The City Council of the City of Beaumont, Texas, met in a regular session on February 1,2005 at
the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the
following:

Consent Agenda
Mayor Lord called the council meeting to order at 1:30 p.m.
Mayor Lord gave the invocation. Councilmember Samuel led the Pledge of Allegiance. Roll call was
made by Rose Ann Jones, City Clerk.
Present at the meeting were Mayor Lord,Councilmembers Smith, Beaulieu,Cokinos, Patterson and
Samuel. Absent: Mayor Pro Tern Ames. Also present were Kyle Hayes, City Manager; Tyrone
Cooper, City Attorney; Rose Ann Jones, City Clerk.

CONSENT AGENDA
Approval of minutes - Minutes of January 25, 2005
Confirmation of committee appointments - Resolution 05-030
Johnny Casmore would be appointed as a memberof the MLK Commission. The term would
commence February 1,2005 and expire January 31,2007. (Councilmember Dr. Lulu Smith)

Johnny Casmore would be appointed as Chairman of the MLK Commission. The term would
commence February 1, 2005 and expire January 31, 2006. (Mayor Evelyn M. Lord)
Lynda Kay Makin would be appointed as Vice-Chairman of the Planning Commission. The
term would commence February 1, 2005 and expire January 31, 2006. (Mayor Evelyn M.
Lord)
Councilmember Cokinos moved to approve the Consent Agenda. Councilmember Smith
seconded the motion.

GENERAL BUSINESS
1. Consider approving the reappointment of Craig Lively as a City Magistrate -
Resolution 05-031
The City Charter states "there shall be one or more magistrates of said Municipal
Court known as City Magistrates,one of whom shall be designated Chief Magistrate."
City Magistrates receive compensation of$250 per session.
Councilmember Cokinos moved to APPROVE RESOLUTION 05-031 REAPPOINTING CRAIG
LIVELY AS A CITY MAGISTRATE OF THE CITY OF BEAUMONT FOR A TWO-YEAR TERM.
COMPENSATION SHALL BE$250 PER SESSION . Councilmember Smith seconded the
motion.

2. Consider approving a requestfora specific use permit to allow a beauty/barbershop,
property management office and meeting facility in an RCR(Residential Conservation
and Revitalization) District at 2406 North Street - Ordinance 05-016
Administration recommended approval of a specific use permit to allow a
beauty/barber shop and property management office only in an RCR (Residential
Conservation and Revitalization) District at 2406 North Street.

Keith Broussard,the applicant and property owner,is requesting a specific use permit
to allow a beauty/barber shop, property management office and meeting facilities at
2406 North. In August, 2004,Aereon Productions received a specific use permit to
allowthe use of the subject property as a film and production facility. That use appears
to have fallen through.
Mr. Broussard has stated thatthe beauty/barber shop would house 2 or3 chairs. The
property management office would employ 1 person and the office would be open from
8 a.m. to 5 p.m.
At a joint Public Hearing held January 24,2005,the Planning Commission voted 7:0
to approve a specific use permit to allow a beauty/barber shop and property
management office in an RCR(Residential Conservation and Revitalization)District
at 2406 North Street subject to the following conditions:
• Limit the uses to a three chair beauty/barber shop and a property management
office.
• Install a 8' tall wood screening fence along the north property line.
• Pave the remainderof the parking lot in the rearwith asphalt,directing drainage
onto North Street.
• Modification to the landscaping requirements along the north property line(no
10'landscaping strip required)and to the landscaping/screening requirements
along the east and west property lines (no 8'tall wood screening fence or 10'
wide landscape strip required).
Councilmember Beaulieu made a motion to ADOPT ORDINANCE 05-016 ENTITLED AN
ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW A BEAUTY/BARBER SHOP AND
PROPERTY MANAGEMENT OFFICE IN AN RCR (RESIDENTIAL CONSERVATION AND
REVITALIZATION)DISTRICT LOCATED AT 2406 NORTH STREET IN THE CITY OF BEAUMONT,
JEFFERSON COUNTY, TEXAS. Councilmember Cokinos seconded the motion.

Review and discuss proposed changes to the Code of Ordinances related to
Dangerous structures and the condemnation process
Start: 1:47 p.m. End: 2:30 p.m.
Public Works Director, Tom Warner, presented a power point presentation on
dangerous structures and the condemnation process which included the current
procedures, the proposed ordinance revisions and the proposed procedures.

This was followed by a question and answer period where Councilmembers had an
opportunity to discuss their ideas and views on the changes they would like to see in
the dangerous structure and condemnation ordinance.
