David Roubein, et at 2) Worker's compensation claim of Arthur Collazo arising out of an incident with Mary �J Leger i Consent Agenda Summary July 13, 1999 • Approval of minutes • Confirmation of committee appointments A) Approve the sale of surplus property to Magnolia Cemetery Company A 3.209 acre tract bordered by Texas, Elm and Pine Streets would be sold to Magnolia Cemetery Company in the amount of$35,501.01. The property was offered for sale and bids were received on June 21, 1999. Mount Gilead Baptist Church and Magnolia Cemetery Company both submitted identical bids in the amount of$25,000. To determine the highest bidder each was asked to submit a revised bid on July 6, 1999. Mount Gilead Baptist Church bid$35,500.10 and Magnolia Cemetery Company bid$35,501.01. Administration recommends that the high bid by Magnolia Cemetery be accepted. Additional information is attached for your review. B)Approve a relocation assistance payment related to the Concord Road Improvement Project Ms. Irene Green is being displaced as a result of the Concord Road Project and qualifies for relocation assistance. The amount of assistance totals $21,337.29 and includes: a housing supplement payment of$20,000,a utility relocation payment of$368.54,a moving expense payment of$775.00 and a closing expense payment of$193.75. Administration recommends approval of this item. A copy of the staff memorandum is attached for your review. C)Approve an annual contract for City employee work uniforms The annual contract would be with Cintas Corporation of Beaumont. The approximate annual expenditure is$33,328.50. Funds for uniforms are budgeted in each department's operating budget. Currently, approximately 400 employees are issued three to five sets of uniforms each year. The contract does not include Fire and Police uniforms. Administration recommends approval of the contract. A copy of the staff memorandum is attached for your review. D) Approve a signatory change for City Accounts Stephen J. Bonczek would be added and Ray A. Riley, Maurine Gray and Kyle Hayes would be deleted as authorized signatories on City Accounts effective July 13, 1999. Administration recommends approval of this change. E)Approve the purchase of a diesel engine generator to provide emergency backup power for the wastewater handling system and all pumps at the Beaumont Fire Training Grounds One diesel engine generator set and transfer switch would be purchased from Southern Plains Power of Houston in the amount of$23,030. The system separates fuel from wastewater, and pumps the separated fuel to designated collection points for re-use. Emergency power is necessary to avoid the risk of contamination of the holding pond with residual fuel during periods of prolonged power outage. Administration recommends approval of this purchase. A copy of the staff memorandum is attached for your review. F) Approve a Pipeline Easement for Centana Intrastate Pipeline,LLC Centana will pay the City$200 per rod for a fifteen-foot permanent easement and a thirty-five-foot temporary construction easement, for a total of$8,308. The easement contains a clause that if the pipeline easement is not used for a period of two years, the easement becomes null and void. Administration recommends approval of the pipeline easement. Additional information is attached in the staff memorandum. G)Approve the purchase of property for the Concord Road Improvement Project Property located on Astor Street 300 feet from the comer of Manning Street(0.023 of an acre)would be purchased from Lacy's Temple Church of God in Christ, Beaumont in the amount of$150.00. The property was appraised by Bishop Real Estate Appraisers, Inc. Administration recommends approval of the purchase. A copy of the staff memorandum is attached for your review. H) Authorize eminent domain proceedings to acquire two properties for the Concord Road Improvement Project T 1)Irene Green owns 0.063 of an acre at 3090 Silver Street and has a tax suit filed on her property. In order to acquire the property that is involved in a tax suit, the City must acquire the property by eminent domain proceedings. The property has an appraised value of$4,300. 2 Linda Gayle Johnson owns 0.056 of an acre located at 2845 Concord Road. Ms. Johnson has signed the Right-of-Way Agreement to accept the appraised value for her property but after repeated attempts, has refused to sign the deed and the final papers. It will be necessary to acquire the property through the process of eminent domain. The property has an appraised value of$6,800. Administration recommends the authorization of eminent domain proceedings to acquire both of the properties. A copy of the staff memorandum is attached for your review. I)Approve the purchase of a diesel truck with a telescopic aerial device for use in the Public Works Department/Transportation Division One 15,000 lb. Gross Vehicle Weight Requirement (GVWR), diesel powered cab and chassis equipped with a telescopic aerial device would be purchased from Philpott Ford of Port Neches in the amount of$51,513. The truck will be issued to the Transportation Division for the repair and maintenance of traffic signal controls. The new truck will replace a 1992 Ford Van that will be disposed of according to the City's surplus property policy. Funds for this purchase are available in the Capital Reserve Fund. Administration recommends approval of the purchase. A copy of the staff memorandum is attached for your review. J)Approve the purchase of three replacement windows for the Beaumont Public Library The windows would be purchased from Ameraglass Company of Beaumont in the amount of $29,968. Two windows will be installed at the Beaumont Public Library and the third window will be stored for future use. The replacements are necessary due to vandalism damage to two existing windows. Funds for this expenditure are available in the Capital Reserve Fund. Administration recommends approval of the purchase. A copy of the staff memorandum is attached for your review. K-) Authorize the settlement of lawsuits and claims 1) The lawsuit of Freddie Gatlin, et al v. David Roubein, et al, would be settled in the amount of $77,700. This matter was discussed in an Executive Session on June 1, 1999. 