REQUESTED ACTION: Consider approving the sale of City-owned surplus property.
RECOMMENDATION
Administration recommends the sale of one (1) parcel of City-owned surplus property to the
individual listed below for a total sum of$300.
BACKGROUND
On October 24, 2006 the lot listed below was on the consent agenda with four (4) other parcels.
The legal description of the lot was listed as Gold Hill 3 Addition, Lot 7, Block 17. This was an
incorrect description. The correct legal description is Gold Hill 3 Addition, Lot 14, Block 5.
Bids were received Thursday, September 21, 2006 for the sale of City-owned surplus property.
The legal description and the bidder for this property is listed below:

REQUESTED ACTION: Consider a Resolution authorizing the City Manager to
execute all documents necessary to accept the project titled
"FY07 S. T. E. P. Waves".
RECOMMENDATION
Administration recommends authorizing City Manager to execute all documents necessaryto accept
the project titled"FY07 S. T. E. P. Waves"which occurs between October 1, 2006 and September
30, 2007.
BACKGROUND
In January, 1999, the City Council passed a resolution authorizing the city to apply for matching
funds for a traffic safety"Safe and Sober S. T. E. P." grant project. The Police Department has
successfully applied for and the City Council approved several traffic safety grants since that one.
This grant application will provide funding for a "FY07 S. T. E. P. Waves" grant program. The
grant would be in the amount not to exceed Thirteen Thousand Thirty Four($13,034)Dollars from
the Texas Department of Transportation with a city"match" funding of Seven Thousand Eighteen
($7,018) Dollars.
BUDGETARYIMPACT
City would receive grant funding in a total amount of Thirteen Thousand Thirty Four($13,034.00)
Dollars with a city contribution of Seven Thousand Eighteen ($7,018) Dollars.
PREVIOUS ACTION
The City has participated in"S. T. E. P."traffic enforcement grants in prior years.

RESOLUTION NO.
BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
WHEREAS, the City of Beaumont has been notified by the Texas Department of
Transportation that it is eligible to receive funding to assist in highway safety enforcement;
and,
WHEREAS, the City of Beaumont recognizes that the safety and security of the
motoring public is of paramount concern to the City; and,
WHEREAS, the City of Beaumont strives to enhance the safety of the motoring public;
and,
WHEREAS, grant funding through the Texas Department of Transportation would
assist in enhancing the safety of the motoring public and reducing motor vehicle crashes
which often result in loss of life or personal injury; and,
WHEREAS, traffic safety enforcement and encouragement of safe driving habits is
a significant goal of the Beaumont Police Department; and,
WHEREAS, the City of Beaumont has been notified by the Texas Department of
Transportation that it is eligible for federal reimbursement funding in an amount not to
exceed Thirteen Thousand Thirty Four ($13,034) Dollars pursuant to the projects titled
"FY07 S.T.E.P. Waves"for occupant protection enforcement, education of the public and
speeding enforcement; and,
WHEREAS, the City of Beaumont has agreed to contribute Seven Thousand and
Eighteen ($7018) Dollars as their portion of the costs for the projects titles "FY07 S.T.E.P.
Waves"which are Thanksgiving 2006 holiday,Valentines Day 2007 holiday, Memorial Day
2007 holiday and Labor Day 2007 holiday.
NOW THEREFORE BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager of the City of Beaumont, be, and is hereby, authorized to execute
all documents necessary to accept the project "FY07 S.T.E.P. Waves" and take such
action as necessary to implement the project which occurs between October 1 st 2006 and
September 30th 2007; and,
Accept and disburse the federal reimbursement grant funding in the amount not to
exceed Thirteen Thousand Thirty Four ($13,034) Dollars; and,
Take such other actions and execute such documents as may be necessary and
appropriate to implement the purpose and objectives of the"FY07 S.T.E.P.Waves"project.

Tract 2 0.005 acre out of Lot 2, Block 8, Beaumont Addition
Owner: Jefferson County, Texas
Administration recommends authorization to accept the donation of the right-of-way described
above.
BACKGROUND
The rights-of-way above are needed for the improvements to the corner of Main and Blanchette
Streets.

