CITY COUNCIL - CITY OF BEAUMONT
HELD AUGUST 23, 1983
BE IT REMEMBERED that the City Council of the City of Beaumont,
Texas met in regular session this the 23rd day of August, 1983,
with the following present:
HONORABLE: William E. Neild Mayor

The invocation was given by the Reverend J.R. Johnson of the
Northwest Christian Church.

The Pledge of Allegiance was led by Citizen J.C. Leggett.

The Mayor issued a proclamation for "Women' s Equality Day" . The
proclamation was accepted by Lin Owen of the League of Women
Voters on behalf of Linda Bottoms, N.O.W. ; Marty Jones, B.P.W. ;
Beth Lazenby, Women ' s Network; and Frances Fagg, American Assoc.
of University Women.

The following items from the Consent Agenda were considered:
Approval of minutes of August 2nd and August 9th
Resolution R-83-294 authorizing payment for books for the
Beaumont Public Library System to Strand Book Store in the
amount of $1, 031. 90.
Resolution R-83-295 authorizing payment of expenses for the
August 13th special election covering payment to Hartgraphics
for election packets in the amount of $1, 157 . 58 and a payment
in the amount of $4 , 021. 78 to Jefferson County for voting machines
ballot cards, ballot printing, personnel, and transportation of
machines used in the election.
Resolution R-83-296 appointing Lewis White to the Senior Citizens
Advisory Committee for a term expiring September 30 , 1985.
The consent agenda was approved on a motion by Councilman Cox
and seconded by Councilman Turner.

Ordinance 83-90 was introduced and the caution read:
ENTITLED AN ORDINANCE AUTHORIZING THE CITY MANAGER
TO EXECUTE CONTRACTS FOR THE SALE OF COMMERCIAL
CLOSED CONTAINER GARBAGE COLLECTION SERVICE; SUS-
PENDING ORDINANCE 0-1974-26 FOR PURPOSES OF SUCH
SALE; AND PROVIDING FOR SEVERABILITY.
The ordinance was adopted on a motion by Councilman Turner and
seconded by Councilman Lord.

The following ordinance was introduced by the Manager:
ORDINANCE 83-91
ENTITLED AN ORDINANCE AMENDING THE BUDGET OF
THE CITY OF BEAUMONT FOR THE FISCAL PERIOD
COMMENCING OCTOBER 1, 1982 AND ENDING
SEPTEMBER 30, 1983 BY ALLOCATING AND APPRO-
PRIATING FORTY THOUSAND DOLLARS ($40, 000. 00)
FROM THE GENERAL FUND ACCOUNT NO. 01-B360-00108
TO ACCOUNT NO. 01-B790-00333 TO BE USED FOR
EMERGENCY MEDICAL SERVICE OPERATIONS .
The ordinance was adopted on a motion by Councilman Turner and
seconded by Councilman Cox.

Resolution R-83-297 was introduced by the Manager authorizing
a contract between the City and John Bankston Construction Com-
pany, in the amount of $152, 136. 60 , for the Crow Road Partici-
pation project.
The City Manager pointed out that, in compliance with the City' s
Minority Business Enterprises Policy, the contractor had submitted
a letter showing that 10. 4 percent of the contract amount would be
allocated to a minority business.
The resolution was passed on a motion by Councilman Lord and
seconded by Councilman Cox.

Resolution R-83-298 was introduced by the Manager accepting
work performed under a contract by Ace Clark Construction Company,
for demolition of a condemned structure located at 805 DeVilleneuve
St, in the City.
The resolution was passed on a motion by Councilman Cox and secon-
ded by Councilman Lord.

Resolution R-83-299 was introduced by the Manager authorizing
the purchase of valves and fittings for the water utilities
stockpile based on bids received July 13, 1983 .
The resolution passed on a motion by Councilman Turner and seconded
by Councilman Lord.

Resolution R-83-300 was introduced by the Manager awarding a
contract to two companies for supplying drainage materials;
Gifford Hill Pipe Company and Pyramid Pipe Company. This is an
annual contract.
The resolution was passed on a motion by Councilman Cox and
seconded by Councilman Turner.

Resolution R-83-301 was introduced by the manager awarding a six-
month contract to Troy Dodson Company for supplying cement
stabilized sand.
The resolution was passed on a motion by Councilman Lord and se-
conded by Councilman Cox.

Resolution R-83-302 was introduced by the Manager and explained
by the Finance Officer. This resolution awarded a two-year
depository contract with First City Bank-Beaumont for city
funds.
The resolution was approved on a motion by Councilman Turner
and seconded by Cox.

Ordinance 0-83-92 was introduced and the caption read by the
Manager.
ORDINANCE 83-92
ENTITLED AN ORDINANCE AMENDING CHAPTER 2 OF THE
CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO
PROVIDE A ONE-YEAR TERM FOR THE CHAIRMAN AND VICE-
CHAIRMAN OF THE PLANNING AND ZONING COMMISSION;
PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL.
The ordinance was adopted on a motion by Councilman Turner and
seconded by Councilman Cox.

Councilman Cox commended City workers for doing a good job
on the "clean sweep" project just completed throughout the
City on trash pickup.
Councilman Lord stated that she had received a number of calls
concerning loose dogs in the City and that she would like to
publicly remind citizens that a $200. 00 fine could be assessed
for allowing their dogs to run loose.
Councilman Lord also informed the Council of complaint calls
from citizens who are unable to reach the Cable Television
office by telephone. Mrs. Lord said that she will be visiting
with other members of Council to consider establishing a
Committee to serve as a repository body to monitor complaints
from citizens relative to Cablevision.
There being no further business, the Mayor invited citizens
present at the meeting to address Council if they wished to do so.
Mr. J.C. Leggett, 1849 Washington Blvd. addressed Council urging
them to hold down expenditures on the budget, saying that he is
concerned with local and national economy and asked that the
City of Beaumont budget not be increased.
Mr. Ed Sigee, 2695 Corley, addressed Council to question their
decision related to action taken at this meeting on closed con-
tainer refuse collection contracts. Mayor Neild asked that Mr.
Sigee visit with the City Manager after the meeting for further
explanation on the matter.
Mr. Dan Kohihofer, 855 Howell , addressed Council to ask how they
had come to the decision on contracting out the closed container
refuse collection and how could other companies operate at a
lower cost than the City, also, who will control charges made by
private companies . Mayor Neild asked Mr. Kohihofer to also visit
with the City Manager after the meeting on this matter.

There being no further business, the Mayor adjourned the
meeting and announced that a workshop would follow a brief
recess.