2)The worker's compensation claim of Arthur Collazo arising out of an incident with Mary Leger would be settled in the amount of$368.63. This matter was discussed in an Executive Session on June 1, 1999. A INTER-OFFICE MEMORANDUM City of Beaumont,Texas Central Services Department Date: July 7, 1999 To: Stephen Bonczek, City Manager From: Kirby Richard,Central Services Director Subject: Sale of Surplus Property 1800 Block of Pine Street James Drake Survey COMMENTS Two bids were received on July 6, 1999,for the purchase of a 3.209 acre tract of land out of the James Drake Survey. 0 The property bordered by Texas, Elm and Pine Streets was the site of the former Pipkin School. The property was acquired by the City in 1974 and the school was demolished in 1981. Since then the property has been used by the Public Works Department to store road materials. Recently,interest was expressed in purchasing the property by adjacent landowners. The property was offered for sale and bids were received on June 21, 1999. Mount Gilead Baptist Church and Magnolia Cemetery Company both submitted identical bids in the amount of$25,000. To determine the highest bidder each was asked to submit a revised bid on July 6, 1999. The project consist of 100 parcels, eight of these are owned by the City. The Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended ensures that persons displaced as a result of an improvement project are treated fairly,consistently, and equitably so that such persons will not suffer disportionate injuries as a result of projects designed for the benefit of the public as a whole. Owners or tenants displaced as a result of a project shall be compensated for actual moving and related expenses. Ms. Irene Green is being displaced as a result of the Concord Road Project and qualifies for relocation assistance. The amount of assistance includes: a housing supplement payment of$20,000.00,a utility relocation payment of $368.54, a moving expense payment of$775.00 and a closing expense payment of$193.75. It is requested that a resolution be adopted authorizing payment of$21,337.29 to Ms. Irene Green for relocation expenses. This contract does not include Fire and Police uniforms. Bids were requested for an annual contract with prices firm for a period of twelve (12)months to allow for additional purchases. Currently, approximately 400 employees are issued three (3)to five (5) sets of uniforms each year. The number of uniforms issued is determined by each department. As employees are hired, new uniforms are issued in the departments requiring uniforms. Specifications required that the bidder have a physical storefront within the city limits of Beaumont to expedite the issuance of uniforms. A Beaumont location allows current or new employees to be fitted with new uniforms throughout the year. Specifications also requested vendors to provide pricing for oversized uniforms. Oversized shirts are defined as 2X and larger and oversized pants as 48"and larger. Cintas Corporation and Munro Safety Apparel bid oversized uniforms at no additional charge. Shepherd's Uniform & Linen Supply, Superior Uniform Company, and Night's Uniform Company quoted an additional 10-20%for oversized uniforms. Eighteen(18)vendors received bid packets with five(5) submitting bids. Vendors were given approximate quantities and were requested to provide an itemized price list and samples of their work uniforms. See attached tabulation. The equipment is warranted for one(1)year. The generator set and transfer switch will be installed by Building Services personnel. Funds for this expenditure are available in the General Improvements Fund. The owner of the minerals has entered into a lease agreement with a company to drill a well in search of oil and gas on the property. The City granted the lessee, Esenjay Exploration,Inc.,a Surface Use Agreement on February 16, 1999. The agreement allowed the company to use and maintain 2100 foot of an existing road and to construct a 500 foot board road to the 400 foot by 400 foot well site. Esenjay paid the City$10,000.00. The well has been drilled and is a producer. The City granted an easement for a pipeline and appurtenances to Esenjay for$200.00 per rod,totaling$24,000.00. Centana Intrastate Pipeline, LLC has requested that a pipeline easement be granted that would begin at Esenjay's Dehydrator site,where their easement ended,to the City's property line. Centana will pay the City$200.00 per rod for a fifteen foot permanent easement and a thirty-five foot temporary construction easement,for a total of$8,308.00. The easement contains a clause that if the pipeline easement is not used for a period of two(2)years,the easement becomes null and void. A plat depicting the proposed pipeline is attached. It is recommended that a resolution be passed granting Centana Intrastate Pipeline,LLC a Pipeline Easement across land out of the C. The third window will be stored for future use. The