Subject: Interstate 10 North/Gladys Avenue Rezoning Study
GENERAL INFORMATION

Boundaries of this study are Gladys, Longfellow, Interstate 10,
and all properties within 1000 feet to the north of Gladys and
within 500 feet south of Gladys. Existing R-3 zoning is original
from 1955. Land use north of Gladys is the Longfellow Apartments;
south of Gladys land uses include a gasoline station, doctors ' ,
dentists and insurance offices. Existing zoning is GC-MD south of
the study and RS across Longfellow to the west. The comprehensive
plan designates the area. in the study as an Activity Corridor.

office nature. Some, but not all, have times of peak traffic
generation. On-street parking lacks adequate area at peak times.

for all other properties in the study.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission recommended approval of the following:

- AREA 2 : NC (Neighborhood Commercial) zoning for all other
properties in the study.
The vote was 4 to 1.
The City Manager recommends approval of the ordinance.

TEXAS, AND IN PARTICULAR THE BOUNDARIES OF
THE ZONING DISTRICTS AS INDICATED UPON THE
ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING
THE ZONING FROM R-3 (MODIFIED TWO FAMILY
AND MULTIPLE DWELLING DISTRICT) TO RM-H
(RESIDENTIAL MULTIPLE FAMILY - HIGH
DENSITY) AND NC ( NEIGHBORHOOD COMMERCIAL
DISTRICT) ON PROPERTY LOCATED ON THE WEST
SIDE OF INTERSTATE 10 NORTH AT GLADYS
AVENUE; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL AND PROVIDING A
PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
THAT Chapter 30 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts as
indicated upon the Zoning Map of the City of Beaumont, referred to
in Section 30-5B thereof , is hereby amended by changing the zoning
classification from R-3 (Modified Two Family and Multiple Dwelling
District) to RM-H (Residential Multiple Family-High Density) and NC
( Neighborhood Commercial District) for property located on the west
ride of Interstate 10 North at Gladys Avenue, as shown on Exhibit
"'A" attached hereto and made a part hereof for all purposes, and
the official zoning map of the City of Beaumont is hereby amended
to reflect such changes.
Section 2 .
That in all other respects the use of the property
h.ereinabove described shall be subject to all of the applicable
regulations contained in Chapter 30 of the Code of Ordinances of
Beaumont, Texas, as amended.
Section 3 .
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
,particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance nance are declared to be
severable.
Section 4.
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only .

That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.

in grocery. Existinq zoning is original from 1955 . Land use

Subject: Delaware/10th Rezoning Study
GENERAL INFORMATION
All properties in the study exhibit original R-3 zoning from 1955 .
Two principle properties in the study exhibit single family resi-
dential use and a nursing home. Surrounding land use abutting the
study properties is generally single family residential. A non-
conforming grocery store is located on the immediate northwest
corner outside of the study area. Delaware is designated as a
major arterial ; it has a 20-foot pavement width. 10th Street is
a local residential street; it has a 20-foot pavement. The compre-
hensive plan designates the area as a Conservation and Revitaliza-
tion Area.

ANALYSIS
The pattern of single family development in the area indicates the
stable nature of the area. One vacant tract west of the study
boundaries remains as the only undeveloped parcel of land in the
vicinity. The narrow pavements of both Delaware and 10th Street
do not lend themselves to an increase in intensity of zoning or
land use.

Subject: Delaware/11th Street Rezoning Study

BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
THAT Chapter 30 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts as
indicated upon the Zoning Map of the City of Beaumont, referred to
in Section 30-5B thereof, is hereby amended by changing the zoning
classification from R-3 (Modified Two Family and Multiple Dwelling
District) to NC ( Neighborhood Commercial District) for property
located approximately 125 feet east of 11th Street on the north
side of Delaware, Beaumont, Jefferson County, Texas, as shown on
Exhibit "A" attached hereto and made a part hereof for all
purposes, and the official zoning map of the City of Beaumont is
hereby amended to reflect such changes.
Section 2 .
That in all other respects the use of the property
hereinabove described shall be subject to all of the applicable
regulations contained in Chapter 30 of the Code of Ordinances of
Beaumont, Texas, as amended.
Section 3 .
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 4 .
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
Section 5 .
That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.

CONDITIONS FOR APPROVAL: A Specific Use Permit shall be issued only if
all of the following conditions have been found:
1) That the specific use will be compatible with and not injurious to the
use and enjoyment of other property, nor significantly diminish or
impair property values within the immediate vicinity;
Development in vicinity is progressively increasing.
Abutting property values will experience no adverse
effects.
2) That the establishment of the specific use will not impede the normal