Jefferson County have agreed to donate right-of-way to the City of Beaumont for the Main
and Blanchette Project described below and as shown on Exhibit "A" attached hereto;

REQUESTED ACTION: Council consider a resolution authorizing the acceptance of a ten(10)
foot wide water line easement for fire hydrants across Joe
Penland/Quality Mat property on Tram Road.
RECOMMENDATION
The Quality Mat Company and Joe Edward Penland, Sr.have agreed to convey a ten foot(10')wide
water line easement to the City of Beaumont. The Water Line Easement crosses Joe Penland/Quality
Mat property on Tram Road and will serve fire hydrants on the property(described as 0.438 acre of
land out of the City Plat RS-4, Tracts 225 and 239, W. B. Dyches Survey, Abstract 17).
Administration recommends acceptance of the easement.
BACKGROUND
The easement is to be used to provide access to the water lines and fire hydrants for the property
named above. It would also allow for the construction, alteration, operation and maintenance of
the said water lines and appurtenances.

WHEREAS, The Quality Mat Company and Joe Edward Penland, Sr. have offered
to convey a ten-foot (10') wide Water Line Easement, as described in Exhibit "A" and

WHEREAS, the City Council has considered the purpose of said conveyance and
is of the opinion that the acceptance of said conveyance is necessary essary and desirable and

REQUESTED ACTION: Council consider a request for a specific use permit for a real estate

RECOMMENDATION
The Administration recommends approval of a specific use permit for a real estate office in an RCR
(Residential Conservation and Revitalization) District at 2339 North Street with a waiver to the
fencing and landscaping requirements (no additional fencing or landscaping).
BACKGROUND
Deborah Terry is requesting a specific use permit to allow the continued operation of her real estate
office at 2339/2349 North. Ms. Terry's business location was brought to the Planning staff's
attention in August, 2006.
Ms.Terry states that she has been operating her office at 2339 North since 1992. She lives next door
at 2349 North. Normal hours of operation are Monday-Friday, 9 a.m. - 6 p.m. Ms. Terry says that
she is the only full-time employee. However, she does have three independent contractors that do
work out of her office.
In August, 2006, the City Council denied a specific use permit for a doctor's office at 2331 North
Street.

• Require an 8'tall opaque fence along the south and west sides of the subject property.
• Require that all lighting in the development,both on the buildings and in the parking
lots, be low wattage, shielded, directed downward and be placed as far away as
possible from the southern property line.
• On the southernmost building, require the dumpster to be located on the north side
of the building and be surrounded on three sides by cinder block.
BACKGROUND
Mark W. Whiteley & Associates is requesting a specific use permit to allow a commercial and
residential development in the 3 600 block of Dowlen Road. The development is called Metropolitan
Park.
In May, 2005, the City Council approved a zone change for the subject property. Due to concerns
that commercial and high density residential development might have on the Barrington Heights
subdivision to the south, GC-MD-2 zoning was put in place on the south 290' of the development.
Metropolitan Park will offer close to 30,000 sq. ft. of first floor retail space surrounding a village
green. An additional 41,000 sq. ft. of office/retail will be available on the second story. Two, three
and four bedroom condominiums ranging in size from 1,250 to 2,200 sq. ft.will be located between
the retail and the single family residential. A fitness club,private pool and spa and covered parking
will be some of the amenities available to the condominium owners.

BACKGROUND
Toya Miller is requesting a specific use permit to allow a beauty shop at 1598 Orange. The existing
shop is located on the first floor of a two story building at the rear of the subject property. Ms.Miller
lives in the house at this address. The shop has two chairs. Hours of operation are 9 a.m. - 8 p.m.,
Tuesday- Saturday. Typically,the last appointment is taken at 5:30 p.m. Ms. Miller states that she
is the only full-time employee. However, she occasionally has a part-time person wash hair.
The operation of this beauty shop was first reported to Planning staff in July, 2006. Upon
investigation,Ms. Miller was informed that a specific use permit was required for her to operate at
this location.
This neighborhood is currently zoned RM-H(Residential Multiple Family-Highest Density)District.
The subj ect property is located in an area that is,for the most part,single family residential in nature.
There are a number of historic houses in the area. A zoning study may be warranted to determine
if RS (Residential Single Family Dwelling) District zoning is more appropriate. To introduce
commercial uses into this neighborhood maybe detrimental to its stability.