replacements are necessary due to vandalism damage to two (2)existing windows. The windows are 24 feet high and 44 inches wide and require a separate manufacturing process than standard production glass. Installation is also a significant factor in the cost due to the oversize panes. The contractor is responsible for the removal of the damaged panes,and the installation of two (2)replacement windows. The bids received are as follow: Company Delivery Time Price Ameraglass Company 589 days $29,968 A-1 Glass Co. 365 days $78,157 It is recommended that the bid for the purchase of three(3)replacement windows for the Beaumont Public Library be awarded to Ameraglass Company in the amount of$29,968. RECOMMENDATION After the initial inspection on July 13, 1998, staff considered the property suitable for rehabilitation. The owner agreed to a 120-day work program on December 14, 1998 and failed to make any repairs upon the expiration of the agreement on April 14, 1999. Therefore, on June 29, 1999, staff requested and Council approved the issuance of a raze order. BACKGROUND At the request of Mayor Moore, 2395 Park is being brought back before City Council for consideration. This structure was identified as being substandard on July 13, 1998. Mr. Kinnear was enrolled in a work program for 120 days which ended April 14, 1999. There was not any work completed during the 120-day period. BUDGETARY IMPACT If the property is not brought into compliance, the City will incur the cost of demolition. PREVIOUS ACTION The Administration recommended and Council approved a raze order for this project on June 29, 1999. A raze order was recommended as a result of the property owner enrolling into a work program and not achieving code compliance. SUBSEQUENT ACTION If Council grants an extension on this property, staff will monitor the progress of work and make a determination if the structure meets City building codes. If the structure is not brought up to code within the specified time period, the structure will be demolished. He informed us that he wanted to make repairs and was in the process of hiring contractors. 12/02/98 This structure was placed on the City Council Agenda for 12/22/98. 12/14/98 Mr. Kinnear came into the office after receiving Council notification and asked to be enrolled in a Work Repair Program. We allowed Mr. Kinnear to enroll into the work program for 120 days which ended April 14, 1999 and removed him from the Council agenda. 04/30/99 Spoke with owner again. He indicated that he was trying to sell the property. No repairs had been done at this time. 06/03/99 A notice was sent to Mr. Kinnear informing him that we would be bringing this structure before City Council on June 29, 1999. 06/29/99 Mr. Kinnear appeared before Council and stated that he wanted to repair the house but would not commit to a 120 day work program. He stated that it would take him three to five years to bring up to minimum housing code. Mr. Kinnear left Council chambers before a decision was made by council members. At the close of the meeting, Council's decision was to demolish and remove structure within thirty (30) days. Based on the extensive repairs needed on this structure caused by the extreme fire damage and the fact that these repairs exceed more than 50% of its appraised value, staff believes that this structure is not suitable for rehabilitation. 04/30/98 This structure was identified as being substandard. 05/06/98 The first letter of notification was mailed to the property owner, Mr. Allen Lafleur. 09/30/98 Notice was sent to property owner notifying him of City Council Meeting on October 20, 1998. 10/07/98 First publication of council meeting notice was published in Beaumont Enterprise. 10/14/98 Second publication of council meeting notice was published in Beaumont Enterprise. 10/20/98 City Council ordered to demolish and remove said structure within 30 days. 10/26/98 Notice was sent to Mr. Allen Lafleur informing him of order from City Council. 11/10/98 Mr. Allen Lafleur contacted the City Manager's office and requested an opportunity to repair the structure. 11/11/98 Mr. Allen Lafleur's request was granted and he was enrolled in a work repair program for 30 days. 11/12/98 A building repair permit was purchased from Building Codes Department with a repair amount of$3,000 and an expiration date of 12/11/98. No attempt to contact this department has been made until 6/24/99 at which time Mr. J'un Lafleur called to request to be allowed to repair said structure. I have spoken with Mr. Jim Lafleur and also Mr. Mike Lafleur and tried to explain that the structure was condemned by City Council in October of 1998. Even though the structure had been condemned in October, extra consideration of thirty(30) days to repair the structure was given to their father. As of this time, no repairs have been made. Pam Loiacano, Field Supervisor, attempted to make an inspection on July 8, 1999 but was not able to enter the property because of locked gates. Viewing the structure from the street indicates there are no apparent repairs that have been made. WHEREAS, the Beaumont Fire Rescue Service has requested that the City Council of the City of Beaumontdeclare the Guest Inn Hotel at 2525 North Eleventh Street to be a public nuisance as a life/safety hazard that may injure or affect the public health or comfort; and WHEREAS, evidence has been presented to the City Council showing that the Guest Inn Hotel is in violation of numerous provisions of the Fire Code as follows: 1. improper storage of readily combustible materials; • 2. fire alarm equipment has been