ENTITLED AN ORDINANCE ISSUING A SPECIFIC
USE PERMIT FOR A HYDROBLASTING SERVICE
LOCATED AT 7011 FANNETT ROAD.
WHEREAS, the Planning and Zoning Commission of the City of
Beaumont considered the issuance of a specific use permit for a
hydroblasting service on property located at 7011 Fannett Road,
Beaumont, Jefferson County , Texas to Glenn Mabry , property owner, his
legal representatives, successors, and assigns for that certain
property hereinafter described; and,
WHEREAS, the City Council is of the opinion that the
:issuance of such specific use permit is in the best interest of the
City of Beaumont and its citizens, subject to the hereinafter
described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That all conditions necessary for issuance of a specific
use permit have been met and the specific use permit for a
hydro-blasting service on property located at 7011 Fannett Road,
Beaumont, Jefferson County, Texas, in accordance with Section 30-26
and Section 30-40 of the Code of Ordinances of the City of Beaumont,
as amended, is hereby granted to Glenn Mabry , property owner, his
legal representatives, successors and assigns for that certain tract
of land described in Exhibit "A" attached hereto and made a part
hereof for all purposes.
Section 2.
That the specific use permit herein granted is expressly
issued for and in accordance with each particular and detail of the
site plan attached hereto as Exhibit "B" and made a part hereof for

ANALYSIS
- Surrounding land uses are predominantly single family residences
with some apartments . The GC-MD district is thus incorrect
for the area.
- The request is contrary to the intent of the CM district which
is to act as a buffer between industrial and general commercial
districts.
- Heisig and Oregon are both local residential streets with narrow
pavement widths , unsuitable for commercial uses . i
CM zoning is contrary to the planning principle which states i
that the intensity of zoning districts should transition away
from and decrease in intensity as the distance increases from
major arterials.
- The request will require additional zone changes in the sur-
rounding area in order that a compatible development pattern
can result.
- The change will transition at front and side lot lines - a condi-
tion which maximizes incompatibility.

CONDITIONS FOR APPROVAL: A Specific Use Permit shall be issued only if
all of the following conditions have been found:
1) That the specific use will be compatible with and not injurious to the
use and enjoyment of other property, nor significantly diminish or
impair property values within the immediate vicinity;
Predominant surrounding land use is medium to low density
residential . Continued viability of residential area is
impaired by establishment of incompatible commercial uses .
2) That the establishment of the specific use will not impede the normal
and orderly development and improvement of surrounding vacant property;
Potential future development of vacant GC-MD zoned lots
will not be affected by proposal.
3) That adequate utilities, access road, drainage and other necessary
supporting facilities have been or will be provided;
Existing utilities are present and adequate for proposal .
4) The design, location and arrangement of all driveways and parking spaces
provides for the safe and convenient movement of vehicular and pedestrian
traffic without adversely affecting the general public or adjacent
developments ;
Driveway and parking area are to be constructed in compliance
with Urban Transportation Department specifications .
5) That adequate nu;sance prevention measures have been or will be taken

in Section 30-5B thereof, is hereby amended by changing the zoning

on Exhibit "A" attached hereto and made a part hereof for all
purposes, and the official zoning map of the City of Beaumont is
hereby amended to reflect such changes.
Section 2.
That in all other respects the use of the property
hereinabove described shall be subject to all of the applicable
regulations contained in Chapter 30 of the Code of Ordinances of
Beaumont, Texas, as amended.
Section 3 .
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 4 .
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
Section 5 .
That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.

use and enjoyment of other property, nor significantly diminish or
impair property values within the immediate vicinity;
Surrounding retail and commercial uses are compatible with
proposed use and will not be affected by it.
2) That the establishment of the specific use will not impede the normal
and orderly development and improvement of surrounding vacant property;
Proposed use is in an area of comparable development without
vacant property in evidence .
3) That adequate utilities, access road, drainage and other necessary
supporting facilities have been or will be provided;
All utilities and drainage are present and adequate for
service to the proposed use .
4) The design, location and arrangement of all driveways and parking spaces
provides for the safe and convenient movement of vehicular and pedestrian
traffic without adversely affecting the general public or adjacent
developments;

Beaumont considered the issuance of a specific use permit for an
eating establishment on property located at 3315 Avenue A,

certain property hereinafter described; and,
WHEREAS, the City Council is of the opinion that the

WHEREAS, the Planning and Zoning Commission of the City of
Beaumont considered the issuance of a specific use permit for a
drinking establishment on property located at 2898 Fannett Road,
Beaumont, Jefferson County, Texas, to Clifford J. LeBlanc,prospective
lessee, his legal representatives, successors , and assigns for that
certain property hereinafter described; and,
WHEREAS, the City Council is of the opinion that the
issuance of such specific use permit is in the best interest of the
City of Beaumont and its citizens, subject to the hereinafter
described conditions;
NOW , THEREFORE, BE IT ORDAINED BY THE

Section 1.
That all conditions necessary for issuance of a specific

Subject: Amendment to Section 30-37.M. of the Zoning Ordinance
The Board of Adjustment has requested an amendment to Section 30-37.M. of
the Zoning Ordinance changing the time period for applications that are
approved for variances from the existing 90-day limit to one year.
The Board felt that since it frequently becomes necessary to delay the con-
struction of some of the projects approved by the variances, in some cases
as much as six months, the applicant has an unnecessary burden in meeting
the 90-day limitation.
For this reason, the Board has recommended that the one extended time period
begin upon the owner' s receipt of notification by the City that his variance
has been approved. From that point, the property owner has one year to
make an application for and receive a building permit. Staff recommended
approval of this amendment and the Planning Commission recommended approval
by a vote of5to0.
It is recommended that this ordinance be adopted.

