Subject: Tennis Court Fence on Klein Park
Hurricane Fence Company has completed a $3,567 contract for erection of a
10-foot-high chain link fence around the new tennis courts on Klein Park.
The contract was let last May 3 but was delayed for completion of the con-
crete slab for the two tennis courts which are being constructed under a
$128,820 sitework contract with Greer Construction Company. The sitework
contract, which also includes the trail system, two parking lots, a sports
field and the entrance drive, is expected to be completed in a few days.
The fence has been completed and all contract requirements have been ful-
filled, as determined in a final inspection.
It is, therefore, recommended that the Council accept the work and authorize
full and final payment to Hurricane Fence Company in the amount of $3,567.

WHEREAS, on May 3 , 1983 the City of Beaumont awarded a
contract to the Hurricane Fence Company in the amount of $3 ,567 .00
for construction of a 10-foot high fence around the tennis courts in
Klein Park; and,
WHEREAS, the project has been completed in accordance with
the plans and specifications;
NOW , THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the construction of the fence around the tennis courts in Klein
Park is hereby accepted by the City of Beaumont and that the City
Manager be, and he is hereby , authorized to make final payment to
the Hurricane Fence Company in the amount of $3 ,567 .00 .

Subject: Exchange of Securities
Texas Commerce Bank-Beaumont, still the City depository until the new con-
tract with First City Bank takes effect October 1st, has requested approval
of an exchange of securities pledged as collateral for City deposits. The
bank wishes to pledge $200,000 in U.S. Treasury notes in place of $200,000
worth of Tarrant County Water Control and Improvement District No. 1 bonds,
leaving the amount of collateral unchanged. Securities pledged by the bank
total $26,875,000, an amount more than sufficient for the dollar-for-dollar
match required by the depository contract. The deposits totaled
$14,816,204.60 as of September 14th.
The Finance Department will begin moving the deposits to First City Bank on
October 1st and should complete the transfer by the end of October. In
the meantime, Texas Commerce will reduce the amount of pledged collateral
accordingly as the City's balance declines, and First City pledges colla-
teral to match the deposits there.
It is recommended that the exchange be approved.

securities in lieu of giving bond as City Depository; and,

It is recommended that the contracts be let to the two low bidders - Trax
Enterprises in the amount of $4,796, for the structures at 1490 Avenue A,
1010 Finis, 2065 Leiper and 1290 S. Major Drive and Ace Clark Construction Co. ,
in the amount of $800, for the structure at 2245 Hebert. The total cost for
demolition of the five buildings, thus, would be $5,596, or an average of
$1 ,119.20 - well below the 52,000 per structure estimated average used in pre-
paring the budget. The average cost. for:the_19:structures. which. have_been_de-
molished is $1,338.45. The total does not include the five structures discussed
in this letter but does include the structure at 1180 Sherman, which was de-
molished under the contract most recently completed.
The contracts for demolition of the five structures discussed in this recom-
mendation would be financed from the $50,173.X remaining unobligated from
the $103,400 Special Services line item of appropriation in the Environmental
Control budget.
It is recommended that the demolition contracts be awarded to the two low bid-
ders.

Subject: License for Pipeline Crossing
United Texas Transmission Company has applied for a license to cross 13
streets with an 18-inch natural gas pipeline to replace an existing line be-
tween the Water Utilities Service Center and the intersection of Keith Road
and Dishman Road. The Pipeline would cross the following streets: Calder,
McLean, Broun, Shepherd, Greeves, Stedman, Clemmons, Smelker, Landis, Avalon,
Glendale, Amelia, and Montrose.
The crossings would be in the following subdivisions: Gulf Terrace, Westfield
Terrace, Wescalder Fig Acres, Mayfair, and Mayfair 2nd Addition.
The license fee would be $970 based on $1 per foot of line within the right-
of-way lines.
It is recommended that the license be approved.