tampered with; 3. necessary fire walls and fire stops and fire rated partitions are not properly maintained; 4. the alarm system does not work properly; 5. personnel have failed to notify the Fire Rescue Service that alarms are being silenced or put out of service; 6. there are not smoke detectors operating in each sleeping room; 7. fire hazards exist in portions of the facility; 8. doors which are required to remain unlocked are locked; and 9. fire rated corridors are not properly maintained; and • WHEREAS, the City Council finds that these violations created an eminent • danger to the public health and comfort if the facility is allowed to remain open without correcting these deficiencies; ~ NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: - Section 1. That the City Council hereby finds that the violations of the Fire Code listed above exist and that these violations constitute an eminent condition which may injure or affect the public health or comfort and, under authority of State law, hereby declares the Guest Inn Hotel to be a public nuisance and orders that a certified copy of this ordinance be delivered to persons responsible for the operation of the Guest Inn Hotel and that those persons immediately close the Guest Inn Hotel to public occupancy until such time as the • violations of all City of Beaumont codes are rectified and abated. Section 2. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 3. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. • - 2 - Section 4. That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of the City of Beaumont, Texas, the maximum fine per day being $500.00. RECOMMENDATION Council approval of the Administration determination that the Guest Hotel should be closed due to extremely serious life/safety problems existing on the premises. BACKGROUND During 1997, Beaumont Fire/Rescue responded to the Guest Inn 109 times, with 99 of these runs being false alarms or fire alarm related. In 1998, there were 115 runs,with 108 being fire alarm related. Through June 21 of this year, there were 61 calls,with 59 being fire alarm related. The Fire Department has written more than 100 citations to the Hotel management for not maintaining their fire alarm system, and the problems continue. The Hotel has an inadequate fire alarm system and management does not heed fire safety codes and generally ignores warnings to achieve compliance. Beaumont, Texas 77703. Some of us have been working at this HOTEL since it was reopened for business since 1991. Since Hotel's opening,we have been paid regularly and never missed a single time by its management although the Hotel have been suffered for years from financial difficulties primarily due to poor revenue caused by low occupancy and room rate. SNonetheless,the Hotel have accommodated an affordable and economical lodging requirements for the local community. At the same time, it provided a stable job opportunity for local residents. Lately, we become very anxiety and concerned since we learned that the City Fire Department(CFD)is trying to close the Hotel down. During the past CFD constantly intimidated to shut down the Hotel. This is because the Hotel has a chronic problem of false fire alarms. Needless to say, we as Hotel workers are quite embarrassed by such problems and they became a very nuisance. In some guest rooms even they are not occupied or unknown locations,the fire alarm went on quite frequently day and night without reasons. Even several times in a single day. Every time when a false alarm went on even in midnight,a fire engine and firemen came to the Hotel waking up the Hotel guests,employees,and some neighbors constantly as well. We feel such actions are more than desirable because they became such a routine and beside, wasting our tax payers monies unnecessarily. Following further describe the facts in details so that our Honorable Councilmerdwoman will understand the situation fully. The Hotel reopened for business as Ramada Hotel in 1991 after the ex Sheraton Inn Spindletop had been closed for a while. As requested by CFD, a central fire monitoring system was installed at a cost as much as $80,000 in 1991. Apparently the system was not installed correctly and properly resulting in today's problem. The Management of the Hotel at that time requested immediate correction by Sonitol of Houston Inc who was the original contractor installing the fire alarm system. An effort was made but obviously unsuccessful. While the Management was eager to correct the f1l0N i P ►_+ problem, had no choice but to ask a new company called National Gardian to correct the problem and resulted in even worse problems. Because National Gardian connected the central monitorial system to CFD. And as a result, Fire Engine and firemen were alerted and rushed to the Hotel, whenever there were false alarms. As of today since it was installed it has been about 9 years, almost all alarms were false and probably remains to be false in the future. We do not know how many smoke sensors were replaced unnecessarily at Hotel's cost during this time. At one time, the Management also installed the smoke sensors by relocating to guest rooms wall from ceiling as advised by CFD but did not solve the problem. They also tried to replace the central monitoring panel. None whatsoever proved to be working. In consideration of such serious problems apparently the State Fire Department was consulted by one of the previous Department Manager, and the State Fire Department found that the fire alarm system was not properly installed. As far as we know even up to today the