Approve compensation for the City Manager
The City Manager, Kyle Hayes, will be paid a base salary of$11,708.33 per month The City of
Beaumont will make an annual contribution of$14,000 to the International City/County Management
Association's Deferred Compensation Program. The City Manager will continue to receive a car
allowance of$583.33 per month and a cell phone allowance of$30 per month. All other benefits
extended to civilian employees will continue to be provided as well. The compensation will be
effective on November 1, 2005.

The City Attorney,Tyrone Cooper, will be paid a base salary of$9,879.17 per month. The City of
Beaumont will make an annual contribution of$14,000 to the International City/County Management

allowance of$583.33 per month and a cell phone allowance of$30 per month. All other benefits
extended to civilian employees will continue to be provided as well. The compensation will be

REQUESTED ACTION: Council consider authorizing the City Manager to execute a grant for
general maintenance at the Beaumont Municipal Airport.
RECOMMENDATION
Administration recommends authorizing the City Manager to execute a grant with the Texas
Department of Transportation(TxDOT) for routine and general airport maintenance.
BACKGROUND
TxDOT's Aviation Division is interested in assisting with maintenance and repairs that will be needed
at the Beaumont Municipal Airport. It has offered a 50/50 matching grant up to $30,000 in state
funding to meet repair and replacement costs. The funds are intended to assist with damage caused
by Hurricane Rita and may be used in the recovery effort for improvements to the hangers,terminal,
wind indicator, lighting and approach aids and grounds.
Attached is a copy of grant agreement.
BUDGETARY IMPACT
Matching funds will be available from the Capital Reserve Fund.

GRANT FOR ROUTINE AIRPORT MAINTENANCE PROGRAM
(State Assisted Airport Routine Maintenance)

Part I - Identification of the Project
TO: The City of Beaumont, Texas
FROM: The State of Texas, acting through the Texas Department of Transportation
This Grant is made between the Texas Department of Transportation, (hereinafter
referred to as the "State"), on behalf of the State of Texas, and the City of Beaumont, Texas,
(hereinafter referred to as the "Sponsor").
This Grant Agreement is entered into between the State and Sponsor shown above, under
the authority granted and in compliance with the provisions of the Transportation Code,Chapter 21.
The project is for airport maintenance at the Beaumont Municipal Airport.
Part II- Offer of Financial Assistance
1. For the purposes of this Grant, the annual routine maintenance project cost, Amount A, is
estimated as found on Attachment A, Scope of Services, attached hereto and made a part
of this grant agreement.
State financial assistance granted will be used solely and exclusively for airport
maintenance and other incidental items as approved by the State. Actual work to be
performed under this agreement is found on Attachment A, Scope of Services. State
financial assistance, Amount B, will be for fifty percent(50%) of the eligible project costs
for this project or$30,000.00, which ever is less, per fiscal year and subject to availability
of state appropriations.
The Sponsor may request the State to provide mowing services, services to be provided at
the discretion of the State. However, mowing services will not be eligible for state
financial assistance. Sponsor will be responsible for 100% of costs of any mowing
services.

