Subject: Payment of Expenses Incurred in Municipal Election
Under established practice, Jefferson County has billed the City for expenses
related to the combined Municipal and School elections held on April 7th of
this year. The cost of $4,756.05 covers voting machine rental , printing ex-
pense, voting cards and personnel cost for counting votes.
While the City will pay the total expense, we will bill two-thirds of the
expense to the two school districts, who are still operating under separate
budgets. Our final expense will be $1,585.35.
It is recommended that the resolution be approved.

Subject: Appointments to the Health Facilities Development Corporation
A Health Facilities Development Corporation was established by Council re-
solution on August 9, 1983. Such public non-profit corporations have been
established to provide a means of financing the cost of health facilities.
They are empowered to issue bonds to be retired from revenues derived from
the operations of facilities so financed.
The Board of Directors of the corporation has consisted of the five members
of the City Council . Although Council now contains seven members, the by-
laws of the Corporation have not yet been amended to provide for the addition
of the two new positions. Because there are Health Facilities projects pend-
ing, the attorneys for the developers have requested that the by-laws not be
amended until bonds are issued for the pending projects.
:[t is recommended that the attached resolution be adopted, appointing
G. Wayne Turner and Nell Weisbach to replace Evelyn Lord and Bill Cox on
the Board. As soon as possible, the by-laws will be amended to provide for
two new Board members.

Subject: Authorization for Jefferson County Mosquito Control District to
Operate Airplanes over City
Each year, the Mosquito Control District requests the governing bodies of the
different communities in Jefferson County to furnish a waiver permitting the
Mosquito Control planes to fly low over the territory under their jurisdiction.
The Jefferson County Mosquito Control District has requested that the City
Council authorize the City Manager to sign a letter granting permission for
the district to operate the airplaces over the City for mosquito control
purposes. Federal Regulations places the responsibility of maintaining all
records and of complying with all the rules and the regulations upon the
operator of the aircraft. This file is open at all times for inspection.
It is recommended that the resolution attached, granting the City Manager
authorization to sign the letter, be approved.

Subject: Payment for Relocation of Light on Cottonwood Park
The Council authorized on February 21, 1984, park improvements on Weiss,
McLean and Cottonwood Parks. These improvements consist of a creative play-
ground in each park, which includes woodform play equipment, sidewalks,
benches, landscaping, grading, pea gravel surfaces, gazebos, drinking foun-
tains, trash containers and wood decks. In addition, a basketball court at
McLean Park will be renovated and a sidewalk at Weiss Park will be built.
The award for the work was $124,405. Eighty percent of the project is funded
by an Urban Parks and Recreation Recvery Program (UPARR) grant from the
National Park Service. The Texas Parks and Wildlife Department and the City
of Beaumont's Community Development Block Grant Program are each contributing
an additional 10 percent.
As a part of ongoing construction, a light pole and service line require re-
location on Cottonwood Park. Inasmuch as Gulf States Utilities owns the pole
and service, it will be necessary to authorize the moving of this fixture by
Gulf States at a cost of $1,123.59. Monies for this are available within the
project budget's contingency line item.
It is recommended that the resolution be approved.

CONDITIONS FOR APPROVAL: A Specific Use Permit shall be issued only if
a 1 of the following conditions have been found:
1) That the specific use will be compatible with and not injurious to the
use and enjoyment of other property, nor significantly diminish or
impair property values within the immediate vicinity;
All new construction will be single story buildings and
similar in character with surrounding commercial development
on Phelan Boulevard.
2) That the establishment of the specific use will not impede the normal
and orderly development and improvement of surrounding vacant property;

3) That adequate utilities, access road, drainage and other necessary
supporting facilities have been or will be provided;

