RECOMMENDATION Administration recommends the purchase of 134 trash receptacles from BJ's Park and Recreation Products of Magnolia, Texas, in the amount of$285.78 each. BACKGROUND The Texas Local Government Purchasing Cooperative's BuyBoard offers products and services that have been submitted for competitive bidding as outlined by state statute. BFs Park and Recreation Products is currently contracted with BuyBoard to provide Wabash Valley brand outdoor furniture and equipment to members of the purchasing cooperative. Membership in the BuyBoard is open to school districts, municipalities, counties, and nonprofit organizations throughout Texas. The City of Beaumont's membership in the purchasing cooperative was previously approved by City Council. By participating in the cooperative, members can reduce the number of bids processed as well as take advantage of volume discounts. Parks and Property Services has initiated a three-year program to replace all trash receptacles located in parks throughout the City. The attractive bright green Wabash Valley brand 32-gallon trash receptacles each have a matching flat top lid with a small round opening. The design will enhance the appearance of parks throughout the City. The initial purchase of 134 trash receptacles this year would be followed by two (2) similar purchases during the next two (2) years. BUDGETARY IMPACT Funds are available in the Capital Reserve Fund. RECOMMENDATION The Administration recommends approval of a specific use permit to allow a tree service business and wood sales in a GC-MD District at 2909 Gulf Street subject to the following condition: • Provide six parking spaces on the subject property. BACKGROUND Charles Walker, dba Walker Trees and Firewood, is requesting a specific use permit to allow the operation of a tree service and wood sales business at 2909 Gulf Street. Mr. Walker is currently operating out of location at 3010 Gulf at Glasshouse. Mr. Walker was notified that he was operating without a certificate of occupancy in June,2005. He is in the process of purchasing the subject property with the intent of moving-his business to this location, pending the approval of a specific use permit. Mr. Walker states that he would like to relocate his business to the new location so that his wood storage would be fully enclosed and out of sight. In addition to his tree service business, Mr. Walker sells fire and cooking wood. He has contracts to supply a number of area restaurants with firewood for cooking. The subject property consists of two connected buildings on one lot and a storage area on the second lot. Mr. Walker will locate his office in the building fronting on Gulf Street. The storage of firewood will be located on the vacant lot. Walker Tree Service employees four persons. Working hours are typically 7 a.m.-6 p.m. Normally, wood that is cut for sale is removed off the premises within 1-2 weeks. Mr. Walker states that wood that is brought in by outside tree cutting services is gone by December of each year. An 8' tall wood screening fence is being constructed along the rear property line, adjacent to the residences to the west. Mr. Walker will also install wood planks along the existing chainlink fences on the Regent and Gulf Street sides of the property. In addition,he is going to gravel the vacant lot. BUDGETARY IMPACT None. PREVIOUS ACTION At a Joint Public Hearing held August 15, 2005, the Planning Commission voted 7:0 to approve a specific use permit to allow a tree service business and wood sales in a GC-MD District at 2909 Gulf Street subject to the following condition: • Provide six parking spaces on the subject property. SUBSEQUENT ACTION None. RECOMMENDED BY Planning Commission, City Manager, Public Works Director and the Planning Manager. ORDINANCE NO. ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW A TREE SERVICE BUSINESS AND WOOD SALES IN A GC-MD (GENERAL COMMERCIAL- MULTIPLE FAMILY DWELLING) DISTRICT LOCATED AT 2909 GULF STREET IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, the City Council for the City of Beaumont desires to issue a specific use permit to Charles Walker, dba Walker Trees and Firewood,to allow a tree service business and wood sales in a GC-MD (General Commercial-Multiple Family Dwelling) District located of 2909 Gulf Street, being Lots 11 and 12, Block 8, Gold Hill Addition, City of Beaumont, Jefferson County, Texas, containing 0.32 acres, more or less, as described on Exhibit "A" attached hereto; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described condition; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. Section 3. Notwithstanding the site plan attached hereto, the use of the property herein above described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. RECOMMENDATION The Administration recommends denial of the request to abandon Cottonwood Street between St. Helena and Concord Road. BACKGROUND Fittz & Shipman, Inc., the applicant for Beaumont Independent School District(BISD), has made a request to abandonment Cottonwood Street, between Concord and St. Helena. BISD is developing the properties on either side of this section of Cottonwood for a school bus yard facility. The applicant states that the closure of Cottonwood would greatly enhance the use of the adjacent properties for the proposed school bus yard. Both the Streets and Drainage Manager and the Transportation Manager object to the abandonment. The Streets and Drainage Manager states that city vehicles use this street to access Concord and the North Yard Facility. The City's material supplier is across the tracks and Cottonwood is the most direct route between it and the North Yard Facility. The St.Helena and Concord intersection is blind and is dangerous for city trucks to use. BUDGETARYIMPACT None. PREVIOUS ACTION At a Regular Meeting held August 15, 2005, the Planning Commission voted 7:0 to deny a request to abandon Cottonwood Street between St. Helena and Concord Road. SUBSEQUENT ACTION None. RECOMMENDED BY Planning Commission, City Manager, Public Works Director and the Planning Manager. a ORDINANCE NO. RECOMMENDATION Administration recommends that Council conduct a public hearing and authorize the City Manager to execute a contract with the Texas Department of Transportation for the City to receive State Public Transportation funds. BACKGROUND City Council annually authorizes the City Manager to execute a contract with the Texas Department of Transportation for the City to receive state public transportation funds. These funds total $431,336 for FY2006. In fiscal years 2004 and 2005 the City received$426,348 and $396,895 respectively. BUDGETARY IMPACT State funding totaling $431,336 will fund part of the estimated local share cost of$1,395,681 to operate the Beaumont Municipal Transit System for FY2005. PREVIOUS ACTION None.
