dead or unproductive vacant land.
- Business productivity is reduced with strip/ribbon develop-
ment.
- Some ribbon or strip commercial development occurs because
it is thought that the land along a major street is unsuitable
for other purposes, usually residential , rather than having a
high desirability for commercial uses .
- As residential areas are demolished or converted, residential
character and stability in the area is reduced.
- Each of the two lots in the request are single family residential
dwellings . The northern lot will have retail satellite dish
sales in combination with the residence. The remaining residence
will not presently change.
- A change to GC-MD will require installation of a 10-foot land-
scaped strip and 8-foot privacy fence.
- If the request is granted, the staff feels similar requests for
GC-MD in the vicinity of the change will be generated. This will
create a "domino effect. "
- The request is in a designated Stable Area of the comprehensive
plan. Encouragement of renewed strip zoning on Concord Road by
extension of the GC-MD district is not in conformance with the
comprehensive plan.
STAFF RECOMMENDATION
Staff recommends denial of the request for GC-MD. The recommenda-
tion is based on:
- strip zoning along arterials produces adverse conditions for
development;
- similar requests for GC-MD will be generated;
- the request is not in conformance with the comprehensive plan..

- GC-MD zoning for the subject tracts will constitute spot zoning
in that it is contrary to the comprehensive plan, incompatible
with adjacent uses , and bestows a special privilege to the owners
which is not enjoyed by other property owners in the area.
- GC-MD zoning of the subject property constitutes the start of
strip commercial development on Highway 105 which is character-
ized by an alternating checkerboard pattern of developed and
vacant properties .
- A change to GC-MD will generate future zone changes in the
immeidate area in order to establish a compatible development
pattern.
- The application is contrary to the planning principle which
states that commercial zoning should be located at major inter-
sections and not originate in mid-block.

Section 1 .
THAT Chapter 30 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts as
indicated upon the Zoning Map of the City of Beaumont, referred to
in Section 30-5B thereof, is hereby amended by changing the zoning
classification from RS (Residential Single Family District) to RM-H
( Residential Multiple Family-High Density District) property
located in the 1900 Block of Dowlen Road, Beaumont, Jefferson
County, Texas, as shown on Exhibit "A" attached hereto and made a
part hereof for all purposes, and the official zoning map of the
City of Beaumont is hereby amended to reflect such changes.
Section 2.
That in all other respects the use of the property
hereinabove described shall be subject to all of the applicable
regulations contained in Chapter 30 of the Code of Ordinances of
Beaumont, Texas, as amended.
Section 3 .
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 4.
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
Section 5.
That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.

WHEREAS, the Planning and Zoning Commission of the City of

This vehicle is to be used in the Water Utilities Department and
is a replacement for a 1969 unit currently in service. The low
bid of UEC Equipment Company of Houston in the amount of
$ 49,776. 24 did not meet specifications in the following four
areas:
1 . 32-gallon oil tank.
2 . Boom is not color-coded to determine
radius from centerline.
3 . Auxiliary outriggers do not have cartridge
holding valve. The holding valve is
attached to the cylinder with steel tubing.
4 . Oil filter does not have visual change
signal guage.
As a part of our continuing efforts to improve our bed specifi-
cations as well as continue good communication with potential
vendors, a pre-bid conference attended by all bidders was held on
June 19. All items were thoroughly discussed and agreed upon.
It is the feeling of staff that the deviations from specifica-
tions are significant and warrant disqualification of the vendor.

Subject: Purchase of Asphaltic Concrete Material
Bids were received June 25, 1984, from three vendors for approximately 4,500
tons of hot mix-cold laid asphaltic concrete for the Street Division. The
material is used primarily for pothole filling and small area patching. Bids
received were as follows:
A & H Asphalt $33.00/ton*
Troy Dodson 33.50/ton
Keown Supply 31.50/ton
*Does not meet specifications.
These materials were texted by a local laboratory to determine their densities
and conformity with bid specifications. Through these findings, costs per
cubic foot of material were calculated.
A & H Asphalt material did not meet the minimum density specification of 140
pounds per cubic foot. This specification is designed to eliminate light-
weight aggregate as the main ingredient in the asphaltic concrete mix. Light-
weight material has proven unsatisfactory for patching pot holes, especially at
intersections, due to its high polish value resulting in reduced skid resis-
tance. A & H's material weighed only 134.6 pounds per cubic foot and was dis-
qualified for this reason.
This material is used on a volume (cubic foot) rather than a weight basis;
therefore, calculations were made to develop costs per cubic foot of material
for purposes of bid evaluation. In addition, the City's cost for hauling of
the material from the vendor to the Street Division were included in the
analysis.