ENTITLED AN ORDINANCE ISSUING A SPECIFIC
USE PERMIT FOR PROFESSIONAL OFFICES
LOCATED AT 6800 PHELAN BOULEVARD.
WHEREAS, the Planning and Zoning Commission of the City of
Beaumont considered the issuance of a specific use permit for
professional offices in an RM-H ( Residential Multiple Family -High
Density) District on property located at 6800 Phelan Boulevard,
Beaumont, Jefferson County, Texas to Carl Kohler, engineer for owner,
Richard Guseman, his legal representatives, successors, and assigns
for that certain property hereinafter described; and,
WHEREAS, the City Council is of the opinion that the
issuance of such specific use permit is in the best interest of the
City of Beaumont and its citizens, subject to the hereinafter
described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That all conditions necessary for issuance of a specific
use permit have been met and the specific use permit for professional
offices at 6800 Phelan Bou 1 levard, Beaumont, Jefferson County, Texas,
in accordance with Section 30-26 and Section 30-40 of the Code of
Ordinances of the City of Beaumont, as amended, is hereby granted to
Carl Kohler, engineer for owner, Richard Guseman, his legal
representatives, successors and assigns for that certain tract
described in Exhibit "A" attached hereto and made a part hereof for
all purposes.
Section 2.
That the specific use permit herein granted is expressly
issued for and in accordance with each particular and detail of the
site plan attached hereto as Exhibit "B" and made a part hereof for
all purposes.

Subject: Amending Section 21.9 of the Code of Ordinances Relating to Personal
Leave and Short-term Disability Leave
In February of this year, the City Council discussed extensively in a Work
Session a Coordinated Employee Health Services Program. A copy of the ex-
planation of this program is attached to this letter. As of this date, all
aspects of the program, with the exception of certain aspects related to
health insurance modifications, have been adopted and approved by Council
action. At the meeting on March 20th of this year, Council did approve a modi-
fication to our Personal Leave and Short-term Disability Leave Program, the
provisions of which are summarized below:
Category I - Personal Leave. In this category, it is proposed
that each regular, full-time employee of the City would earn
leave on the basis of 2.15 hours per each bi-weekly pay period.
This roughly translates to seven days per year. Within this
category, leave can be accumulated, up to a maximum of 20 days
per year, or 160 hours, for the employee with less than ten
years of service. After ten years of service, an employee may
accumulate an additional 32 hours of personal leave for each
year of service over ten years. This accumulation is limited
to 720 hours of leave. Any employee who leaves the City in
good standing and has more than one year of service would be
paid for all accumulated personal leave. Within this category,
personal leave can be used for illness, or upon the supervisor's
approval , for any purpose that the particular employee may desire.
Category II - Short-term Disability Leave. Within this category,
each eligible employee would earn 3.69 hours of short-term dis-
ability at each bi-weekly pay period. This approximates 12 days
per year. Accumulation in this category is unlimited, and usage
of hours within this category is limited to time absent caused
by an illness of over ten consecutive days for the same illness.
Provisions for the transfer of hours accumulated under the old sick leave
Policy to the new Personal Leave/Temporary Disability policy are also in-
cluded within the ordinance. They would be as follows: all hours ac-
cumulated under our old policy shall be retained for each employee. The
first 120 hours shall be credited to Personal Leave as defined in the new
policy; the next 240 hours shall be credited to Short-term Disability, as
dE!fined in the new policy. All accumulated hours in excess of 480 hours

shall be credited under the following formula: 25 percent to the Personal
Leave category and 75 percent to the Short-term Disability category. In
the event that the amount of such leave to be credited to Personal Leave
exceeds the amount which may be accumulated, the balance shall be credited
to the Short-term Disability category. Finally, provisions are included
within the ordinance to insure that City employees who have more than 15
years of service with the City, who are 60 years of age or older, or who
retire under our existing TMRS System, or the Beaumont Fireman's Pension
Fund, would be paid for all accumulated Personal Leave and sick leave
accumulated prior to April 1 , 1984. This provision, in effect, insures
retention for these individuals of the current retirement benefit for
the payment of 720 hours of sick leave upon their termination.
This program was discussed extensively with all employees by use of a video
tape presentation as well as employee handouts and question and answer
periods. Within these discussions, it became apparent that certain omis-
sions had occurred in the original amendment that would affect existing em-
ployees who are not members of TMRS. While it was the intent of the
ordinance to insure that all individuals who currently have 720 hours of
sick leave accumulated would retain that amount as of April 1, 1984, and
would be paid for that amount upon retirement, it was discovered that,
in a few cases, the language of the amendment was inadequate to protect
current levels. Therefore, we are proposing an amendment which will allow
those individuals who are 62 years of age or over, who have five years or
more of service on April 1, 1984, and who have currently 720 hours of
sick leave accumulated, to retain that accumulation which would then be paid
to them upon retirement.
In the category of Personal Leave, we also discovered in extensive discussions
with numerous employees and employee groups, that certain modifications would
be necessary in this particular category. These modifications will clarify
that the cap on Personal Leave accumulation will operate in the same fashion
as our existing policy and vacation pay. This will allow an employee to ac-
cumulate, within a 12-month period, Personal Leave hours in excess of the
maximum cap that can be carried over from year to year. All time earned in
excess of the cap must be utilized within the employee year that is defined
as beginning with the date of hire. Time not used within this period will
be lost on the next year's anniversary date. In addition, for those em-
ployees who are currently employed by the City and are at their maximum cap,
it will be necessary to administratively establish a six-month period within
which all employees will be given an opportunity to utilize that tine that
is being accumulated in excess of their cap. This will allow those employees
who have dates of hire in the near future to effectively get within the
intent of the ordinance.

