REQUESTED ACTION: Council consider a resolution authorizing the execution of a License
to Encroach Agreement with Neches Street Properties, L.L.C.,
through their agent Apollo Environmental Strategies, Inc., on the
City's right-of-way on Milam and Neches Streets for the installation
of three(3) groundwater monitoring wells.
RECOMMENDATION
The groundwater monitoring wells will be installed by Apollo Environmental Strategies,Inc. The
license will cover the wells at the following locations:
MW-23 encroaching onto the City's right-of-way,one hundred twenty-six(126)feet
west of the edge of the pavement of Milam Street and eight(8)feet north of the edge
of pavement of Neches Street.
MW-24 encroaching onto the City's right-of-way, sixty-one (61) feet west of the
edge of the pavement of Milam Street and eight (8) feet north of the edge of
pavement of Neches Street.
MW-25 encroaching onto the City's right-of-way, fifty-four (54) feet north of the
edge of the pavement of Neches Street and eight feet six inches (8' 6") west of the
edge of pavement of Milam Street.
The administration recommends authorization to execute the License to Encroach Agreement.
BACKGROUND
The groundwater monitoring wells are being installed to delineate groundwater contamination.
The License Agreement protects the City from liability and provides a thirty(30)day cancellation
clause.
BUDGETARYIMPACT
There is a one time fee of$500 for the License to Encroach.

RESOLUTION NO.
WHEREAS, Neches Street Properties, L.L.C., through their agent Apollo
Environmental Strategies, Inc., has requested the City of Beaumont to allow them to
encroach on street rights-of-way to install three (3) groundwater monitoring wells to
delineate groundwater contamination at the following locations as depicted on Exhibit"A"
attached hereto and made a part hereof for all purposes:
MW-23 encroaching onto the City's right-of-way, one hundred twenty-six (126)
feet west of the edge of the pavement of Milam Street and eight (8)feet north of
the edge of pavement of Neches Street.
MW-24 encroaching onto the City's right-of-way, sixty-one (61) feet west of the
edge of the pavement of Milam Street and eight (8) feet north of the edge of
pavement of Neches Street.
MW-25 encroaching onto the City's right-of-way, fifty-four (54) feet north of the
edge of the pavement of Neches Street and eight feet six inches (8' 6") west of
the edge of pavement of Milam Street;
and,
WHEREAS City staff has expended considerable time and effort in investigating the
effect of such encroachment upon the City and utilities serving the same; and,
WHEREAS, it appears that it would be equitable to allow such encroachment at this
time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager is hereby authorized to execute a License to Encroach to
Neches Street Properties, L.L.C., to encroach on the above-referenced street rights-of-
way to install three (3) groundwater monitoring wells to delineate groundwater
contamination, if any, at the locations shown above and as depicted on Exhibit "A"
attached hereto and made a part hereof for all purposes, for a one-time fee of Five
Hundred Dollars ($500).

RECOMMENDATION
Administration recommends the purchase of twenty(20)laptop computers for$1,723.66 each from
Dell Computer Corporation of Round Rock, Texas.
BACKGROUND
The State of Texas Cooperative Purchasing Program offers the Catalog Purchasing Program for the
purchase ofhigh technology items. A list of qualified Catalog Information Services Vendors(CISV)
is provided by the State for the procurement of high technology goods such as personal computers,
software, and telecommunications'systems. Vendors must offer a published catalog or an Internet
site describing their products and prices. Local entities must contact a minimum of three(3)vendors
for furnishing bids on specified products. In addition to price,the award of the bid may be based on
criteria such as technical support,expansion and upgrading,and compatibility with existing systems.
Bids were solicited from five (5) CISV companies for twenty (20) laptop computers. Bids were
received from two(2)qualified vendors as indicated below. Minimum specifications include a 2.0
Gigahertz (GHz) processor, 80 Gigabyte (GB) Hard Drive, and 1 GB Random Access Memory
(RAM). The new laptops will replace desktop computers used by detectives in the Police
Department's Criminal Investigations Division. The laptops will allow detectives to enter and
manage criminal case files from the field as well as from their offices.