RECOMMENDATION
The Administration recommends denial of a specific use permit to allow a counseling office in an
RCR(Residential Conservation and Revitalization)District at 2659 McFaddin.
BACKGROUND
Ella Mae Chisum is requesting a specific use permit to allow her to operate a counseling office at
2659 McFaddin. She currently offices across the street from the subject property at 2628 McFaddin.
Ms. Chisum states that she sees between 15 and 20 clients a week. She provides mental health
counseling Monday-Friday. A rear entrance will be provided to allow her clients privacy coming
and going.
The 2600 block of McFaddin is a mix of commercial and residential uses. Fronting on 11 h Street are
a motel and a restaurant. Except for a small apartment complex and an insurance agency parking lot,
the rest of the commercial uses in this block front on McFaddin and are located in single family
residential structures that have been converted to commercial. The subject property has been single
family residential for several years.
Enough single family residences and single family residential-type structures remain so that this block
could easily be converted back to its original residential character.

DISTRICT LOCATED AT 2659 MCFADDIN IN THE CITY OF
BEAUMONT, JEFFERSON COUNTY, TEXAS.
WHEREAS,the City Council for the City of Beaumont desires to issue a specific use
permit to Ella Mae Chisum to allow a counseling office in an RCR (Residential
Conservation and Revitalization) District located at 2659 McFaddin, being Lot 9, Block 51,
Averill Addition, City of Beaumont, Jefferson County, Texas, containing 0.172 acres, more
or less, as described on Exhibit "A" attached hereto; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens subject to the
hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That a specific use permit to allow a counseling office in an RCR (Residential
Conservation and Revitalization) District located at 2659 McFaddin, being Lot 9, Block 51,
Averill Addition, City of Beaumont, Jefferson County, Texas, containing 0.172 acres, more
or less, as described on Exhibit "A" attached hereto and made a part hereof for all
purposes, is hereby granted to Ella Mae Chisum, her legal representatives, successors and
assigns.
Section 2.
That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as Exhibit "B"
and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein above
described shall be in all other respects subject to all of the applicable regulations contained
in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.

