HomeMy WebLinkAboutORD 06-068 ORDINANCE NO. 06-068 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW COMMERCIAL RETAIL FACILITIES, A RESTAURANT,CONDOMINIUMS AND RELATED PARKING LOTS IN A GC-MD-2 (GENERAL COMMERCIAL-MULTIPLE FAMILY DWELLING-2) DISTRICT LOCATED IN THE 3600 BLOCK OF DOWLEN ROAD IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS,the City Council for the City of Beaumont desires to issue a specific use permit to LLM Development Group, Inc. to allow commercial retail facilities, a restaurant, condominiums and related parking lots in a GC-MD-2(General Commercial-Multiple Family Dwelling-2) District located in the 3600 block of Dowlen Road, as described in Exhibit "A" and shown on Exhibit "B" attached hereto; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That a specific use permit to allow commercial retail facilities, a restaurant, condominiums and related parking lots in a GC-MD-2 (General Commercial-Multiple Family Dwelling-2) District located in the 3600 block of Dowlen Road, as described in Exhibit "A" and shown on Exhibit "B" attached hereto and made a part hereof for all purposes, is hereby granted to LLM Development Group, Inc., their legal representatives, successors and assigns, subject to the following conditions: Require an 8' tall opaque fence along the south and west sides of the subject property. Require that all lighting in the development, both on the buildings and in the parking lots, be low wattage, shielded, directed downward and be placed as far away as possible from the southern property line. On the southernmost building, require the dumpster to be located on the north side of the building and be surrounded on three sides by a cinder block enclosure. Section 2. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit "C" and made a part hereof for all purposes. Section 3. Notwithstanding the site plan attached hereto,the use of the property herein above described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.
