REQUESTED ACTION: Council consider a resolution authorizing eminent domain
proceedings to acquire Lot 7 of Block 9 of the Van Wormer Addition

RECOMMENDATION
The property owner listed below has accepted the appraised value for the property[the appraiser was
Bishop Real Estate Appraisers] .However,the delinquent taxes on the property exceed the appraised
value making it necessary to acquire the property through condemnation.
Parcel 1: Lot 7 of Block 9 of the Van Wormer Addition
Appraised Value: $2,200
Owner: Anthony M. Padilla and wife, Rose G. Padilla
Administration recommends authorization to acquire this property by eminent domain.
BACKGROUND
The City of Beaumont, in cooperation with the Texas Department of Transportation has entered
into an agreement to lease a portion of the Martin Luther King,Jr.Parkway(Spur 380)right of way
for park purposes. The City of Beaumont desires to also acquire all of Block 9 of the Van Wormer
Addition for Park purposes.
BUDGETARYIMPACT
This project is funded under the Capital Improvement Program.

REQUESTED ACTION: Council consider a resolution authorizing the acceptance of two(2) -
ten foot (10') wide water line easements providing access for fire
prevention services.
Antioch Missionary Baptist Church has agreed to convey two(2)-ten foot(10')wide Water Line
Easements to the City of Beaumont. The easements will provide mandatory access for fire
prevention services for the Antioch Missionary Baptist Church located at 3920 Cardinal Drive
(out of Blocks 14 and 15, M. C. Cartwright Subdivision).
Administration recommends acceptance of the easements.
BACKGROUND
The easements are to be used to provide access to the water lines and fire hydrants for the property
named above. They would also allow for the construction, alteration,operation and maintenance
of the said water lines and appurtenances.

south side of the Delaware Extension, approximately 106' northeast
of Wilcox.
RECOMMENDATION
The Administration recommends approval of a zone change from A-R (Agricultural-Residential)
District to GC-MD-2(General Commercial-Multiple Family Dwelling-2)District and a specific use
permit to allow medical and professional offices and a daycare center located on the south side of
the Delaware Extension, approximately 106' northeast of Wilcox, subject to the following
conditions:
Provide one multi-tenant sign.
No exposed metal wall panels shall be allowed on the daycare building.
BACKGROUND
Beaumont Property Investments,the applicant,is requesting a zone change from A-R to GC-MD-2
and a specific use permit to allow doctors' offices and professional offices and a children's day care
center. The proposed property is located on the south side of the Delaware Extension,approximately
106' northeast of Wilcox bane.
The proposed development on the property will include a 4,800 sq. ft., 2 story structure that will
house an optometrist on the first floor and a second story for tenant office space,a 3,200 sq. ft.single
story dentist office and an 8,000 sq. ft. day care.
It is estimated that the doctors' offices will generate approximately 20 patients daily. The applicants
state that the day care would generate only slightly more traffic. All ingress and egress will be off
of Delaware. An 8' tall wood screening fence and 10' wide landscape strip will be installed along
the south and east property lines. The site plan shows monument signage in front of each of the three
buildings. One multi-tenant detached sign will be required.

At a Joint Public Hearing held June 20,2005,the Planning Commission voted 7:0 to approve a zone
change from A-R District to GC-MD-2 District and a specific use permit to allow medical and
professional offices and a daycare center located on the south side of the Delaware Extension,
approximately 106' northeast of Wilcox, subject to the following conditions:
Provide one multi-tenant sign.
No exposed metal wall panels shall be allowed on the daycare building.

BEAUMONT, TEXAS, BY CHANGING THE ZONING OF
PROPERTY PRESENTLY ZONED A-R (AGRICULTURAL-
RESIDENTIAL) DISTRICT TO GC-MD-2 (GENERAL
COMMERCIAL-MULTIPLE FAMILY DWELLING-2)DISTRICT
FOR PROPERTY LOCATED ON THE SOUTH SIDE OF THE
DELAWARE EXTENSION, APPROXIMATELY 106'
NORTHEAST OF WILCOX, BEAUMONT, JEFFERSON

side of the Delaware Extension, approximately 106' northeast of Wilcox, as described on
Exhibits "A" and "B" attached hereto and made a part hereof for all purposes, and the
official zoning map of the City of Beaumont is hereby amended to reflect such changes.
Section 2.
That, in all other respects, the use of the property herein above described shall be
subject to all of the applicable regulations of the underlying zoning district as well as those
regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as
amended.
Section 3.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.