problems were not corrected despite the fact the Hotel Management desperately desires to correct the problem. We must emphasize that by any means Hotel was in fault in fact they are innocent victim. It is clear that by blaming the Hotel and intend to close the Hotel down is totally unfair. Moreover,Our Honorable Councilman/woman must remember that so many families are depending on the Hotel's employment for living. Some of us has a sick member of family and some has a small baby. We are more than willing to testify in behalf of Hotel in these respects if so requested. Although we are not experts to advise what measures should betaken at this juncture, we are just full of anxiety and are very concerned about what we heard about CFD's intention. We feel CFD's petition is very unreasonable,unfair and very abusive. Your kind considerations of not allowing CFD to close the Hotel are mostly appreciated. RECONIMENDATION The Administration acknowledges the consensus of the Council to consider allocating the remaining $2.825 million Section 108 funding for the Melton YMCA($1.825 million) and the proposed Southend Branch Library ($1.0 million). BACKGROUND The City of Beaumont has an approved one-time Section 108 line of credit up to $11 million. To date, $8.175 million has been committed by the Council as follows: $3.175 million for Hotel Beaumont; $3.0 million for Crockett Street; and $2.0 million for the Jefferson Theatre restoration. There is a remainder of$2.825 million which has not been committed. In March of this year, representatives of the Melton YMCA made a request of Section 108 funds in the amount of$2.23 million to construct a new gymnasium and fitness center. BUDGETARYIMPACT The Section 108 grant would be repaid with CDBG funds over a 20-year period. A grant in the amount of$1,825,000 would require a CDBG payment of approximately $157,000 a year for 20 years based on an estimated interest rate of 6%. Davis, Security for the Ramada Hotel Beaumont during the hours of 2230 ( 10 : 30 PM until 06: 30 AM) , Monday through Friday. Our problems started in March 1994, with the excessive fire alarms and the answering by the Beaumont Fire Department to what turned out to be false alarms . From installation, approximately 2 and 1 /2 years ago, the Beaumont Fire Department had only been required to answer 3 alarms . Once when all lights were out due to stormy weather and our phones were also down, once when an air conditioner .unit caught fire and once when a grease fire happened in the kitchen which was taken care of by our Ansel System. Beginning in March, 1994, the National Guardian Company, our Security Contract Company, would call the Fire Department when an alarm sounded and then check with us while the fire vehicles were in transit. At times our Security would have already located the problem false alarm and would be waiting for the Fire Department to arrive. The normal time for our Security to arrive in the problem area to check for fire or other problems would be approximately one minute. National Guardian had been contracted to maintain the system and gave us many reasons why thing were happening as they were but apparently did not improve the situation since the false alarms continued. The Hotel even went to the expense of installing a new system to replace the Sensican 2000 Alarm Panel with the now placed system, a Sensican 1000 , because the 2000 supposedly was not compatible with the Detectors, DS200HD, (Detector w/heat sensor) . Wiring has been torn out and replaced, detectors cleaned, sensitized and or replaced. We still had false alarms until the weather cooling off slowed them down. To each of National Guardian' s complaints, the Hotel apparently complied and even where no false alarms were noted, the detectors were cleaned. The previous (2) contract company and the one in charge when I was hired in January of 1992 was Sonitrol of Houston. There was never any problem with false alarms until the change in Security Companies . The false alarms immediately began and Nation Guardian would call the Fire Department immediately upon an alarm and then contact us too late to stop the Fire Vehicles already in route. It was felt by the Hotel that these calls were not required since Security already had the situation well in hand. National Guardian has apparently changed this procedure for a false alarm is no longer answered by the Fire Department and now contact is made with us at the Hotel. The Ramada Hotel Beaumnot would like to apologize for any inconvenience that we have caused the Beaumont Fire Department or City of Beaumont. The Hotel has made every effort to correct any problems and have brought in other companies to investigate our problem and have Sonotrol and National Guardian repairmen in to help correct the situation many times. The welfare and safety of our personnel and guests have at no time been compromised and they have or never will be placed in danger. Levoid C. Davis; Security, Ramada Hotel Beaumont: 3-13-95 SONITROL 1 . 6-5-91 Plan submitted by fax plan for installation of Fire Alarm System. 