Section 1 .
That Chapter 30, Section 30-37(m) of the Code of
Ordinances of the City of Beaumont be, and the same is hereby ,
amended to read as follows:
Section 30-37(m) . Validity.
If an application is granted by the board, all
permits necessary for the prosecution of the
work must be obtained within one ( 1 ) year and
construction completed within the time
established by the building code. All previous
applications approved by the board for which
building permits have not been issued shall be
valid only if a building permit is obtained
within one ( 1 ) year after receipt of a written
notice of the requirements of this section and
construction must be completed within the time
limits set forth in the building code. Written
notice shall be considered received on the date
such notice is mailed to the person, firm or
corporation who received the variance addressed
to the address of such person, firm or
corporation as the same shall appear in the
records of the planning department relating to
the granting of such application.
Section 2.
That if any section, subsection, sentence, clause or
phrase of this ordinance or the application of same to a particular
set of persons or circumstances should for any reason be held to be
invalid, such invalidity shall in no wise affect the remaining
portions of this ordinance, and to such end the provisions of this
ordinance are declared to be severable.
Section 3 .
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.

Subject: Purchase of Aerial Lift Truck
On June 11, 1984, six bids were received for an aerial lift truck. This
truck is used in the Traffic Division for the installation and maintenance
of traffic signals. The estimated replacement cost for this vehicle was
$30,000 and was included in the fiscal year 1984 Fleet Replacement budget.
Of the six firms to submit bids, there were two "no bids" because they
could not meet the minimum dielectric rating specifications. The dielectric
rating allows a vehicle to operate adjacent to electrical power lines with-
out being grounded. This is a safety feature of the aerial lift. One
other firm also "no bid" due to the cut-off dates for 1984 models having
already passed. A summary of the other three bids is provided below:

Bids were received on June 11, 1984, for the purchase of clamps and Coupl-
ings for the Water Distribution Division for their inventory. These clamps
and couplings are utilized both in repair of existing lines and in installa-
tion of new residential and commercial services.
Bids were received from seven vendors and all bids were on an "all or none"
basis, in order to eliminate the potential problems involved in dealing with
up to 23 separate vendors. The low bid for this purchase was Golden Tri-
angle Pipe and Water Supplies of Beaumont. These bids ranged from
$29,958.96 to $54,658.80 in price.
It is recommended that the bid of Golden Triangle Pipe and Water Supplies,
Inc. , be accepted.

Subject: Purchase of Portable Generators
Bids were received April 30, 1984, for Contract 8E, which consists of
furnishing two portable generators and 23 manual electrical power transfer
switches. This is the 14th and final project to be bid under Phase I of
the City/Federal Sanitary Sewer Improvements Grant. The equipment is re-
quired to comply with provisions of our Environmental Protection Agency

Wastewater Discharge permit and the Federal 75/25 Grant requirements.
The generators will be used to provide power for operating lift stations
during Gulf States Utilities power outages. The sewer system currently
contains 32 lift stations, nine of which are already equipped with manually
operated power transfer switches.
Bids were advertised for 45 days. Three companies, Saucier and Sons Enter-
prise, Inc. , Hubbard Electric Company, and Stewart and Stevenson Services,
Inc. , picked up bid specifications. The only bid received, submitted by
Stewart and Stevenson Services, Inc. , is for $93,113, which is $82,520 be-
low our preliminary engineering estimate of $175,623. The bid has been re-
viewed by Environmental Protection Agency/Texas Department of Water Resources
and they recommend acceptance. Local funds are available from the 1982 bond
sale for our share of the project cost.
It is recommended that this resolution be approved.

In accordance with State Municipal Solid Waste Management Regulations, two feet
of cover material is required to be applied to the old landfill site. It is
anticipated that we will need to rent five 14-yard dump trucks for hauling
material to the Pine Street Landfill from the Lafin Road site. The rental of
these trucks are needed due to the lack of available equipment in the City.
Approximately 75,000 cubic yards, or 5,357 loads, will be transported to the
Pine Street site at an estimated cost of $144,643. Bids were received May 14th
for five 14-cubic yard dump trucks with operators, for the hauling of the
cover. The lowest bid received was from Donald Barber Dump Truck Service of
Vidor, in the amount of $27 per load, $27 per hour, with operator, and $4,320
per month. All specifications were met. The bids are as follows:

Subject: Installation of Creative Playground on Alice Keith Park
The Steinhagen Foundation has assisted the Parks and Recreation Department and
the Parks and Recreation Advisory Committee in publishing a first-ever gift
catalog. The Foundation donated some $2,500 for this expense. In addition,
they are also the first group to make a contribution towards a project identi-
fied within the gift catalog. Some $40,000 of Foundation monies has been de-
dicated to the installation of a creative playground on Alice Keith Park. The
creative playground system on Alice Keith Park is composed of several wood-
form playground equipment pieces, some metal climbing pieces, a pea gravel
surface under the equipment, a free form concrete border to contain the gra-
vel , a gazebo, free form beams around the playground, stepping blocks for
access to and across the playground, and additional support items such as a
drinking fountain, benches and trash containers. Bids recently taken on this
project are shown below:

In order to secure sufficient funds for this project, it will be necessary for
the City to budget an additional $8,200 to allow the project to be built with
all its components.