Subject: Purchase of Wheel Balancer
Bids were taken on September 12 for furnishing a wheel balancer for the
Fleet Service Center on Lafin Drive. Bids were received from four vendors
as follows:

The Snap-On Tools bid is lower than the others because the balancer offered
is manually operated. The others bids are on supplying motor-driven units.
In a study of the bids, it was determined that the lower priced manual unit
complies fully with the advertised specifications and meets all requirements
for use in the Service Center.
It is recommended that the low bid of Snap-On Tools be accepted.

Subject: Section III of the Pine Street/Magnolia Rezoning Study
Section III of the Pine Street/Magnolia Rezoning Study was heard by the
Planning Commission and City Council at a joint public hearing on
September 12, 1983.
This is a staff-initiated request based on the decision of the City Council
to eliminate all R-3 zoning. This is the 17th R-3 rezoning study which has
been prepared by the staff.
The predominate land use in the area was single family residential and the
planning staff recommended RS (Residential Single Family) zoning for all the
land in the study area except for the Magnolia Gardens Housing Project.
Staff recommended that Magnolia Gardens be rezoned to RM-H (Residential
Multiple Dwelling - High Density) .
The Planning Commission voted 6 to 0 to recommend approval of the rezoning
recommendations of the planning staff.
It is recommended that the Planning Commission's recommendations be ap-
proved.

SUBJECT: Summary of Planning Commission action on Pine Street/
Magnolia Rezoning Study, Section III; September 12, 1983.
GENERAL INFORMATION
This section of the Pine Street/Magnolia Study reflects many of
the same land use characteristics of the two previous sections and
R-3 areas in general -- a predominance of single family residences
and scattered retail uses.
The study begins generally 150 feet east of Magnolia and extends
to Pine Street from Gill on the north to Delaware on the south.
Existing utilities are generally adequate for residential uses.
All streets are local residential which vary in right-of-way widths
from 40-60 feet and pavement widths from 16-30 feet. The compre-
hensive plan designates the area in this section as a Conservation
and Revitalization Area.
PLANNING STAFF RECOMMENDATION
Based on the predominant exhibited land use, single family residen-
tial , the staff recommended RS zoning for all of the properties
within Area 1 and RM-H for property in Area 2.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission recommended approval of the proposal by a
vote of 5 to 0.

That in all other respects the use of the property
hereinabove described shall be subject to all of the applicable
regulations contained in Chapter 30 of the Code of Ordinances of
Beaumont, Texas, as amended.
Section 3 .
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set of
persons or circumstances, should for any reason be held to be
invalid, such invalidity shall not affect the remaining portions of
this ordinance, and to such end the various portions and provisions
of this ordinance are declared to be severable.
Section 4 .
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only .
Section 5 .
That any person who violates any provision of this
ordinance shall , upon conviction, be punished as provided in Section
1-8 of the Code of Ordinances of Beaumont, Texas.

Subject: Request for Rezoning from HI to GC-MD
This request for rezoning of property located in the 3500 and 3600 Blocks
of west Cedar just west of the IH-10 access road was considered on
September 12. 1983 at a joint public hearing of the Planning Commission and
City Council .
The applicant, Mr. Morris Anderson, is seeking the down-zoning in order to
obtain the same zoning as the property located to the east of this request
that abuts the I-10 access road. The two properties are proposed to be
combined and developed as a retail shopping complex and a motel . The down-
zoning is not required in order to develop the property; however, the de-
veloper desires this lower zoning classification.
The Planning staff recommended approval of the request and the Planning
Commission voted 6 to 0 to recommend approval .
It is recommended that the rezoning be approved.

Subject: Request for a Zoning Change from RM-H to NSC and a Specific Use
Permit
This request for rezoning and a specific use permit for a shopping center
and a Whataburger restaurant was heard at the September 12, 1983 joint
public hearing of the Planning Commission and City Council . The applicant
revised his initial application for rezoning to GC-MD (General Commercial -
Multiple Dwelling) and accepted the planning staff's suggestion that he
apply for NSC (Neighborhood Shopping Center) and for a specific use permit
for a shopping center. The applicant's site plan shows an "L" shaped
building complex and a free-standing restaurant.