2 . The Installation plan called for installation of DS 200 Photoelectric Smoke Detectors with a Sensican 1000 main board in accordance with NFPA 72-E guarneteed to meet all local fire department standards and regulations . This would meet all State and Federal regulations . (Letter of June 9, 1991 from Sonitrol to Ramada Hotel) 3. This was sub-leased to Gary Allen Collins , 2405 Barnington Place Dr. , Sugarland Tx. 77473 . However the installer was a person by the name of Fernando. Mr. Fernando was a frequent visitor to the Lounge and usually stayed as long as it was open. If the Hotel Lounge was not open, he found another one. The installation was sloppy, not wired properly and needed much repairs afterwards. I estimate it took Mr. Fernando at least 3 to 4 months to do the job and was the only employee I saw performing the work. (Letter of July 10, 1992) 4 . The letter of July 10, 1992 stated that an action plan must be submitted to Ramada Inn by July 13, 1992, a year after original plan was submitted. There were 15 problems noted in the letter . (Note envoice and repair forms) The problems continued. 5 . The DS 200 Series dectors are UL listed as open area photo- electric smke dectors designed for use with commercial fire signaling system, NFPA 72-E (Automatic Fire Dectors ) with 135 degree Farenheigt Temp. The DS 20OHD series dectors were installed which are heat/smoke dectors with a recommended 50 feet space between dectors . The DS 200 HD specifications: Max Installation Temp.-100 degrees F. Someone goofed or did not read the regulations. -P19 After receiving advice to hire a local company, an agreement with National Guardian dated on 9-1 -94 . Immediately the problems with false alarms increased. As a result of their services and materials , the number did not decrese causing a fine of over $16, 00 .00 to be charged to Mr. Ken Chen, Manager of the Ramada Inn. Beaumont, Tx. April 4 , 1996 Subject: Fire Alarm System, To whom it may concern, I am Levoid C. Davis, and am in charge of Security at the Ramada Hotel Beauomont duing the hours of 10 :30 PM and 06:30 AM. In the past we have been plagued with problems with the Fire Alarm System and many "false alarms . However, during this past year I can only remember one false alarm since the first of January. I have been employed at the Ramada Hotel for over four years and have witnessed a constant flow of incompetent and money grabbing repairmen personnel from local management companies . The most outstanding being the National Guardian Company. The records will show that there is a preponderance of false alarms while the National Guardian Company was contracted to do this work. The record will also show a constant threat of punishment instead of a willingness to work together to correct the problem by City officials responsible. It seems that someone wants the Hotel closed instead of the problem solved and the Hotel doing business. The charge, (A) Failure to maintain a safe Fire Alarm System, is to say the least outrageous . At no time has any guest, employee or anyone been injured or in danger while in the building. The opposite would be more correct. The system that is not responsible for warning the occupants is so sensitive that it over reacts to the slightest hint of smoke or heat. There is no way that any amount of smoke or heat no matter how small would fail to sound an alarm. The System and monitors installed and approved by the City are over sensitive because they are for a larger area than a normal room in a hotel. Please note that the monitors in larger areas, such as 20 square feet or more, have not been a problem. There have been no alarms for areas such as the lobby, hall ways and Ballrooms. Why was new system installed in the first place when the old system used by Sheraton Spindletop were of the type that sounded in a single room with an alarm mounted to the wall and gave a warning at the Front Desk indicating the area. These systems qualified under the State and City codes. Why was that system not activated Each time a false alarm sounded, Fireman answering it would proceed to knock on every door in the area of the alarm waking guests to "find the monitor" even though there was clear evidence of no problem and the absence of any fire had already been determined. Evidently this was done to harass guests so they would not return. The repair and upgrading of the system has been a constant thing and since National Guardian no longer performs work on the system, it is working excellant now. (3 ) It appears that the Ramada has spoent numerous hours and a large amount of money trying to furnish a safe atmosphere for their guests . Some examples . 1 . When the pull down type alarms were pulled as a prank by intoxicated patrons leaving the Club, plastic boxes were installed with a localized alarm is sounded when it it tampered with. 2 . When a monitor gives any signs of giving out false alarms , it was immediately replaced. 3 . Full cooperation was and is now being given to any City Officals who wish to consult with the Ramada about changes or upgrading of the system. No one seems to be interested and the Security was informed during Court tha "you don' t know anything about the system, " when he was trying to explain what happens during his hours of duty. 4 . Everything was done including a change to another Secuirity Company that has improved the system and almost cut out all false alarms. 