RECOMMENDATION
The Administration recommends approval of a request for amendments to the Code of Ordinances,
Chapter 27, Trailers and Trailer Parks to amend development regulations for recreational vehicle
parks.
BACKGROUND
Sec. 27-1. Definitions.
Recreational Vehicle: A vehicular type unit primarily designed as temporary living
quarters for recreational, camping or travel use, which either has its own motive
power or is mounted on or drawn by another vehicle. The basic entities are travel
trailer,camping trailer,fifth-wheel camper and motor home. For the purposes of this
chapter, RV's shall be classified as either dependent, meaning a RV that does not
contain toilet and/or bathing facilities, or independent, a RV that contains toilet
and/or bathing facilities.
Recreational Vehicle Lot: A parcel of land in a recreational vehicle park set aside for
the placement of a single recreational vehicle and for the exclusive use of its
occupants.
Recreational Vehicle Pad: That area of a recreational vehicle lot intended for the
placement of the recreational vehicle.
Type C Recreational Vehicle Park: A parcel of land which is occupied or intended
for occupancy by recreational vehicles for transient dwelling purposes regardless of
whether or not a charge is made for such service. For the purposes of this chapter,
recreational vehicle park and travel trailer park shall have the same meaning.
Transient: To occupy a space for only a brief stay.
Sec. 27-11. Minimum standards for a type "C"recreational vehicle park.
Any recreational vehicle park hereinafter established,constructed, erected and in the
case of existing recreational vehicle parks that portion extended,
altered,expanded and/or improved shall conform to and comply with
the following minimum standards:
(A) Park area. Each recreational vehicle park shall provide a minimum of three
(3)acres in area but in no case shall there be less than fifteen(15)recreational
vehicle lots. The perimeter of every recreational vehicle park shall be
surrounded by an eight(8) foot tall solid permanent screening fence or wall.
(B) Private streets. Private streets shall be provided and shall extend
continuously from the public street right-of-way so as to provide suitable
access to all recreational vehicle sites and other facilities or uses permitted in
the recreational vehicle park. Private streets shall meet the following
standards:
(1) Minimum pavement widths shall be as follows:
(a) One way streets - fourteen (14) feet
(b) Two way streets - twenty(20) feet
(2) Private street intersections shall generally be at right angles, off-sets
at intersections of less than one hundred twenty-five (125) feet
(centerline to centerline)should be avoided,intersection ofmore than
two (2) streets at one point shall be avoided.
(3) Dead-end private streets shall be limited to a maximum length of one
thousand(1,000) feet and shall be provided with a vehicular turning
space with a turning circle of eighty(80) feet in diameter.
(4) All private streets shall be constructed of a minimum of asphalt and
shall be well drained under normal use and weather conditions.
(5) Private streets which may connect two(2)public street rights-of-way
shall by the use of curves, off-sets, location and/or the use of two (2)
or more streets be located so as to discourage through traffic.
(C) Recreational vehicle lot. Each and every recreational vehicle lot shall
conform to the following standards:
(1) Provide a minimum width of twenty-four (24) feet and a minimum
depth of sixty(65) feet.
(2) Provide a recreational vehicle pad site which will provide a hard
surface for the placement of one recreational vehicle. Minimum pad
size shall be eleven (11) feet in width and sixty-four (60) feet in
depth. Pads shall be impervious to plant material.
(3) Setbacks.
(a) Back-in lots: Pads shall be located a minimum of three (3)
feet from the recreational vehicle side lot line and a minimum
of five (5) feet from the recreational vehicle rear lot line
(b) Pull-through lots: Pads shall be located a minimum of three
(3) feet from the recreational vehicle side lot line
(c) All recreational vehicle pad sites shall be located a minimum
of ten (10) feet from any recreational vehicle park property
line.
(4) Provide sewer, water and a minimum of 30 amp electrical hookups.
One-half(%2)of the lots shall be provided 50 amp electrical hookups.
(5) Abut and/or have access to a private street for a minimum distance of
fifteen (15) feet.
(6) Frontage on two private streets shall be permitted to allow for pull-
throughs.
(7) Provide a minimum of one off-street parking space for each
recreational vehicle site. One (1) common guest space shall be
provided for every three (3)RV sites. All parking spaces shall have
a permanent all-weather surface and shall conform to the City of
Beaumont Off-Street Parking and Driveway Standards.
(8) No vehicular access to a recreational vehicle lot is permitted from a
public dedicated street.
(D) Common park facilities. Common park facilities shall be provided so as to
conform to the following standards:

(1) Usable open space. Usable open space shall be provided so as to
conform to the following standards:
(a) Conveniently situated and containing a minimum of one
thousand (1,000) square feet for the first fifteen (15)
recreational vehicle lots or three (3) acres in the recreational
vehicle park; for each additional recreational vehicle lot over
fifteen (15), twenty(20) additional square feet is required.
(b) Such open space may be in one or more areas but shall be of
such size and shape as to afford reasonable use by the
occupants.
(c) No portion of such required usable open space shall be used
for off-street parking, vehicular drive loading areas or
accessory uses, save and except recreational uses such as
swimming pools and tennis courts.
(2) Office. A minimum of three hundred (300) square feet of office
space shall be provided to provide for the check-in/check-out of park
patrons.
(3) Restrooms and Showers. A minimum of two (2) men's and two (2)
women's or four(4)unisex restrooms and showers shall be provided.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a Regular Meeting held October 16, 2006, the Planning Commission voted 7:0:1 to approve a
request for amendments to the Code of Ordinances, Chapter 27,Trailers and Trailer Parks to amend
development regulations for recreational vehicle parks.

BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
THAT Chapter 27, Section 27-1, of the Code of Ordinances of the City of Beaumont be
and the same is hereby amended to read as follows:

Site plan: A line drawing clearly describing the trailer park and its environs and shall
include adequate labeling and dimensioning of all fundamental features of the project, the
legal description of the property; north point, date, shall be drawn to engineering scale.
Trailer coach: A transportable, single-family dwelling unit which is or may be
mounted on wheels, suitable for year-round occupancy and containing the same water
supply,waste disposal and electrical conveniences as immobile housing, and shall include
the terms "mobile home" and "modular home".
Trailer Park "A": A parcel of land under single ownership which has been planned
and improved for the placement of trailer coaches for transient use, supplementary
structures and accessory uses not prohibited by Chapter 30 of this Code of Ordinances.
Trailer Park "B": A parcel of land which is (a) under multiple ownership or which
may be developed under multiple ownership; (b) recorded in its entirety as a subdivision
plat with the appropriate right-of-way dedications for streets, alleys and/or easements, lots
and blocks; and (c) for the placement of trailer coaches for nontransient use,
supplementary structures and accessory uses not prohibited by Chapter 30 of this Code
of Ordinances.
Trailer Park "C": A parcel of land which is occupied or intended for occupancy by
recreational vehicles for transient dwelling purposes regardless of whether or not a charge
is made for such service. For the purposes of this chapter, recreational vehicle park and

BACKGROUND
Terry Richard III is requesting a zone change from RS(Residential Single Family Dwelling)District
to NC(Neighborhood Commercial)District to allow him to operate a clothing store,photocopy shop
and tax return and financial services business. The property is located at 4205 Highland.
Along Highland, there is a mix of zoning districts. In addition to residential zoning, NC zoning
exists along the west side of Highland, from just north of Irby to Palm. One lot on the east side of
Highland, at Caston,is also zoned NC. South of Palm,there is RCR(Residential Conservation and
Revitalization),GC-MD(General Commercial-Multiple Family Dwelling)and GC-MD-2(General
Commercial-Multiple Family Dwelling-2) zoning.
The South Park Neighborhood Plan designates the subject property for commercial uses. This
proposed rezoning is in conformance with the Neighborhood Plan.

regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as
amended.

BACKGROUND
Tim Satre is requesting an amended specific use permit to allow him to not have to reconstruct an
T tall wood screening fence along the north side of his property at 4184 Treadway. In August, 1998,
Mr. Satre received a specific use permit for a financial advisor's office. At that time, additional
fencing was required after the adjacent property owner to the north protested. That fencing was
installed.
However, Hurricane Rita destroyed that f ence in 2005. After receiving a complaint from the
neighboring property owner, Planning staff contacted Mr. Satre that he would have to reinstall the
required fence.
Mr. Satre is now requesting an amendment to his original specific use permit's fencing requirement.
He states that he has had consistent problems servicing and maintaining that side of his building.
The property line, in some spots, is only 12" from his building. Mowing and servicing an existing
sewer line was difficult with the fence in place.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a Joint Public Hearing held October 16, 2006, the Planning Commission voted 6:2 to deny a
request for an amended specific use permit to allow the deletion of the requirement for an 8' tall

WHEREAS, Ordinance 98-51 passed on August 11, 1998 granted to Tim Satre a
specific use permit to allow a financial planning and brokerage office in an existing
residence in an RM-H (Residential Multiple Family Dwelling-Highest Density) District
located at 4184 Treadway at Collier Road intersection in the City of Beaumont, Jefferson
County, Texas; and,
WHEREAS, Tim Satre has requested an amendment to the specific use permit to
modify the screening requirements (an 8' tall wood screening fence along the north
property line) as provided for in the specific use
p permit, and,
WHEREAS, the City Council for the City of Beaumont finds that the requested
amendment would not have an adverse impact on the citizens of the City of Beaumont:
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That the specific use permit to allow a financial planning and brokerage office in an existing
residence in an RM-H (Residential Multiple Family Dwelling-Highest Density) District
located at 4184 Treadway at Collier Road intersection, being Tax Roll Tract No. 109, Plat
D-22, F. Bigner Survey, Ab-1, said Tr. 109 being out of Block 1 of the Harvey Collier
Addition, Beaumont, Texas, containing 0.92 acres, more or less, as shown on Exhibit "A"
attached hereto, is hereby amended to modify the screenin g requirements.