Scope of Services, Attachment A, of this Grant, may be amended, subject to availability
of state funds, to include additional approved airport maintenance work. Scope
amendments require submittal of an Amended Scope of Services,Attachment A.
Services will not be accomplished by the State until receipt of Sponsor's share of project
costs.
Only work items as described in Attachment A, Scope of Services of this Grant are
reimbursable under this grant.
Work shall be accomplished by August 31, 2006,unless otherwise approved by the State.
2. The State shall determine fair and eligible project costs for work scope. Sponsor's share
of estimated project costs, Amount C, shall be as found on Attachment A and any
amendments.
It is mutually understood and agreed that if, during the term of this agreement, the State
determines that there is an overrun in the estimated annual routine maintenance costs, the
State may increase the grant to cover the amount of the overrun within the above stated
percentages and subject to the maximum amount of state funding .
The State will not authorize expenditures in excess of the dollar amounts identified in this
Agreement and any amendments, without the consent of the Sponsor.
3. Sponsor, by accepting this Grant certifies and, upon request, shall furnish proof to the
State that it has sufficient funds to meet its share of the costs. The Sponsor grants to the
State the right to audit any books and records of the Sponsor to verify expended funds.
Upon execution of this Agreement and written demand by the State, the Sponsor's
financial obligation (Amount C) shall be due in cash and payable in full to the State.
State may request the Sponsor's financial obligation in partial payments. Should the
Sponsor fail to pay their obligation, either in whole or in part, within 30 days of written
demand, the State may exercise its rights under Paragraph V-3. Likewise, should the
State be unwilling or unable to pay its obligation in a timely manner, the failure to pay
shall be considered a breach and the Sponsor may exercise any rights and remedies it has
at law or equity.
The State shall reimburse or credit the Sponsor, at the financial closure of the project, any
excess funds provided by the Sponsor which exceed Sponsor's share(Amount C).
4. The Sponsor specifically agrees that it shall pay any project costs which exceed the
amount of financial participation agreed to by the State. It is further agreed that the
Sponsor will reimburse the State for any payment or payments made by the State which
are in excess of the percentage of financial assistance (Amount B) as stated in Paragraph
II-1.

5. Scope of Services may be accomplished by State contracts or through local contracts of
the Sponsor as determined appropriate by the State. All locally contracted work must be
approved by the State for scope and reasonable cost. Reimbursement requests for locally
contracted work shall be submitted on forms provided by the State and shall include
copies of the invoices for materials or services. Payment shall be made for no more than
50%of allowable charges.
The State will not participate in funding for force account work conducted by the
Sponsor.
6. This Grant shall terminate upon completion of the scope of services.
Part III- Sponsor Responsibilities
1. In accepting this Grant, if applicable,the Sponsor guarantees that:
a. it will, in the operation of the facility, comply with all applicable state and federal
laws, rules, regulations, procedures, covenants and assurances required by the
State in connection with this Grant; and
b. the Airport or navigational facility which is the subject of this Grant shall be
controlled by the Sponsor for a period of at least 20 years; and
C. consistent with safety and security requirements, it shall make the airport or air
navigational facility available to all types, kinds and classes of aeronautical use
without discrimination between such types, kinds and classes and shall provide
adequate public access during the period of this Grant; and
d. it shall not grant or permit anyone to exercise an exclusive right for the conduct of
aeronautical activity on or about an airport landing area. Aeronautical activities
include, but are not limited to scheduled airline flights, charter flights, flight
instruction, aircraft sales, rental and repair, sale of aviation petroleum products
and aerial applications. The landing area consists of runways or landing strips,
taxiways,parking aprons,roads, airport lighting and navigational aids; and
e. it shall not enter into any agreement nor permit any aircraft to gain direct ground
access to the sponsor's airport from private property adjacent to or in the
immediate area of the airport. Further, Sponsor shall not allow aircraft direct
ground access to private property. Sponsor shall be subject to this prohibition,
commonly known as a "through-the-fence operation," unless an exception is
granted in writing by the State due to extreme circumstances; and
f. it shall not permit non-aeronautical use of airport facilities without prior approval
of the State; and

