ENTITLED AN ORDINANCE VACATING AND ABANDONING A
545' PORTION OF EAST LAVACA LOCATED IN THE J. W.
BULLOCK SURVEY, ABSTRACT NO. 7, BEAUMONT,
JEFFERSON COUNTY, TEXAS AND PROVIDING FOR THE
RETENTION OF A 60' GENERAL UTILITY EASEMENT.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
THAT a 545' portion of East Lavaca Street, located in the J. W. Bullock Survey, Abstract
No. 7, in Beaumont, Jefferson County, Texas, as shown on Exhibits "A," "B" and "C"
attached hereto, be and the same is hereby, vacated and abandoned and that title to such
property shall revert to and become the property of the persons entitled thereto, as
provided by law, subject to the retention of a 60' general utility easement.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 8th day of
March, 2005.

LEGAL DESCRIPTION FOR ORDINANCES PURPOSES
BEING a 0.7183 acre tract or parcel of land situated in the J. W. Bullock Survey, Abstract
No. 7, Jefferson County, Texas and also being a portion of the right-of-way of East Lavaca
Street (based on a width of 60 feet) and also being out of and part of that certain tract of land
as described in a deed from The Lummus Company to The City of Beaumont as recorded in
Volume 709, Page 555, Deed Records, Jefferson County, Texas and also out of and part of
that certain called 20,929 square feet tract of land as described in a deed from Kell Jones and
G. S. Jones to The City of Beaumont as recorded in Volume 709, Page 580, Deed Records,
Jefferson County, Texas and being all of that certain called 0.0413 acre tract of land as
described in a deed from The Wilson Holding Company to The City of Beaumont as recorded
in Volume 1410, Page 207, Deed Records, Jefferson County, Texas, said 0.7183 acre tract
being more particularly described as follows:
NOTE: All bearings are based on the Northeasterly right-of-way line of Spur
380 as NORTH 37°06'18" WEST as recorded in Volume 1430, Page 617, Deed
Records, Jefferson County, Texas.
COMMENCING at a Texas Department of Transportation concrete monument found for the
most Easterly corner of that certain called 0.405 acre tract of land identified as Parcel No. 30
as condemned by the State of Texas by Judgment recorded in Volume 1430, Page 617, Deed
Records, Jefferson County, Texas and also being an interior ell corner of that certain tract of
land as described in a deed from The Wilson Company to Lamar State College of Technology
as recorded in Volume 1456, Page 361, Deed Records, Jefferson County, Texas and said
corner also being an exterior ell corner of the Northeasterly right-of-way line of Spur 380
(width varies);
THENCE NORTH 37 006'18" WEST, for the boundary between the said Lamar State College
of Technology tract and the Northeasterly right-of-way line of Spur 380, for a distance of
46.23 feet to a Texas Department of Transportation concrete monument found for corner, said
corner being the most Southerly corner of that certain called 0.018 acre tract of land,
identified as Parcel No. 31, Part 1, as condemned by the State of Texas by Judgment recorded
in Volume 1442, Page 144, Deed Records, Jefferson County, Texas and being an exterior ell
corner of the said Lamar State College of Technology tract and an interior ell corner of the
Northeasterly right-of-way line of Spur 380;
THENCE NORTH 52 053'42" EAST, continuing for the boundary between the said Lamar
State College of Technology tract and the Northeasterly right-of-way line of Spur 380, for a
distance of 14.00 feet to a 5/8" iron rod set for corner, said corner being an interior ell corner
of the said Lamar State College of Technology tract and an exterior ell cornier of the
Northeasterly right-of-way line of Spur 380;
THENCE NORTH 37 006'18" WEST, continuing for the boundary between the said Lamar
State College of Technology tract and the Northeasterly right-of-way line of Spur 380, for a
distance of 50.00 feet to a 5/8" iron rod set for corner in the South right-of-way line of East
Lavaca Street and also being the POINT OF BEGINNING of the tract herein described, said
corner also being the Northwest corner of the said Lamar State College of Technology tract:

Lavaca Street, for a distance of 60.00 feet to a 5/8" iron rod set for corner, said corner being in
the North right-of-way line of East Lavaca Street and the South line of that certain tract of
land as described in a deed from Kell Jones and G. S. Jones to The Kansas City Southern
Railway Company as recorded in Volume 1306, Page 359, Deed Records, Jefferson County,
Texas;
THENCE SOUTH 88 015'17" EAST, for the boundary between the North right-of-way line of
East Lavaca Street and the said Kansas City Southern Railway Company tract, for a distance
of 460.96 feet to a "PK" nail set in a railroad cross tie for corner, said corner being the
intersection of the North right-of-way line of East Lavaca Street and the Southwesterly line of
the Kansas City Southern Railroad right-of-way;
THENCE SOUTH 43°29'18" EAST, for the boundary between the tract herein described and
the Southwesterly line of the Kansas City Southern Railroad right-of-way, for a distance of
85.20 feet to a 518" iron rod set for corner, said corner being the most Easterly corner of the
above referenced 0.0413 acre City of Beaumont tract and the most Northerly corner of that
certain tract of land as described in a deed from The Wilson Holding Company to Lamar State
College of Technology as recorded in Volume 1411, Page 203, Deed Records, Jefferson
County, Texas;
THENCE SOUTH 28 025'02" WEST, for the boundary between the said 0.0413 acre City of
Beaumont tract and the above referenced Lamar State College of Technology tract as
recorded in Volume 1411, Page 203, for a distance of 42.08 feet to a 518" iron rod set for
corner, said corner being the most Southerly corner of the said 0.0413 acre City of Beaumont
tract and the most Westerly corner of the above referenced Lamar State College of
Technology tract as recorded in Volume 1411, Page 203 and an angle corner in the East line
of the said Lamar State College of Technology tract as recorded in Volume 1456, Page 361;
THENCE NORTH 62 024'14" WEST, for the boundary between the said 0.0413 acre City of
Beaumont tract and the said Lamar State College of Technology tract as recorded in Volume
1456, Page 361, for a distance of 86.24 feet to a 5/8" iron rod set for corner, said corner being
the most Westerly corner of the said 0.0413 acre City of Beaumont tract; the Northeast corner
of the said Lamar State College of Technology tract as recorded in Volume 1456, Page 361
and in the South right-of-way line of East Lavaca Street;
THENCE NORTH 88 015'17" WEST, for the boundary between the South right-of-way line