Section 2.
That the previously granted specific use permit as amended herein is expressly issued for
and in accordance with each particular and detail of the site plan attached hereto as Exhibit
"B" and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property hereinabove
described shall be in all other respects subject to all of the applicable regulations contained
in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.

BACKGROUND
Mark W. Whiteley& Associates is requesting the abandonment of a 20' x 141'portion of an alley
located in Block 40 of the Van Wormer Addition. This request is being made to allow the owner
to utilize the land on both sides of the alley for a single use. In 1989, the City abandoned the
southwesterly half of the alley.
This request was sent to all interested parties. No negative responses were received.

None.

BACKGROUND
St. Luke Missionary Baptist Church is requesting an abandonment of the 2400 block of Douglas
Street. The church is located south and east of the subject property.
The church states that abandoning the street would provide a safer situation for church members;
provide additional parking for church and community functions; and provide room for the future
expansion of church facilities. The street currently dead-ends into church property.
This request was sent to all interested parties. There are water and sanitary sewer facilities in the
street right-of-way.

BACKGROUND
Judy Hardy is requesting the abandonment of the west 10'of the 15'utility easement along the rear
of h er 1 of at 7 510 C helsea P lac
e. Ms. Hardy states that she wishes to construct an i nground
swimming pool. The pool will encroach 6' into the easement. According to the survey, there is an
additional encroachment by an existing carport and metal storage building. The Planning Manager
suggested to Ms. Hardy that she include an additional 4' in her request to remedy those
encroachments as well.
This request was sent to all interested parties. Entergy has facilities in the easement,therefore they
have denied the request for an abandonment of any of the easement.

REQUESTED ACTION: Council approval of a resolution authorizing the City Manager to
execute a contract for the Rehabilitation of the Primary and Secondary
Trickling Filters.
RECOMMENDATION
Administration recommends approval of a contract with Allco, Ltd. of Beaumont, Texas in the
amount of$1,496,254.00 for the Rehabilitation of the Primary and Secondary Trickling Filters. The
project will remove and replace the primary and secondary truss arms, distribution tubes, center
column assembly and turntables,install two new 42 inch and two new 36 inch sluice gates,repair the
division boxes and replace electrical components related to the project.
The MBE goal will be met through a subcontract with the certified MBE firm of Vision Equipment
of Spring,Texas for a total amount of$925,000.00. This amount represents 61.8 percent of the total
bid.
BACKGROUND
The primary and secondary filters were originally built in 1952. The proposed additions and
modifications to the trickling filters are mandated by equipment failure,increased flows during normal
operational conditions and deteriorated structures and equipment. The project will rehabilitate and
replace structural components and install new equipment to meet present and future demands and
State and Federal regulations.
BUDGETARY IMPACT
Funds for the project are available in the Capital Program.

RECOMMENDATION
The administration requests approval of a resolution to write-off uncollectible delinquent accounts
totaling $1,350,376.80 for which each individual account exceeds $1,000.
BACKGROUND
This request is in accordance with the write-off policy approved by City Council on December 21,
1999. The policy gives Council the final authority to write-off any individual account receivable
identified as uncollectible when the balance due exceeds $1,000. All accounts included are for
transactions between 1999 and 2005 and collection efforts have been unsuccessful. A summary by
receivable type is shown below.
1. BuildingPermits- $157.50
Write offrequest involves 1 business who had incurred charges for permits between 1999 and
2000. The business owner could not be located and the City's collection agency has been
unable to collect.
2. EMS Ambulance Charles - $1,099,806.75
These charges include uninsured claims or co-pay and deductibles that the customer should
be responsible for. Original charge dates range from April 2002 to February 2005 and
accounts have been with the collection agency for at least one year.
3. Landfill Usage_Fees - $8,973.00
Includes one account from 2004 that is out of business.
4. Weed Abatement Charges - $241,439.55
Charges included are for transactions between May 2002 and February 2005 and have been
with the City's collection agency for at least one year. These account are difficult to collect
because of limited owner information,
Auditors have requested that uncollectible balances be cleared from subsidiary ledgers. If at any time
an account becomes collectible after having been written-off, the receivables of the City shall be
adjusted accordingly. The balance of the account shall be reinstated and payments shall be applied
to that balance.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
Council approved a resolution to write-off uncollectible delinquent account totaling $2,274,549.85
on December 13, 2005.

