ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE
PERMIT TO ALLOW COMMERCIAL RETAIL FACILITIES, A
RESTAURANT,CONDOMINIUMS AND RELATED PARKING
LOTS IN A GC-MD-2 (GENERAL COMMERCIAL-MULTIPLE
FAMILY DWELLING-2) DISTRICT LOCATED IN THE 3600
BLOCK OF DOWLEN ROAD IN THE CITY OF BEAUMONT,
JEFFERSON COUNTY, TEXAS.
WHEREAS,the City Council for the City of Beaumont desires to issue a specific use
permit to LLM Development Group, Inc. to allow commercial retail facilities, a restaurant,
condominiums and related parking lots in a GC-MD-2(General Commercial-Multiple Family
Dwelling-2) District located in the 3600 block of Dowlen Road, as described in Exhibit "A"
and shown on Exhibit "B" attached hereto; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That a specific use permit to allow commercial retail facilities, a restaurant, condominiums
and related parking lots in a GC-MD-2 (General Commercial-Multiple Family Dwelling-2)
District located in the 3600 block of Dowlen Road, as described in Exhibit "A" and shown
on Exhibit "B" attached hereto and made a part hereof for all purposes, is hereby granted
to LLM Development Group, Inc., their legal representatives, successors and assigns,
subject to the following conditions:
Require an 8' tall opaque fence along the south and west sides of the subject
property.
Require that all lighting in the development, both on the buildings and in the
parking lots, be low wattage, shielded, directed downward and be placed as far
away as possible from the southern property line.
On the southernmost building, require the dumpster to be located on the north
side of the building and be surrounded on three sides by a cinder block
enclosure.
Section 2.
That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as Exhibit "C"
and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto,the use of the property herein above
described shall be in all other respects subject to all of the applicable regulations contained
in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 24th day of
October, 2006.

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
BEING a 5.880 acre tract or parcel of land situated in the H. Williams Survey, Abstract
No. 56, Jefferson County, Texas and being out of and part of that certain called 19.30 acre
tract of land as described in "Special Warranty Deed" from The Young Men's Christian
Association of Beaumont, Texas to LLM Development Group. Inc. as recorded in Clerk's
File No. 2005025119 Official Public Records of Real Property, Jefferson County, Texas;
said 5.880 acre tract being more particularly described as follows:
NOTE: All bearings are based on the West Right-of-Way line of Dowlen
Road and the East line of the herein described tract as SOUTH 00°39'17"
East as recorded in Clerk's File No. 9807948, Official Public Records of
Real Property, Jefferson County, Texas.
BEGINNING at a Concrete Monument found in the west right-of-way line of Dowlen
Road (based on a 100' R.O.W.) for the northeast corner of Barrington Heights Subdivision
as per plat recorded in Volume 15, Page 348, of the Map Records of Jefferson County,
Jefferson County, Texas;
THENCE SOUTH 89019'50" WEST, for the boundary between the tract herein described
and the said North line Barrington Heights Subdivision a distance of 874.08 feet to a point
for corner;
THENCE NORTH 00 039'17" WEST, for the boundary between the tract herein described
and the called 5.0 acre tract for a distance of 109.03 feet to a point for corner;
THENCE NORTH 09°36'43" WEST, for the boundary between the tract herein described
and the called 5.0 acre tract, for a distance of 183.37 feet to a point for corner;
THENCE NORTH 89 020'29" EAST, over and across the tract herein described for a
distance of 902.63 feet to a point for corner;
THENCE SOUTH 00°39'21" EAST, along and with the west right-of-way line of Dowlen
Road(based on a 100' R.O.W.) for a distance of 290.00 feet to the POINT OF -
BEGINNING and containing 5.880 ACRES, more or less.