Subject: Request for H-C Designation for Property at 1895 McFaddin
This request for H-C, Historical-Cultural' Landmark District designation for
the structure at 1895 McFaddin was recommended by a vote of 5 to 0 for ap-
proval at the July 27, 1983 public hearing of the Landmark Commission. A
joint public hearing by the City Council and the Planning Commission was held
on this request on September 12, 1983.
The applicant, Mr. Frank Inzer, requested the H-C designation in order to
make his property eligible for an Historic preservation grant under the
CDBG program. The structure is the J.W. Garth home built in 1913. It has
been converted to a four-unit dwelling but is currently in the process of
being returned to its original use as a single-family dwelling.
The structure meets the criteria for Historical-Cultural and was recommended
for approval by the Planning Commission by a vote of 5 to 0.
It is recommended that the H-C District designation be approved.

The Beaumont Heritage Society is seeking this designation for a vacant

Subject: Consider a Request for H-C, Historical-Cultural District
Designation for 1208 Gilbert
This request for an H-C District designation for the property located at
1208 Gilbert Street was considered at a joint public hearing by the Planning
Commission and the City Council on September 12, 1983.
This request was submitted by Laurie Hall on behalf of the Beaumont Heritage
Society. The structure was recently given to the Beaumont Heritage Society
and they plan to use it as a demonstration project to show others the cor-
rect way to rehabilitate an historical structure. When the project is com-
plete, it will be sold and the proceeds placed in a restricted preservation
fund.
The subject property is an excellent example of Victorian architecture built
in the period from 1874-1900. Staff concluded that the structure satisfied
the criteria for Historical-Cultural Landmark designation and recommended
approval of the request. The Historical Landmark Commission reviewed the
request at a public hearing on July 27, 1983 and recommended its approval
by a vote of 5 to 0. The Planning Commission voted 6 to 0 to recommend ap-
proval of the request.
It is recommended that the H-C designation be approved.

This request for a specific use permit to operate a lounge at 5550 Eastex
Freeway was considered at the September 12, 1983 joint public hearing of

desires to operate a proposed night club entertainment center for adults
that would offer dancing to Top 40 style music, sale of mixed drinks and

This request for a specific use permit to construct a duplex at 8280 Voth
Road was heard at the September 12, 1983 joint public hearing of the Plan-
ning Commission and the City Council .
The applicant, Mr. David Emerson, is seeking to build a duplex on a 16,156
square-foot lot. He intends to live in one of the units and to rent or
lease the other unit.
Duplexes are allowed in single-family residential zones conditioned upon
obtaining a specific use permit. In the RS District (Residential Single
Family) , a minimum lot area of 10,000 square feet is required as mentioned.
The property in question has 16,156 square feet in lot area and easily

This request for a specific use permit for a lounge at 6725 Eastex Freeway
was heard at the September 12, 1983 joint public hearing of the Planning
Commission and the City Council . The applicant, Mr. John Lagios, plans to
operate a discotheque restaurant featuring disc jockeys or live band-piano
bar entertainment. The establishment, to be identified as Rumors, will also
have a dance floor.
This proposed establishment was previously known as Caligula XXII and, as
part of an agreed court judgment, the applicant agreed to eliminate the
adult use aspects of his business and to obtain a specific use permit before
he would open a new lounge.
The planning staff recommended approval of the permit and it was recommended
for approval by the Planning Commission by a vote of 5 to 1.