BACKGROUND
The State Homeland Security Program is administered through the Southeast Texas Regional
Planning Commission and is intended to enhance capabilities of jurisdictions to prevent terrorism.
Regional emergency exercises are intended to enhance capabilities and performance in responding
to homeland security threats, and tests and improves plans, procedures, coordination between
agencies, communication, training and equipment. TDEx is a web-based secure information
sharing network which will connect law enforcement databases in the state and with federal
agencies. It can be used to quickly search subject or incident information, locally, statewide and
nationally. Live Scan is a fully integrated electronic identification system that will allow the police
department to capture fingerprints, mug shots and data at one integrated booking station, and will
shorten booking procedures and background checks.
BUDGETARY IMPACT
An additional $ 307,988.45 in city equipment with no matching funds required.

• WHEREAS, on September 12, 2006, the City Council passed Resolution NO. 06-
266 authorizing the City Manager to apply for and receive funding in the amount of
$217,819.43 through the Department of Homeland Security Law Enforcement Terrorism
Prevention Program (LETPP) to enhance capabilities of law enforcement agencies to
prevent terrorism; and,
WHEREAS, an additional $90,169.02 is available to the City through the State
Homeland Security Program resulting in a total grant amount of$307,988.45 through the
U. S. Department of Homeland Security Home Grant Program.
NOW, THEREFORE, BE IT RESOLVED that the Mayor is hereby authorized to
execute the necessary documents to receive the total grant proceeds in the amount of
$307,988.45 as a sub-recipient of grant funds from the Homeland Security Home Grant
Program.
BE IT ALSO RESOLVED THAT the Mayor is hereby authorized to execute a
memorandum of election regarding state use of Homeland Security grant funding for
statewide local protection on behalf of the City of Beaumont for the implementation of
statewide interoperability with Regional Emergency Exercises, Texas Data Exchange

fees received from developers for past and future projects.
RECOMMENDATION
The administration requests approval of a resolution to charge an administrative fee to the Beaumont
Housing Finance Corporation and the Beaumont Multi Family Housing Finance Corporation in an
amount equal to the fees such corporations receive from developers for past and future projects.
BACKGROUND
Because the Corporations are funding conduits and have no other activities, they rely on the City of
Beaumont to provide any administrative services necessary relating to their issues.From time to time
they receive application fees and/or administrative fees from developers. The Corporations have no
bank accounts or any other transactions aside from the issuance and payment of debt.For that reason,
it is requested that the City charge the Beaumont Housing Finance Corporation and the Beaumont
Multi-Family Housing Finance Corporation fees for administrative services equal to the application
and administrative fees received from developers for past and future projects to compensate the City
for administrative services provided.
State law provides that these Corporations are separate legal entities from the City and the City is not
responsible for any debt incurred by the Corporations.
BUDGETARY IMPACT
Revenues received will be deposited in the General Fund.

WHEREAS, City staff provide administrative services to both the Beaumont Housing
Finance Corporation and the Beaumont Multi-Family Housing Finance Corporation in the
administration of the Corporation's projects; and,
WHEREAS, fees received from developers should be charged to the Corporations
as fees for services provided by the City;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Council hereby approves charging to the Beaumont Housing Finance
Corporation and the Beaumont Multi-Family Housing Finance Corporation administrative
fees for services provided by the City in an amount equal to the application and
administrative fees received from developers for past and future projects.
