Administration recommends Council approve a resolution authorizing the City Manager to execute
Change Order No. 1 in the amount of$21,741.80 to the Theodore R. John's Sr. Library Repair
Project.
BACKGROUND
On December 20, 2005, City Council awarded a contract to McInnis Construction in the amount
of $154,000 to repair Hurricane Rita damage to the Theodore R. John's Sr. Library. Repairs
include new roofing, sheetrock replacement, interior painting, rehanging wallpaper and damaged
light fixtures and carpet cleaning. During the course of these repairs, the architect for the project
noted a high failure rate of the flourescent light fixture ballasts and identified additional damage
to the ceiling grid. The failure of the ballasts is due to storm related water and high moisture
conditions in the building in the weeks following the storm. The replacement of the ballasts was
not included in the original scope of work.
Due the height of the fixtures and difficulties in changing out the ballasts after furniture placement,
the contractor was requested to provide a price to change out all of the ballasts in the reading/stack
area. The contractor's cost proposal of$20,116.80 consists of the furnishing and replacing all of
the ballasts and the extended rental of the hydraulic lift platform. Additionally, the cost to replace
the rusted suspension grid in several areas is $1,625.00.
BUDGETARY IMPACT
The cost of the additional work will be filed with the insurance carrier for reimbursement.
PREVIOUS ACTION
City Council awarded the contract for repairs to the library on December 20, 2005.

RECOMMENDATION
The Administration recommends denial of a specific use permit to allow a drinking place in a GC-
MD (General Commercial-Multiple Family Dwelling) District at 4345 Eastex Freeway.
BACKGROUND
Frederick J. Smith, Jr. has applied for a specific use permit to allow a drinking place in a GC-MD
(General Commercial-Multiple Family Dwelling)District. The property is located at 4345 Eastex
Freeway. The night club will not provide"adult entertainment". Proposed hours of operation will
be 9 p.m. -2 a.m.,Tuesday- Sunday. The applicant states that the club will cater to adults 30 years
and older.
In 2002, a specific use permit was approved by the City Council allowing a drinking place at this
address. This approval was based upon a condition that the occupancy of the night club be limited
to 244 persons. This limitation was based upon the number of parking spaces(6 1)that the applicant
could provide. Based upon the square footage of the club, 116 spaces are required. A capacity limit
of 240 persons reflects the current 60 parking spaces that the Traffic Manager has approved. The
ultimate capacity of the club will also be determined by the Fire Marshall. His determination will
be based upon a number of factors that will be considered at the time of the issuance of the certificate
of occupancy.
Two businesses now occupy the subject property,Aaron's Rentals and an insurance office. The club
will be open when the other businesses are closed.
In March, 2 004, the original specific use permit was rescinded because that night club began
providing adult entertainment which was in violation of the original specific use permit.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a Joint Public Hearing held March 20, 2006, the Planning Commission voted 7:0 to deny a
specific use permit to allow a drinking place in a GC-MD (General Commercial-Multiple Family
Dwelling) District at 4345 Eastex Freeway.
SUBSEQUENT ACTION
None.

WHEREAS,the City Council for the City of Beaumont desires to issue a specific use
permit to Frederick J. Smith, Jr. to allow a drinking place in a GC-MD (General
Commercial-Multiple Family Dwelling) District located at 4345 Eastex Freeway, being Plat
D22, Tract 53, F. Bigner Survey, City of Beaumont, Jefferson County, Texas, containing
0.996 acres, more or less, as described on Exhibit"A" attached hereto and made a part
hereof for all purposes; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens;
NOW, THEREFORE, BE IT ORDAINED BY THE

Section 1.

That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as Exhibit "B"
and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto and made a part hereof for all
purposes, the use of the property herein above described shall be in all other respects
subject to all of the applicable regulations contained in Chapter 30 of the Code of
Ordinances of Beaumont, Texas, as amended.

housing offenders for the treatment of substance abuse in a GC-MD(General Commercial-Multiple
Family Dwelling) District at 1765 and 1785 Washington Boulevard.
BACKGROUND
Land Manor, Inc./Melton Center is applying for a specific use permit to allow a halfway house for
offenders with alcohol and drug abuse problems. The property is located at 1765 and 1785
Washington Boulevard. Land Manor has operated a 49 bed indigent male substance abuse facility
at this location since 1987.
Land Manor is now applying to the Texas Department of Justice for a contract to keep services for
its adult male parolee, mandatory and community supervision (probation) therapeutic transitional
clients. Under its current TDCJ contract, Land Manor's clients have participated in a 9 month in-
prison Therapeutic Community for treatment of addiction. They also provide these male clients with
additional chemical dependency treatment and assistance through the Department of Assistive and
Rehabilitative Services.
The Melton Center is licensed by the Department of State Health Services as a residential and
outpatient substance abuse facility. In addition to its 49 beds, the facility is licensed to treat 55
intensive and supportive outpatient clients. The projected length of stay at Melton Center ranges
from one to three months,depending upon the client's needs. Outpatient services may continue for
one year.

