Subject: Change Order No. 1 to Contract for 1983 CDBG Street Rehabilitation
Project
On June 8, 1984, the City Council authorized a contract with Trotti and
Thomson Company for street rehabilitation within the Community Development
Block Grant Strategy Areas.
Eight streets were scheduled to be repaired at a cost of $70,000. The neces-
sary funds were appropriated from Community Development Block Grant. Repairs
were made to each of the target roads except Brahma Street.
A sanitary sewer along the centerline of Brahma Street from Brickyard Road
to its deadend, is included in the Separation Sewers North Project 6B, 18B
and 18 D.
City Council awarded this contract on May 1, 1984. Due to the depth of the
trench required for installation of the new sewer pipe, the street is to be
rebuilt by the contractor of the Sewer Project. This construction work has
allowed the City to delete the street rehabilitation under the Trotti and
Thomson contract. A Change Order reducing the original contract by $8,683.89,
from $70,000 to $61,316.11, has been prepared. The $8,683.89 will be re-
turned to the Communicy Development Block Grant Program for future designated
use.
It is recommended that this resolution be approved.

WHEREAS, on June 12, 1984, the City awarded construction
of the 1983 CDBG Street Rehabilitation Project to Trotti &
Thomson Company; and,
WHEREAS, Change Order No. 1 is being proposed to delete
the rehabilitation of Brahma Street from the 1983 CDBG Street
Rehabilitation Project at an estimated reduction of $8 ,683.89 ;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT :
THAT the City Manager be, and he is hereby , authorized to execute
Change Order No. 1 to the contract with Trotti & Thomson Company
deleting the rehabilitation of Brahma Street from the 1983 Street
Rehabilitation Project.

OF THE CITY OF BEAUMONT REGARDING THE SIZE
OF CERTAIN BOARDS AND COMMISSIONS; PROVIDING
FOR SEVERABILITY AND PROVIDING FOR REPEAL.
Section 1 .
That Sections 7-30 through 7-45, inclusive, and
Sections 26-3 and 26-4 , of the Code of Ordinances of the City of
Beaumont be, and the same are hereby , repealed.
Section 2 .
That Chapter II of the Code of Ordinances of the City
of Beaumont is hereby amended to add a new Section 2-11 to read
as follows:
Section 2-11:
There is hereby created a Health Advisory
Board composed of seven ( 7 ) members who are
resident citizens and voters of the City of
Beaumont. The members of the Health
Advisory Board shall be' appointed by the
City Council. Of the seven (7 ) members,
three ( 3 ) shall be appointed for a term of
two (2 ) years and four .( 4 ) shall be
appointed for a term of one ( 1 ) year ;
thereafter, the term of office of each
C board member shall be for two (2 ) years or
until a successor is appointed. Two ( 2 ) of
the members of the board shall be appointed
from the health care provider community in
the City of Beaumont; one ( 1 ) member shall
be appointed from the business community in
the City of Beaumont; one ( 1 ) member shall
be appointed from the labor community in
the City of Beaumont; one ( 1 ) member shall
be appointed from the medically indigent
population in the City of Beaumont; two (2 )
members shall be appointed from the general
public at-large of the City of Beaumont.
The City Council shall name the chairman
and vice chairman. The City Council shall
appoint one ( 1 ) of its number to serve as
an ex-officio member of the board without
vote. Vacancies shall be filled by the
City Council for the unexpired term.
Members of the board shall serve without
compensation.
The duties of the Health Advisory Board
shall be advisory in nature to the City
Council and the City Manager. Its duties,
among others, shall be to recommend policy
relating to public healtr affecting the
community; assist in the development and
implementation of a master public health
services plan for the City of Beaumont;
recommend program and service improvements;
_facilitate communications between the City
Council , the Beaumont Health Department,
the community at-large, the health care
community, targeted populations and
regulated groups.