The 1984 budget contains the provision that all General Revenue Sharing
monies, some $1,500,000, will be transferred in to the General Fund of the
City. As you remember, this extraordinary action was necessary in the cur-
rent budget to insure a positive fund balance of some $712,000. Adjustments
to the General Fund could be made by Council during the year, dependent upon
improvements in our fiscal condition. While we budgeted as revenue some
$1,500,000 from Federal Revenue Sharing, our estimate from the Office of
General Revenue Sharing for fiscal year 1984 is $1,781,377.
Since January of this year, the City has appropriated some $243,500 of that
$281,377 not included in our conservative fiscal year 1984 budget. The
monies were appropriated for four trash trucks for Sanitation and a one-ton
truck with power crane for the Water Department.
As of this date, approximately $37,500 remains available for allocation to
other needs. We would suggest that $8,200 be appropriated from this source
into the General Improvement Fund for General Park Improvements which will
allow us to construct the creative playground with all options. The neces-
sary budget amendments can be prepared and submitted with our end-of-year
adjustments.
It is recommended that this resolution be approved.

The counterweight fly system of the Julie Rogers Theatre is the series of
line sets in the fly loft (cables, ropes, weights, pipe, etc. ) used for
temporary installation of scenic elements for dramatic, operatic and dance
productions. Bids were taken May 14, 1984 from the following companies:
Katem Theatricals; Illinois $28,000
TRS, Inc. ; Minnesota 23,339
Whitman and Associates, Inc. ;
Florida 24,965
The system, installed new as a part of the renovation of the Theatre, is
sized for a capacity of 42 line sets; structural steel beams, guide tracks
and locking rail positions sufficient for that number were provided as a
part of the renovation. However, only 25 of the 42 line sets were pur-
chased and installed. The remaining 17 were apparently deleted as a cost-
saving measure.
Those 17 line sets are needed to bring the counterweight fly system up to
capacity. Six of the new line sets will be required to hang overhead and
rear wall sections of the proposed acoustical shell , and the remaining
number will enable us to fully present such scenic element intensive
events as "Amadeus". There are sufficient funds available for this purchase
in the Theatre Renovation Account.
It is recommended that the bid of TRS be accepted.

Subject: Reassignment of Contract
Sanitary Sewer Improvements Contract 16, Separation Sewers - South, Environ-
mental Protection Agency Grant #C-481254-04, was awarded to C & P Equipment
Corporation September 20, 1983, in the amount of $1,463,914.35. The scope
of the contract consisted of installing some 21,200 feet of 6-inch through
15-inch gravity sanitary sewer lines to separate existing combined sanitary
sewer and storm drains in the south-central part of the City.
By the first of February, 1984, the contractor had installed approximately
4,400 feet of sewer. However, none of the work was complete, such as:
incomplete manhole construction, incomplete restoration of damaged storm
sewer and catch basins, incomplete base/pavement replacement, damage to pri-
vate property and general clean-up along all areas of construction. Fre-
quent counseling with the contractor by the engineer and the City had little
effect.
A formal meeting was held with the contractor, engineer and City on
January 25, 1984, to resolve the problems of clean-up and incomplete work.
Violations of the contract were pointed out to the contractor. Although
the meeting appeared fruitful , no progress was made in the field.
The following is the sequence of events since the January 25th meeting:
February 16, 1984 - contractor was notified by letter
that he was in violation of the contract and suspension
of primary line construction would result if the de-
ficiencies were not corrected.
February 29, 1984 - contractor was notified that he
was to suspend construction of all primary sanitary
sewer lines until deficiencies in previously-per-
formed work were corrected and clean-up was performed
to within 1,000 feet of new construction.
April 12, 1984 - contractor was notified that he could
proceed with primary construction.
On or about April 13, 1984 - contractor requested
street cut permit from Department of Urban Transporta-
tion. Urban Transportation tentatively approved permit
with condition that contractor have new street surface
placed on completed work prior to start of new construc-
tion on April 18, 1984.

April 18, 1984 - Contractor did not have new street
surface on completed work; Department of Urban Trans-
portation cancelled street cut permit.
April 19, 1984 - contractor issued letter to City of
Beaumont claiming "Abandonment of Contract" by City.
April 30, 1984 - meeting scheduled with contractor
and City to attempt to get project moving. Contractor
cancelled meeting.
May 7, 1984 - meeting held between contractor, City
and engineer. Results of the meeting were:
a. Contractor could resume work on project
as soon as new street surface or temporary
surface was placed on completed work.
b. Contractor had option to work as many
crews as necessary, as long as clean-up
was kept within 1,000 feet of each crew.
c. City would show project as being in sus-
pension from April 19, 1984 through
May 14, 1984, to allow contractor time to
restart construction operation.
d. Contractor was to reach decision on project
and respond to engineer by May 9, 1984.
e. Contractor was to make arrangements with
his subcontractors and suppliers to satisfy
approximately $109,000 in claims against
the contract.
May 14, 1984 - a meeting was held with the contractor,
engineer and city. Contractor requested subcontracting
the remaining portion of the contract to Sterling
Utility Construction, Inc. , second low bidder on the
project. After considerable discussion between the
City and engineer, it was decided that it would be
in the best interest of all parties to notify the
contractor's surety company of the situation.
June 13, 1984 - a meeting was held with the surety
company attorney, representatives of Sterling Utility
Construction, Inc. , the City and the engineer. The
following agreement was reached:

a. Surety company will assume responsibility
for work in place and debts of C & P Equip-
ment Corporation.
b. Sterling Utility Construction, Inc. agrees
to finish project within the allotted 228
days remaining on the contract for the
remaining amount of compensation in the
original contract, $1,220,978.91.
c. The City agrees to recommend to Council as-
signment of the contract to Sterling
Utility Construction, Inc. Contract time
will be suspended until assignment is made;
contractor will then have ten days to
move in and start work.
The discussions with all the parties have been long, complex and difficult.
It is our feeling that the proposed assignment of the contract, at no ad-
ditional cost, is in the best interest of the City. It will be necessary
for Council to authorize the City Manager to execute an assignment of the
contract.
It is recommended that this resolution be approved.

Subject: Resolution Supporting Rebuilding of State Highway 87
At the request of several Councilmembers, a resolution is attached supporting
the rebuilding of Highway 87.
During 1980 and 1983, Hurricanes Allen and Alicia caused extensive damage to
ten miles of various parts of Highway 87. As a result, the only coastal
route linking the major cities of Port Arthur and Galveston is unsafe for
travel .
Several other problems have occurred because of the damage:
1. Indigent persons seeking medical attention from hospitals
in the Galveston area must take an alternate route, which
is longer.
2. A drop in tourism in the area, causing a loss of as much
as 80 percent revenue to merchants along the highway.
3. One business has closed because of the loss of revenue
(Geneva's Seafood Restaurant) and other businesses are
threatened with the same problem.
The John Gray Institute recognizes and supports the need to rebuild Highway
87. It sees Highway 87 as an important part of this area' s economic di-
versification goal , citing it as a vital part in promoting tourism to the
Golden Triangle.
Jefferson County, the City of Port Arthur, Galveston and several other City
governments support any rebuilding efforts.
State Senator Carl Parker has petitioned U. S. Congressmen Jack Brooks and
Charles Wilson, along with Senators John Tower and Lloyd Bentsen, for
federal funds to reconstruct this vital stretch of road.
It is recommended that this resolution be approved.

WHEREAS, Hurricane Allen in 1980, and Hurricane Alicia in
1983 substantially destroyed State Highway 87 , the only coastal
route between the major cities of Port Arthur and Galveston, making
said Highway unsafe for travel; and,
WHEREAS, the State Department of Highways and Public
Transportation, pressed for funds necessary to provide highways for
the second largest state of the union, has learned that an
objection has been raised by the Fish and wildlife Service as to
the funding from federal funds of the reconstruction of Highway
87; and,
WHEREAS, State Highway 87 is an integral part of the "Hug
the Coast" network of highways running from Canada to Mexico that
has played an important role in making the great American coast
visible to its citizenry; and,
WHEREAS, although the Fish and wildlife Service may be
correct that relatively few permanent residents reside along the
closed portion of State Highway 87, the census data does not reveal
the reality that many citizens of Beaumont and Jefferson County, of
all income brackets, own, rent and enjoy summer vacation houses at
such locations as High Island, Gilchrist, and Crystal Beach, and
that such citizens of the City of Beaumont, and Jefferson County
are greatly inconvenienced by the closure of State Highway 87;
and,
WHEREAS, census data further does not reflect that many
restaurants and other businesses in Sabine Pass, which is now
:incorporated into the City of Port Arthur in Jefferson County,
have, for many years, drawn a substantial portion of their income
from permanent and vacationing residents of High Island, Gilchrist,
Crystal Beach and even Galveston, and that these businesses are
substantially damaged by the closure of State Highway 87 ; and,
WHEREAS, the closing of State Highway 87 has had a
substantial impact upon recreation in South Jefferson County, and
has already resulted in the loss of airboat service in Sea Rim
State Park , thus depriving the citizenry of Beaumont and Jefferson
County and elsewhere the opportunity to see marshland life in its
natural habitat; and,
WHEREAS, there is an economic and recreational
relationship between Beaumont/Port Arthur and Galveston that is
dependent upon Highway 87 and the points in between connected by
Highway 87; and,
WHEREAS, the emergency created by the foregoing factors
is a real and present danger to the health, economy , and recreation
of the aforesaid citizens of Beaumont and Jefferson County that is
not diminished by the passage of time, because the citizens who
rely upon State Highway 87 for transportation to and from Galveston
and areas in between are innocent victims of the closing of State
Highway 87 and the danger and alarm caused to the economy , health,
and recreation of these citizens continues to grow with each day
said Highway remains c losed;

NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT in light of the points cited above, the City Council of the
City of Beaumont is supporting the State Department of Highways and

Service to reconsider and withdraw its objection to the
;reconstruction of State Highway 87 on the grounds that a real and
present emergency does exist.