We are also developing an injury leave policy which will be presented to
Council within the next several weeks. It will be the intent of this policy
to establish a period of time that would be granted to each and every em-
ployee in the event of an on-the-job injury.
It is recommended that the proposed amendment be approved.

Subject: Coordinated Employee Health Services
One of the five top goals targeted by the City Council recently has been to
improve employee morale. Obviously, there are many employee relations work
activities that could be considered to accomplish this overall goal . The
City staff is recommending the development of a Coordinated Health Services
program as the first staff effort to improve employee morale. One of the
benefits of this staff choice is that both the City and the employee will
eventually save money they are currently spending on health services.
In an organization that is oriented toward services as opposed to manufactur-
ing, the implementation of such programs to improve employee morale and pro-
ductivity will ultimately affect the quality of services provided to the
citizens.

The City expense in the area of health care costs has been skyrocketing,
as evidenced by the fact that our costs have risen from $2,106,000 in 1981-82
to an estimated $2,975,000 in 1983-84. Our actuarial estimates for the ire
mediate future continue to project a rate of increase of 20 percent, consi=
derably higher than the overall rate of inflation.
Over the past several years, it has become increasingly apparent that
achieving and maintaining good health among employees will bring short and
long-term benefits to the employer and employees. This achievement of good
health goes far beyond the traditional sick leave policy and insurance pro-
grams addressing illness only. Rather, it entails providing a comprehensive
and coordinated approach to employee health services with component parts
that serve to complement each other.
Such an approach has been developed for consideration by the City staff.
The key program components are:
1. An Employee Wellness Program
2. An Employee Assistance Program
3. Expanded City Health Services
4. A Personal Leave Policy
5. Modification to the Health Insurance Package

All five program elements provide a comprehensive approach to employee health
that should save the employee and the City health dollars, provide additional
health services not now available, and focus on prevention and early inter-
vention as the best approach to help employees "achieve and maintain" good
health.
Implementation of this coordinated plan will require the City to commit re-
sources to fund a full-time City Doctor and a full-time Occupational Health
Nurse. It will also require contracting with a screening and diagnostic
agency to provide the Employee Assistance Program activities.
For the past several years, the City has operated its Health Department with
a part-time Health Authority. This has posed severe limitations on the City's
capability to provide required medical services to on-going medical and
nursing clinics. Establishing a full-time City Doctor position will enable
us to name this individual as the City's Health Authority to provide that
full-time medical coverage to existing and potential Health Department Clinic
activities, as well as providing medical coverage for Wellness Program acti-
vities and the medical services (such as City physicals and emergency first-
aid treatment for on-the-job injuries) to City employees.
An Employee Wellness Program. The first link in a comprehensive
and coordinated employee health services program falls in the
area of prevention. An Employee Wellness Program is designed to
convince people they are both responsible for their own health
and also able to control their personal risk levels. A typical
Wellness Program offers health screening activities to all em-
ployees, educational and training sessions to raise knowledge
levels and awareness, specific intervention activities to assist
employees in changing health behaviors, and employee support
groups to reinforce newly-learned behaviors. Participating em-
ployees will choose his/her own personal health goals to achieve
during the year.
Where individuals are identified as high risk for various health
concerns, more specific and intense follow-up testing and screen-
ing will be available.
All employees will have the opportunity to work on developing new
habits to deal with the major health risk factors: overweight,
lack of proper nutrition, lack of adequate exercise, high stress
levels , smoking, alcohol and substance misuse, and poor safety
practices. A Wellness Program precisely documents an employee's
overall level of health and fitness and motivates him to take
steps to overcome personal risk levels.