Subject: Public Hearing on Transit Fares
The current transit fares were established in 1982. Since that time, modifi-
cations to the fare schedule were authorized for passes and the Special Transit
Service. In 1982, the revenue - operating expense ratio for the transit system
was 38%. This could decrease to 29% in FY 84. In order to maintain an opera-
ting ratio near 34%, adjustment to the fare structure would be necessary.
Possible fare increases were discussed with you in a recent budget work session.
The Urban Transportation Department has submitted the attached fare structure.
The proposed fare increases include single trip rates for adults (from $.40
to $.50) and young persons (from $.15 to $.20) on fixed route service. Monthly
passes for adults are proposed to increase from $15 to $18. Rate increases are
also proposed for regular charter service.
We are not proposing any increase in fares for elderly persons and handicapped
persons. Transfers and all Special Transit Service fares are also proposed to
remain unchanged. The attached exhibit details the proposed fares. The pro-
posed increase is estimated to result in approximately $4D,000 of additional
revenue from fares/passes and $10,000 from charters. The City share of the
transit deficit would be reduced approximately $25,000
In order to increase fares, federal regulations require a public hearing on
proposed fares and publication of a notice of public hearing at least thirty
days prior to the public hearing date.
It is recommended that October 25, 1983 be set as the public hearing date.

Subject: Consideration of an Abandonment of 1-Foot Portion of Park Street
Between Crockett and Bowie
This request for a partial abandonment of a portion of Park Street was con-
sidered by the Planning Commission and City Council on September 12, 1983.
In the planning for Market Square, it was discovered that the Stedman Build-
ing encroached several inches on the Park Street right-of-way; for the build-
ing to be sold for redevelopment, it is necessary to have a clear title.
The request for partial abandonment was submitted by the Stedman Company in
order to clear the title.
All City departments and public utility companies have indicated support for
the abandonment. The Planning staff recommended approval of the request
and the Planning Commission voted 5 to 0 to recorrunend approval of the abandon-
ment.

Subject: Sarah Street TIP Project
On November 3, 1981, the City of Beaumont awarded a contract to John Bankston
Construction and Equipment Rental Co. , Inc. in the amount of $1,152,775.50 for
construction of Sarah Street, from Fourth Street to the Fannett Road at
Eleventh Street. The project also included water line and sanitary sewer
improvements between Fatima and Fannett Road. The roadway has been constructed
as a four-lane concrete curb and gutter with protected left turn provision at
the Fannett Road - Eleventh Street intersection. Completion of this project
provides a four-lane Type A arterial connecting Spur 380 with the Fannett Road.
Final acceptance of this project was delayed several weeks due to numerous
uncontrolled cracks in the center 22 feet of 1,120 lineal feet of the pavement
located west of Fatima Street. In our opinion, the cracks were caused due to
the Contractor' s delay in sawing planned transverse and longitudinal joints.
This section has been repaired by the Contractor at no additional cost to the
City. The repair consisted of routing and sealing the uncontrolled transverse
cracks and removal of seven sections where the cracking was so severe as to
produce small triangular sections. In addition to the repair work, the Con-
tractor was assessed a loo reduction to the cost of the pavement involved,
plus a $1,500 maintenance fee for anticipated future repair work. The final
estimate reflects a Special Reduction of 57,934.00 as a result of the 10%
reduction and maintenance fee.
During the construction of this project flooding was experienced at the Fourth
Street - Sarah Street intersection. Investigation by the Project Engineer and
City Drainage Division personnel revealed that downstream blockages existed in
the Fourt Street outfall . These blockages were corrected by City forces. Upon
completion of the project between Fourth Street and Fatima Street, there re-
mains a section near Sarah Street in the vicinity of Fourth Street where storm
water is slow in draining off the roadway. It is recognized that future work
will be required to remedy this condition.
The Engineering Division has inspected the project and it was found to have
been satisfactorily constructed in accordance with plans and specifications
at a total cost of $1,137,601.41, 1.3% below the original contract amount.
It is recommended that final payment in the amount of $51,020.67 be made to
John Bankston Construction and Equipment Rental Co. , Inc