5. Ramade allowed another Monitor Control Box to be installed even though this was not the problem. This antique Box that replaced a digital Box was not needed but no one would listen to our suggestions or explanations. No one considered the cost or whether the Control panel was the problem. ( 4 ) The Ramada is open for suggestions but would like to know exactly, A. where is Ramade' s falure in providing adaquate protection for the guests, B. why is there such a problem in letting the Naional Guardian Company go when they were not providing the maintenance contracted for, C. and why is Ramada continously singled out for such charges as presented by the City? This has been an ongoing problem since installation in 1992 with numerous false alarms . The false alarms are causing problems with our guests since a single alarm sets the central alarm off not to mention the continued answering by the Fire Department. A small amount of cigarette smoke or a guest taking a hot shower will cause the alarm to sound. Mr. Lance Levens of American Alarm has informed us that the whole system was poorly installed and is not compatible with a Hotel atmosphere. He suggested that we contact your office for help with dealing with Sonitrol. If you need any more information about the problem, he suggests your office contact him for a more detailed description and explanation of how we can correct the system. INVESTIGATIVE ACTIONS AND CHRONOLOGICAL SUMMARY On February 13, 1995, a search of the State Fire Marshal's Office Licensing Administration records revealed that Sonitrol Management Corporation holds a certificate of registration to work in the fire alarm industry, and that Patrick Speight holds a license to work in the fire alarm industry. Page 2 Case L-51-030-11-7 On December 7, 1994, this investigator made contact with David Hicks, Chief Engineer for the Ramada Hotel, 2525 North 1 Ith Street, Beaumont, Texas, to obtain authorization to conduct the investigation at 2525 North 1 I th Street, Beaumont, Texas. Authorization was granted on December 7, 1994, and the investigation was conducted on that same day. The investigation revealed that Sonitrol of Houston, Sonitrol of Austin, and Sonitrol of Ft. Worth, joined to form Sonitrol Management Corporation on May 16, 1994. The investigation revealed that Sonitrol was awarded the contract to install the fire alarm system at the Ramada Hotel and subcontracted the installation to Benco Systems, Inc. Patrick Speight completed the installation on or about January 1, 1992. Patrick Speight stated that he signed the fire alarm installation record label on January 1, 1992, and that Benco was suppose to certify the system (an installation certificate was not discovered). On February 14, 1995, this investigator contacted Ben Reyes, owner of Benco Systems, Inc. Mr. Reyes stated that he had a verbal agreement with Sonitrol to installed the fire alarm system per the drawings provided by Sonitrol. Mr. Reyes further stated that it was Sonitrol's responsibility to certify the fire alarm system after inspecting Benco's work. Mr. Reyes informed this investigator that Sonitrol was concerned that his company did not attach the smoke detectors to back boxes. On February 14, 1995, this investigator contacted Jeff Matrachisia, technical support for Detection Systems, Inc. Mr. Matrachisia stated that the smoke detector installation information, at that time, did not indicate that their detectors should be supported and attached to an electrical back box. The Sensiscan 2000 control panel was found not to be compatible with the approximate 576, Detection Systems, Inc., Model DS 200HD, smoke detectors connected to MB200-2W bases, installed in the hotel. National Guardian discovered the problems while servicing the fire alarm system, and brought them to the attention of Jack Maddox. Sonitrol was in the process of correcting the violations (at no cost to the owner) prior to this investigator's site visit. Sonitrol replaced the existing Sensiscan 2000 control panel with a Sensiscan 1000 control panel. The new control panel is compatible with the existing smoke detectors, and the system was certified by Michael Waters, a partner of Security and Fire Engineering, on January 10, 1995. Page 3 Case L-51-030!-1 l-7 On February 14, 1995, this investigator contacted Jack Maddox. Jack Maddox stated that his fire inspectors accepted the system last week, and the previous false alarm problem appears to have been solved. Jack Maddox also stated he was pleased with Sonitrol's actions in correcting the violations and feels that Sonitrol has fulfilled their obligations on the project. On February 22, 1995, John Meace, Chief Engineer for Ramada Hotel (replaced David Hicks), contacted this investigator complaining of false fire alarm problems, and was very concerned that the Beaumont Fire Dept. was fining the hotel for each false alarms On that day this investigator contacted Jack Maddox. Jack Maddox stated that he was unaware of any alarm problem at the Ramada Hotel, and that he would investigate the problem as soon as possible. Jack Maddox contacted this investigator later in the day, and revealed that the bell silence switch had been deactivated (this action disabled the alarm monitoring contacts). The hotel personnel had documented 17 fire alamms since the fire alarm control panel had been changed and recertified by Michael Waters. John Mease stated that the majority of the alarms had been caused by cigarette smoke and steam from the occupied rooms, and cigarette smoke in the bar area. On February 23, 1995, this investigator contacted Michael Waters. Michael Waters stated that after investigating the problem, he discovered that the bell circuit power supply was defective, and he would have the system repaired as soon as possible. On March 8, 1995, this investigator was contacted by Michael Waters. Mr. Waters stated that Jack Maddox was allowing the owner of the Ramada Hotel to remove the fire alarm system in the unoccupied, third, fourth, and fifth floors in B wing, if the owner removed all the combustibles from that area, and also shut off the power. Mr. Waters believed that eliminating the fire alarm system in the unoccupied areas would help solve the unexplained false alarm problem. The unoccupied areas are not