Section 3 .
That Chapter II of the Code of Ordinances of the City
of Beaumont is hereby amended to add a new Section 2-12 to read as
follows:
Section 2-12:
The City Council shall appoint one ( 1 ) of its
number to serve as an ex-officio member
without vote to each board and commission
appointed by the City Council. Any appointed
member of any board or commission who fails
to attend three ( 3 ) regular meetings in
succession or does not attend at least seventy
percent ( 70% ) of the regularly scheduled
board meetings in a six ( 6 ) month period will
be considered to have automatically resigned
from the board or commission.

Subject: Change Order No. 1 at Alice Keith Park
In June of this year, Council awarded a contract to D & H Construction for
the installation of a Creative Playground on Alice Keith Park. The play-
ground system is composed of several woodform playground equipment pieces,
some metal climbing pieces, a pea gravel surface under the equipment, a free
form concrete border to contain the gravel , a gazebo, free form beams around
the playground, stepping blocks for access to and across the playground, and
additional support items such as a drinking fountain, benches and trash con-
tainers.
Recently, in a series of pre-construction meetings relating to this project,
the Parks and Recreation Director and the Project Landscape Architect agreed
that the back portion of the eastern berm was not needed. It is their
opinion that this section of the berm would cause severe damage, perhaps even
kill , the existing oak trees the berms would be under. It is the opinion of
the Landscape Architect that the continued existence of the oak tree is more
important to the design flow and character, visual quality and functional
use of the Creative Playground System than the back half of the eastern bern.
A site plan is attached.
A Change Order has been prepared for the following items:
1. Deletion of berms -$3,450.00
2. Addition of plaque recognizing the
Steinhagen' s contribution to Project + 127.50
Total : -$3,322.50
It is recommended that the resolution approving the Change Order be adopted.

July 31st, Council decided to hire Touche Ross and Company for preparation
of the City's annual audit.
The cost for the audit is $38,000. Funds will be available in the 1985 budget
for this purpose.

Subject: Crockett Connector Condemnation
On July 12, 1983, City Council authorized contracts for appraisal services for
the Crockett Connector Project. The Project provides for improvement of
Crockett/Liberty/Laurel between Main and Forrest Streets. This includes two-
way traffic on the Crockett Street portion, which transitions into the Liberty/
Laurel one-way pair. The flow of traffic will eventually be reversed on the
one-way pair, with Liberty being westbound and Laurel being eastbound.
There are eleven parcels in this Project. Parcel 11, illustrated by the at-
tached exhibit, is located on the northeasterly corner of Pearl and Crockett
Streets. It is a 2,380.67 square-foot tract of land out of Lots 90 and 91
of the Original Townsite of Beaumont. The owner, George Wise, has rejected
our appraised value and negotiations have reached an impasse.
It is recommended that a resolution, authorizing the Legal Department to
institute eminent domain proceedings, be approved.

WHEREAS, the City Council of the City of Beaumont deems
it necessary that Crockett, Liberty, and Laurel Streets in the City
of Beaumont, Jefferson County , Texas be located, constructed,
widened, extended and maintained; and,
WHEREAS, said City Council has found that a public
necessity exists requiring the location, construction, widening,
extension and maintenance of said street on the hereinafter
described property; and,
WHEREAS, the City Council deems it necessary to acquire
the hereinafter described interests in and to the hereinafter
described property for said location, construction, widening,
extension and maintenance of said street, and has found and
determined that said interests in and to the hereinafter described
land is suited for such purposes and that it is necessary to
acquire same for said purposes; and,
WHEREAS, the City of Beaumont, through its duly
authorized representatives, has negotiated in good faith with the
owners of the hereinafter described land and has been unable to
agree with such owners of such property as to the fair market value
thereof and damages, if any ,
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY OF BEAUMONT :
THAT the City Attorney , be and he is hereby authorized and directed
to file or cause to be filed against all owners of the following
parcel of land, and all claimants of any interest therein,
proceedings in eminent domain to acquire fee title for said

the three small pickups for a total price of $18,276. This is a total expendi-
ture of $32,790.70, with funds available within the 1984 Fleet Replacement
Budget.
It is recommended this resolution be approved.

