Subject: Certificates of Obligation
On July 26, Council deferred issuance of $1.7 million of certificates of
obligation for landfill acquisition, construction and equipment because all
details of the transaction had not been resolved. Capital costs associated
with the new landfill were to have been paid from the proceeds of the sale
of the certificates and from $570,000 available in the capital projects fund.
In the process of preparing our proposed 1983-84 budget, we have determined
that financing all landfill capital costs from the sale of certificates will
free up the $570,000 previously set aside so that other necessary capital
projects may be done within the proposed '84 budget. We have, therefore,
published notice of intention to issue $2,350,000 in certificates of obliga-
tion on or after August 16. The proposed ordinance ratifies publication of
that notice.
We planned to place the certificates privately without having them rated.
Texas Commerce Bank was unable to place all of the certificates on a non-rated
basis so we have asked Underwood, Neuhaus and Company, the City's financial
advisor, to act as placement agent. Underwood, Neuhaus will work with Texas
Commerce Bank in placing the certificates. At their suggestion, we have
tentatively agreed to have the certificates insured which will assure a
limited "AAA" rating by Standard and Poors. The insurance premium will be
approximately $23,000 which will be recovered through lower interest costs.
The bonds will still be placed privately with banks and other institutional
investors.
It is recommended that Council ratify publication of the notice of intent
to issue and sell the certificates of obligation.

Subject: Purchase of Water Meters
Bids were taken on July 6 for furnishing some 3,260 water meters for inventory,
as ordered, over a one-year period. Prices were quoted individually on six bid
items on an all-or-none basis. A $91,498.74 total bid of Neptune Water Meter
Company of Dallas was the lowest of the four bids received, the others ranging
up to $142,932.06. The Neptune unit prices were the lowest quoted on all items,
as follows:

The bids came in lower than the prices the city has been paying for the meters,
as shown by the following comparison of the Neptune low bid with the last pre-
vious low bid price:

(The last purchase of 5/8" meters was on bids received January 9, 1980, for
furnishing 7,000. The supply was sufficient to last to the present time. )
Believed to be responsible for the lower prices are market conditions, includ-
ing a decline in residential construction and the fact that a number of cities
in this region have completed multiyear programs for the system-wide replace-
ment of old meters with newer, more accurate meters. Beaumont's replacement
program was completed in fiscal year 1982. During this program, some
35,000 new meters were installed to replace meters which were 30 years old.
All of the 40,000 meters now in service are less than 15 years old.

The Water Utilities Department makes regular spot checks in all areas in a
testing program for the detection and replacement of defective or inaccurate
meters. The meters carried in inventory are used for replacements as well
as for new service.
The 5/8" meters are normally used for single-family residential connections
and the larger meters for residences where water usage is high and for various
commercial and industrial establishments.
It is recommended the bid of Neptune Water Meter Company be accepted.

Subject: Acceptance of Park Buildings
On November 16, 1982, a contract was awarded to Galaxy Building Corporation
for construction of three concrete-block buildings on Klein Park and Babe
Zaharias Park in the total amount of $167,185. The contract has been com-
pleted and inspections made to determine that all work was performed satis-
factorily.
The three buildings include a 2,212-square-foot restroom and shelter structure
with concession stand on Babe Zaharias Park and a 936-square-foot storage
building and a 1,160-square-foot restroom and shelter structure on Klein Park.
The completed cost of the contract is $166,485, reflecting a deduction of
$700 for deletion of plaques included in the original contract for installa-
tion on the two restroom-shelter structures.
The costs of construction of each building after the deduction are as follows:
Babe Zaharias Park restroom-shelter-concession stand, $90,575; Klein Park
restroom-shelter, $47,450; and Klein Park storage building, $28,460.
This would be the second contract to be completed in a grant-assisted
$300,000 project for development of Klein Park. Three other contracts are
under construction. The first contract was for construction of three pedes-
trian bridges totaling $24,985. These bridges, crossing a ditch meandering
across the park, will link up sections of an all-purpose exercise trail which
is included with other site work in a $128,820 contract, now 85 percent com-
plete. A $51 ,288 contract for playground and park buildings and equipment
was let June 17, and the contractor is awaiting delivery of the materials and
equipment necessary to proceed with the work. Construction on a $3,567
contract for fencing the two tennis courts, being .constructed under the
sitework contract, is awaiting completion of _the courts.
The five contracts add up to $293,297 spent or committed, including $3,377
for architectural and engineering services, $3,500 for other costs,. such as
soil tests, blueprints and installation of water lines, and $1,500 reserved
for purchase of playground cover material . The project is progressing on
schedule and should be completed by November, well within the budget. Half
the cost is being financed by a $150,000 matching grant from the Texas Local
Parks, Recreation and Open Space Fund. The $150,000 local match includes a
$50,000 endowment from the Klein family.