(GENERAL COMMERCIAL-MULTIPLE FAMILY DWELLING-
2) DISTRICT LOCATED ON THE SOUTH SIDE OF THE
DELAWARE EXTENSION IN THE CITY OF BEAUMONT,
JEFFERSON COUNTY, TEXAS.
WHEREAS,the City Council for the City of Beaumont desires to issue a specific use
permit to Beaumont Property Investments to allow medical and professional offices and
a daycare center in a GC-MD-2 (General Commercial-Multiple Family Dwelling-2) District
located on the south side of the Delaware Extension, approximately 106' northeast of
Wilcox, as described on Exhibits "A" and "B" attached hereto and made a part hereof for
all purposes; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens, subject to the
hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That all conditions necessary for issuance of a specific use permit have been met
and a specific use permit to allow medical and professional offices and a daycare center
in a GC-MD-2 (General Commercial-Multiple Family Dwelling-2) District located on the
south side of the Delaware Extension, approximately 106' northeast of Wilcox, as
described on Exhibits"A"and "B,"attached hereto and made a part hereof for all purposes,
is hereby granted to Beaumont Property Investments, its legal representatives, successors
and assigns, as described in Exhibits"A" and "B" attached hereto and made a part hereof
for all purposes, subject to the following conditions:
0 Provide one multi-tenant sign.
No exposed metal wall panels shall be allowed on the daycare building.
Section 2.
That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as Exhibit "C"
and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein above
described shall be in all other respects subject to all of the applicable regulations contained
in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.

RECOMMENDATION
The Administration recommends approval of a zone change from RS (Residential Single Family
Dwelling) District to RM-H (Residential Multiple Family Dwelling-Highest Density) District at
1125 E. Lucas Drive.
BACKGROUND
Rosetta Jones, Executive Director of Statewide Consolidated CDC, Inc., is requesting this zone
change so that they can build a 14 unit housing complex for persons with disabilities adjacent to the
subject property. The subject property is located at 1125 E. Lucas. The housing complex will be
to the east of the subject property at 1005 E. Lucas.
In April, 2004, City Council approved a zone change to RM-H for the south 236'of 1005 E. Lucas
to allow the housing complex. Ms.Jones states that plans were then drawn for the housing complex.
Because that property is adjacent to RS zoning on the east and west sides, an 8' tall wood screening
fence and a 10' wide landscape strip would be required. The plans, as drawn, do not accommodate
the 10' wide landscape strip.
At this time, Ms. Jones is requesting this zone change for the south 236' of the subject property so
that the housing complex can be built without having to install the landscape strip along the west
property line of 1005 E. Lucas. Eventual plans include building a similar housing complex for the
disabled on the subject property, as well.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a Joint Public Hearing held June 20,2005,the Planning Commission voted 7:0 to approve a zone
change from RS (Residential Single Family Dwelling) District to RM-H (Residential Multiple
Family Dwelling-Highest Density) District at 1125 E. Lucas Drive.

That if any section, subsection, sentence, clause or phrase of this ordinance, or the

BACKGROUND
Walter and Keith Broussard,the applicants,are requesting a specific use permit to allow a"Daiquiri
King" at 1801 Washington Boulevard. The business would provide both seating for customers and
a drive-through. Beer, wine, daiquiris, snow cones and snacks would be served. The Broussards
estimate that 95% of their business will be drive-through.
Hours of operation will be 11 a.m. - 10 p.m., Monday through Thursday and 11 a.m. - 11 p.m.,
Friday through Sunday. The business will employee three persons.