g. the Sponsor shall submit to the State annual statements of airport revenues and
expenses when requested; and
h. all fees collected for the use of the airport shall be reasonable and
nondiscriminatory. The proceeds from such fees shall be used solely for the
development, operation and maintenance of the airport or navigational facility;
and
i. an Airport Fund shall be established by resolution, order or ordinance in the
treasury of the Sponsor, or evidence of the prior creation of an existing airport
fund or a properly executed copy of the resolution, order, or ordinance creating
such a fund, shall be submitted to the State. The fund may be an account as part of
another fund, but must be accounted for in such a manner that all revenues,
expenses, retained earnings, and balances in the account are discernible from other
types of moneys identified in the fund as a whole. All fees, charges, rents, and
money from any source derived from airport operations must be deposited in the
Airport Fund and shall not be diverted to the general revenue fund or any other
revenue fund of the Sponsor. All expenditures from the Airport Fund shall be
solely for airport purposes. Sponsor shall be ineligible for a subsequent grant or
loan by the State unless, prior to such subsequent approval of a grant or loan,
Sponsor has complied with the requirements of this subparagraph; and
j. the Sponsor shall operate runway lighting at least at low intensity from sunset to
sunrise; and
k. insofar as it is reasonable and within its power, Sponsor shall adopt and enforce
zoning regulations to restrict the height of structures and use of land adjacent to or
in the immediate vicinity of the airport to heights and activities compatible with
normal airport operations as provided in Tex. Loc. Govt. Code Ann. Sections
241.001 et seq. (Vernon and Vernon Supp.). Sponsor shall also acquire and retain
avigation easements or other property interests in or rights to use of land or
airspace, unless sponsor can show that acquisition and retention of such interest
will be impractical or will result in undue hardship to Sponsor. Sponsor shall be
ineligible for a subsequent grant or loan by the State unless Sponsor has, prior to
subsequent approval of a grant or loan, adopted and passed an airport hazard
zoning ordinance or order approved by the State.
2. The Sponsor, to the extent of its legal authority to do so, shall save harmless the State, the
State's agents, employees or contractors from all claims and liability due to activities of
the Sponsor, the Sponsor's agents or employees performed under this agreement. The
Sponsor, to the extent of its legal authority to do so, shall also save harmless the State, the
State's agents, employees or contractors from any and all expenses, including attorney
fees which might be incurred by the State in litigation or otherwise resisting claim or

liabilities which might be imposed on the State as the result of those activities by the
Sponsor, the Sponsor's agents or employees.
3. The Sponsor's acceptance of this Offer and ratification and adoption of this Grant shall be
evidenced by execution of this Grant by the Sponsor. The Grant shall comprise a
contract, constituting the obligations and rights of the State of Texas and the Sponsor
with respect to the accomplishment of the project and the operation and maintenance of
the airport.
If it becomes unreasonable or impractical to complete the project, the State may void this
agreement and release the Sponsor from any further obligation of project costs.
4. Upon entering into this Grant, Sponsor agrees to name an individual, as the Sponsor's
Authorized Representative, who shall be the State's contact with regard to this project.
The Representative shall receive all correspondence and documents associated with this
grant and shall make or shall acquire approvals and disapprovals for this grant as required
on behalf of the Sponsor, and coordinate schedule for work items as required.
5. By the acceptance of grant funds for the maintenance of eligible airport buildings, the
Sponsor certifies that the buildings are owned by the City and/or County. The buildings
may be leased but if the lease agreement specifies that the lessee is responsible for the
upkeep and repairs of the building no state funds shall be used for that purpose.
6. Sponsor shall request reimbursement of eligible project costs on forms provided by the
State. All reimbursement requests are required to include a copy of the invoices for the
materials or services. The reimbursement request will be submitted no more than once a
month.
7. The Sponsor's acceptance of this Agreement shall comprise a Grant Agreement, as
provided by the Transportation Code, Chapter 21, constituting the contractual obligations
and rights of the State of Texas and the Sponsor with respect to the accomplishment of
the airport maintenance and compliance with the assurances and conditions as provided.
Such Grant Agreement shall become effective upon the State's written Notice to Proceed
issued following execution of this agreement.