This program will basically be funded out of existing City budgets,
particularly the City Health Department's current operation. It
will operate as a volunteer program run by and for City employees.
Task forces of City employees will manage program offerings. Com-
munity resources will be utilized where practical . This program
will rely heavily on the proposed City Doctor and Occupational
Health Nurse positions outlined later in this proposal .
National surveys show that organizations in the private sector
which have implemented Wellness Programs have an average annual
health care cost savings per employee of $209, or approximately
a 20 percent savings per employee over traditional health care
costs.
An Employee Assistance Program. The second link within this
program effort will be the establishment of an intervention
mechanism intended to provide employees with the means of
securing assistance in areas such as substance abuse and stress
where these personal problems are substantially affecting the
employee's ability to perform his job. Most major employers
in the area currently have an Employee Assistance Program; many
other companies are in the process of developing such programs.
An Employee Assistance Program is a professional diagnostic
and referral program provided by an employer so that employees
and their families may seek help for personal problems. Be-
cause of confidentiality of treatment, the need for employees
to trust the system, and the need for special counseling and
diagnostic skills, this program should be provided by an out-
side organization on a contract basis. It is estimated that
this cost will be approximately $25,000 per year.
Our preliminary investigation in this area has demonstrated that
there are several such programs already in existence. Of equal
importance, acceptance of such a program is widespread if and
when management is sensitive enough to take the necessary steps
to involve as many employees as possible in the development of
the program. It is our intent to utilize a joint management/
labor committee as an interview and selection team for the pur-
pose of locating a firm that is best suited to develop a program
for City employees. Several preliminary discussions have already
taken place and a broad outline for the interview process is
being developed. Any program for Beaumont will emphasize super-
visor training in dealing with troubled employees, self-referral
by employees and will include a mandate of absolute confidentiality.

Expanded City Health Services. The third linkage in the program
involves the expansion of the City's ability to provide medical
services to its employees. Any long-range effort in health de-
livery must include some degree of medical support. A Doctor and
Occupational Health Nurse added to existing Health Department
staff will be of benefit in providing direct medical services, in
addition to providing assistance in achieving our goals of illness
prevention and early detection. This program expansion will be
involved in active administration of the "Wellness" effort, ex-
pansion of pre-employment physicals, provision of required annual
physicals for police and fire personnel , emergency first-aid
treatment for on-the-job injuries, and monitoring and improving
our already existing Workers Compensation Program.
Personal Leave Policy, A fourth linkage in the program is an
innovative effort by the City staff to change the perception of
sick days from something provided by the employer to personal
leave earned by the employee. The implementation of a "personal
leave" program that allows an employee to earn seven days per year
which can be used for any need of the employee, including sickness,
which can be accumulated from year to year to a defined number of
days and that allows the employee on retirement or separation in
good standing to be paid for such accumulation is , we feel , a
positive step in program improvement.
This program will also contain a short-term disability leave pro-
vision within which days are accumulated at a rate of one day
per month. The maximum accumulation allowed under the disability
leave program will be unlimited. Leave charged against this
category will be used in the event of an illness of over ten con-
secutive days.
In addition, within the important area of employee benefits, the
staff will investigate the entire issue of long-term disability
income protection for employees. Such a program is intended to
fill the gap between the expiration of a short-term disability
program and an individual 's eligibility for retirement and/or
Social Security benefits.
The various levels of coverages and the cost implication of this
benefit will be carefully analyzed. If this component proves
to be feasible, a further report will be forthcoming.

