Cooper, City Attorney Kyle Hayes, City Manager Rose Ann Jones, City Clerk The City Council of the City of Beaumont,Texas, met in a regular session on March 1,2005,atthe City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items/Consent Agenda Consent Agenda Mayor Lord called the council meeting to order at 1:30 p.m. Reverend James Blackwell of the South Park Baptist Church gave the invocation. City Attorney, Tyrone Cooper led the Pledge of Allegiance. Roll call was made by Rose Ann Jones, City Clerk. Present at the meeting were Mayor Lord, Mayor Pro Tern Ames,Councilmembers Smith, Beaulieu, Cokinos, Patterson and Samuel. Also present were Kyle Hayes,City Manager;Tyrone Cooper,City Attorney; Rose Ann Jones, City Clerk. Proclamations, Presentations, Recognitions Youth and Government Team from Clifton J. Ozen High School - Recognition read by Councilmember Patterson on behalf of the Mayor and members of City Council was given to the Youth and Government Team from Clifton J.Ozen High School for their accomplishments at the local, regional and national level of competition Public Comment: Persons may speak on scheduled agenda items/Consent Agenda. None CONSENT AGENDA Approval of minutes - Minutes of February 22, 2005 Confirmation of committee appointments - Resolution 05-048 June Brailsford would be reappointed to the Convention and Tourism Advisory Committee. The current tern would expire November 25, 2006. (Councilmember Audwin Samuel) Minutes-March 1,2005 Barbara White would be reappointed to the Parks and Recreation Advisory Committee. The current term would expire October 8, 2005. (Councilmember Bobbie J. Patterson) Gloria Harrison would be appointed to the Library Commission. The term would commence March 1, 5005 and expire February 28, 2007. (Councilmember Bobbie J. Patterson) Lee Smith would be appointed to the Keep Beaumont Beautiful Commission. The term would commence March 1, 2005 and expire February 28, 2007. (Councilmember Bonnie J. Patterson) Shederick Evans would be appointed to the Community Development Advisory Committee. The term would commence March 1, 2005 and expire February 28, 2007. (Councilmember Bobbie J. Patterson) A) Approve settlement of the claim of George Smith brought in the lawsuit styled Penni Simonson, et al v. City of Beaumont - Resolution 05-049 B) Authorize the settlement of the claim of Willie Parker III - Resolution 05-050 Councilmember Cokinos moved to approve the Consent Agenda. Mayor Pro Tern Ames seconded the motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS, PATTERSON AND SAMUEL NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. PUBLIC HEARING: Receive comments on the 2005 Action Plan of the Five Year Consolidated Block Grant Program Open: 1:40 p.m. Close: 1:43 p.m. Public Comments: None Consider approving the preliminary2005 HUD Consolidated Grant Program Budget- Resolution 05-051 Administration recommended approving the Preliminary 2005 HUD Consolidated Grant Program Budget. As mandated bythe U.S. Department of Housing and Urban Development(HUD),City Council has conducted public hearings/workshops in previous years priorto adopting the City's Annual Action Plan. To date, the Community Development Advisory Committee(CDAC)has held two(2)meetings to discuss and review the process for submitting 2005 Action Plan Budget recommendations to the City Council. Community Development staff along with other City of Beaumont staff involved with the Page 2 of 6 Minutes-March 1,2005 Consolidated Grant program hosted three (3) Public Hearings to receive public comments relating to the process and activities germane to the 2005 Action Plan and the Five Year Consolidated Plan. Subsequent public hearings/workshops will follow. The preliminary 2005 budget is comprised of federal allocations of $2,016,696 in Community Development Block Grant funds,$809,799 in HOME funds and$150,000 of estimated program income. City Manager,Kyle Hayes presented an overview of the preliminary budget submitted. A question and answer discussion followed. Councilmember Beaulieu moved to APPROVE RESOLUTION 05-051 TO APPROVE THE PRELIMINARY 2005 HUD CONSOLIDATED GRANT PROGRAM BUDGET AS SUBMITTED. Councilmember Smith seconded the motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS, PATTERSON AND SAMUEL NAYS: NONE MOTION PASSED COUNCILMEMBER COMMENTS COUNCILMEMBER PATTERSON - ASKED PUBLIC WORKS DIRECTOR, TOM WARNER, TO PRESENT A REPORT OF THE 23RD STREET PROJECT TOM WARNER- GAVE AN UPDATE ON THE STATUS OF THE ELEVEN STREET LIGHTS WHICH ARE BEING REPLACED AND THE INCREASE OF TEN ADDITIONAL LIGHTS; THE STREETS AND DRAINAGE