BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT:
THAT the City Manager is hereby authorized to execute an amendment to the Beaumont
Police Officers Association Labor Agreement amending Articles 16 and 17 and Appendix
C attached hereto as Exhibit "A."
BE IT FURTHER RESOLVED THAT sworn Beaumont Police personnel will be
allowed to schedule fiscal year 2005 personal leave orfloating holidays through December
31, 2005. After December 31, 2005, all personal leave and floating holidays will be
scheduled pursuant to the terms of the Labor Agreement.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 20th day of

AMENDMENT TO LABOR AGREEMENT
• The City of Beaumont, a municipal corporation of the State of Texas, and Beaumont Police
Officers Association hereby agree to amend their Labor Agreement for the period October
1, 2004, through September 30, 2007, to amend Article 16, Section 5, Article 17, Section
1, and Appendix C to read as follows:
ARTICLE 16
LEAVE
Section 5. Personal Leave.
Employees will earn eight(8) or ten (10) hours of personal leave for each calendar quarter
of perfect attendance depending upon whether the employee is assigned to an eight (8)
hour or a ten (10) hour shift. In reference to personal leave only, use of any sick leave
shall constitute non-attendance. The employee may use such leave for any purpose
subject to the advance approval of the employee's commanding officer.The employee may
not carry across contract or fiscal years more than thirty-two (32) or forty (40) hours
depending upon shift assignment. An employee may not accrue more than fifty-six (56) or
sixty (60) hours of personal leave at any given time, again, depending upon the eight (8)
• or ten (10) hour shift assignment.
ARTICLE 17
HOLIDAYS
Section 1. The following holidays shall be recognized and observed:
New Year's Day
Labor Day
Good Friday
Easter Sunday
Thanksgiving Day
Day after Thanksgiving
Memorial Day
Christmas Day
Independence Day
A"floating" holiday is hereby granted to every employee during the fiscal year; scheduling
of time off must be approved by the Chief or the Chiefs designee.

EXHIBIT "A"
Holiday pay is defined as eight (8) or ten (10) hours pay at the employee's hourly rate of
pay depending upon whether the employee is assigned to an eight (8) or ten (10) hour
shift.
APPENDIX C
The Union and the Employer agree at this time that should the Employer adopt ten (10)
hour shifts in the department or in any division of the department that they will amend this
agreement and the following will apply:
Any employee who is assigned to work a ten-hour shift and is off on sick time
shall be charged 10 hours sick time.
Any employee who is assigned to work a ten-hour shift and is off on vacation
time shall be charged 10 hours vacation time.
Any employee who is assigned to work a ten-hour shift and is off on personal
leave shall be charged 10 hours personal leave.
Holiday pay for employees assigned to work 10 hours shifts is defined as 10
hours pay at the employee's hourly rate of pay. This provision also applies to
floating holidays as well.
• Any employee who is assigned to work a ten hour shift shall accrue personal
leave and floating holidays based upon a ten-hour day.
If the employee who is assigned to work a 10-hour shift takes off or is required
to take off on a Holiday that falls on his regular day to work shall receive 10
hours holiday pay.
Any employee who is assigned to work a 10-hour shift and attends a school
or any other city business during his regular shift shall be paid for 10 hours up
to a maximum 40-hour week.
Any disciplinary actions involving suspensions taken against an employee who
is assigned to work a 10-hour shift shall be listed in hours rather days.
Shift differential will be implemented as follows:
Any officer whose regular shift shall begin between the hours
of 0600-1100 hours shall not receive shift differential.

Anyofficerwhose regular shift shall begin between 1100 hours
. and 1600 hours shall receive $.20 per hour.
Anyofficerwhose regularshift shall begin between 1600 hours
and 2100 hours shall receive $.27 per hour.
Anyofficerwhose regularshift begins between 2100 hours and
0600 hours shall receive $.35 per hour.