Improvements on Zaharias Park are continuing in accordance with a master plan
for its development prepared by the Planning and Parks Departments. The
recently-improved soccer fields will be ready for league play to be resumed
next month. Playground equipment donated by the Beaumont Rotary Club will be
installed by members of the club this weekend. in an area near the restroom/
shelter/concession facility.
It is recommended that the Council accept the work performed under the con-
tract for construction of the three buildings and authorize final payment to
the contractor.

Subject: Acceptance of Street and Utility Improvements
Recently-completed street and utility improvements in two subdivisions have
been inspected by the Engineering Division and the Water Utilities Department
and have been found to comply with City standards.
The subdivisions are Westchase Addition, on the north side of Washington Boule-
vard west of Major Drive, and Howell Courts, on Howell Street north of Derby
Drive.
The recently-completed improvements in Westchase include Westchase Drive, ex-
tending from Washington Boulevard northward approximately 585 feet then west-
ward for approximately 280 feet; Winter Lane extending from Westchase west-
ward about 225 feet, and water and sewer lines serving the lots fronting on
these streets.
The Howell Courts improvements include a 169-foot extension of Howell Street
from the end of the existing pavement to a Drainage District 6 Easement and
water and sewer lines serving eight lots fronting on d. private drive extend-
ing eastward from the Howell Street extension.
It is recommended that the Council adopt a resolution accepting these improve-
ments for maintenance as part of the City systems.

WHEREAS, the developers of Westchase and Howell Courts
subdivisions have completed the water, sanitary sewer, storm sewer,
and street improvements as follows:
Westchase Subdivision
Street improvements on Westchase Drive from Washington
Boulevard north approximately 585 feet, then west
approximately 280 feet; Winter Lane from Westchase
Drive west for approximately 225 feet; and water and
sewer improvements in Lots 1-31 , Block 1 .
Howell Courts Subdivision
Street improvements extending Howell Street approxi-
mately 169 feet north to Drainage District 6 easement
and water and sewer improvements in Lots 1-8 .
and,
WHEREAS, the developers of said subdivisions desire to
have these improvements accepted and maintained by the City; and,
WHEREAS, the directors of the Urban Transportation and
Water Utilities departments recommend that said improvements qualify
for acceptance for permanent maintenance, and the City Council is of
the opinion that said improvements should be accepted and maintained
by the City of Beaumont;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAI' the water, sanitary sewer, storm sewer, and street improvements
in Westchase and Howell Courts subdivisions as above described, be,
and the same are hereby, accepted by the City of Beaumont and shall

Subject: Dilapidated Structures Hearing
Dilapidated structures at 12 locations are scheduled for consideration at
Tuesday's condemnation hearing. Included are the former Charlton-Pollard High
School band room and cafeteria at 1400 Lincoln - two metal buildings left
standing when the main buildings were demolished with CDBG funds four years
ago. The owner, now living in Florida, has been contacted several times. He
has informed the city of his plans to sell the buildings for removal but as
yet has not made the arrangements. Although structurally sound, the build-
ings have been damaged by vandals. A large hole in the wall of the cafeteria
building needs to be closed and doors on both buildings secured to bar tres-
passers and abate an attractive nuisance.
Also to be considered are two vacant two-story apartment buildings at
1.172 Broadway and 1186 Broadway. Both have been damaged by fires and break-
ins. The owner has been fined in Municipal Court on charges of ordinance
violations involving the conditions of the buildings and premises. The En-
vironmental Control Division will recommend that the buildings be condemned
for removal in 30 days.
One of the vacant dwellings to be considered is a historically significant
1,wo-story residence, owned by W. J. Bergeron, at 1842 Liberty. The owner is
being encouraged to restore the building and has undertaken repairs but has
riot completed them. The recommendation will be that the Council order the
building repaired or removed in 30 days.
The other buildings to be considered are dwellings and garages. All are vacant.
The Council will be asked to authorize the removal by the city, under contract
demolition, of a one-story frame dwelling at 1490 Avenue A after noncompliance
with a condemnation order issued after a hearing two months ago. The owner
agreed to obtain a demolition permit by July 11 but failed to do so and has
riot asked for an extension of the time allowed.

