HELD FEBRUARY 21 , 1984
BE IT REMEMBERED that the City Council of the City of Beaumont , Texas,
met in regular session this the 21st day of February, 1984, with the
following present :

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held February
14, 1984;
Resolution 83-64 granting a 20-foot wide utility easement at the Lafin Road
Landfill to Gulf States Utilities Company;
Resolution 83-65 appointing James Bohl , Brian Riddle, Selman Clark, Dr.
Larry LeBoeuf, terms expiring February 28, 1986, and Dr. Michael Homes,
Dr. G. I . Holmes, Dr. R. T. Douthat , Wallace D. Williams and Elmer Embs,
terms expiring February 28, 1985 and naming Elmer Embs Chairman and Brian
Riddle as Vice-Chairman to the Emergency- Medical Services Commission ;
Resolution 83-66 authorizing the annual renewal of Standard and Poor's
Reference Library in the amount of $2 ,128. 00; and
Resolution 83-67 authorizing repairs to twelve (12) birth. record books
by R. D. Peeler & Sons (books are to be handsewn and papers repaired for
birth records from 1915 - 1943, repair work to be done in the Health De-
partment office) in the amount of $2 , 100.00.
The Consent Agenda was approved on a motion made by Councilman Lord and
seconded by Councilman Deshotel .

PUBLIC HEARING
APPLICATION FOR U.M.T.A.
TRANSIT OPERATING ASSISTANCE GRANT
MR. JOE TERNUS DIRECTOR OF URBAN TRANSPORTATI"ON:
This public hearing is for an application to the Urban Mass Transportation
Administration for 1984 Transit Operating Assistance. Under Section 5 of
the Urban Mass Transportation Act of 1964, as amended, the Federal Govern-
ment will participate with the City up to fifty (50) percent of the City' s
annual transit operating deficit . During 1984 . . . fiscal year 1984, we
estimate that there will be $1 ,498, 300.00 of expenditures with revenues
from Charter of $90,630. 00 and passenger revenues of $419,070.00, for a
net cost of $988,600. 00. We are asking for federal funds in the amount of
half of that or $494, 300. 00. This public hearing will be part of the grant
application that would be submitted to the Federal Government .

Thank you, Mr. Ternus. I think at this time , then, it is appropriate to
call the public hearing on the Urban Mass Transportation Administration
application for the Transit Operating Assistance funds. If there is any
one that would like to speak in connection with that , may do so at this
time. There not being anyone to speak on the public hearing, then I de=
clare the public hearing closed.

Resolution 84-68 authorizing the City Manager to make application with the
Urban Mass Transportation Administration for Transit Operating assistance
grant in the amount of $494, 300. 00 was approved on a motion made by Coun-
cilman Deshotel and seconded by Councilman Moore.

PUBLIC HEARING
APPLICATION FOR UMTA AID IN FINANCING FOR
MUNICIPAL TRANSIT PASSENGER' S AMENITIES PROJECT
MR. JOE TERNUS, DIRECTOR OF URBAN TRANSPORTATION:
This public hearing is on an application to the Urban Mass Transportation
Administration for aid in financing the Beaumont Municipal Transit Passen-
ger Amenity Project . Under the Section 5 of the Urban Mass Transportation
Act , capital projects such as Passenger Support Amenities are provided.
This particular grant is in the amount of $156, 573.00. This project will
include the engineering, design, inspection, purchase and installation of
a number of items including twenty (20) passenger shelters , one hundred
twenty-five (125) passenger benches; sixty (60) litter receptacles , six-
ty-five (65) litter barrels and fifteen ('15) display stands. This pro-
ject is a joing 1983-1984 capital improvement program and we are recom-
mending your approval. The public hearing will be a part of the grant
application.

I think it ' s appropriate now to call the public hearing on the Urban Mass

Resolution 84-69 authorizing the City Manager to make application with
the Urban Mass Transportation Administration for aid in financing for the

Ordinance No. 84-33 appointing Lane Nichols as City Attorney, effective
March 1 , 1984, at a base annual rate of pay of $57,500. 00 and confirming
and approving Kenneth Wall as an assistant city attorney at the same rate
of pay which he is receiving on the date of this ordinance was considered:

Resolution 84-70 awarding a contract to J. R. Plake, Inc. for improvements
on Weiss , McLean and Cottonwood Parks at a cost of $124 ,405:00 (8070 of the
project to be funded by Urban Parks and Recreation Recovery Program grant
from the National Park Service and The Texas Parks and Wildlife Department
and the City of Beaumont ' s Community Development Block Grant Program are
each contributing an additional 1070) was approved on a motion made by Coun-
cilman Moore and seconded by Councilman Deshotel .

