ENTITLED AN ORDINANCE ESTABLISHING A MUNICIPAL
COURT JUVENILE CASE MANAGER FUND AND
PROVIDING FOR THE ASSESSMENT AND COLLECTION
OF A $2.50 MUNICIPAL COURT JUVENILE CASE
MANAGER FEE; PROVIDING FOR SEVERABILITY;
PROVIDING FOR PENALTY AND PROVIDING FOR
REPEAL.
Section 1.
WHEREAS, Article 102.0174 of the Texas Code of Criminal Procedures provides
for the establishment of a Municipal Court Juvenile Case Manager Fund; and,
WHEREAS, a $2.50 Juvenile Case Manager fee shall be collected to provide
monies for such fund;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT
Section 2.
THAT there is hereby established a Municipal Court Juvenile Case Manager Fund, the
money from which may only be used for the purposes outlined in Article 102.0174 of the
Code of Criminal Procedure to provide for the salary and benefits of a Juvenile Case
Manager in the Municipal Court.
Section 3.
The Clerk of the Municipal Court shall collect a $2.50 Juvenile Case Manager fee
from each person convicted of a fine-only misdemeanor offense in Municipal Court as a
cost-of-court from and after the effective date of this Ordinance. This fee shall be
deposited into the Municipal Court Juvenile Case Manager Fund. For purposes of
collection of this Juvenile Case Managerfee a person is considered convicted if a sentence
is imposed on the person,the person receives deferred disposition,orthe person receives
deferred adjudication from the court.
Section 4.
The Municipal Court Judge is hereby authorized to waive the fee required by this
ordinance in a case of financial hardship.
Section 5.
The City Manager be and he is hereby authorized to expend monies from the fund
in accordance with the ordinances of the City of Beaumont and laws of the State of Texas.
Section 6.
That if any section, subsection, sentence, clause or phrase of this ordinance, orthe
application of same to a particular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 7.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished as provided in Section 1-8 of the Code of Ordinances of the City of Beaumont,
Texas.
Section 8.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