It is intended that this innovative program will cut down on the
current heavy usage of sick leave as an employee entitlement,
while at the same time rewarding employees with "personal leave"
days which may be taken for any reason.
Modification to the Health Insurance Package. The fifth and final
link in this program involves revisions and alterations in our
existing benefit package within our health insurance program.
These changes in the "benefit mix" are designed to achieve cost
reductions in our program by providing additional benefits (in-
centives) for having medical services performed "outside" the
hospital . This cost reduction effort, in this first phase, is ac-
complished by increasing the benefits paid for pre-admission test-
ing for out-patient surgery, by controlling whenever possible
weekend admissions, by encouraging second opinion surgery and by
providing new benefits to cover home health care, and hospice
care for the care for the terminally ill .
This entire modification in our insurance program has been de-
veloped in close coordination with the administrators of our self-
insurance program as well as representatives of the Texas Municipal
League. Projected annualized savings of $180,000 accruing to our
fund have been provided by actuaries representing these two groups.
While it is realized that additional studies will need to be made to determine
other additional methods to control skyrocketing health insurance costs, these
measures will provide a significant savings to the City while not imposing an
increasing cost burden on the employee. At the same time, the program will
provide for payment for additional services not now available.
This entire effort in coordination of Employee Health Services is targeted to-
ward a reduction in the rate of increase in the cost of health services to
City employees by putting together a mix of programs that is aimed at employee
involvement and participation. While it is a fact that we propose a long-
range commitment involving additional funding for the various programs in-
volved, industry statistics support the fact that increases in health care
costs can best be controlled by preventive programs as compared to after-the-
fact treatment/payment programs. A study by the Prudential Insurance Company
of Houston of its 1,500 employees showed that direct savings from salary paid
out during sickness totaled $204 per employee (or a $265,200 savings to the
company). A 1981 survey of 1,500 of the largest employers in the United
States showed that organizations offering preventive health programs to
efmployees had an average annual health care cost per employee of $806.
This compared with the average per employee cost of $1,015 for all companies,
representing a $209 savings per employee or an approximate 20 percent dif-
ference.

Summary. Targeted goals for estimated medical claim expenditures under the
City's insurance program are being developed to document savings to be de-
rived from implementation of these new program elements, as compared to es-
timated cost increases under the existing program. This effort will be
coordinated with our underwriters in Houston. A report will be forthcoming.
Currently, we estimate on an annual basis that our savings will approximate
the following amounts:
I. City Health Services. An approximate $42,000 reduction will
be realized with the use of additional medical personnel .
The expanded staff will allow us to treat many on-the-job
injuries which are now handled by outside medical programs.
II. Wellness and Employee Assistance Program. Based on all
available information, we feel that a first-year average
savings of $100/employee can be realized through emphasis on
the Wellness and Employee Assistance Program. This amounts
to an annual savings of $130,000.
III. Health Insurance Modification. Based on information pro-
vided by our underwriters , we project a reduction in medi-
cal costs of $180,000/year as a result of program modifica-
tions.

AND (C) DEALING WITH PERSONAL LEAVE AND
SHORT-TERM DISABILITY LEAVE; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL.
Section 1 .
That Chapter 21 of the Code of Ordinances of the City of
Beaumont is hereby amended by repealing Section 21-8( 3 ) .
Section 2 .
That Chapter 21, Section 21-9(A) is hereby amended to
read as follows:
Section 21-9(A)
(A) Each regular full-time employee of the
city shall earn personal leave which may be
used for illness or, upon the supervisor' s
approval, for any purpose. Each eligible
employee shall earn 2. 15 hours of personal
leave each biweekly pay period. No employee
who is paid for fewer than 80 hours in a
biweekly pay period shall earn personal leave
for that pay period.
Unused personal leave may be accumulated
based upon length of service. An employee
with fewer than eleven ( 11) years' service may
accumulate a maximum of 160 hours personal
leave. An employee with eleven ( 11 ) or more
years' service may accumulate an additional 32
hours personal leave for each year of service
over ten ( 10) . An employee may not accumulate
more than 720 hours of personal leave.
Effective October 1 , 1984, an employee may
not carry more than the maximum accumulation
of personal leave hours provided for herein
past any anniversary of his date of hire by
the City of Beaumont. An employee with more
than one year of service who leaves employment
in good standing shall be paid for all
accumulated personal leave upon termination.
Section 3 .
That Chapter 21 , Section 21-9( C) is hereby amended to
read as follows:
�iection 21-9( C)
(C) Employees who have accumulated sick
leave under Section 21-9 of the Code of
Ordinances as it existed prior to the
effective date of this ordinance shall retain
such accumulated sick leave. All such
accumulated sick leave, not to exceed 120
hours, shall be credited to personal leave
pursuant to Section 21-9(A) of this ordinance.
All such accumulated sick leave in excess of
120 hours, but not to exceed 360 hours, shall
be credited to short-term disability leave
pursuant to Section 21-9( B) of this
ordinance. All such accumulated sick leave in
excess of 480 hours shall be credited as
follows: 25% to personal leave pursuant to
Section 21-9(A) of this ordinance and 75% to
short-term disability leave pursuant to
Section 21-9( B) of this ordinance; provided
that the total amount of such accumulated sick
leave credited to personal leave shall not
exceed the total amount of personal leave
which may be accumulated pursuant to Section
21-9(A) of this ordinance. If the amount of
such accumulated sick leave to be credited to
personal leave exceeds the amount of personal
leave which may be accumulated, the balance
shall be credited to short-term disability
leave pursuant to Section 21-9( B) of this
ordinance.
City employees with five ( 5 ) or more years
of creditable service who are sixty-two (62)
years of age or older, or who retire under the
Texas Municipal Retirement System or the
Beaumont Firemen' s Pension Fund, shall be paid
upon termination for all accumulated personal
leave and for all sick leave accumulated prior
to April 1 , 1984 , that is credited to
short-term disability leave pursuant to this
section; provided that the total payment shall
not exceed 720 hours.

