January 27, 1984 Council Letter 279 Honorable Mayor and Members of City Council Subject: Rezoning Study for Property in the 3200 Block of French Road and All Properties on Carlisle Drive from Concord Road to French Road At its joint public hearing held January 16, 1984, the Planning Commission and the City Council reviewed a study prepared by the Planning staff. The study boundary begins approximately 140 feet west of Redwood and extends northwest to Pinkston and north to Concord Road. The southern boundary is French Road; the western boundary is 450 feet east of Eastex Freeway. The study includes all of the French High School and athletic fields , as well as Eugene Fields Elementary School There are seven single-family resi- dences on French Road. Two of the tracts in the study have producing oil wells in place. The larger of these two tracts is a 5-acre tract with ac- cess to Pinkston on the north and French Road on the south. All existing R-3 (Modified Two Family and Multiple Dwelling) zoning is original from 1955. The Comprehensive Plan designates the area in the study as a stable area. Based on exhibited land uses, existing utilities and the Comprehensive Plan designation, the Planning staff proposed the following: Area 1: GC-MD (General Commercial-Multiple Dwelling; this is the westernmost 0.25-acre tract in the study abutting Eastex frontage road. Area 2: RM-H (Residential Multiple Family-High Density) ; three tracts which will act as a transition area. Two tracts have access to French Road; the third, a 5-acre oil well site, lacks sufficient width for single-family platting purposes and has major access to Pinkston. Area 3: RS (Residential Single Family) ; all remaining properties in the study, including both school sties, residential properties on French Road and a 0.97-acre tract front- ing the 4300 Block of Concord Road. The Planning Commission recommended approval of the request as proposed by the staff with the exception of Area 2, which is recommended for RM-M (Residential Multiple Family-Medium Density) by a vote of 6 to 0. The Planning staff is agreeable to the RM-M designation in Area 2. It is recommended that this ordinance be adopted. ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM R-3 (MODIFIED TWO FAMILY AND MULTIPLE DWELLING) DISTRICT TO GC-MD (GENERAL COMMERCIAL - MULTIPLE DWELLING) , RM-M ( RESIDENTIAL MULTIPLE FAMILY - MEDIUM DENSITY) , AND RS ( RESIDENTIAL SINGLE FAMILY) DISTRICTS ON PROPERTY LOCATED IN THE 3200 BLOCK OF FRENCH ROAD AND FOR ALL PROPERTIES ON CARLISLE DRIVE FROM CONCORD ROAD TO FRENCH ROAD; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . THAT Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-5B thereof , is hereby amended by changing the zoning classification from R-3 (Modified Two Family and Multiple Dwelling) District to GC-MD (General Commiercial - Multiple Dwelling) , RM-M ( Residential Multiple Family - Medium Density) , and RS ( Residential Single Family) Districts for an area as shown on Exhibit "A" attached hereto and made a part hereof for all purposes, and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4 . That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5. That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. It also includes two apartment complexes, doctors ' offices, gasoline stations, restaurants, a washateria, a day care center and various other retail uses. Based on the intensity of retail uses in the study area, the surrounding land uses and on implementation of the Comprehensive Plan, the staff recom- mended GC-MD (General Commercial-Multiple Dwelling) for all of the study area. The Planning Commission recommended approval of the proposal by a vote of 6 to 0. It is recommended that the study area be rezoned from R-3 (Modified Two Family and Multiple Dwelling) to GC-MD (General Commercial-Multiple Dwelling) , as recommended by the Planning staff. January 27 , 1984 Council Letter 277 Honorable Mayor and Members of City Council Subject: Request for Zone Change for Property on South Side of Gladys, 135 feet West of Shakespeare At a joint public hearing held January 16, 1984, the Planning Commission and City Council considered a request by Don Streety for a zoning change from RS (Residential Single Family) to RM-H (Residential Multiple Family-High Density) for property located in the 7100-7200 Blocks of Gladys. The Planning staff recommended approval of an RM-H (Residential Multiple Family-High Density) designation for the following reasons: the request will complete the zoning pattern on the east side of the Major Drive/Gladys intersection; the request is consistent with land use principle; and the request is consistent with the Comprehensive Plan. After discussion with the Planning Commission, the applicant accepted a recommendation for a RM-M (Residential Multiple Family- Medium Density) designation rather than RM-H (Residential Multiple Family- High Densi;ty) . The Planning Commission recommended approval of RM-M (Residential Multiple Family-Medium Density) by a vote of 6 to 0. RECOMMENDATION Staff recommends approval of the request for RM-H. January 27, 1984 Council Letter 289 Honorable Mayor and Members of City Council Subject: General Municipal Election The attached ordinance calls the general municipal election for the City of Beaumont. The ordinance provides that