PART IV-Nomination of the Agent
1. The Sponsor designates the State as the party to receive and disburse all funds used, or to
be used, in payment of the costs of the project, or in reimbursement to either of the parties
for costs incurred.
2. The State shall, for all purposes in connection with the project identified above, be the
Agent of the Sponsor. The Sponsor grants the State a power of attorney to act as its agent
to perform the following services:
a. accept, receive, and deposit with the State any and all project funds granted,
allowed, and paid or made available by the Sponsor, the State of Texas, or any
other entity;
b. enter into contracts as necessary for execution of scope of services;
C. if State enters into a contract as Agent: exercise supervision and direction of the
project work as the State reasonably finds appropriate. Where there is an
irreconcilable conflict or difference of opinion, judgment, order or direction
between the State and the Sponsor or any service provider, the State shall issue a
written order which shall prevail and be controlling;
d. receive, review, approve and pay invoices and payment requests for services and
materials supplied in accordance with the State approved contracts;
e. obtain an audit as may be required by state regulations; the State Auditor may
conduct an audit or investigation of any entity receiving funds from TxDOT
directly under this contract or indirectly through a subcontract under this contract.
Acceptance of funds directly under this contract or indirectly through a
subcontract under this contract acts as acceptance of the authority of the State
Auditor, under the direction of the legislative audit committee, to conduct an audit
or investigation in connection with those funds. An entity that is the subject of an
audit or investigation must provide the state auditor with access to any
information the state auditor considers relevant to the investigation or audit.
f. reimburse sponsor for approved contract maintenance costs no more than once a
month.
PART V-Recitals
1. This Grant is executed for the sole benefit of the contracting parties and is not intended or
executed for the direct or incidental benefit of any third party.

2. It is the intent of this grant to not supplant local funds normally utilized for airport
maintenance, and that any state financial assistance offered under this grant be in addition
to those local funds normally dedicated for airport maintenance.
3. This Grant is subject to the applicable provisions of the Transportation Code, Chapters 21
and 22, and the Airport Zoning Act, Tex. Loc. Govt. Code Ann. Sections 241.001 et seq.
(Vernon and Vernon Supp.). Failure to comply with the terms of this Grant or with the
rules and statutes shall be considered a breach of this contract and will allow the State to
pursue the remedies for breach as stated below.
a. Of primary importance to the State is compliance with the terms and conditions
of this Grant. If, however, after all reasonable attempts to require compliance
have failed, the State finds that the Sponsor is unwilling and/or unable to comply
with any of the terms of this Grant, the State, may pursue any of the following
remedies: (1) require a refund of any financial assistance money expended
pursuant to this Grant, (2) deny Sponsor's future requests for aid, (3) request the
Attorney General to bring suit seeking reimbursement of any financial assistance
money expended on the project pursuant to this Grant, provided however, these
remedies shall not limit the State's authority to enforce its rules, regulations or
orders as otherwise provided by law, (4) declare this Grant null and void, or (5)
any other remedy available at law or in equity.
b. Venue for resolution by a court of competent jurisdiction of any dispute arising
under the terms of this Grant, or for enforcement of any of the provisions of this
Grant, is specifically set by Grant of the parties in Travis County, Texas.
4. The State reserves the right to amend or withdraw this Grant at any time prior to
acceptance by the Sponsor. The acceptance period cannot be greater than 30 days after
issuance unless extended by the State.
5. This Grant constitutes the full and total understanding of the parties concerning their
rights and responsibilities in regard to this project and shall not be modified, amended,
rescinded or revoked unless such modification, amendment, rescission or revocation is
agreed to by both parties in writing and executed by both parties.
6. All commitments by the Sponsor and the State are subject to constitutional and statutory
limitations and restrictions binding upon the Sponsor and the State (including Sections 5
and 7 of Article 11 of the Texas Constitution, if applicable) and to the availability of
funds which lawfully may be applied.

REQUESTED ACTION: Council consider a resolution authorizing the City Manager to
execute a release of a ten foot (10') wide water line easement
originally conveyed to the City by Antioch Missionary Baptist
Church.
RECOMMENDATION
The City of Beaumont,through a Release of Easement,is relinquishing a ten foot(10')wide water
line easement,accepted by the City on June 28,2005(Res.No.05-147),from Antioch Missionary
Baptist Church. The easement is located at 3920 Cardinal Drive (out of Blocks 14 and 15,M. C.
Cartwright Subdivision).
Administration recommends execution of the Release of Easement.
BACKGROUND
On June 28,2005,the Beaumont City Council passed a resolution(Res.No.05-147)authorizing the
acceptance of two (2) water line easements from Antioch Missionary Baptist Church at 3920
Cardinal Drive. Shortly after, it was discovered that the water line was not constructed within the
easement granted. An easement replacing the original one is being requested in conjunction with
this Release of Easement.

