Subject Sewer Easement
COMMENT:
This resolution would authorize the purchase of a 6,267.5-square foot
sanitary sewer easement from Joe O'Fiel for the appraised price of
$4,231.
The 20-foot-wide easement would be used for construction of two new
mains in a project for the elimination of a combination sewer line.
The existing 60-inch main would continue to serve as a storm sewer
but sanitary sewage would be diverted to a new eight-inch gravity
flow main to be constructed in the easement. A six-inch force main,
also would be constructed in the easement to connect the Verone Street
lift station with a main on Buford Street.
The project is part of an effort to relieve the load on the sewage
treatment plant by excluding storm drainage.

COMMENT:
This resolution would authorize payment in the amount of $1 ,190
to Intercoastal Electric Co. of Port Arthur for emergency re-
pairs to the motor of a lift station pump serving the underpass
at College Street and Railroad Avenue.
The motor was removed for repairs Monday after shorting out. The
repair work, including rewinding, baking and d'

completed, and the pump is back in service.
Westinghouse Electric quoted a price of $1,287 on the work.

Subject Monitor Test Set
COMMENT:
A $2,448 bid of Doerr Associates of Arlington was the lowest meeting
the specifications for a bench mountable test set for use by the
Transportation Department in testing signal controller conflict
monitors.
The bid recommended for acceptance is $244.20 lower than a $2,692.80
bid received from Augustine Sales , also of Arlington.
A $1,570 bid of Traffic Signals , Inc. , of Edmond, Ok. , did not meet
specifications.
The Doerr Associates bid price is well below the $4,000 budget esti-
mate for the purchase.

Subject Landfill Road Right-of-Way
COMMENT:
An agreement has been reached, subject to Council approval , for
the purchase of 3.15 acres of right-of-way needed for the access
road to the new landfill site.
The property would be acquired from the J.L. Caldwell Company Trust
for the appraised price of 535,305, including
taken and $14,830 for damages to the remainder$20,475 for the land
The purchase would complete the right-of-way needed for the access
road which would extend eastward from Lafin Drive to the landfill
as shown on the attached map.
The consulting engineers are preparing plans for construction of
the road under a contract that would also include improvement of
Lafin Drive. The plans are nearing completion and should be ready
for bidding soon.

Subject: Willow Bend Drive
COMMENT:
Maco Construction, Inc. , was low bidder at $181 ,383 on a contract
for construction of the Willow Bend Drive participation project.
Twelve bids were received on the contract June 1, ranging up to
$246,560.
Bids were taken on 7,044 square yards of 10-inch-thick concrete
paving with curbs and gutters on a two-inch sand cushion.
The bid prices per square yard ranged from $25.75 to $35.
Based on the Maco low bid, the city's share of the construction
costs would be $66,539.40 and the developers ' share, $114,843.60.
Addina the cost of engineering services at 10 per cent of construc-
tion costs , city participation in the project would total $73,193.34 .
The apportionment of the costs is based on the formula for city
participation when developers are required to construct residential
collector streets to serve the needs of through traffic rather than
narrower standard residential streets.

Subject Purchase of Fire Hose
COMMENT:
This resolution would authorize the purchase of 4,100 feet
of fire hose from Claude Wright and Associates of Houston
for $10,455, including:
1,100 feet of 5-inch hose at $5.55 a foot -- $6,105.
2,000 feet of 22-inch hose at $1.54 a foot --$3,080.
1,000 feet of 12-inch hose at $1.27 a foot --$1 ,270.
The Wright bids were the lowest received on 5-inch and 22-inch
hose
Lower bids were received on the 12-inch hose -- from Ed
Cummans Co. of Arlington at 51.22 a foot and from Halprin
Supply Co. of Houston at $1.24 a foot. The Cummans bid, however,
was quoted as part of an all-or-none bid on 12-inch and 22-inch
hose. Accepting it would require acceptance also of a higher
bid on furnishing 22-inch hose at $1.58 a foot.
Although the Halprin bid was three cents lower than the Wright
bid of $1.27 per foot on 12-inch hose, the Fire Department felt
that the total savings of $30 would be outweighed by the advantages
of placing the entire order with one supplier and recommended
acceptance of the Wright bids for furnishing all three sizes.

