The Pledge of Allegiance was led by Councilman Cox. -000- Two proclamations were issued: "Hire a New Employee in Beaumont" (spon- sored by Radio Station KIEZ-EZ 1380 AM) , week of January 30th; and "American History Month in Beaumont" - February, 1984. -000- Government students of Westbrook High School were welcomed to today's session. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held Janu- ary 17, 1984; Resolution 84-35 authorizing Change Order No. 1 to the contract with Mid- west Mechanical Contractors, Inc. in the amount of $2,828. 00 for improve- ments to the Water Treatment Plant , Contract 3 (painting, a revised pier depth and costs of temporary electrical service - contract from $6, 106,920 to $6, 109,788) ; Resolution 84-36 authorizing execution of a contract with Mobil Oil Cor- poration for supplying raw water ; Resolution 84-37 authorizing payment of $1,075.20 to Transit Mix Concrete & Foundation for 24 cubic yards of sand cement 2 SX Material for emergency repairs to a street ; Resolution 84-38 authorizing accepting Eighty-Eight Circle from Washington Boulevard 360-feet south to and including the cul-de-sac and water and sewer improvements in Lots 1-10, Block 1, Eight-Eight Place; Resolution 84-39 accepting portions of Ridgeland Avenue, Ford Street and Reagan Street and water and sewer improvements- in Lots 1-48, Block 48 and Lots 1-21 , Block 49, Calder Highland Extension Addition ; Resolution 84-40 accepting the Crow Road Participation Project as complete and authorizing final payment to John Bankston Construction Company in the amount of $7, 543. 38 (revised total - $150,867. 50) and authorizing reimburse- ment of $792. 00 to W. T. Little, developer, due to the project costs under- run; and -16- January 31 , 1984 Resolution 84-41 authorizing purchase of office furniture for the Sani- tation and Drainage Divisions at the Fleet Service Center from Etex Office Products, Inc. in the amount of $1 , 033 . 55 and Lamb' s Office Products in the amount of $1 , 776.75. The Consent Agenda was approved on a motion made by Councilman Lord and seconded by Councilman Cox. Question : Ayes: All Nayes : None -000- Ordinance No. 84-16 changing the zoning from R-3 (Modified Two Family and Multiple Dwelling) to GC-MD (General Commercial - Multiple Dwelling) , RM-M (Residential Multiple Family-Medium Density) , and RS (Residential Single Family) for property located in the 3200 Block of French Road and for all properties on Carlisle Drive from Concord Road to French Road - French Road Rezoning Study - was considered: ORDINANCE NO. 84-16 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICIATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM R-3 (MODIFIED TWO FAMILY AND MULTIPLE DWELLING) DISTRICT TO GC-MD (GENERAL COMMERCIAL - MULTIPLE DWELLING) , RM-M (RESIDENTIAL MULTIPLE FAMILY - MEDIUM DENSITY) , AND RS (RESIDENTIAL SINGLE FAMILY) DISTRICTS ON PROPERTY LOCATED IN THE 3200 BLOCK OF FRENCH ROAD AND FOR ALL PROPERTIES ON CARLISLE DRIVE FROM CONCORD ROAD TO FRENCH ROAD; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVID- ING FOR A PENALTY. The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Moore. Question : Ayes : All Nayes : None -000- Ordinance No. 84-17 changing the zoning from R-3 (.Modified Two Family and Multiple Dwelling) to GC-MD (General Commercial-Multiple Dwelling) for property bounded by North Street , Interstate 10, Liberty Street from 12th to 14th Street and all property between North and Liberty extending east of 14th Street for 650 feet (Calder/14th Street Rezoning Study) was con- sidered: ORDINANCE NO. 84-17 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM R-3 (MODIFIED TWO FAMILY AND MULTIPLE DWELLING) TO GC-MD (GENERAL COMMERCIAL-MULTIPLE DWELLING) DISTRICT ON PROPERTY KNOWN AS THE CALDER/14TH REZONING STUDY; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Cox. Question : Ayes : All Nayes : None -000- -17- January 31 , 1984 Ordinance No. 84-18 changing the zoning from RS (Residential Single Family) to RM-M (Residential Multiple Family-Medium Density) for property on the south side of Gladys, 135 feet west of Shakespeare (requested by Don Streety) was considered: ORDINANCE NO. 84-18 ENTITLED AN ORDINANCE AMENDING CHAPTER 39 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM RS (RESIDENTIAL SINGLE FAMILY) DISTRICT TO RM-M (RESIDENTIAL MULTI- PLE DWELLING - MEDIUM DENSITY) DISTRICT ON PROPERTY LOCATED ON THE SOUTH SIDE OF GLADYS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Lord. Question : Ayes: All Nayes : None -000- Ordinance No. 84-19 changing the zoning