REQUESTED ACTION: Council consider a resolution authorizing the acceptance of two(2) -
ten foot (10') wide water line easements providing access for fire
prevention services.
RECOMMENDATION
Antioch Missionary Baptist Church has agreed to convey two (2)-ten foot(10')wide Water Line
Easements to the City of Beaumont. The easements will provide mandatory access for fire
prevention services for the Antioch Missionary Baptist Church located at 3920 Cardinal Drive
(out of Blocks 14 and 15, M. C. Cartwright Subdivision).
Administration recommends acceptance of the easements.
BACKGROUND
On June 28, 2005,the Beaumont City Council passed a resolution(Res.No. 05-147) authorizing
the acceptance of two (2)water line easements from Antioch Missionary Baptist Church at 3920
Cardinal Drive. Shortly after,it was discovered that the water lines were not constructed within the
easement granted. A request for that easement to be relinquished through a Release of Easement
is being presented iri conjunction with this easement request.

RECOMMENDATION
Administration recommends approval to reallocate funds from the 2000, 2002, 2003 and 2004
Consolidated Block Grant Programs totaling$380,254 which would allow for the administration of
an Emergency Repair Program based upon urgent need.
BACKGROUND
Due to the devastation caused by Hurricane Rita, the Administration proposes implementing an
Emergency Repair Program, in order to provide urgent Community Development and Housing
assistance to homeowners impacted by this storm. The Emergency Repair Program would provide
grants to homeowners for repairs that are of an urgent need,with first priority given to persons age
62 and above who are also disabled. Second priority would be to persons age 62 and above. Third
priority would be to persons who are disabled. The City will accept applications for up to six months.
BUDGETARY IMPACT
Funding is available from the 2000(Charlton-Pollard Strip Center-$126,000),2002(Acquisition-
$85,376, Infrastructure - $53,878), 2003 (Infrastructure - $100,000) and 2004 (Infrastructure -
$15,000) Consolidated Grant Programs.

QUESTION: Can Small Businesses be provided assistance in the form of a grant?
ANSWER: Small Businesses may be given a grant. However,funds must be
used for activities that are not funded by FEMA or SBA CDBG
funds may be used to provide utilities,such as water, sewer, and gas
lines to a site where jobs will be created. Other funds are usually
available from FEMA or SBA for situations where assistance is
needed to rebuild or replace a building.However,where it is
documented that no other assistance is available or other assistance is
being utilized to the maximum extent and is still not adequate to allow
the company to return to operation,rehabilitation or new construction
of a building is eligible. Also,at least 51%of the jobs must be
available to LMI persons in order to meet the national objective. The
building and related facilities can be returned to their original state
prior to the storms. Eligible activities could include repairs to an
industrial park or commercial area that experienced damage by the
hurricane; assistance to a business that closed or relocated to another
state due to the hurricane and wishes to return to the jurisdiction; a
small business that experienced loss or damage and had no or
insufficient insurance and could not qualify for SBA or other fimdmg.
QUESTION: Can the City be reimbursed by FEMA for any CDBG funds it uses to
provide Tenant-Based Rental Assistance("TBRA")to displaced
families?
ANSWER Federal fiords may not be used to reimburse another federal program.
Communities may use their CDBG funds to provide assistance for
activities that are not funded by FEMA or SBA.
QUESTION: What is the definition of low/moderate income?
ANSWER: Low/Moderate Income limits are based on HUD estimates of median
family income, with adjustments based on family size. Income limits
are established for low-income families, very low-income families,
and families at 60%of median income by family size.
Moderate Income-Households whose incomes are between 81 percent and 95
percent of the median income for the area, as determined by HUD, with adjustments
based on family size.
Low Income- A household whose income does not exceed 80 percent of the median
income for the area, as determined by HUD, with adjustments based on family size.
Vm Low-Income-Households whose incomes do not exceed 50 percent of the
median area income for the area, as determined by HUD,with adjustments based on
family size.