Subject: Speed Zone for Schools
The merger of the Beaumont and South Park Independent Districts has resulted
in changes to school hours. Effective August 23, 1984, all the schools, with
the exception of West Brook Senior Campus, will begin at 8:00 a.m. and end at
3:00 p.m. The hours for West Brook Senior Campus will be from 8:30 a.m. to
3:30 p.m. . However, the ordinance amendment will not effect this school .
Our current ordinances establish the time periods for reduced speed zones for
schools based on the starting and ending time of a school . Under our existing
system, there are three time schedules. The existing time schedules are pro-
vided below:
Schedule A 7:15 - 8:15 a.m.
2:00 - 3:30 p.m.
Schedule B 8:00 - 9:30 a.m.
3:00 - 4:00 p.m.
Schedule C 7:15 - 9:00 a.m.
2:00 - 4:00 p.m.
In order that the City Code will reflect actual school times, Section 26-24 of
the Code of Ordinances needs to be amended to eliminate Schedules A, B and C
and establish the time period for school speed zones to be from 7:15 - 8:15 a.m.
and from 2:45 - 3:30 p.m. The new time periods affects all 77 school zones.
This issue has been discussed with the appropriate school officials. They
agree with this procedure. This proposed amendment will affect the time periods
only.
It is recommended that this ordinance be adopted.

PROVIDING FOR REPEAL AND PROVIDING A
PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
That Chapter 26, Section 26-24 of the Code of Ordinances
of the City of Beaumont be, and the same is hereby amended to read
as follows:
Sec. 26-24. Decreased in school zones.
It is hereby determined upon the basis of an engineering and
traffic investigation, that the speed permitted by state law upon
those streets, or portions of streets described in the schedule
below is greater than is reasonable or safe under the conditions
found to exist upon such streets and it is hereby declared that the
prima facie speed limit upon those streets or portions thereof
described in the schedule below shall be decreased as therein stated
and the limits so delcared shall be effective at the times specified
therein when signs are erected giving notice thereof.
In accordance with this section, and when signs are erected
giving notice thereof, the prima facie speed limit shall be twenty
( 20) miles per hour in the following zones between the hours of
7 : 15 a.m. and 8 : 15 a.m. and 2 : 45 p.m. and 3 : 30 p.m. , Monday through
Friday on school days.

Section 2.
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a particular
set of persons or circumstances, should for any reason be held to be
invalid, such invalidity shall not affect the remaining portions of
this ordinance, and to such end the various portions and provisions
of this ordinance are declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
Section 5.
That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.

Subject: Award of Bid for Acoustical Tile Ceilings
In preparation of the Traffic Division move to the North Facility on Concord,
modifications to the existing buildings were required. One modification in-
cludes the installation of acoustical tile ceilings in three buildings. The
new ceilings will be located in the Administrative Building (Building 101) ;
in the Signal Shop (Building 102) ; and in the Sign Shop (Building 103) .
Bids were recently received for the installation of the acoustical tile ceilings.
The low bidder is A-1 Acoustics with a bid of $2,622.00. All the bids are sum-
marized below:

Subject: Lease Agreement Between City of Beaumont and Beaumont Riverboat
Company
The attached amendment to the Lease Agreement between the City of Beaumont
and the Beaumont Riverboat Company provides for use by the Riverboat Company
of additional space in Riverfront Park. That additional space consists of
the restroom building and the paved area directly adjacent to the restroom
building and the concession building. A site plan showing the area is at-
tached.
It is the Riverboat Company' s intention to obtain a license to sell liquor
on those premises and, by catering extension of that license, on the riverboat.
It will be necessary for the Riverboat Company to enclose and secure those
premises when liquor sales take place. The method of enclosure will be marine
rope on portable stanchions, which should be aesthetically acceptable, and
consistent with the design of other improvements on the Park. The proposed
arrangement has been reviewed by the Director of Parks and Recreation and the
Director of Community Facilities, as well as a representative of the Planning
Department; i .e. , those involved with development of and operation of the Park.
There is a consensus that this proposed lease amendment is consistent with use
of this Park and should be approved.
This issue is of some importance with respect to this expanded use of the
Park and it is my feeling that the issue should be thoroughly discussed in
Work Session.

WHEREAS, on the 22nd day of November, 1983 , the City of
Beaumont ( City) and 'the Beaumont Riverboat Company (BRC) entered
into a lease ( the "original lease" ) ; and,
WHEREAS, City and BRC desire to amend such lease to provide
for the leasing of additional property by BRC, the sale of liquor and
an amendment to rental.
NOW, THEREFORE, this amendment to the lease agreement
heretofore signed by City and BRC on the 22nd day of November, 1983,
is entered into by and between City , acting by and through its duly
authorized City Manager, and BRC, acting by and through J. Hoke
Peacock II:, its president, duly authorized, and City and BRC hereby
agree as follows:
W I T N E S S E T H
1 .
Exhibit "A" to the original lease is hereby amended to
substitute therefor a new Exhibit "A" attached hereto and made a
part hereof for all purposes.
2.
Paragraph 4 of the original. lease is hereby amended to add a
new sentence to read as follows:
"City will execute all documents necessary to assist BRC in
obtaining an alcoholic beverage permit for the property described in
Exhibit ' A' and specifically will allow the sale of alcoholic
beverages within such area. "
3.
Paragraph 7 of the original lease is hereby amended to
add a new concession percentage subcategory 3 to read as follows:
"3. Alcoholic Beverages--Ten Percent ( 10% ) of Gross Sales. "