from RM-H (Residential Multiple Family-High Density) to RS (Residential Single Family) for property in the 2100-2200 Blocks of Pecos Street (requested by a petition of residents) was considered: ORDINANCE NO. 84-19 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM RM-H (RESIDENTIAL MULTIPLE FAMILY - HIGH DENSITY) DISTRICT TO RS (RESIDENTIAL SINGLE FAMILY) DISTRICT ON PROPERTY LOCATED IN THE 2100-2200 BLOCKS OF PECOS STREET, PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Cox. Question : Ayes: All Nayes : None -000- Ordinance No. 84-20 calling the General Municipal Election for the City of Beaumont was considered : ORDINANCE NO. 84-20 ENTITLED AN ORDINANCE ORDERING A GENERAL MUNICIPAL ELECTION TO BE HELD IN THE CITY OF BEAUMONT, TEXAS, ON THE 7th DAY OF APRIL, 1984, AS PROVIDING BY THE CHARTER OF THE CITY OF BEAUMONT, AND THE STATUTES OF THE STATE OF TEXAS, FOR THE PURPOSE OF ELECTING A MAYOR, TWO COUNCILMEN-AT-LARGE AND FOUR WARD COUNCILMEN; NAMING THE PRECINCTS AT WHICH THE ELECTION SHALL BE HELD; APPOINTING OFFICERS TO PRESIDE OVER SAID ELECTION; APPOINTING A CANVAS- SING BOARD FOR ABSENTEE VOTING; APPOINTING A MANAGER AND JUDGE OF THE CENTRAL COUNTING STATION; PROVIDING FOR NOTICE THEREOF; PROVIDING FOR A JOINT ELECTION WITH THE SOUTH PARK INDEPENDENT SCHOOL DISTRICT; AND PROVIDING FOR SEVERABI'LITY. The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Moore. Question: Ayes: All Nayes : None -18- January 31 , 1984 Resolution 84-42 authorizing the City Manager to execute an amendment to Article XI of the contract with the Beaumont Police Officers concerning promotions was approved on a motion made by Councilman Lord and seconded by Councilman Cox. Question : Ayes: All Nayes : None -000- Resolution 84-43 authorizing purchase of a one-ton truck with a power crane for the Water Reclamation Division from Kinsel Ford, Inc. , in the amount of $23 ,617. 04 was approved on a motion made by Councilman Lord and seconded by Councilman Moore. Question : Ayes: All Nayes : None -000- Resolution 84-44 authorizing purchase of 1 ,100 tons limestone rock asphalt pavement from White's Mines of San Antonio in the amount of $10. 99 per ton plus rail freight was approved on a motion made by Councilman Deshotel and seconded by Councilman Cox. Question: Ayes: All Nayes: None -000- Resolution 84-45 awarding annual contracts for 50,000 feet cable from Traffic Signals, Inc . in the amount of $11 , 024. 80 and 44,000 feet of copper wire from Consolidated Electrical Distributors in the amount of $2, 827. 52 was approved on a motion made by Councilman Cox and seconded by Councilman Lord. Question : Ayes: All Nayes: None -000- Resolution 84-46 authorizing purchase of an underground piercing tool for the Sewer Maintenance Division from Boehck & Gardner Equipment Com- pany was approved on a motion made by Councilman Lord and seconded by Councilman Lord and seconded by Councilman Moore. Question : Ayes: All Nayes: None -000- A resolution awarding annual contracts for traffic marking materials was deferred by the City Manager . -000- Resolution 84-47 appointing Dr. Fred Arcala as Acting Health Authority, effective February 1 , 1984, was approved on a motion made by Councilman Lord and seconded by Councilman Cox. Question : Ayes: All Nayes: None -000- After a brief discussion, Council requested that the City Attorney prepare information for the establishment of a Social Policy Advisory Committee for coordination of various social service agencies in areas where coopera- tion would result in elimination of duplication/over-lapping of time, money, etc. , for discussion at a future workshop session. -000- Mrs. Delia Harrington, 815 Willow Street , addressed Council first to ques- tion garbage pickup along Grand and Magnolia Avenues and to ask the School District to consider building new schools in the downtown area and that one of these could be named in memory of Dr. Martin Luther King, Jr. Mr. J. C. Leggett , 1849 Washington Boulevard, addressed Council to speak of the need of Kelly High School for Cable Television. -19- January 31 , 1984 Alex Stelly, president of the student body of Kelly High School , in recog- nition of Catholic Schools Week, January 29 - February 4 , 1984 , presented Council with a tray of croissants . -000- There being no further business, Mayor Neild called an Executive Session pursuant to Article TI of the Texas Open Meetings Law. -000- I , Myrtle Corgey, City Clerk of the City of Beaumont , Texas, certify that the above is a true copy of the Minutes of the regular City Council ses- sion held January 31, 1984 .