temperature controlled and some of the vacant rooms were exposed to the outside elements because of missing air conditioning units from the walls. Mr. Waters will be testing the fire alarm system with the Beaumont Fire Department as soon as the owner removes the combustibles from the unoccupied areas. On March 8, 1995, Jack Maddox informed this investigator that he is very displeased with the fire alarm system at the Ramada Hotel, and that a follow-up investigation from the TCFP may be required II1. ALLEGED VIOLATIONS I. On or about January 1, 1992, Sonitrol Management Corporation, through it's agent or employee Patrick Speight and Patrick Speight individually completed the Fire Lite Alarms, Model Sensiscan 2000 fire alarm system at the Ramada Hotel, 2525 North 1 lth Street, Beaumont, Texas, even though the system was not in compliance as follows, contrary to the Texas Insurance Code, Article 5.43-2, section 7(3)(1989) Page 4 Case L-51-030-11-7 a. This building is in major need of renovations for it is in such tragic shape. it should be condemned or closed down until such repairs are completed and meets City codes. For example, the "C" building in the rear is nothing but a serious drug haven and fire hazard. It is completely destroyed on the inside. There are old mattresses all over the place, wallcovering falling off of the walls, etc. It also is home to several rodents. The same also holds for `B" building. There are windows that are missing or broken out. Curtains flying out of the windows, etc. There are also a lot of wall plates on the electrical plug ins that are missing, and this is a violation of city code. In "A" building there are some exposed wires that have not been fixed. These are in the first few rooms. Also I believe that they are suppose to use Fire coded sheetrock on their walls, and they are using only ', inch. I think this also is a violation of city code. The interior walls around the window area are completely rotted. They have metal studs and they are completely eaten up with rust. This cw surely be dangerous. I feel that with a thorough investigation of this building, you will see what I am talking about, and I am quite sure that you will close this place down until this business comes in compliance with the city ordinances like everyone else has to. I would like to speak few words to express my opinion in behalf of all our co-workers from the bottom of my heart. I have been working at this Hotel for more than 7 years. Some of us here in this group, even have been worked longer. I must say and I must retaliate to you that during this 7 years, there have never been an actual fire accident, any what so ever at all. These was a prove that our Hotel fire protection system is really working effectively. We had worked diligently, responsibly and dependably, It is true that the present Hotel's fire alarm system constantly went on giving false signals. There have been such a chronic problem for nearly 8 years since 1991 when. it was installed. We can say that this problem can only contribute the fire alarm system itself has yet a technical and/or a mechanical faulty. Nevertheless, you can never blame on us as workers performance or management problems. Furthermore, you can not use this as a reason to close down the whole Hotel.. Based on the fact I know of, our Hotel was originally built as a Sheraton Inn, called Spindletop, the symbol of Beaumont, At that time, a complete working system although it was an old type which is very similar to our home alarm type. However, the City Fire Marshall insisted to demand the Hotel to change to a new system when it was reopened. Unfortunately the new system was never proved to be workable. He took advantage of owner's absent and stole a large amount of cash from Hotel's petty cash account. He repaired his own Cadillac and charged to Hotel. The Hotel CPA have the evidence. If you are interested I can obtain. the evidence for you. He also sold his old lawn mower to Hotel secretly at a very high price. He collected many invoices as much as he can and charged to the Hotel. Bonczek, City Manager FROM: Tom Warner, Public Works Director SUBJECT: CONCORD ROAD - PHASE H COMMENTS The construction of Concord Road from IH-10 to East Lucas was divided into three phases. The limits of construction for each phase are approximately IH-10 to St. Helena, from St. Helena to the railroad tracks and from the railroad tracks to East Lucas. Construction of Phase I began in December 1998 and is currently 36 percent complete with 30 percent of the construction time used. The Engineer for Phases I and II of the project recently submitted plans for construction of the drainage outfall associated with Phase II. Due to the length of the outfall (1.5 miles), roadway improvements to Concord Road are proposed to be included in a separate contract. The proposed outfall will be constructed within the Delaware Street right-of-way from Concord Road to Pine Street. The outfall will continue on Pine Street to Manning Street and then down Manning Street to the Neches River. There are fifteen parcels that will be acquired because of this construction. The estimate.cost for the drainage outfall is $5.0 million. Completion of the outfall is necessary before beginning the roadway improvements to Phase II of Concord Road. It is anticipated that roadway improvements will be let for bid and construction beginning in the fall of 2000. The estimated cost for the roadway improvements in Phase II is $ 3.5 million. The lans and p specifications for Phase III of Concord Road are approximately 65 percent complete.