amount of $1,723.66 each for a total cost of$34,473.20; and,
WHEREAS, the City Council is of the opinion that the bid submitted by Dell
Computer Corporation, Round Rock, Texas, should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the bid submitted by Dell Computer Corporation, Round Rock, Texas, for the
purchase of laptop computers forthe Police Department's Criminal Investigations Division
in the amount of$1,723.66 each for a total cost of$34,473.20 be accepted by the City of

The City Council shall elect one of its members as Mayor Pro Tempore for a one(1)year term.
The Mayor Pro Tempore shall perform the duties of the Mayor in case of the absence or inability
of the Mayor to perform the duties of the office, and, if a vacancy occurs, shall become Mayor for
the unexpired term. If the Mayor Pro Tempore is unwilling to assume the duties of Mayor in the

REQUESTED ACTION: Council approval of a resolution authorizing the City Manager to
execute a contract for the Proposed 2 MG Elevated Water Tank at
Dishman Road.
RECOMMENDATION
Administration recommends approval of a contract with Landmark Structures I, L.P., Fort Worth,
Texas, in the amount of$2,778,000.00 for the construction of the Proposed 2 MG Elevated Water
Tank at Dishman Road Project. The project will construct 132 feet of reinforced concrete pedestal
and install of a 2 MG steel tank with all related piping and instrumentation.
The MBE goal will be partially met through subcontracts with the certified MBE firms Cardinal Fence
of Beaumont, Texas for $21,169.00 and Gulf States Protective Coatings of LaPorte, Texas for
$204,525.00 for a total amount of$225,694.00. The amount represents 8.12 percent of the total bid.
The specialized work related to the project limits the availability and participation of minority
businesses.
BACKGROUND
The City of Beaumont was cited by TCEQ for not having sufficient elevated storage capacity for the
number of customers served.The City is required to eliminate the deficiency before August 2008.The
proposed improvements will provide the water system with additional elevated storage capacity
required to meet State and Federal regulations. In addition, the new elevated tank will increase the
water pressure in the area and provide adequate water supply for future development.
BUDGETARY IMPACT
Funds for the project are available in the Capital Program. The project's construction cost is
$167,640.00 over the estimated cost. The Capital Program has sufficient unencumbered funds to
proceed with the project due to the fact the Water and Sanitary Sewer System Improvements IH-10
Frontage Road East Walden Road to Brooks Road Project is expected to be completed at
$412,372.00 under budget which offsets this overage. The estimates for both of these projects will
be updated in the final 2007 Capital Program.

RECOMMENDATION
Administration recommends authorizing the City Manager to execute a three(3)year lease agreement
with Madeline L. Walker, for EMS Medic No. 5 facilities located at 6452 Concord Road, at a
monthly rental fee of$1,320, or$47,520 for the three-year term.
BACKGROUND
On July 1, 2000 the City originally entered into a three (3)year lease agreement with Madeline L.
Walker for the use of approximately 900 square feet of office space located at 6452 Concord Road.
The rental fee was $1,170 per month; $42,120 for the three—year term. This property provides the
primary operational headquarters for EMS Medic No. 5. This EMS station serves the north end of
the City, which is a targeted area of low to moderate income families.
The lease was renewed on July 1,2003 for three years with an increase of$100 per month,for a new
rental fee of$1,270 per month; $45,720 for the three-year term. The current lease expires June 30,
2006. The Public Health Department's Emergency Medical Services would like to remain in this
location for its EMS Med 5 operations.
Because of the rising cost of maintenance, electricity and tax expenses, the owner feels a modest
increase of$50 per month is required for the renewed lease. This would increase the monthly rental
fee from $1,270 to $1,320. The monthly rental fee includes electricity, water/sewer and

garbage disposal.
The City may terminate the lease by giving the Landlord six (6) months written notice. All other
provisions of the current lease will remain the same. The landlord is responsible for all maintenance
and repairs of the facility, including parking lots and driveways. The City is responsible for
telecommunications and housekeeping of the leased premises.
A copy of the lease in its substantial form is attached for your review.
BUDGETARY IMPACT
As consideration for the leased premises, the City agrees to pay a monthly rental fee of$1,320 for
the three-year term of the lease. Funds will be provided from the Public Health Department's
Operating Budget.