BACKGROUND
Sybil Comeaux, the applicant, is requesting a specific use permit to allow her to build an enclosed
breezeway between her home at 4625 Corley and her mother's home which is under construction at
4635 Corley. The exterior of the two houses will have matching brick veneer. The addition
between the two houses will include a sunroom, entry hallway and closet totaling 233 sq. ft.
Ms. Comeaux states that her elderly mother is visually impaired. Connecting the homes would
enable her mother safe access between the two houses. Ms. Comeaux says that the breezeway will
give her mother the mobility she needs as well as allow Ms. Comeaux swift entry to care and assist
her mother.
A duplex is allowed in an RS District with a specific use permit.
BUDGETARY IMPACT

The"20% Rule"
Section 30-40. D. of the Zoning Ordinance states the following:
Protest: The City Council shall not amend, supplement, change,
modify or repeal any regulation, restriction or boundary or approve a
Specific Use Permit where a protest against such change, signed by
the owners of twenty(20) percent or more either of the area of the
lots included in such proposed change or of the lots or land
immediately adjoining the same and extending two hundred (200)
feet therefrom, except by the favorable vote of three-fourths (3/4) of
all the members of the City Council.
This means that in order to approve a zone change or specific use permit when the
20% rule has been invoked at least six Council members must vote in favor of the
Ordinance.
On File 1786-P, a protest of 30.75% was received, therefore invoking the Rule on
this case.

RECOMMENDATION
The Administration recommends approval of a specific use permit to allow an auto repair shop and
carwash in an NC (Neighborhood Commercial) District at 2795 Eastex Freeway subject to the
following conditions:
• Modification to the landscaping/screening requirement along the west property line
(no 8' tall wood screening fence or 10' wide landscape strip).
• Adherence to the City of Beaumont stormwater standards.
BACKGROUND
Bruce Caley, the property owner, is requesting a specific use permit to allow a general automotive
repair shop and a carwash at 2795 Eastex Freeway. Mr. Caley states that the subject property was
originally developed as a service station in the 1980's. Gasoline sales ceased in the 1990's.
According to Mr. Caley, car repairs continued after the cessation of gasoline sales. The applicant
would also like to wash cars. All washing would be done by hand. No machine or pressure washing
would occur at this location.
In March, 2005, the City Council denied a request to rezone this property to GC-MD. The intended
use of the property, at that time,was to operate a used car sales lot. The sale of cars is not permitted
in an NC District. Both general automotive repair and car washing is permitted in an NC District
with a specific use permit.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a Joint Public Hearing held June 20, 2005, the Planning Commission voted 7:0 to approve a
specific use permit to allow an auto repair shop and carwash in an NC(Neighborhood Commercial)
District at 2795 Eastex Freeway subject to the following conditions:
• Modification to the landscaping/screening requirement along the west property line
(no 8' tall wood screening fence or 10' wide landscape strip).

DISTRICT, LOCATED AT 2795 EASTEX FREEWAY, IN THE

WHEREAS,the City Council forthe City of Beaumont desires to issue a specific use
permit to Bruce Caley to allow an auto repair shop and carwash in an NC (Neighborhood
Commercial) District, located at 2795 Eastex Freeway, being Lots 1 and 2, Northwood
Addition, City of Beaumont, Jefferson County, Texas, containing 0.34 acres, more or less,
as described on Exhibit"A" attached hereto and made a part hereof for all purposes; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens, subject to the
hereinafter described conditions;

BACKGROUND
The Port of Beaumont is requesting the abandonment of a sliver of right-of-way that was acquired
by the City of Beaumont as part of the Pennsylvania Avenue street improvements.
The Port has acquired a lot adjacent to the subject property. The abandonment of the subject
property would ensure unimpeded access to the Port's property.
BUDGETARYIMPACT
None.

Advance Funding Agreement and authorize the City Manger to enter into such agreement.
BACKGROUND
The Intermodal Surface Transportation and Efficiency Act of 1991 (ISTEA)and the Transportation
Equity Act for the 21st Century(TEA-21) authorize transportation programs to meet the challenges
of protecting and enhancing communities and the natural environment and to advance the nations
economic growth and competivness.
The scope of work authorized by this agreement is described as the installation of traffic signal
preemption devices at 102 locations citywide. The metropolitan planning organizations participation
in this $356,491 project is usually 20%; however, since the project is safety related, 100% of the
construction cost is federally funded.
BUDGETARY
None. 100% of the project is federally funded.