the election will be held jointly with the South Park Independent School District. The ordinance is being presented to you at this time to allow 60 days for Justice Department preclearance re- view under the Voting Rights Act of those changes affecting voting which have occurred since the last general municipal election. The last day to submit such changes to the Justice Department is February 6, 1984. It appears likely that one or more propositions may be added to the ballot in the future. By law, such propositions may be added by an amendment to this ordinance passed anytime prior to March 8, 1984 (30 days prior to the elec- tion) . However, practical problems exist in that 14 different elections will be occurring in the County on April 7 and absentee voting must commence on March 19th. In order to avoid possible ballot printing problems, the best course of action would be to establish the Beaumont ballot at the earliest possible date. January 26, 1984 Council Letter 283 Honorable Mayor and Members of City Council Subject: Purchase of One-Ton Truck Mounted with Power Crane On January 15th, the City received bids for a one-ton truck with a power crane mounted in the bed to be used by the Water Reclamation Division. This unit was not scheduled for replacement this year, but was involved in an ac- cident which rendered the vehicle inoperable and not repairable. The vehicle was due to be replaced next fiscal year. The City received an insurance re- imbursement from the other driver's insurance company of approximately $5,000, which was the fair market value of the vehicle. The insurance payment, to- gether with $18,617.04 of available Revenue Sharing money, can be transferred to the Fleet Replacement Fund to cover a replacement cost of $23,617.04. As rioted in Council Letter 242, which is attached, Revenue Sharing funds for 1984 will amount to $1,781,377 - $281,377 more than budgeted; of-this amount, $225,000 was utilized for the purchase of trash trucks, leaving an available balance of $56,377. As this truck is necessary for the operation of this Division, it is recom- mended that Council approve the bid of Kinsel Ford at $23,617.04 for the re- placement of the unit. �L t�a),"Q,� Karl Nollenberger City Manager Attach. 4 1. January 6, 1984 Council Letter 242 Honorable Mayor and Members of City Council Subject: Purchase of Sanitation Vehicles for Trash Collection Over the past two years, the City has initiated a concerted and expensive effort intended to improve the quality of the specialized vehicles used for residential garbage collection by purchasing heavy-duty chassis designed specifically for heavy commercial use. This addition of ten units to our fleet will mean that none of our 27 side-loader units for residential col- lection will be older than 1980. In addition, sufficient backup units, if needed, will be maintained by retaining certain older side-loaders or rear packers. This level of vehicles, given adequate and proper maintenance, should allow us to guarantee proper garbage service. In the 1984 Fleet Replacement budget for Sanitation, some $400,000 was budgeted for residential units and only $40,000 was allotted for one unit for trash and limb collection. It was decided at the time that our most immediate priority lay in improvement of the residential garbage collec- tion phase of this operation and that upgrading of trash collection vehicles could wait until subsequent budgets. In the recent goal-setting process by Council , one of the principal priorities identified related to the establishment of a sanitary service component with the capability to provide reliable garbage and trash service for the citizens. Our recent experiences with the aftermath of a very heavy and difficult period of collecting of trash has convinced us that this upgrading of this crucial component of the Sanitation Division needs to be addressed as quickly as possible and should be addressed in this budget year. Our current trash collection function has the following equipment: 2 - 1979 Grapplers with dump bodies 1 - 1981 Grappler with dump body 1 - 1982 Grappler unitary no dump body 9 - Trash dump trucks This amount of equipment, especially in the case of the specialized and totally essential grappler units, is simply not adequate during heavy periods of the year in maintaining a timely collection schedule. What is needed is enough equipment to allow the City to greatly increase, when needed, the number of units committed to trash pickup. While additional dump trucks can be secured from other line departments, it is crucial that additional grapplers with dump bodies be purchased. Purchase of this equip- ment will also insure that the Drainage Division of Urban Transportation can utilize this specialized equipment in cleaning out numerous large drainage ditches within its jurisdiction. Council Letter 242 January 6, 1984 Page 2 Bids were originally requested on two trash dump trucks and four grapplers with dump bodies. However, on review, we feel that purchase of the grap- plers with bodies will enable us to meet our service level requirements. Any temporary additional equipment needs can be secured from other areas. The bids for the four trash trucks with grappler bodies were: Tidelands International $264,800.00 Kinsel Ford 276,111. 