City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by the Reverend Buddy Burton, Associate Pastor of Trinity United Methodist and Chaplin of the City Jail . The Pledge of Allegiance was led by Mayor Neild. -000- Five proclamations were issued: "Vocational Education Week in Beaumont" February 12-18, 1984 ; "Scouting Anniversary Week in Beaumont" - February 5-11 , 1984 ; "Phi Kappa Alpha Week in Beaumont" - February 6-12, 1984; "Beaumont Sales Month" - February, 1984; and "Willie Bauer Day in Beau- mont" - February 7, 1984 (Chief Willie Bauer retired today after 45 years of service with the Police Department and was also named "Police Chief Emeritus" ) . -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held January 31 , 1984 ; Resolution 84-48 executing an agreement with the State Department of High- ways and Public Transportation permitting them to construct , maintain and operate a safety lighting system on U. S. 69 from Lawrence Drive to Pine Island Bayou; Resolution 84-49 authorizing payment of $4,075.00 to Loden Machine Shop for emergency repairs to a storm water lift station pump at the llth Street Underpass; Resolution 84-50 authorizing purchase of two ice machines and one bin from C & L Ice Company at $6, 540. 00 and Resolution 84-51 reappointing Dewey Gonsoulin (.term expiring January 31, 1985) , Robert Edwards (terms expiring January 31 , 1986) and Gayle Yarbrough (term expiring January 31 , 1987) to the Civil Service Commission. The Consent Agenda was approved on a motion made by- Councilman Lord and seconded by Councilman Deshotel . Question: Ayes: All Nayes : None -000- -21- February 7 , 1984 Ordinance No. 84-21 granting a Specific Use Permit to establish an auto- mobile re_oa.ir and paint and body shop in a GC-MD (General Commercial - Multiple Dwelling) district at 745 Lindberg (requested by Gerald R. Con- don) was considered: ORDINANCE NO. 84-21 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR AN AUTOMOTIVE REPAIR AND PAINT AND BODY SHOP AT 745 LINDBERG. Mr. Jesse Torres, Asst . Planning Director, told Council that "after exam- ing the eight conditions necessary for approval of the Specific Use Permit, the staff recommended approval of the request with the installation of a 10-foot landscape buffer and an eight-foot privacy fence along the northern property line. You will note that his property has GC-MD zoning to its south and it is boarded on the north by the R-3 district which at a future date would be a target of a rezoning study by the staff . However, due to the ordinance requirements, the staff made that recommendation to the Plan- ning Commission. The Commission thereafter made a recommendation for ap- proval of the request with the installation of the 10-foot landscape buffer and an eight-foot privacy fence on that same northern property line by a vote of 5 to 1 . All of the other conditions for the approval of the Speci- fic Use Permit had been satisfied by the applicant . " Councilman Cox made a motion to approve the ordinance as recommended by the Planning Commission with the exception of the "North property line fence. " Councilman Deshotel seconded the motion with the amendment . Question : Ayes: All Nayes : None 000- Ordinance No. 84-22 abandoning Helbig Road from Voth Road northward to Pine Island Bayou was considered: ORDINANCE NO. 84-22 ENTITLED AN ORDINANCE VACATING AND ABAN- DONING HELBIG ROAD FROM VOTH ROAD NORTH- WARD TO PINE ISLAND BAYOU. The ordinance was approved on a motion made .by Councilman Deshotel and seconded by Councilman Cox. Question : Ayes: All Nayes : None -000 Resolution 84-52 executing an agreement with the State Department of High- ways and Public Transportation for installation of a traffic signal at S.H. 124 (Fannett ) and U. S. 69 frontage roads (S'tate to furnish funds for the preparation of plans and specifications, construction, and will be respon- sible for installation ; the City will maintain the signal after installa- tion) was approved on a motion made by Councilman Lord and seconded by Councilman Deshotel . Question : Ayes : All Nayes : None -000 Resolution 84-53 accepting the Dowlen Road T. I .P. Project as complete and authorizing final payment of $158, 204. 04 to Troy Dodson Construction Com- pany, Contractor (total construction cost - $2,889,601 . 