Rhodes, West Tabernacle Baptist Church. The Pledge of Allegiance was led by Councilman Lord. -000- The following proclamations were issued: "National Future Homemakers of America and Home Economics Related Occupations Week in Beaumont" - Feb- ruary 12-18, 1984; "Texas School Lunch Week in Beaumont" - February 20-24, 1984; and "National Engineers Week in Beaumont" - February 19-25, 1984. -000- The Consent Agenda was considered: Approval of the Minutes of the regular City, Council session held February 7, 1984; Resolution 84-60 accepting a 10-foot water line easement from Lamar Uni- versity (8" water line to provide service and fire protection to the new Montagne Activities Center Building under construction at the north end of the existing football stadium site) ; and Resolution 84-61 authorizing execution of a 1-year agreement with Carl Neukirch, Sr. , for parachuting activities at the Beaumont Municipal Air- port . The Consent Agenda was approved on a motion made by Councilman Deshotel and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- Ordinance No. 84-25 abandoning a portion of a utility easement in Lot 16, Block 12 , Delaware Place, Section II (requested by Carl Kohler, engineer for the owner, Bob Douds) was considered: ORDINANCE NO. 84-25 ENTITLED AN ORDINANCE ABANDONING A 1-FOOT PORTION OF A 20-FOOT UTILITY EASEMENT IN LOT 16, BLOCK 12, DELAWARE PLACE, SECTION II , BEAUMONT, JEFFERSON COUNTY-, TEXAS. The ordinance was approved on a motion made by Councilman Cox and seconded by Councilman Lord. L. Lefler) was considered: ORDINANCE NO. 84-26 ENTITLED AN ORDINANCE VACATING AND ABAN- DONING 12TH STREET FROM CORLEY AVENUE SOUTH. TO TERRELL STREET AND PORTIONS OF CARTWRIGHT, ROBERTS AND TERRELL STREETS , BEAUMONT, JEF- FERSON COUNTY, TEXAS. The ordinance was approved on a motion made by Councilman Lord and secon- ded by Councilman Moore. Question : Ayes : All Nayes : None -000 Ordinance No. 84-27 establishing speed limits On Dowlen Road, Sarah Street and Eleventh. Street was considered: ORDINANCE NO. 84-.27 ENTITLED AN ORDINANCE AMENDING CHAPTER 26, SECTION 26-23 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ESTABLISH MAXIMUM SPEED LIMITS ; PROVIDING FOR SE'VERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Speed limits established are : DOWLEN ROAD a) : from a point 150 feet west of the centerline of Eastex West Frontage Road to a point 2 ,090 feet west of the centerline of Crow Road north and south direction of travel - to 40 m. p. h. ; b) : from a point 2 ,090 feet west of the centerline of Crow Road to a point 560 feet north of the center line of Gladys north and south direction of travel - to 45 m.p. h. ; c) : from a point 560 feet north of the centerline of Gladys to a point 150 feet north of the centerline of College - north and south direction of travel to 35 m.p. h. SARAH STREET a) : from the centerline of Fannett Road to a point 200 feet west of' the centerline of Fatima - east and west direction of travel - to 35 m.p.h. and ELEVENTH STREET d) : from a point 485 feet south Of the centerline of Cole- lege Street (U. Highway 90 (College Street ) was considered: ORDINANCE NO. 84-28 ENTITLED AN ORDINANCE AMENDING CHAPTER, 26, SECTION 26-23 OF THE CODE OF ORDINANCES' OF THE CITY OF BEAUMONT TO ESTABLISH MAXIMUM AND MINIMUM SPEED LIMITS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PRO VIDING A PENALTY. Speed limits established for U. S. Highway 90 are : (a) from a point 90 feet east of the centerline of the Santa Fe Railroad tracks to the centerline of 23rd Street - east and west direction of travel 35 m.p.h. ; (b) from a point 340 feet west of the centerline of 23rd Street to a point 450 feet west of the centerline of Langham Road - east and west direction of travel to 40 m. p. h. ; (c) : from a point 450 feet west of the centerline of Langham Road to a point 300 feet west of the centerline of Wooten Road - east and west direction of travel - to 45 m. p. h. and (-d) from a point 400 feet west of the centerline of Wooten Road to the west City limits - east and west -26- February 14, 1984 I II (Ordinance No. 84-28 continued: ) direction of travel - to 55 m.p.h. Question : Ayes : All Nayes : None -000- Ordinance No. 84-29 establishing speed limits on State Highway 105 was considered: ORDINANCE NO. 84-29 ENTITLED AN ORDINANCE AMENDING CHAPTER 26, SECTION 26-23 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ESTABLISH MAXIMUM SPEED LIMITS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Speed limits established for State Highway 105 (Sour Lake Rd) are: (a) from the centerline of U. S. 69 to a point 148 feet west of the centerline of E. Major Drive - east and west direction of travel - 45 m.p.h. ; (b) from a point 148 feet west of the centerline of E. Major Drive to a point 292 feet west of the centerline of FM 364 (Major Drive) - east and west direction of travel - to 50 m.p.h. ; and (c) from a point 292 feet west of the centerline of FM 364 (_Major Drive) to the west City limits - east and west direction of travel - to 55 m.p.h. The ordinance was approved on a motion made by Councilman Moore and se- conded by Councilman Deshotel. Question : Ayes : All Nayes : None -000- Ordinance No. 84-30 establishing speed limits on FM 364 (Major Drive) was considered: ORDINANCE NO. 84-30 ENTITLED AN ORDINANCE AMENDING CHAPTER 26, SECTION 26-23 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ESTABLISH MAXIMUM SPEED LIMITS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Speed limits established for FM 364 (Major Drive) are: (_a) from the center, line of Tram Road to a point 160 feet north of the center line of Dishman Road - north and south direction of travel -, to 