16 Sabine Machinery 290,752.00 Beaumont Truck & Trailer 303,504.40 The monies necessary for this additional expenditure can be secured in the following manner. The 1984 budget contains the provision that all General Revenue Sharing monies, some $1,500,000, will be transferred into the General Fund of the City. As you remember, this extraordinary action was necessary in the current budget to insure a positive fund balance of some $712,000. Adjustments to the General Fund could be made by Council during the year, dependent upon im- provements in our fiscal condition. While we budgeted as revenue some $1,500,000 from Federal Revenue Sharing, our estimate just received from the Office of General Revenue Sharing for fiscal year 1984 is $1,781,377. Some $225,000 of the additional $281,377 which was not included in our de- liberately conservative 1984 reserve estimates can be transferred to the Fleet Replacement Fund in order to purchase this equipment. Additionally, our most recent projections from sales tax show an encouraging upward trend, which if continued over the year, will greatly improve our fiscal position within the General Fund. January 27, 1984 Council Letter 290 Honorable Mayor and Members of City Council Subject: Underground Piercing Tool On December 19, 1983, bids were received for the purchase of an underground piercing tool to be used by the City's Sewer Maintenance Division. The operational concept of this tool is quite different from a standard type boring machine. It uses ram-type percussion instead of a more conventional trenching approach. Because it is trenchless , it eliminates breaking con- crete or asphalt and does not disturb the existing landscape. Backfilling operations are eliminated and traffic can be maintained on busy streets. Only one company, Allied Products, manufactures a machine of this type. For this reason, the bid of Boehck and Gardner Equipment Company, their dis- tributor, was the only bid received. It is recommended that the bid of Boehck and Gardner Equipment Company, Inc. , in the amount of $9,739, be accepted. Water Treatment Plant Improvements Contract 3 A contract in the amount of $6,106,920 was awarded to Midwest Mechanical Con- tractors, Inc. in September, 1982, for improvements to the Water Treatment Plant. The purpose of this project was to increase production of the plant from 20 million gallons daily to 30 million gallons daily of treated surface water. Work on this project is now 80 percent complete. It is proposed that Change Order No. 1 in the amount of $2,828 to Midwest Mechanical Contractors, Inc. for the following work be authorized and executed: 1. Painting of exterior walls of Sedimentation/Flocculator basins was not shown on the plan; however, in order to provide for a complete renovated plant appearance, painting of these exterior walls is recommended. Estimate for this work is $8,173. 2. Credit: For revised pier depth at Chemical Building. The Chemical Building pier depth was revised from elevation 11.0 to elevation 16.0 due to water bearing sand caving in pier bell areas. There were twenty 36-inch diameter piers and thirteen 42-inch diameters reduced in volume, for a credit of $6,125 for this item. 3. Extra cost of temporary electrical service between north and south Head House. Temporary service was installed due to potential unsafe and deteriorated condition of an existing electrical conduit crossing at the new 42-inch raw water line installation. Amount for this work is $780. The cost pro- posals for this item were reviewed prior to authorization and found to be reasonable. Total cost for Change Order No. 1 is $2,828. Council Letter 285 Honorable Mayor and Members of City Council Subject: Mobil Oil Refinery Raw Water Contract The Water Department has supplied untreated river water to the Mobil Refinery since 1926 through a pump installed at the pumping station on Pine Street and an 18-inch diameter line installed by Plobil from Pine Street to the Mobil Refinery. The Water Department has provided operation, minor maintenance on equipment, electric power for the pump motor, 50 pounds of chlorine per day, and water, for a charge to Mobil of $.045 per thousand gallons, by contract, which was executed in February, 1972 until August, 1982. In August, 1982, the charge was increased to $0. 12 per thousand gallons in order to offset substantial increases in electric power cost, labor and chemical cost. Mobil requested that they be allowed to provide electric power service directly to their pumping unit, pay Gulf States Utilities for their charges, and pay the remaining cost for producing raw water to the City. This cost was determined to be $.045, which Mobil has agreed to. It is recommended that the contract be approved. The project has been in- spected and found to be completed in accordance with plans and specifications at an actual cost of $150,867.50. The underrun is due to a variation in plan quantities and actual quantities. The developer had previously deposited his share of the construction cost, in the amount of $97,416 with the City. With the underrun in construction costs, his actual share is $96,624, or $792 less than the amount deposited. It is recommended that these improvements be accepted for City maintenance and that final payment in the amount of $7,543,38 be made to John Bankston Construction Company and that the developer, W.