63) was approved on a motion made by Councilman Moore and seconded by Councilman Deshotel . Question : Ayes : All Nayes: None -000- -22- February 7, 1984 Ordinance No. 84-23 changing the speed limit on Keith Road between Calder and College from 30 m.p.h. to 40 m.p. h. was considered : ORDINANCE NO. 84-23 ENTITLED AN ORDINANCE AMENDING CHAPTER 26, SECTION 26-23 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ESTABLISH A MAXIMUM SPEED LIMIT ON KEITH ROAD; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PRO- VIDING A PENALTY. The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Cox. Question : Ayes : All Nayes : None -000- Resolution 84-54 accepting as complete the Gorman Street Bridge Replace- ment and the Hillebrandt Bayou at 23rd Street Crossing Project and auth- orizing final payment of $6, 855. 94 to Saucier & Sons Enterprises, Inc. , (Contract awarded at $156, 130. 29 with 60 working days to complete; completed at $147,795. 09 after 70 working days - $8 , 335.20/5% below the original con- tract price less $2, 100. 00 for liquidated damages for the 10-day overrun) was approved on a motion made by Councilman Lord and seconded by Councilman Deshotel . Resolution 84-55 accepting the Lafin Road Project as complete and authoriz- ing final payment to Trotti and Thomson, contractor , in the amount of $13 , 075. 09 (total - $261, 501 . 75) was approved on a motion made by Council- man Moore and seconded by Councilman Lord. Question: Ayes: All Nayes : None --000- Resolution 84-56 authorizing annual traffic marking material contracts to Titan Fence Supply Company, Inc. at $10, 000. 00; Vulcan Signs at $4, 556.25; Pinkley Sales Company at $5, 794. 50; Crabtree Barricade Systems at $124.80; U. S. Standard Sign Company at $665. 98; D & S Barricading at $1 , 365.30; P.P.G. Industries, Inc. at $2,623 . 50; Mid Ohio Markings and Traffic at $14, 157. 55; Cataphote Division Ferro Corporation at $740. 58 ; Ennis Paint Manufacturing at $8 , 193 . 50; Road Runner Marker Manufacturing at $516.00; Southwestern Materials at $9, 650. 00; Highway Ceramics at $1 ,720. 00; Smith Municipal at $87. 50 and 3M at $15, 942. 60 (total of contracts - $76, 138 .06) was approved on a motion made by Councilman Lord and seconded by Council- man Cox. Question : Ayes: All Nayes : None -000- Resolution 84-57 authorizing purchase of an annual supply of computer stock paper from Moore Business Forms of Beaumont in the amount of $16, 105. 27 was approved on a motion made by Councilman Deshotel and se- conded by Councilman Cox. Question : Ayes: Mayor Neild Abstained: Councilman Councilman Cox Moore Councilman Lord Councilman Deshotel 000- Resolution 84-58 authorizing purchase of interest bond coupons from treas- ury bonds to be used in the City sinking fund for debt service was approved on a motion made by Councilman Lord and seconded by Councilman Cox. Question : Ayes: All Nayes : None -000-. -23- February 7, 1984 i Resolution 84-59 authorizing payment of approximately $11 ,000.00 to the State Department of Highways and Public Transportation from the Street Division for fabrication and installation of six (6) 8-foot by 92-foot "Thru Hazardous Materials Route" signs on State maintained highways within the City limits was approved on a motion made by Councilman Lord and se- conded by Councilman Moore. Question : Ayes : All Nayes: None -0 00 A public hearing was held to consider dilapidated structures: Mr. George Gardner, Director of Urban Rehabilitation Division, told Council that all the below-listed structures are in violation of Article III, Sec- tions 14-50 and 14-51 , of the Dangerous Structures Ordinance of the City of Beaumont , Texas, and that all notification procedures have been met : 1790 CARROLL - Willie Johnson, owner (13 violations) , recommendation to raze or repair within 30 days; 275 S. CENTER Alex Barrow, Jr. and Barry Goodman, owners (11 violations) recommendation to raze or repair within 30 days; 1321 CENTER - Maxine Alexis, owner (19 violations) , recommendation to raze or repair within 30 days; 1375 CENTER - Maxine Alexis, owner (20 violations) , recommendation to raze within 30 days; 2980 S. MAJOR DRIVE - Joseph E. Cicardo, owner (25 violations - fire damaged) , recommendation to raze within 30 days; 1460 SHERMAN - Mollie Bean, owner (20 violations) , recommendation to raze within .30 days; and 2236 VICTORIA - Rev. Horace S. Hall, owner (18 violations - fire damaged) , recommendation to Raze or'' Repair within 30 days. No citizens addressed Council in connection with the public hearing. -000- Ordinance No. 84-24 declaring certain dilapidated structures to be public nuisances and requiring their repair or removal was considered: ORDINANCE NO. 84-24 ENTITLED AN ORDINANCE FINDING CERTAIN STRUC- TURES TO BE PUBLIC NUISANCES AND ORDERING REPAIR OR DEMOLITION; PROVIDING A PENALTY; AND PROVIDING FOR SEVERABILITY. The ordinance was approved on a motion made by Councilman Lord and se- conded by Councilman Cox.