Councilman Moore mentioned receipt of a letter from residents of Burgandy
Place & Dauphine Place complaining about poor drainage and flooding of
their homes after heavy rains. They also complained about a repair garage
being operated in violation of the zoning ordinance.
Mayor Neild asked for a status report for solving the problems of opera-
tion with the City ' s five (5) street sweepers.

Mrs. Mabel Turner, 2390 Basin Street , operator of a small day care center,
addressed Council to complain about the increase in the- food permit rates
from $15. 00 to $80. 00.
Mr. Herman Davis, 790 Amarillo, addressed Council to complain about poor
drainage; unsightly ditches; grass and trash in the main drainage ditch to
4th Street off Wall; broken sidewalks; overgrown alleys; outdated, worn and
unsafe power lines; standing water; dead and diseased trees in his neighbor-
hood. Mr. Davis presented a petition urging favorable response to these
problem areas.

MR. HERMAN DAVIS;
My name is Herman Davis and I reside at 790 Amarillo Street and the pro-
blem I am going to present you with I am pretty sure we have this problem
all over the City, but as . . . in our neighborhood, we .want to get started
on our problem right now and present it verbally to the Council and then
we want to present a petition to the Council from our community so we can
upgrade our neighborhood.
"Dear City Administration : Your attention is urgently needed on the en-
closed petition to help us, the citizens who care for our c�Zmunity neigh- •
borhoods' future appeal. Our neighborhood houses permanent-. families onf
stable jobs and 75% senior citizens retired and 20`,�o middle-aged families
who are concerned about our neighborhoods' future. These arq points of
interest requiring immediate attention: first , we have poor'-drainage to
none at all; unslightly •ditches dug out of grade; grass and trash *; a our
main drainage to Fourth Street off Wall (behind the Rice Mill and Beaumont
Steel Grounds and at College: What we are . . . ) . . . severer broken side-
walks, as much as 6-inches pointed up creating a safety haza 0; to citizens
hampering drainage also; alleyways adjacent to our pr6perti6lot with trees
growing and outdated; worn , unsafe power lines; and high grass' and stand-
ing water; dead and diseased trees needing removal before an kqcideia is
caused adds to an unslightly but could be a beautiful die ghborh od With-
out them; very poor night lighting caused by our tree pr-eblem;g urb erosion
into our ditches; high grass; garbage; stopped-up drainage and' neglected
upkeep as storage grounds; of Beaumont Steel and Gatlin',s plaed"at business.

"Whereas, we the citizens and taxpayers. want our shor e Cif planning
and revitalization and. regular maintenance; .
Whereas,w.e want covered, well-drained ditches an&repat e( main ditches;
Whereas, we want broken sidewalks removed and need not k>e replaced.
Whereas, we want special lighting for our particular initiation in our
neighborhood.
Whereas, we want firms'Jn our neighborhood to contribute to the cleanup
on our business sites (as our one business has already d6ne an the corner
of Fourth and Wall. It ' s a machine shop there and it really cleaned up
that area. It looks real nice. )
We want grass removed, from our main drain ditches... _(There are two main
drain ditches. going to Fourth Street by Duhon's Carr leaning Place there
and we have problems by taking tires out of it eves',*" once in awhile and
trash in there. There' s high grass growing in- there. )
We want our City Council and our At Large Council members to come into
our neighborhoods and view our situation needing attention. (Whgt the
problem is, we feel that we havd..people serving us that really do° not con-,
ceived our problem because a lot,.of them have not been into-,,our neigghbor-,
hoods 1 th t i we could see there in our neighborhoods , we feel

MR. DAVIS continued:
that they will know our problems. We know it 's a big problem but any
problem can start. We can start to finish that problem by coming up with
some ideas for the community.
I moved into the neighborhood in 1979 and the house that I moved into there
was a dilapidated house and had been unowned for 9 months and this house . . .
I brought it up to standard of the neighborhood because at that time, it
was the oldest house on the block and I feel that since we are doing this
particular job down there we feel there are some we call cosmetics around
our community that can be done also.
(.Mr. Davis showed pictures of his house when first moved in and when re-
paired. He also showed pictures of the poor drainage in the area. )