QUESTION: Does the"Urgent Need"category require the Residential Emergency
Repair Program to be available to all residents of the city,regardless of
income?
ANSWER: The"Urgent Need"category of defined National Objectives may only
be used when there is a particular urgency because existing conditions
pose a serious and immediate threat to the health or welfare of the
community where other financial resources are not available to meet
such needs. Assistance may be provided to non-LMI
families/individuals as long as a national objective is met. The
regulations provide this flexibility to address specific disaster related
needs and specify that at least 50%of the funds benefit LM persons
citywide. Following a disaster, everyone living in the disaster area is
presumed to have urgent needs. Additionally, assistance may be
provided to over income families/individuals under the"Urgent
Need"objective with proper documentation of the amount and use of
private insurance, as well as other assistance available from FEMA,
SBA or other funding sources.
QUESTION: Can single head-of-households be considered a priority category for
receiving assistance?
ANSWER: Single head-of-households may be considered a priority category for
Isreceiving assistance as long as a national objective is met and proper
documentation of the amount and use of private insurance, as well as
other assistance available from FEMA, SBA or other funding sources
is provided. However, due to the limited amount of available
funding,the Administration does not recommend assigning a priority
to single head-of-households. Assigning this priority would open
eligibility to thousands of residents who would not likely be served at
a 4th priority level. Additionally,since single head-of-households do
not fall under the category of presumed benefit, income verifications
must be done to insure that at least 50%of those served are LW
This process would be extremely cumbersome and Housing Services
does not have sufficient staff to effectively administer the Residential
Emergency Repair Program if this priority were included.
QUESTION: What can the Administration do to ensure quality workmanship from
contractors?
ANSWER Interested contractors will be required to sign an assurance of intent to
comply with the established Contractor Guidelines, establishing an
approved contractors list that will be provided to each approved
applicant. No payments will be made to a contractor who has not
provided such assurance, and certification upon completion of repairs.

The objective of the Residential Emergency Repair Program is to provide
assistance to homeowners with an urgent need for emergency repairs when they are
without sufficient resources to make those repairs themselves. This program is
designed to assist with "urgent need"repairs resulting from Hurrica ita.
Who is Eligible?
As a homeowner, you may be eligible for assistance under t
program, if you meet all the following conditions:
A You are age 62 and above and/or disabled. First orit w' e

application and requested repairs must be approved by the
City of Beaumont. Please note that all other disaster recovery
funds, including but not limited to homeowner's insurance
proceeds and funds from FEMA, Small Business
Administration (SBA), Red Cross, etc., must be used and
evidence provided, prior to the disbursement of any
Residential Emergency Repair funds.

etc. Properties in the 100-year floodplain or floodway are of
eligible for assistance.

Generally, repairs that area rgent need are eligible for assistance. Community

Please note that all other disaster recovery funds including but not limited to homeowner's

Residential Emergency Repair Program funds.Such evidence includes FEMA damage
assessment report,insurance Adjusters report or independent work write-up from a bonded
contractor,paid receipts andfor canceled checks. If owner has already spent insurance funds
for repairs,owner must provide proof of payment and detailed documentation of work

What Happens After I Apply?

environmental restrictions and regulations. Application and repair requests
will be submitted for review to Housing Services. If any information Is found
to be intentionally falsified, the application will be rejected and the
applicant will not be allowed to reapply to this program.

rejected with details of the decision if the application is rejected.
❑ In the event your house is 45 years old or older, the Texas Historical
Commission may have to be notified.
❑ After your application has been accepted, get at least two writt s ma s