Subject: Amendment to Texas Department of Health Contract
The Health Department has been successful in securing two additional nursing
positions with funding from the State Health Department, starting July 1st.
These two positions will allow the Health Department to significantly increase
its maternal and child health services to indigent populations for its child
health screening program. Follow-up visits cannot be scheduled for seven to
nine months following the initial visit. Newborns are currently seen at two
months of age instead of the recommended one month.
These positions will not only reduce the backlog and maintain an acceptable
case load of maternal and child health patients, but will also enable exist-
ing staff nurses to free up their time to impact other service areas, in-
cluding chronic disease screening for senior citizens and more appropriate
community outreach.
Funds for these positions would be added to the existing contract for state
assistance with the Texas Department of Health. The amendment to the con-
tract being requested will increase State funding by $37,212 on an annualized
basis; at present, we receive $26,947. State support for these positions
can be expected to continue in future years.
It will be necessary for Council to approve, at a later date, budget amend-
ments increasing our staffing level by two positions and the revenue and
expense items by the appropriate amount. These will be presented later this
,year.
It is recommended that this resolution be approved.

Subject: Rental Rehabilitation Program
The purpose of the Rental Rehabilitation Program is to help states and local
governments operate a cost-effective rental property rehabilitation program
as part of the community development and revitalization strategies. The De-
partment of Housing and Urban Development has allocated funds in the amount
of $96,400 for the Rental Rehabilitation Program for fiscal year 1985. In
addition, Section 8 Existing Certificates will be made available based on a
ratio of one for every $5,000 allocated. The Public Housing Authority will
make application independently for the Section 8 Existing Certificates.
The funds will be used to reduce the costs of financing repairs so that
projects are financially feasible. The rehabilitation loans will be made
in the Community Development Strategy Area (Census Tracts 7, 8, 9, 10, 15,
17, 18, 22 and 23 and portions of 19 and 20) and the existing Community
Development Block Grant Housing Rehabilitation staff will administer the
program. The program is designed for the rehabilitation of privately-owned,
residential , rental properties which require moderate rehabilitation (costs
may not exceed $10,000 per unit) . The maximum loan amount per unit will
not exceed 50 percent of the rehabilitation, with the remainder of the
costs supplied from private sources. The funds will be used for physical
rehabilitation. Thus, no administrative costs will be charged to the re-
habilitation loan. The initial occupancy of the unit, after the rehabili-
tation, will be by a lower income (50 percent of the area median income)
resident and the City will place an emphasis on rehabilitating large-family
units (two bedrooms or more) .
In addition, the program allows for no specific rent controls. Decisions
on rent increases will solely be the province of the investor in response
to economic considerations and market conditions. Therefore, the program
will operate in lower-income neighborhoods where after rehabilitation,
market rents will not exceed Section 8 Fair Market Rents.
The Section 8 Existing Certificates will be used by the Public Housing
Authority to assist eligible tenants (i .e. low income persons) residing in
the units at the time of rehabilitation to remain in the units after the re-
habilitation or to place tenants on the Public Housing Authority's waiting
list for assistance into the vacant, rehabilitated units. The City and the
Public Housing Authority will execute a written agreement to administer

Section 2-11:
There is hereby created a Health Advisory
Board composed of seven ( 7 ) members who are
resident citizens and voters of the City of
Beaumont. The members of the Health
Advisory Board shall be appointed by the
City Council. Of the seven (7 ) members,
three ( 3 ) shall be appointed for a term of
two (2 ) years and four (4 ) shall be
appointed for a term of one ( 1 ) year;
thereafter, the term of office of each
board member shall be for two ( 2 ) years or
until a successor is appointed. Two ( 2 ) of
the members of the board shall be appointed
from the health care provider community in
the City of Beaumont; one ( 1 ) member shall
be appointed from the business community in
the City of Beaumont; one ( 1 ) member shall
be appointed from the labor community in
the City of Beaumont; one ( 1 ) member shall
be appointed from the medically indigent
Population in the City of Beaumont; two ( 2 )
members shall be appointed from the general
public at-large of the City of Beaumont.
The City Council shall name the chairman
and vice chairman. The City Council shall
appoint one ( 1 ) of its number to serve as
an ex-officio member of the board without
vote. Vacancies shall be filled by the
City Council for the unexpired term.
Members of the board shall serve without
compensation.
The duties of the Health Advisory Board
shall be advisory in nature to the City
Council and the City Manager. Its duties,
among others, shall be to recommend policy
relating to public health affecting the
community; assist in the development and
implementation of a master public health
services plan for the City of Beaumont;
recommend program and service improvements;
facilitate communications between the City
Council , the Beaumont Health Department,
the community at-large, the health care
community , targeted populations and
regulated groups.

