RECOMMENDATION The property owner listed below has accepted the appraised value for the property. However, the delinquent taxes on the property exceed the appraised value making it necessary to acquire the property through condemnation. Parcel 2: Lot 5 and Lot 6 of Block 9 of the Van Wormer Addition Appraised Value: $13,300 Appraiser: Bishop Real Estate Appraisers Owner: Habert Rhodes and wife, Gloria Rhodes Administration recommends authorization to acquire this property by eminent domain. BACKGROUND The City of Beaumont, in cooperation with the Texas Department of Transportation has entered into an agreement to lease a portion of the Martin Luther King, Jr. Parkway (Spur 380) right of way for park purposes. The City of Beaumont desires to also acquire all of Block 9 of the Van Wormer Addition for Park purposes. BUDGETARYIMPACT This project is funded under the Capital Improvement Program. RECOMMENDATION Administration recommends the approval of a contract with Alpha-Lee Enterprises, Inc. for the Independence Day fireworks display on July 4, 2005 in the amount of$25,000. BACKGROUND Alpha-Lee Enterprises, Inc. of Friendswood, Texas has provided the City's Fourth of July fireworks display for the past twenty(20)years. This service is exempt from competitive bidding since it is a personal service of an artistic nature. Alpha-Lee provides an aerial fireworks display which lasts approximately 16-18 minutes and includes the firing of over 1,000 various size shells. The$25,000 fee includes all labor, equipment, transportation, insurance, and permits necessary to produce a professional fireworks display on July 4, 2005. The contract includes a rain date of July 5, 2005. BUDGETARY IMPACT Funds are available for this service in the Convention Facility Division's operating budget. PREVIOUS ACTION None. Council shall meet and canvass the returns and officially declare the results. This ordinance will canvass the results of the May 7, 2005 election to elect a Mayor, two Councilmembers-At-Large, Councilmember Ward I, 11, 111 and IV. RECOMMENDATION Administration recommends awarding a contract to Moncla's, Inc. of Beaumont, Texas, for furnishing lunches for the Summer Food Service Program sponsored by the Recreation Division in the amount of$2.24 per lunch served. BACKGROUND The program,which is funded by the U.S.Department of Agriculture and administered by the Texas Department of Human Services,provides free, nutritious, and well balanced meals to any child up to eighteen(18)years of age. This is the fourteenth year the Recreation Division has participated in this program. The 2005 Summer Food Service Program will provide lunches at the following ten(10)locations: SITE ADDRESS L.L. Lunches will be served Monday through Friday excluding the Independence Day holiday on July 4, 2005. The number of lunches to be served at each location will be determined by the enrollment in summer activities, although participation is not a requirement to receive a lunch. Last year, 18,858 meals were delivered by Moncla's Inc. at a cost of$2.24 per lunch for a total of $42,241.92. Lunches were served for forty(40) days last summer at six(6)locations. The number of lunches served this year is expected to increase to approximately 58,000 because lunches will be served forty-nine (49) days and will be delivered to ten (10) locations. The additional days and locations are in response to citizens' requests. The new locations added this year include the Tracewood,North Ridge, Concord Manor, and Magnolia Garden apartment complexes. Bids were solicited from fourteen(14) food service vendors. Moncla's Inc. submitted the sole bid of$2.24 per lunch. BUDGETARY IMPACT The cost of each lunch served will be reimbursed to the City from the Texas Department of Human Services. The cost based on serving an estimated quantity of 58,000 lunches at $2.24 each is $129,920. PREVIOUS ACTION None. SUBSEQUENT ACTION None. RECOMMENDATION Administration recommends awarding the bid for the Downtown Improvements Pearl Street (Calder Avenue to College Street), Bowie Street(Pearl Street to Main Street), and Liberty Street (Pearl Street to Main Street) Interlocking Concrete Brick Pavers Project to Placo, Ltd., in the amount of$2,094,178.15. BACKGROUND On March 28, 2005, a total of three (3) bids was received for the Project with Placo, Ltd. being the apparent low bidder. During the review and evaluation of the bids, an error was discovered in the apparent low bidder's bid documents. The error changes the position of the low bidder to the second lowest bidder. A copy of the bid tab is attached. The review and evaluation of the bids for the new apparent low bidder, Allco, Inc., revealed that they did not attend the mandatory pre-bid conference as required by the bid documents. If the project was awarded to Allco, the other bidders would have grounds to challenge the award since they did not attend the pre-bid conference. The disqualification of the Allco bid now makes Placo the low bidder for the project. Additionally, Placo has indicated that they will execute a change order reducing the contract amount by $100,000 to reflect their bid based on the numerical unit cost for Item 686 Pedestrian Signal Assembly. The numerical unit cost and the written unit cost were in conflict. The written unit cost takes precedent in the bid specifications. BUDGETARY IMPACT Funds are available for this project in the Capital Improvement Program Fund. PREVIOUS ACTION None. SUBSEQUENT ACTION None.