Subject: Award of Contract for Project 16 - Separation of Sewers - South
On August 29, 1983, bids were received for construction of certain sanitary
sewer lines in the south end of town which are being replaced under Phase I
of the sewer separation program. Sanitary sewer lines being constructed
under this project are those that will discharge into the Sabine Pass trunk
which is currently under construction. The existing lines are to be used
exclusively for storm sewer purposes.
It is recommended that a contingent award, subject to Texas Department of
Water Resources and Environmental Protection Agency approval , be made to the
low bidder, C & P Equipment Co. , Inc. for the amount of $1,463,914.35.
Eight contractors submitted bids for this project. Bids ranged from
$1,463,914.35 to $2,751 ,046.00. Estimated cost for this project was

Subject: Tyrrell Park Recreation Building Architectural
Contract
The Tyrrell Park Recreation Building will be renovated
with funds from an Urban Parks (UPARR) qrant from the
National Park Service. Construction cost will be approxi-
mately $120 , 000. A three-phase master plan has been pre-
pared for the building. Phase One includes structural
repairs , such as roof replacement and repair of beams
and trusses , that are essential to prolong the useful
life of the building. Phase Two includes installation
of ceiling fans and cosmetic repairs, such as interior
painting and cleaning of exterior masonry. Phase Three
includes improvements to garden walls, courtyards, grounds ,
and landscaping. It is anticipated that the currently
available funds will allow completion of Phase One and part
of Phase Two. The construction budget may be increased
after cost estimates are finalized for three playground
projects also funded by the UPARR grant.
Architectural proposals were solicited from seven local
firms. Three proposals were received. These are sum-
marized as follows:

Construction is expected to begin in early 1984. The
work must be completed by September 1984 under the terms
of the UPARR grant.
Although this structure is not listed on the National
Historic Register, the Texas Historic Commission has ruled
that the building is potentially eligible for inclusion on
the Register. Therefore, the Department of Interior' s
historic renovation standards must be followed.

is recommended for approval because of the firm' s quali-
fications for historic renovation projects and because
of the proposed basic fee.

Subject: Residential Collection Units
Bids on furnishing five new side-loading residential collection units were
received on August 22, 1983. Bids were received from a total of five vendors,
two of which bid on the cab/chassis and three who bid on the packer units.
Chassis
It is recommended that the apparent low bid of American LaFrance be rejected
in favor of the Crane Carrier bid by Tidelands International . There are
several reasons for this recommendation. First, American LaFrance failed to
meet specifications as they bid a tilt-up versus a fixed cab. A fixed cab is
important in that it allows a single operator to check fluid levels on the
unit. A tilt-up cab requires a crew of two to check these same fluid levels.
Of equal importance is delivery time - use of the Crane Carrier chassis means
that we would have, per bid statements, all units in service within a 3-month
period. Use of the American LaFrance chassis means that we would have, per
bid statements, all units in service within a 7-month period. Upgrading the
Sanitation fleet on a timely basis is of primary importance if we are to im-
prove service delivery in this area.
Finally, the Crane Carrier has proven itself to be a superior piece of equip-
ment in thorough use in the City fleet. We have carefully analyzed its per-
formance and have compared its construction against the American LaFrance
unit. Staff believes it to be the best buy for the money.
Packer Body
The bid from Able Body Company is the low bid for packer bodies. While the
actual type of unit quoted does not meet the bid requirement of three years
of actual field service, the company itself has been building packer bodies
for more than the length of time. Indeed, some 16 of our 27 side-loaders
are Ables and we are generally satisfied with the units. The newer unit
quoted by Able will have an improved electrical system utilizing micro-
switches, which meets or exceeds our specifications.
Because of the importance of the purchase and the disparity between some of
the bids, we sent two individuals to the plant in California to carefully
analyze the unit and make an assessment with respect to the company. It
is their collective opinion that this unit will perform as claimed - meets
or exceeds specifications in all aspects.

We had estimated that the total package would cost $80,000 per unit, or
$400,000 total . The purchase components as recommended total $75,595 per
unit or $377,975 total . These purchases will be made out of the Fleet Re-
placement Fund.