That Chapter II of the Code of Ordinances of the City
of Beaumont is hereby amended to add a new Section 2-11 to read as
follows:
Section 2-11:
The City Council shall appoint one ( 1 ) of its
number to serve as an ex-officio member
without vote to each board and commission
appointed by the City Council. Any appointed
member of any board or com-mission who fails
to attend three ( 3 ) regular meetings in
succession or does not attend at least eighty
percent ( 80% ) of the regularly scheduled
board meetings in a six (6 ) month period will
be considered to have automatically resigned
from the board or commission.

The City Manager or his designee shall
monitor attendance and maintain attendance
records for boards and commissions and notify
the City Council of resignations under this
section.
Section 4 .
That Chapter II, Section 2-5 of the Code of Ordinances
of the City of Beaumont be, and the same is hereby , amended to read
as follows:
There is hereby created an airport advisory
committee composed of ten ( 10) members who
are resident citizens and qualified voters
of the City of Beaumont. The members of the
airport advisory committee shall be
appointed by the city council. Of the ten
( 10) members first appointed, five ( 5 ) shall
be appointed for a term of one year and five
( 5 ) shall be appointed for a term of two ( 2 )
years. Thereafter, the term of office of
each member of the airport advisory
committee shall be two ( 2 ) years or until a
successor is appointed. The chairman and
vice chairman shall be appointed by the City
Council. Vacancies shall be filled by the
City Council for the unexpired term.
Members of the airport advisory committee
shall serve without compensation and all
members of said committee shall be subject
to removal at the will and pleasure of the
City Council. The duties of the airport
advisory committee shall be advisory in
nature and it shall advise the City Council,
the City Manager and Director of Traffic and
Transportation concerning the needs of the
Beaumont Municipal Airport and other airport
matters and policy . The airport advisory
committee shall meet as required by the
chairman or the Director of Urban
Transportation.
Section 5 .
That Chapter II, Section 30-39(A) (2 ) of the Code of
Ordinances of the City of Beaumont be, and the same is hereby ,
amended to read as follows:

Section 30-39(A) (2 ) :
The historical landmark commission shall be
appointed by resolution of the City Council
and shall serve for a period of three ( 3 )
years, except that of the nine (9 ) members
first appointed, three ( 3 ) shall be
appointed for a term of one year, three ( 3 )
for a term of two (2 ) years, and three ( 3 )
for a term of three ( 3 ) years. The chairman
and vice chairman shall be appointed by the
City Council. Vacancies shall be filled for
the remainder of the unexpired term of any
member whose place becomes vacant for any
cause.
Section 6 .
That Chapter_ II, Section 2-10 of the Code of
Ordinances of the City of Beaumont be amended to read as follows:
Section 2-10:
There is hereby created a senior citizens
advisory commission composed of fourteen ( 14)
members who are resident citizens and
qualified voters of the City of Beaumont.
Members shall be senior citizens and others
knowledgable and interested in the concerns
of senior citizens. Members of the senior
citizens advisory commission shall be
appointed by the City Council. Of the
fourteen ( 14) members first appointed, five
(5 ) shall be appointed for a term of one
year, five ( 5 ) shall be appoin'ted for a term
of two ( 2 ) years, and four ( 4 ) shall be
appointed for a term of three (3 ) years;
thereafter, the term of office of each member
of the senior citizens advisory commission
shall be three ( 3 ) years or until a successor
is appointed. The chairman and vice chairman
shall be appointed by the City Council.
Vacancies shall be filled by the City Council
for the unexpired term. Members of the
senior citizens advisory commission shall
serve without compensation and all members of
said commission shall be subject to removal
at the will and pleasure of the City Council.
The duties of the senior citizens advisory
commission shall be advisory in nature, and
it shall advise the City Council and the City

Manager in matters affecting senior
citizens' interests and assist in planning
and policy making for* related activities.
These duties will include, but not be
limited to assisting in the development of
plans and policies for the Best Years
Center and other programs and facilities
provided by the city for senior citizens.
The senior citizens advisory commission
shall meet monthly or as required by the
chairman or the City Manager.
Section 7 .
That Chapter II, Section 2-87 of the Code of
Ordinances of the City of Beaumont be amended to read as follows:
Section 2-87:
There is hereby established a community
development advisory committee to be
composed of twenty-one ( 21 ) members who are
resident citizens of the city. The members
of the community development advisory
committee shall be appointed by the City
Council for two-year terms. The City
Council shall name one ( 1 ) of the members
as chairman and one ( 1 ) as vice chairman.
Vacancies shall be filled by the City
Council for the unexpired term. Members of
the committee shall serve without
compensation.
Section 8 .
That Chapter II, Section 13-66 of the Code of
Ordinances of the City of Beaumont be amended to read as follows:
Section 13-66:
There is hereby created a clean community
commission composed of twenty-one ( 21)
members who are residents, citizens and
qualified voters of the City of Beaumont.
Members of the clean community commission
shall be appointed by the City Council and
the chairman shall be selected by the City
Council. Vacancies shall be filled by the
City Council for the unexpired term.
Members of the clean community commission