55 m.p.h. ; (b) from a point 160 feet north of the centerline of Dishman Road to a point 200 feet north of the centerline of Manion Drive - north and south direction of travel 45 m.p.h. ; (c) from a point 200 feet north of the centerline of Manion Drive to a point 265 feet north of the centerline of Brighton Street north and south direction of travel - 35 m.p.h. ; (d) from a point 265 feet north of the centerline of Brighton Street to a point 300 feet south of the center-- line of Washington Boulevard - north and south direction of travel 45 M.p.h. (e) from a point 300 feet south of the centerline of Washington Boulevard to a point 538 feet north of the centerline of IH-10 west entrance and exit ramps - north and south direction of travel - 55 m.p.h. ; and (f) from a point 538 feet north of the centerline of IH-10 west entrance and exit ramps to the centerline of State Highway 124 (Fannett Road) - north and south direction of travel - 45 m. p. h. Question : Ayes : All Nayes : None -27 February 14, 1984 I Ordinance No. 84-31 setting rates for Entex, Inc. , was considered: ORDINANCE NO. 84-31 ENTITLED AN ORDINANCE SETTING RESIDENTIAL AND SMALL COMMERCIAL RATES FOR ENTEX, INC. ; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. KENNETH WALL, CITY ATTORNEY: In December, 1983 , Entex requested an increase in small commercial and residential rates within the City. The request by Entex would increase their annual revenues in Beaumont by about $228,000.00. We have reviewed the matter as detailed in the memorandum that we furnished you and recom- mend that their requested increase be reduced to about $217,000.00. This recognizes a reduction in the requested return on Common Equity from 17.6% to 16%. We think 16% is more reasonable for a regulated gas utility. The increase as proposed will increase the Company's total revenues slightly less than 1%. The monthly increase for residential customers will be 500 and we recommend that the ordinance be approved. The ordinance was approved on a motion made by Councilman Lord and se- conded by Councilman Cox. Question : Ayes : All Nayes : None -000- Ordinance No. 84-32 adopting new food service regulations and a food man- ager' s certification program was considered: ORDINANCE NO. 84-32 ENTITLED AN ORDINANCE .AMENDING CHAPTER 11 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT, TEXAS; PROVIDING FOR HEALTH REGULATIONS; PRO- VIDING FOR SPECIAL EVENT FOOD SERVICE ESTAB- LISHMENTS; AMENDING DEFINITIONS; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR FEES; PRO- VIDING FOR SEVERABILITY; PROVIDING FOR RE- PEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Moore and secon- ded by Councilman Deshotel. Question : Ayes : All Nayes : None -000- Resolution 84-62 authorizing purchase of pit sand (F.O.B. pit site at $1. 75 per cubic yard, delivered to landfill on Pine Street at $4.45 per cubic yard) and clay (F.O.B. pit site at $1.75 per cubic yard, delivered to landfill on Pine Street at $4.45 per cubic yard) from Beeco of Rose City (rebid necessary when a new law, passed January 1 , 1984, on gross weight of dump trucks on State Highways cut the amount of loads from 14 cubic yards to 10 cubic yards) was approved on a motion made by Councilman Deshotel and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000 Resolution 84-63 authorizing an amendment in the amount of $5,117.31 to the Walden Meadows Participation agreement with George A. Dishman, devel- oper, and Fittz and Shipman, engineers (48 storm sewer pipe required to tie into the outfall from the subdivision drainage system in lieu of the 36' pipe originally planned, increasing the City' s estimated cost from $49,989.49 to $55, 106. 80, including engineering fees, and the total esti- mated cost of the project from $128, 190.00 to $146,440. 00) was approved on a motion made by Councilman Moore and seconded by Councilman Deshotel. Question : Ayes: All Nayes : None -28- February 14, 1984 Councilman Deshotel mentioned receipt of a petition from residents on Fleming Lane complaining about the poor condition of the street . The petition was given to the Urban Transportation Director. Councilman Lord expressed her concern for a sign painting group - City Addressing Service - painting house numbers on curbs and implying this is done because of a need by the Police, the Fire Department , etc. She said, "I think we should all understand that you are perfectly free to go ahead and have these numbers painted - they charge you $3. 00 for it - perfectly free to do this , but you should understand this is not a City requirement nor is it a City outfit that is doing it . I would appreciate that being brought to the people' s attention. " Councilman Moore mentioned receipt of a petition from residents in the West Oakland Addition complaining about poor drainage in their area and requested ditches be dug on Estelle Street . -000- Jo Helen Easley, 955 Iris Lane ; John Williams, 1265 Stacewood; Carol Flatten, 6360 Arrowhead; Doreen Hammer, 1055 Dowlen ; Jan Ruppel , 1345 Stacewood; Betsy Hines, 6770 Greenwood; and Carolyn Loker, 6460 Wilder; all addressed Council to express their opposition to the Truck Route designation for Dow- len Road and urged Council to reconsider this designation in concern for the safety of children travelling to the two schools , the library, YMCA, park and play areas in the Dowlen area. -000- There being no further business, the meeting was recessed before continu- ing with the City Council Workshop Session. -000- I , Myrtle Corgey, City Clerk of the City of Beaumont , Texas , certify that the above is a true copy of the Minutes of the regular City Council ses- sion held February 14, 1984.