Subject: Annual Contract for Zinc Metaphosphate
Elids were received from three vendors for an annual contract for zinc meta-
phosphate for the Water Production Plant. The bids are as follows:

Shannon Chemical Company 1,292.60/ton
It is recommended that the bid of Shannon Chemical Company, at $1,292.60/ton,
be accepted. Funds are available in the inventory account. This chemical
will be used in the treatment of the City's water supply at the Surface Water
Treatment Plant. Our yearly usage of this chemical , which is utilized in
corrosion control within the lines, is approximately 20/tons year.
It is recommended that this resolution be approved.

Subject: Crockett Street Right-of-Way Acquisition
Council approved hiring of consulting engineers on October 12, 1982, for the
Crockett Connector Project to connect the downtown area with Phelan Boulevard
west of Interstate 10. Phase I of this project begins at Main Street and
ends on Forrest Street, and includes eleven parcels to be purchased for the
right-of-way. Appraisals and negotiations have been completed on two additional
parcels as follows:
1. Parcel 7 - 35,912.80 square feet. $161,606.43
This parcel will be used for right-of-way
as well as future development of a down-
town off-street parking area. We are in
the process of finalizing a plan for this
parking area and will bring it to Council
in Work Session within the next month.
2. Parcel 12 - 5,294.28 square feet. 40 622.00
Restripe parking lot and adjust underground
sprinkler system. 1,310.00
The owner has also requested continued use
of the area for parking until needed by the
City. We have no objection to this and re-
commend adoption of a License Agreement
between the City and First City National
Bank for this purpose.
Total : $203,538.43
Monies are available for this within the Capital Improvement Program under
Liberty/Laurel , Phase I.
It is recommended that this resolution be approved.

ORDERING THEIR REPAIR OR DEMOLITION;
PROVIDING FOR SEVERABILITY AND
PROVIDING FOR PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT :
Section 1 .
That the City Council of the City of Beaumont hereby
finds and declares the buildings located at:

each to be a public nuisance in that said buildings violate Chapter
14, Section 14-50 of the Code of Ordinances of the City of Beaumont
and are for want of repairs, or by reason of age or dilapidated
condition, likely to cause or promote fires that would endanger
persons or property.
1 Section 2 .
In accordance with Article XVII, Section 2 of the
Charter of the City of Beaumont, Sections 10-2 and 14-52 of the
Code of Ordinances of Beaumont, Texas, and Section 103.4 of the
Standard Building Code, it is hereby ordered that the owner or
owners of the following buildings either repair or demolish and
remove said structures within thirty ( 30) days of the date of the
passage of this ordinance:

If such action is not taken, request shall be made that the City
Council authorize appropriate City officials to demolish and remove
said structures at the expense of the City of Beaumont on account
of the owner thereof and such expense shall be assessed as a

Section 3 .
In accordance with Article XVII, Section 2 , of the
Charter of the City of Beaumont, Sections 10-2 and 14-52 of the
Code of Ordinances of Beaumont, Texas and Section 103. 4 of the
Standard Building Code, it is hereby ordered that the owner or
owners of the following described buildings demolish and remove
said structures within thirty ( 30) days of the date of the passage
of this ordinance:

deemed guilty of a misdemeanor and said buildings shall be
demolished and removed at the expense of the City of Beaumont on
the account of the owner thereof and such expense shall be assessed

situated and a lien shall exist for such special tax, which lien
shall be foreclosed and said expense be recovered by the City of
Beaumont as in the case of any other debt and lien in favor of the
City of Beaumont.
Section 4 .
The following structures are hereby ordered to be
demolished and removed by the City of Beaumont on the account of
the owners thereof and such expense of demolition and removal shall
be assessed as a special tax against the property upon which the
buildings are situated. The following structures were theretofore
declared to be public nuisances in violation of Chapter 14 ,
Section 14-50 of the Code of Ordinances of the City:

Section 5.
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 6 .
That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.