Altho a Residential Emergency Repair Program is designed to respond to a
variety f problems, it has limits and should not be confused with other programs
offered by the City of Beaumont Community Development Division.
A It is not a Rehabilitation program. The most recent item, system, or
structure to fail in a home may prompt the homeowner to seek assistance
from the Residential Emergency Repair Program while many other items are
also in need of repair. The Residential Emergency Repair Program is
designed to respond to urgent needs resulting from hurricane force winds
and/or rain and, that if left unrepaired, would lead to further deterioration or to

the house becoming unlivable. The City of Beaumont, Community
Development Division offers a Minor Repair Program that can address many
more issues than Residential Emergency Repair.
A It is not assistance for home sellers.The homeowner must affirm that they
intend to live in the home for the next 12 months as far as foreseeable. The funds
are designed to keep a homeowner living in their home rather than assist them in
selling it. If it is determined after repairs are made that residency requirements
have been falsified, the City may require that all funds be repaid.

We encourage you to compare prices. Get at least two w " im s for the
same work when possible. Ask for local references fro a . You can also
call the Texas Department of Licensing and Regulation t(80 03-9202 to see if a
contractor has a current license in good standing.
• Don't agree to or sign anything you do not unde d. k uestions-know what you
are getting for your money.
• Don't be pressured into purchasing items or cont ng for repairs you don't want or
really need.
• Ask about guarantees and warranties he materials and the labor.
• Never pay for repair wo advance. (Although you may have to pay a deposit if your

REQUESTED ACTION: Council consider award of a contract for a telecommunications data
infrastructure upgrade.
RECOMMENDATION
Administration recommends the award of a contract to SBC Communications to provide all hardware
necessary for an upgrade to the telecommunications infrastructure. The total cost of the hardware
is $74,880.05.
BACKGROUND
The City's current data telecommunications infrastructure supports communications between thirty-
nine city locations providing access to the City's computer network. This system was implemented
in 2000 and has allowed the City to expand its database services to include Internet access,online bill
payment, and Intranet and Internet email. Most of the current hardware is outdated and no longer
supported.
The hardware to be purchased includes two new routers for City Hall to service offices in Water
Customer Service, Fleet Maintenance, Fire Headquarters, Police, Streets and Drainage, Health
Department,Municipal Court,Narcotics,Building Services,Water Utilities,Auto Theft,and Family
Violence. Integrated controller cards must be installed at twenty remote sites to communicate with
the new routers. These sites include Fire Stations,Parks Operations,Recreation,Water Production,
Water Reclamation, Landfill and Fire Fleet. Upgrades to hardware in both Police and Fire
Headquarters will be installed to communicate with the new routers serviced from City Hall.
Additional hardware will be purchased for the Beaumont Public Library,which serves as a hub to its
remote sites. The price includes implementation and installation by SBC.
The total cost of the proposed SBC telecommunications infrastructure is $106,971.50 less 30% or
$32,091.45. Proceeds from a legal settlement with SBC provide for the additional 30% discount

from the total cost. All purchases made through SBC Communications until the expiration date of
December 9, 2005 qualify for the discount.
BUDGETARY IMPACT
The total net cost of the telecommunication infrastructure upgrade after the lawsuit settlement
discount of 30%is$74,880.05. Funds are available in the Capital Reserve Fund for this expenditure.

BACKGROUND
The City of Beaumont (City) and AMSET entered into a lease agreement on December 30, 1996
whereby the City and AMSET agreed to a 99-year lease on the land and building to be used as an
art museum. The City supports AMSET with annual allocations and garbage removal. In return
AMSET is open to the general public and strives to provide programs and services to the entire
community. Approximately 60,000 children and adults participate in Art Museum activities each
year. The City may utilize a portion of its revenue derived from the hotel-motel occupancy tax to
promote the arts.
BUDGETARYIMPACT
Funds are available in the FY 2006 budget with$50,000 funded through the Hotel Occupancy Tax
Fund and $125,000 funded with general revenues.