Subject Contract for Paternal and Child Health Care Services
COMMENT:
This resolution would authorize execution of an agreement with the
Texas Health Department, under which the city would receive $29,400
in grant funds annually toward the salaries of city health depart-
ment personnel engaged in maternal and child health care services.
The grant would enable the department to employ an additional field
nurse and fill a budgeted clerk's position at savings of $6,692.88 on
its present budget.
Until two years ago, the health department staff was augmented by two
nurses employed by the state for maternal and child health care.
The new agreement would restore some of the assistance lost as a result
of the 1980 cutback in federal funding.
The additional personnel would be employees of the health department
rather than state employees, as under the former arrangement.
The additional nurse would give the department four field nurses '
positions in its table of organization.
The funding contract with the state would be applicable on a pro-rata
basis for the remainder of the current fiscal year and renewable for the
next fiscal year beginning October 1.

Subject: License for Encroachment
COMMENT:
Two pipes, a telephone box, a gas meter and brick trim on the Szafir
building, at Main and Forsythe, were found to extend over the property
line of the adjacent Tyrrell Historical Library site at Forsythe and
Pearl .
The encroachment was discovered by engineers employed by Alex Szafir,
Jr. , to survey the property which is being offered for sale.
Because of the cloud on the title, Mr. Szafir is seeking a license for
the encroachment on a 1.2 foot strip of the library site.
A resolution being prepared for Tuesday's agenda would Grant the
license in consideration of a $1,500 payment to the city, an amount
equivalent to the market value of the land.

Subject- Alcoholic Beverages in Riverfront Park
COMMENT:
This amendatory ordinance would permit the use of alcoholic beverages
in Riverfront Park by persons attending functions in the park sponsored
by organizations renting civic center complex facilities.
Chapter 20, Section 20-10 (h) of the City Code prohibits possession,
sale and consumption of alcohol in city parks with specific exceptions
for Fair Park buildings and the coliseum area.
The amendatory ordinance would add an exception for Riverfront Park as
item "d. " on the list of areas where the prohibition would not apply,
as follows :
"d) within Riverfront Park so long as the sale is to and
possession and consumption is by, persons who are
attending functions sponsored by groups or organiza-
tions and which are held in conjunction with the
rental and use of facilities in the civic center
complex. "
ORDINANCE NO.
ENTITLED AN ORDINANCE AMENDING CHAPTER
20 SECTION 20-10( H) OF THE CODE OF
ORDINANCES OF THE CITY OF BEAUMONT TO
ALLOW THE SALE, CONSUMPTION AND
POSSESSION OF ALCOHOLIC BEVERAGES IN
RIVERFRONT PARK ; PROVIDING FOR
SEVE RABILITY; PROVIDING FOR REPEAL AND
PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
That Chapter 20, Section 20-10( h) of the Code of Ordinances
of the City of Beaumont be, and the same is hereby , amended to read
as follows:
Section 20-10(h) :
No person shall sell, consume or possess any
alcoholic beverage within any park of the City.
The prohibition against sale, consumption and
possession of alcoholic beverages shall not
apply in the following areas:
a) inside the Harvest Club;
b) inside the YMBL Building;
c) inside the Coliseum or the fenced
area surrounding the Coliseum;
d) within Riverfront Park so long as the
,awi sale is to and possession and
consumption is by , persons who are
attending functions sponsored by groups
or organizations and which are held in
conjunction with the rental and use of
facilities in the civic center
complex.
The prohibition against the consumption and
possession of alcoholic beverages at Fair Park
shall not apply inside any permanent building
except concession stands .
Section 2 .
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set of
persons or circumstances, should for any reason be held to be
invalid, such invalidity shall not affect the remaining portions of
this ordinance, and to such end the various portions and provisions
of this ordinance are declared to be severable .
Section 3 .
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only .