Section 4 .
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a particular
set of persons or circumstances, should for any reason be held to be
invalid, such invalidity shall not affect the remaining portions of
this ordinance, and to such end the various portions and provisions
of this ordinance are declared to be severable.
Section 5 .
All ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only .

Subject: Sanitary Sewer Improvements
This is the second of nine projects to be bid under Phase II of our City/
Federal Sewer Improvement Project. A description of all nine projects was
furnished to you as a part of the April 17th meeting.
Bids were received April 9 1984
p on Contract 6B, 18B and 18D, Separation
Sewers-North and Sanitary Sewer replacement on Lucas, Concord and Magnolia
Street areas. A project map is attached. Estimated cost for the project
was $1,076,617. The bids ranged from $1,211,430 to $1,879,468. While there
is an overage of some $134,813 over the original engineering estimate, the
total project budget of $13,800,000 contains some $1,380,000 as a contingency
against this type of occurrence. It should be noted that we have been ex-
periencing underruns on projects and that this is our first experience with
a bid over original estimate. We will be monitoring the situation closely
in future bids on this project. This is an Environmental Protection Agency
Federal participation 75/25 project.
Work to be performed under this contract consists of installing 9,879 feet
of sanitary sewer, sizes 12" , 15", 18" and 21"; and 5,473 feet of storm
sewer, sizes 18 24" , 36" and 42". The proposed storm sewer will be used
to separate storm water from an existing combined sewer in Grand Street.
In this case, it was less expensive to construct a new storm sewer instead
of a sanitary sewer.
It is recommended that a contingent award, subject to Texas Department of
Water Resources and Environmental Protection Agency approval , be made to
the low bidder, John Bankston Construction and Equipment Rental , Inc. for
the amount of $1,211,430. The bids are as follows:

During the preparation of the current year operational budget, discussions
were held with the Fire Chief concerning the necessary replacement of a pumper
located at our No. 10 Fire Station at Washington Boulevard and Municipal Drive.
The pumper in question was a 1970 Ward La France 1,000 gallon-per-minute pumper.
This particular station serves an area of the City where dependability and ef-
ficiency of operation are extremely critical . This engine responds to the
Medical Complex, the IH-10 area, and the Southern Pacific Railroad Yard.
Because of our budgetary problems in this year, it was decided that the re-
placement of this pumper could be deferred for one additional year. and that
the purchase could be made as a part of the 1985 budget. Due to the fact that
the lead time for replacement of this specialized equipment is approximately
ten to twelve months, we have prepared specifications and have taken bids on
this unit. Bids were received from:

Bids were recently received for an annual contract on PVC and rigid metal
conduit as well as nipples, couplings, elbows, straps, adapters and boxes
needed for the installation and maintenance of traffic signals, school
flashers and freeway lights.
Six companies submitted quotes on 40 separate items. The bids are broken
down into two broad catagories: rigid steel conduit and related accessories
and PVC conduit and related accessories. In order to secure the best possible
prices, all purchases were selected on an item-by-item basis. Any deviation
from low bid occurred because items were not compatible with current equip-
ment, or because prices quoted were not firm for one year. Because of the
great numbers of items in the bid tabulation, we are attaching a copy of the
analysis of the bids done by departmental staff.