RECOMMENDATION
The Administration recommends approval of a specific use permit to allow professional offices in
an RM-H(Residential Multiple Family Dwelling-Highest Density)District at 3590 Delaware subject
to the following conditions:
• Modify Site Plan"A"by relocating Building C to the northeast corner of the property
with parking located to the south and west of the building.
• Modification to the landscaping requirements along the east side of the property (0'to
5' landscape strip)
BACKGROUND
Sheri Arnold is applying for a specific use permit to allow the construction of three office buildings
at 3590 Delaware. One of the three buildings will house Ms. Arnold's real estate business. The
other two buildings will be used for other professional office uses.
The three buildings comprise a maximum of 9,850 sq.ft.of office space. According to the site plan,
two buildings will be built initially with the third building for a future date.
Ms. Arnold has submitted two proposed site plans. She has discussed both plans with the Fire
Marshall to get his input on driveway layout. His recommendation would be Site Plan"A"with a
modification to Building C and its parking. The Fire Marshall recommends that Building C be
shifted to the northeast corner with parking located to the south and west of the building. This would
allow fire trucks to pull in and back up.
BUDGETARYIMPACT
None.

REQUESTED ACTION: Council consider the approval of a contract for the construction of
a Compressed Natural Gas (CNG) fueling facility.
RECOMMENDATION
Administration recommends approval of a contract with Pinnacle CNG Company of Midland,
Texas to furnish all labor, materials, supplies and equipment to design and build a CNG fueling
facility at Beaumont Municipal Transit (BMT) in the amount of$2,068,950.
BACKGROUND
Sixteen (16) new CNG transit buses were ordered in December 2005 for BMT. The new buses
are fueled by compressed natural gas, an alternative fuel source designed to reduce air pollution.
The cost of the buses are fully funded by a federal grant provided to entities that convert to
alternative fuel sources.
A high pressure CNG fueling facility must be constructed at BMT. The CNG fueling facility must
be capable of fueling the entire bus fleet daily. Natural gas from a nearby CenterPoint gas line
will be piped to the facility for onsite compression.
Requests for bids from contractors to design, build, test, operate and maintain a CNG fueling
facility were received March 9, 2006. Contractors were instructed to propose a system capable
of fueling transit buses within certain parameters. The parameters included the ability to fuel at
least seven (7) buses per hour, or each bus in eight (8) minutes or less. The requested two-hose
fast-fill dispensing system is a fully automated, self service vehicle fueling station.
The design and build proposals received are listed in the table below.

* Add-on options include a redundant compressor, backup generator, and vehicle data modules
for each bus.
The optional redundant compressor will ensure continued operation in the event a compressor is
unavailable. The optional diesel-fueled backup generator will provide fueling operation during
a power outage. The Vehicle Data Modules, installed on each bus, store, record and transmit data
such as vehicle identification, odometer readings, engine hours, miles, miles per gallon and hours
of operation.
The successful contractor is also responsible for providing O&M services. O&M includes
performing all scheduled and unscheduled maintenance and repairs as needed. All parts, labor
and materials shall be provided by the contractor to ensure the continuous operation of the CNG
facility. The O&M services were requested for a ten(10)year period and the annual cost is based
on fuel usage.
Three(3)of the four(4)proposals received included the requested O&M service agreement. BGI
of Beaumont submitted the highest bid to design and build the facility, but proposed an extended
equipment warranty agreement in lieu of an O&M service agreement. Beaumont Municipal
Transit does not have staff knowledgeable and experienced in the maintenance and repair of a
CNG facility, therefore, it is imperative that the City contract for O&M services.
The apparent low bidder, Pinnacle CNG Company, proposes to meet the 1,260 Standard Cubic
Feet Per Minute(SCFM)compression requirement by installing two(2) 630 SUM compressors.
These compressors are designed to dispense CNG at fueling rates in excess of 10 gallons per
minute. They also propose an additional 630 SUM redundant compressor, a 550 KW diesel
powered backup generator and Vehicle Data Modules. Pinnacle's first year O&M cost, based on
projected fuel usage of 378,000 therms, is a minimum of $119,000. (A therm is a unit of
measurement for natural gas. One gallon of diesel is equal to 1.37 therms.) The remaining years'

cost, based on a projected annual fuel usage of 452,000 therms, is a minimum of$131,000. It
is projected, based on current diesel fuel usage, that the buses will use approximately 420,000
therms per year of CNG.
Pinnacle has built numerous CNG fueling facilities in Texas and California. They have built CNG
fueling facilities for the Fort Worth Transportation Agency and the City of Dallas. In California,
references include the United Parcel Service Center in West Sacramento, San Ramon and Fresno,
California, the State of California Department of Transportation in Los Angeles, Ventura County
and numerous other government entities.
Based on references, costs and the proposed system, Pinnacle CNG Company's design and build
proposal was recommended by a review committee consisting of staff from Public Works,
Beaumont Transit and Purchasing.
Completion of the project is expected to be in six (6) months.
BUDGETARY IMPACT
Funding will be provided for the construction of the facility from the following sources:
1) a grant from the Texas Emissions Reduction Plan(TERP) through the Texas Commission
on Environmental Quality (TCEQ) in the amount of$472,600 with no City match;
2) a grant from South East Texas Regional Planning Commission(SETRPC)through Federal
Transit Administration (FTA) Congestion Mitigation and Air Quality (CMAQ) in the
amount of$200,000 with the City's match of$50,000;
3) a grant from the FTA CMAQ in the amount of $1,550,000 with the City's match of
$387,500.
The FTA will provide 80% of the funding for the annual O&M costs with the remaining 20%
funded by the City.