RECOMMENDATION - URBAN REHABILITATION DIVISION: Raze within 30 days
CONDEMNATION
The structure listed below has been condemned by the City
Council and the owner ordered to either repair or raze the structure
within a specified time frame. Reinspection of this property has
revealed noncompliance with the Council's order.
The Code Enforcement Department is requesting authorization from
the City Council to demolish this structure in accordance with the
City Codes and charge the property owner with the cost of this
demolition.

STRUCTURES TO BE PUBLIC NUISANCES, AND
ORDERING REPAIR OR DEMOLITION;
PROVIDING A PENALTY ; AND PROVIDING FOR
SEVERABILITY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
That the City Council of the City of Beaumont hereby finds
and declares the buildings located at:
1172 Broadway
1186 Broadway ( Front & Rear)
2550 Brooklyn (Garage)
1542 Cable ( Rear)
1325 Cartwright
3575 Delta Street
1186 Lamar
1842 Liberty
1400 Lincoln (Band Room and Cafeteria)
1179 North
3883 St. Helena ( Rear)
3885 St. Helena
3515 Washington
each to be a public nuisance in that said buildings violate Chapter
14 , Section 14-50 of the Code of Ordinances of the City of Beaumont
and are for want of repairs, or by reason of age or dilapidated
condition, likely to cause or promote fires that would endanger
persons or property .
Section 2 .
In accordance with Article XVII, Section 2 of the Charter
of the City of Beaumont, Sections 10-2 and 14-52 of the Code of
Ordinances of Beaumont, Texas, and Section 103 .4 of the Standard
Building Code, it is hereby ordered that the owner or owners of the
following buildings either repair or demolish and remove said
structures within thirty ( 30) days of the date of the passage of this
ordinance:
1325 Cartwright
3575 Delta Street
1842 Liberty
1400 Lincoln (Band Room and Cafeteria)
3885 St . Helena
If such action is not taken, request shall be made that the City
Council authorize appropriate City officials to demolish and remove
said structures at the expense of the City of Beaumont on account of
the owner thereof and such expense shall be assessed as a special tax
against the property upon which the buildings are situated .
Section 3 .
In accordance with Article XVII, Section 2 , of the Charter
oj- the City of Beaumont, Sections 10-2 and 14-52 of the Code of
Ordinances of Beaumont, Texas and Section 103 .4 of the Standard
Building Code, it is hereby ordered that the owner or owners of the
following described buildings demolish and remove said structures
within thirty ( 30) days of the date of the passage of this
ordinance:

If such action is not taken, the owners of said buildings shall be
dE�emed guilty of a misdemeanor and said buildings shall be demolished

and removed at the expense of the City of Beaumont on the account of
the owner thereof and such expense shall be assessed as a special tax
against the property upon which said buildings are situated and a
lien shall exist for such special tax, which lien shall be foreclosed
and said expense be recovered by the City of Beaumont as in the case
of any other debt and lien in favor of the City of Beaumont.
Section 4 .
The following structure is hereby ordered to be demolished
and removed by the City of Beaumont on the account of the owner
thereof and such expense of demolition and removal shall be assessed
as a special tax against the property upon which the building is
situated. The following structure was heretofore declared to be a
public nuisance and violation of Chapter 14 , Section 14-50 of the
Code of ordinances of the City:

Section 5 .
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set of
persons or circumstances, should for any reason be held to be
invalid, such invalidity shall not affect the remaining portions of
this ordinance, and to such end the various portions and provisions
of this ordinance are declared to be severable.
Section 6 .
Any person who violates any provision of this ordinance
shall, upon conviction, be punished as provided in Section 1-8 of the
Code of ordinances of Beaumont, Texas.