shall serve without compensation and all
members of said commission shall be subject
to removal at the will and pleasure of the
City Council. Members shall be appointed
for two-year terms.
Section 9 .
That Chapter II, Section 20-2 ( a) of the Code of
Ordinances of the City of Beaumont be amended to read as follows:
Section 20-2 ( a) :
There is hereby created a parks and
recreation advisory committee to be composed
of fourteen ( 14) members who are resident
citizens and qualified voters of the city.
The members of the parks and recreation
advisory committee shall be appointed by the
City Council. Of the initial fourteen ( 14)
members appointed, seven (7 ) shall be
appointed for a term of two ( 2 ) years; and
seven ( 7 ) shall be appointed for a term of
one ( 1 ) year; thereafter, the term of office
of each member of the parks and recreation
advisory committee shall be for two ( 2 ) years
or until a successor is appointed. The City
Council shall name one of the members of the
parks and recreation advisory committee as
chairman for two ( 2 ) years. Vacancies shall
be filled by the Council for the unexpired
term. Members of the parks and recreation
advisory committee shall serve without
compensation. All members of the parks and
recreation advisory committee shall be
subject to removal at the will and pleasure
of the Council.
Section 10.
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.

Section 11 .
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.

Subject: Award of Bid for Waterproofing Two Buildings
The original master plan for our new service facility called for the re-
location of the Drainage and Street Divisions. This relocation would re-
quire additional building and modifications to the existing facilities for
the sign shop. Since the Streets and Traffic activities are related, it
was decided to move Drainage to the new service facility. In addition, it
was recommended that the Street and Traffic Divisions be housed within one
facility to increase productivity and consolidate the number of Urban Trans-
portation Department facilities. However, because of necessary reductions
in the scope of the project, it is now not feasible to construct an addi-
tional building at the new service facility. Therefore, we have been re-
novating and remodeling our older existing location on Concord. In order
for the Street and Traffic Divisions to operate from the north facility,
certain modifications are required of the existing buildings.
One of the proposed modifications is to waterproof Buildings 101 and 102.
'These modifications are required prior to Traffic moving to the north
facility (see attached drawing) .
The only firm to submit a bid was Texas Coatings Application and Water-
proofing. Eight other firms "no bid" the project. These firms were con-
tacted to determine why they "no bid". The majority of firms did not
:submit a bid because of no prior experience in the use of one of the
materials specified. These firms had experience in waterproofing masonary
buildings, similar to Building 101, but were not experienced in water-
proofing metal buildings, similar to Building 102, with polyurethane foam.
Since both buildings were bid at the same time in an attempt to reduce the
project cost, these firms "no bid" because they were not capable of water-
proofing Building 102 as specified. One other firm "no bid", due to their
current work load.
It is recommended that the bid be awarded to Texas Coatings Application
and Waterproofing in the amount of $31,824. The estimated price for this
work is $30,800. Funds are available for all modifications in the Urban
Transportation operating budget. Transfer of funds to the operating ac-
counts will be made at a later date.
It is recommended that this resolution be approved.

Subject: Proposed Ordinance against Prostitution
Attached is an ordinance for your consideration. One of the prime targets
on the list of "top priorities" for the City of Beaumont, set by Council in
1983, is to suppress the Forsythe Street problem. A City ordinance has been
proposed to prohibit the act of loitering for the purpose of prostitution.
It provides Beaumont law officials with the right to cease any action which
is considered "intentionally, knowingly or recklessly loitering in or near
any thoroughfare, street, highway, or place open to the public in a manner
and under circumstances manifesting the intent of inducing, enticing, solicit-
ing or procuring another to commit an act of prostitution or assignation".
In addition to enforcing this ordinance, it is the intent of the Beaumont
Police Department to form a temporary small task force to make initial
arrests after the ordinance is enacted.

1) That the specific use will be compatible with and not injurious to the

impair property values within the immediate vicinity;

tensity and general range of uses with the proposed request
and will not be affected.
2) That the establishment of the specific use will not impede the normal
and orderly development and improvement of surrounding vacant property;

3) That adequate utilities , access road, drainage and other necessary
supporting facilities have been or will be provided;
All utilities are present and adequate for the proposed
use.
4) The design, location and arrangement of all driveways and parking spaces
provides for the safe and convenient movement of vehicular and pedestrian
traffic without adversely affecting the general public or adjacent
developments;
Existing parking and driveways are adequate for the proposed
use.
5) That adequate nu4sance prevention measures have been or will be taken

PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
THAT Chapter 30 of the Code of Ordinances of Beaumont,
Texas, and in particular the boundaries of the zoning districts as
indicated upon the Zoning Map of the City of Beaumont, referred to
in Section 30-5B thereof , is hereby amended by changing the zoning
classification from R-3 (Modified Two Family and Multiple Dwelling
District) to NC ( Neighborhood Commercial District) for property
located at 3390 Harrison (rear) , Beaumont, Jefferson County, Texas,
as shown on Exhibit "A" attached hereto and made a part hereof for
all purposes, and the official zoning map of the City of Beaumont
is hereby amended to reflect such changes.
Section 2.
That in all other respects the use of the property
hereinabove described shall be subject to all of the applicable
regulations contained in Chapter 30 of the Code of Ordinances of
Beaumont, Texas, as amended.
Section 3 .
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 4 .
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only .
Section 5.
That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.