Subject: Purchase of Radio Equipment
A bid was received from General Electric of Houston, Texas, for the purchase
of radio equipment for the City for this fiscal year. These bids were re-
ceived on the same specifications that we have used for the past several
years for our radio equipment. Bid packets were mailed to twelve prpspective
bidders and only General Electric Company responded. Last year, under these
same bid specifications, our radio equipment was purchased from the General
Electric Company, with Motorola submitting a bid. No local companies have
submitted bids in the last five years.
All of the radio equipment was provided for in the current year's operating
budget and these units will be used in the following departments. As a
point for comparison, we have listed prices paid last year for the same units.

Departmental staff was concerned that only one bid was received on this impor-
tant purchase. However, it was found that the radios purchases three years ago
from Motorola have not been performing satisfactorily, especially in the
Police Department. Motorola representatives have stated that no bid was sub-
mitted because the company has withdrawn their radio meeting specifications from
the market for redesign. We do not anticipate this problem to recur in the
future.

BE IT ORDAINED BY THE CITY OF BEAUMO NT:
Section 1 .
That the City Council of the City of Beaumont hereby
finds and declares the buildings located at:
3430 W. Euclid 1139 Evalon
1149 Evalon 1238 Evalon(Rear)
1520 Evalon 680 Forrest
1415 Grand 1415 and 1425 Grand
( Rear - Garage)
1425 Grand 2250 Johnson
2095 Lela 2196 Liberty
4120 E. Lucas 2480 Monroe
2060 Pear 2255 Railroad
each to be a public nuisance in that said buildings violate Chapter
14, Section 14-50 of the Code of Ordinances of the City of Beaumont
and are for want of repairs, or by reason of age or dilapidated
condition, likely to cause or promote fires that would endanger
persons or property.
Section 2.
In accordance with Article XVII, Section 2 of the
Charter of the City of Beaumont, Sections 10-2 and 14-52 of the

Code of Ordinances of Beaumont, Texas, and Section 103.4 of the
Standard Building Code, it is hereby ordered that the owner or
owners of the` following buildings either repair or demolish and
remove said structures within thirty ( 30) days of the date of the
passage of this ordinance:
680 Forrest 1415 Grand
1425 Grand 2095 Lela
If such action is not taken, request shall be made that the City
Council authorize appropriate City officials to demolish and remove
said structures at the expense of the City of Beaumont on account
of the owner thereof and such expense shall be assessed as a
special tax against the property upon which the buildings are
situated.
Section 3.
In accordance with Article XVII, Section 2 , of the
Charter of the City of Beaumont, Sections 10-2 and 14-52 of the
Code of Ordinances of Beaumont, Texas and Section 103. 4 of the
Standard Building Code, it is hereby ordered that the owner or
owners of the following described buildings demolish and remove
said structures within thirty ( 30) days of the date of the passage
of this ordinance:

1520 Evalon 1415 and 1425 Grand
(Rear - Garage)
2250 Johnson 2196 Liberty
4120 E. Lucas 2480 Monroe
2060 Pear 2255 Railroad
If such action is not taken, the owners of said buildings shall be
deemed guilty of a misdemeanor and said buildings shall be
demolished and removed at the expense of the City of Beaumont on
the account of the owner thereof and such expense shall be assessed
as a special 'ax against the property upon which said buildings are
situated and a lien shall exist for such special tax, which lien
shall be foreclosed and said expense be recovered by the City of

Beaumont as in the case of any other debt and lien in favor of the
City of Beaumont.
Section 4 .
The following structure is hereby ordered to be
demolished and removed by the City of Beaumont on the account of
the owner thereof and such expense of demolition and removal shall
tie assessed as a special tax against the property upon which the
building is situated. The following structure was heretofore
declared to be a public nuisance in violation of Chapter 14 ,
Section 14-50 of the Code of Ordinances of the City:

Section 5.
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 6 .
That any person who violates any provision of this
ordinance shall, upon conviction, be punished as provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.