RECOMMENDATION
Administration recommends the purchase of auditorium seating for the Julie Rogers Theatre from
Rick Lowe&Company,a distributor for American Seating Company,in the amount of$455,391.72.
The contract for seating has been awarded by the Texas Building and Procurement Commission,
Texas Multiple Award Schedule(TXMAS) and is available to governmental entities.
BACKGROUND
The Julie Rogers Theatre was severely damaged during Hurricane Rita. As a result, the auditorium
seating was removed and discarded due to extensive water damage. Preparations are currently
underway for a complete renovation of the building.
American Seating Company provided the original seats in 1983. They have the auditorium's original
seating layout of 1,701 chairs. They can begin production immediately for delivery and installation
in approximately sixteen (16) weeks. The chairs will be similar in style with a plastic outer back,
wood arm rests and cast iron end panels. The vinyl backed suede fabric chosen is more durable and
resistant to spills and stains than the original fabric.
BUDGETARY IMPACT
Funds for replacement of the auditorium seating will be provided by insurance proceeds.

RECOMMENDATION
Administration recommends the purchase of radio equipment through the Houston-Galveston Area
Council (H-GAC) Cooperative Purchasing Program at a total cost of $191,911.95, with the
equipment to be ordered from Motorola.
BACKGROUND
The purchase will allow the Beaumont Police Department to add radio equipment which will
enhance communication among first responders in the prevention and response to any criminal
activity on the waterway within its jurisdiction, and to assist other agencies in the region. The
radio equipment is being purchased in conjunction with other law enforcement equipment to
facilitate crime prevention and emergency response in ports under an initiative by the Department
of Homeland Security.
The equipment to be purchased includes sixty-five (65) Motorola 800 MHz mobile radios for use
in police vehicles, five(5)of which are encrypted digital(scrambled signal for non-detection), and
the balance are digital mobiles, an upgrade from the analog radios currently in use in patrol
vehicles. A detailed breakdown of the cost is attached for review.
The purchase price will include a three(3) year full warranty on all equipment. Warranty service
will be provided by Motorola. Delivery is expected within four (4) weeks after receipt of order.
BUDGETARY IMPACT
Funding for this expenditure will be provided by a grant obtained from the Department of
Homeland Security.

The radio equipment being purchased will allow the Beaumont Municipal Transit system to be
added to the 800 mHz radio trunking system currently utilized by Police and Fire. This will

existing system to be expanded by one channel. This will preclude overloading the existing
system and should enhance reception due to lower radio traffic per channel.
The equipment to be purchased includes equipment module for the additional channel, four (4)
desk-top radio control stations for Transit dispatch and office personnel to communicate with field
personnel; sixteen (16) dash-mount digital mobile radios for use in nine (9) existing paratransit
vehicles and three (3) buses to be retained, and in four (4) support vehicles; eight (8) hand-held
digital portable radios for support and field personnel; ancillary equipment necessary to connect
the system to the existing communication grid; and system integration, installation and post-sale
support to be provided by Motorola. A detailed breakdown of the cost is attached for review.
The purchase price will include a three (3) year full warranty on all equipment. Warranty service

FTA grant utilized recently to purchase CNG powered buses.

RECOMMENDATION
The Administration recommends that Council conduct a Public Hearing to receive public comments
on Public Services, which includes the Emergency Shelter Set-Aside and the Public Facilities &
Improvements line items of the 2006 Consolidated Grant Program Annual Action Plan.
BACKGROUND
As mandated by the United States Department ofHousing and Urban Development,City Council has
conducted such Public Hearings in previous years, prior to adopting the City's Final Annual Action
Plan. In addition, the Community Development Advisory Committee (CDAC) has held five (5)
meetings to discuss the 2006 Action Plan, in order to make its recommendations to City Council.
BUDGETARY IMPACT
The 2006 federal allocation of$2,730,362 is comprised of$1,818,982 in Community Development
Block Grant funds, $761,380 in HOME funds and an estimated $150,000 in Program Income.
During the February 21, 2006 Public Hearing, Council allocated $100,000 to the Public
Services/Public Facilities and Improvements line item and$85,000 to the Public Services/Emergency
Shelter Set-Aside line item.
PREVIOUS ACTION
Council adopted the 2006 Preliminary Budget on Tuesday, February 21, 2006.
SUBSEQUENT ACTION
Council will decide the budget allocations for Public Services,which includes Emergency Shelter Set-
Aside,Public Facilities and Improvements line items and issue a resolution adopting the 2006 Annual
Action Plan of the Five Year Consolidated Plan on Tuesday, April 11, 2006.