DEPARTMENT IS CURRENTLY PREPARING A PLAN TO ADDRESS THE DRAINAGE OF THE EXISTING SEWER SYSTEM; THE DRAINAGE ON PRIVATE PROPERTY IS THE RESPONSIBILITY OF THE PROPERTY OWNER COUNCILMEMBER PATTERSON- WISHED TO THANK THE PUBLIC FORATTENDING THE BLACK HISTORY PROGRAM HELD LAST WEEK AND FOR THE PARTICIPANTS WHO ASSISTED IN THE PROGRAM COUNCILMEMBER SAMUEL- COMMENDED THE ST.DREXAL ORGANIZATION AS WELL AS THE NEIGHBORHOOD ASSOCIATION FOR THE HEALTH FAIR AND THE AVAILABILITY OF SUCH A VARIETY OF MEDICAL PERSONAL AND HEALTH SERVICES; THANKED THE CITY MANAGER FOR THE POLICE REPORT RECEIVED ON THE PROGRESS MADE BY CHIEF SCOFIELD AND OFFICER FLANNIGAN FOR THE PROGRESS MADE IN THE POLICE Page 3 of 6 Minutes-March 1,2005 DEPARTMENT TO REFLECT THE POPULOUS OF OUR CITY; ANNOUNCED THAT LAMAR IS GOING TO THE BASKETBALL PLAYOFFS;WISHED THE BEST OF LUCK TO THE OZEN HIGH SCHOOL BOYS BASKETBALL TEAM IN THE PLAYOFFS; CONGRATULATED THE KELLY BULLDOGS FORWINNING THE STATE CHAMPIONSHIP MAYOR PRO TEM AMES - NONE COUNCILMEMBER COKINOS - NONE COUNCILMEMBER BEAULIEU - CONGRATULATED THE LAMAR UNIVERSITY GROUP THAT WORKED HARD ON HOMECOMING PROGRAM AND ALL THOSE WHO HELPED CELEBRATE; ALSO A THANKS YOU TO ALL THOSE WHO PARTICIPATED IN THE MAIN STREET FILM FESTIVAL COUNCILMEMBER SMITH - CONCERNED ABOUT THE RECENT HOME INVASIONS AND PROPERTY DAMAGE BETWEEN THE HELBIG ROAD AND WOODLAND ACRE AREA CITY ATTORNEY COOPER- NONE CITY MANAGER HAYES - NONE MAYOR LORD - POLICE AND LAW ENFORCEMENT RECEIVED THEIR RECOGNITION WITH AWARD NIGHT AND THE 100 CLUB RECOGNITION AND ARE PROUD OF THOSE PEOPLE WHO WERE RECOGNIZED; THANKED THE MAYOR PRO TEM FOR FILLING IN LAST WEEK WHILE SHE WAS ATTENDING TRAINING FOR ESTABLISHING AN INCIDENT COMMAND CENTER; TRAINING IS DONE ON A REGIONAL BASIS TO BETTER PREPARE THIS AREA FOR ANY INCIDENT WHICH MIGHT OCCUR Public Comments (Persons are limited to three minutes) LeRoy Lewis III 7866 Gladys Beaumont TX Ideals for City Council: suggested creating programs to take homeless off the streets or to install streets and drainage;suggested that police qualifications be reconsidered;would like better streets, sidewalks, school, etc. Page 4 of 6 Minutes-March 1,2005 Byron L. Lewis 4390 Corley Beaumont TX President of South 23rd Street Neighborhood Association: concerned with the yard and drainage problems from the street project and feels that this is not a homeowner issue;feels that the yards need to be returned to original condition Paul A. Brown 4370 Cartwright St. Beaumont TX 77707 Thanked the City for the street and sidewalk improvements but concerned with the all the excess water in the area as a result of the project and feels that this is not the problem of the property owner and the many problems that this can cause Amy Guidroz 4720 Littlefield Beaumont TX 77702 Thanked the Police Department and the media for their recent efforts for increasing the citizens awareness of recent illegal drug activities in the area and create citizens to help bring these activities undercontrol;suggested that a program to increase awareness in domestic violence; challenged every candidate to reinforce to citizens that it is their responsibility to make this community work Ernest Rollins 4745 Bolivar Beaumont TX Concerned with the drainage problems in his neighborhood;concerned with citizens blowing yard debris into the streets and clogging the drains Emma Brown 4370 Cartwright Beaumont TX Would like some improvements in the Hotel Beaumont parking conditions forthose living there J. W. Daniels 4270 Cartwright Beaumont TX Has had an erosion problem in front of his house forthe past fourteen years and would like a copy of the video tape of the storm drainage which was taken for his property and future plans of the City to take care of this problem Irma Keyes 4465 Cartwright Beaumont TX Concerned with the erosion and water problems in her backyard due to the new sewage lines Luke Jackson 4580 Cartwright Beaumont TX Concerns with the new sewage lines and the flooding problems that this has created on his property Allen Lee 5095 Maddox Beaumont TX Page 5 of 6 Minutes-March 1,2005 Proposed a new propertytax relief program forthe taxpayers in the City;concerned with the downtown development plans Joseph Lewis Box 62 Beaumont TX Feels thatthe City is responsible forthe rehabilitation of older houses instead of demolishing them,feels that this destroys the tax base and feels that this also denies the owner financial help to repair these homes There being no Executive Session, Council adjourned meeting at 2:35 p.m. Audio tapes are available upon request in the City Clerk's Office.
