WHEREAS, the City Council of the City of Beaumont deems it necessary that
property located at 825 McFaddin be acquired for the future site of a new Convention and
Visitors Bureau Office Building; and,
WHEREAS, the City Council has found that a public necessity exists requiring the
hereinafter described property and as shown in Exhibit "A" attached hereto and made a
part hereof:
A 159.7' x 75.75'x 159.7' x 76.8' tract of land out of Tract 2, Block
4 in the Fuller Keith Addition
and,
WHEREAS, the City Council deems it necessary to acquire the hereinafter
described interests in and to the hereinafter described property for the future site of the
Convention and Visitors Bureau, and has found and determined that said interests in and
to the hereinafter described land is suited for such purposes and that it is necessary to
acquire same for said purposes; and,
WHEREAS, the City of Beaumont, through its duly authorized representatives, has
negotiated in good faith with the owners of the hereinafter described land and has been
unable to agree with such owners of such property as to the fair market value thereof and
damages, if any, and further negotiations for settlement have become futile and
impossible;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Attorney be and he is hereby authorized and directed to file or cause to be
filed against all owners of the following parcel of land, and all claimants of any interest
therein, proceedings in Eminent Domain to acquire fee simple title for said purposes, in
and to the said parcel of land shown in Exhibit "A" attached hereto and made a part
hereof, the parcels of land being situated in Beaumont, Jefferson County, Texas.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 22nd day of
March, 2005.

BEING a tract of land out of Block Number Four (4) of the Fuller-Keith Addition to
Beaumont,Texas,and being a portion of that certain tract of land conveyed by I H Phe tan,
et ut,to Mrs Margaret Phelan Reed by deed dated April 8, 1938, and recorded in Vol 447
Page 553, Deed Records,Jefferson County,Texas and being more particularly descnbed as
follows '
For a location point,BEGIN at the Southwest comer of BlockNumber Four(4)of the Fuller-
Keith Addition in the North tine of Calder Avenue and in the West line of Willow Street,
THENCE North 00 18' East with the West litre of Willow Street 224 25 feet to a mark in
the concrete locating the Southeast and the BEGINNING CORNER of the tract of land
herein described;.
THENCE West along the South side of a concrete curb 159 7 feet to a steel rod placed for
comer in the West I ine of the Reed Tract and in the East line of the Holley Motor Company
Tract,
THENCE North 00 18' east with the West line of the Reed Tract 75 77 feet to a steel rod .
for corner in the South,line of McFadden Avenue;
THENCE North 890 39'East with the South line of McFadden Avenue 159 7 feet to a point
for corner in the West line of Willow Street;
