WHEREAS, an agreement has been negotiated for the acquisition of property at
790 Orleans Street for its appraised value for use by the Police Department;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the purchase of the following described property, as shown on Exhibit"A" attached
hereto, in the amount of$480,000 be and the same is hereby approved:
Southeast 80' of Lots 305, 306, 307, 308 and 309, Block 49,
Beaumont Addition (790 Orleans Street)
Appraiser: Bishop Real Estate Appraisers,
Inc.
Total Appraised Value: $480,000
Owner: Goodwill Industries of SE Texas
and SW Louisiana
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 10th day of
October, 2006.

Consideration: Ten Dollars and other good and valuable consideration, the receipt
and sufficiency of which is hereby acknowledged.
Property:
BEING the Southeast Eighty feet (S.E. 801) of Lot Numbers Three
Hundred Five (305), Three Hundred Six (306), Three Hundred Seven
(307), Three Hundred Eight (308) and Three Hundred Nine (309), in
Block No. Forty-nine (49), in ORIGINAL TOWNSITE OF THE
CITY OF BEAUMONT, and being a tract of land Eighty feet(801) in
width fronting on both Orleans and Park Streets, and Three
Hundred feet (3001) in length fronting or immediately adjacent to
Wall Street in the City of Beaumont and described by metes and
bounds as follows:
BEGINNING at the most Easterly corner of Lot no. Three Hundred
Five (305), in Block No. Forty-nine (49) at the corner of Orleans and
Wall Streets, a 5/8 in. iron bar for corner;
THENCE in a Southwesterly direction along the Northwesterly
right-or-way line of Wall Street and the Southeasterly line of said
block a distance of Three Hundred feet (3001) to a 5/8 in. iron bar for
corner, said corner being the most southerly corner of said block and
also being the corner of Park and Wall Streets;

THENCE in a Northwesterly direction along the right-of-way line of
Park Street and the Southwesterly line of said Block Forty-nine (49),
a distance of Eighty feet(801) to a point for corner;
THENCE in a Northeasterly direction on a line parallel with first
call, a distance of Three Hundred feet (300') across Lots Three
Hundred Nine (309), Three Hundred Eight(308), Three Hundred
Seven (307), Three3 Hundred Six (306) and Three Hundred Five
(305) to a point for corner in the Northeast line of Lot Three
Hundred Five (305), in Block Forty-nine (49), said point being in the
Southwest right-of-way line of Orleans Street;
THENCE in a Southeasterly direction along said lot line and said
right-of-way line a distance of eighty feet (80') to the POINT OF
BEGINNING.
Exceptions to
Conveyance and
Warranty: This conveyance is made subject to the following:
(a) all prior reservations, conveyances, agreements, leases, and/or other
agreements, if any, related to the mineral estate of the hereinabove
described property as shown in the records of the County Clerk of
Jefferson County,Texas;
(b) any and all validly existing easements,encumbrances, conditions and
restrictions, if any, relating to the hereinabove described property as
now reflected by the records of the County Clerk of Jefferson County,
Texas;
(c) ad valorem taxes for the current year and subsequent years,together
with any subsequent assessments for prior years due to changes in land
usage and/or ownership;
(d) all existing statutes,zoning laws,ordinances,rules and/or regulations
of municipal, county, state, federal and other governmental entities, to
the extent same affect the hereinabove described property; and
(e) additional reservations, easements, covenants, conditions and/or
restrictions created or otherwise set forth herein,if any.
Conveyance and
Warranty
Of Title: Grantor, for the consideration but subject to the exceptions to the
conveyance and warranty, GRANTS, SELLS and CONVEYS unto
the Grantee, the Property, together with all singular the rights and
appurtenances thereto in anywise belonging, TO HAVE AND TO

HOLD it to Grantee, Grantee's heirs, devisees, administrators,
executors, personal representatives, successors and assigns forever.
Grantor binds Grantor, Grantor's heirs, devisees, administrators,
executors, personal representatives, successors and assigns to warrant
and forever defend the Property hereby conveyed unto the Grantee,
the Grantee's heirs, devisees, administrators, executors, personal
representatives, successors and assigns against every person lawfully
claiming or to claim the same or any part thereof, but subject to the
exceptions to the conveyance and warranty stated above.