Baptist Church for parking lot improvements in consideration for the

RECOMMENDATION
Administration recommends Council authorize the City Manager to execute an agreement with First
Baptist Church for parking lot improvements in consideration for the transfer of approximately 0.48
acres to the City for the new Convention and Visitors Bureau building and parking lot.
BACKGROUND
The design for the new Convention and Visitors Bureau building, to be constructed on the southwest
corner of Willow and McFaddin Streets, is nearing completion. The size of the building and proposed
parking lot requires the acquisition of approximately 0.48 acres of property to the south of the
proposed location from First Baptist Church.
The Church has agreed to convey the property to the City in consideration for improvements to their
parking lot. In consideration of the transfer of fee title to the 0.48 acres of land, the City will make
the following improvements to the Church parking lot located on the northwest corner of Calder and
Willow Streets.
• Apply a 2-inch hot mix asphaltic concrete overlay to the existing
asphalt parking lot remaining after the taking. The overlay includes
cleaning and sealing of the existing surface and installation of a
protective fabric.
• Disconnect and remove existing parking lot poles.
• Provide and install four (4) new light poles.
• Stripe the parking lot.
• Install a concrete driveway on Willow Street.
• Provide and install softscape materials and beds to comply with the
City's landscaping ordinance.
• Demolish existing masonry brick building.
• Install limestone base and 2-inch hot mix asphalt where building was
removed.
• Provide electrical service to the parking lot lights. (Church will be
responsible for the operation of the lights.)
Additionally, the Church will be allowed to use the City parking lot after normal business hours and
conversely, the City would be allowed to use the Church's parking lot if needed. A copy of the
Agreement, in substantial form, is enclosed.
BUDGETARY IMPACT
The estimated cost of the parking lot improvements is approximately$120,000. The total value of the
land, including diminution in value to the remaining property, is $112,750.

COUNTY OF JEFFERSON § KNOW ALL MEN BY THESE PRESENTS
CITY OF BEAUMONT §
This Agreement made by and between First Baptist Church(herein called "Church")
and the City of Beaumont, Texas (herein called "City")for the purposes of acquiring
property for the proposed Convention and Visitors Bureau building and parking lot in
consideration for improvements to the First Baptist Church parking lot located on the
northwest comer of Calder and Willow Streets.
I.
The City is desirous of obtaining fee title to property south and west of the proposed
Convention and Visitors Bureau site, specifically Tract 7 (25 feet x 159.7 feet) Block
4, and an approximate 40-foot x 159.7-foot area from Tracts 5 and 6 of Block 4 and
an approximate 75-foot x 140-foot area from Tract 3 Block 3.
II.
In consideration for the Church transferring fee title to the land to the City, the City
shall make the following improvements to the parking lot owned by the Church on the
northwest comer of Calder and Willow Streets.
1. Apply a 2-inch hot mix asphaltic concrete overlay to the
existing asphalt parking lot remaining after the conveyance.
The overlay includes cleaning and sealing of the existing
surface and the installation of a protective fabric.
2. Disconnect and remove existing parking lot poles.
3. Provide and install four (4) new light poles.
4. Stripe the parking lot.
5. Install a concrete driveway on Willow Street.
6. Provide and install softscape materials and beds to comply
with the City's landscaping ordinance.
7. Demolish the existing masonry brick building.
8. Install limestone base and 2-inch of hot mix asphalt where the
building was removed.
9. Provide electrical service to the parking lot lights. (Church
will be responsible for the operation and maintenance of the
lights.)

III.
Upon completion of the aforementioned improvements, the Church would be
responsible for the maintenance and operation of their parking facility and landscaping.
IV.
It is also mutually agreed that the Church may park on the City parking lot after
normal business hours and conversely, the City may use the Church parking lot if
needed.
