HELD AUGUST 2, 1983
BE IT REMEMBERED that the City Council of the City of Beaumont , Texas,
met in regular session this the 2nd day of August , 1983 , with the fol-
lowing present :

The Invocation was given by the Reverend Wayne Middleton, pastor of
Trinity United Methodist Church.
The Pledge of Allegiance was led by Councilman Cox.

One proclamation was issued: "Mikhail Baryshnikov Day in Beaumont" -
August 2, 1983 .

Presentations of Service Awards and Retirement Plaques were made :
Those receiving pins for 15 years of service were: Allen Kyles, Drainage;
Paul N. Bounds, Fire Department ; Virginia Leon, Municipal Court ; Prent
Craig, Parks Department and Weldon C. Dunlap, Police Department .
Those receiving pins for 20 years of service were : Pat Dickerson, Muni-
cipal Court ; David R. Ivey and George D. Schuldt , Police Department ; and
Shelby Bundick, Water Distribution.
Those receiving pins for 25 years of service were: Samuel Mayes, Drainage;
Charles T. Pierce, Fire Department ; Denny R. Stark and Maurice Mitchell,
Police Department ; James Foster , Monroe Guillory, William D. Lane and Charles
E. Moore, Sanitation; Dannie Toney, Urban Transportation; and Pierre A.
Comeaux, Water Distribution.
Those receiving pins for 30 years of service (pin has one ruby) were :
Clifford Baize and Cecil F. Rush, Police Department and Herman V. Burkett ,
Water Commercial .
35-year pin (with one diamond) was given to Frank Rose, Jr . , Drainage De-
partment .
Chief of Police Willie Bauer was given a pin with three diamonds for his
45 years of service.
Retirement Plaques were given to the following: John Vernon Barnett , Fire
Department ; Hugh Wright , Health Department ; Norma McCoy and Ruth Buskirk,
Library; Maurice Mitchell , Police Department ; Leroy Minton, Willie E. Thomas
and O'Neal Young, Urban Transportation; and David Carnley and George Moses
with Water Utilities Department ..

Ordinance No. 83-86 ratifying publication of notice of intention to issue
and sell $2, 350, 000 in certificates of obligation were considered:
ORDINANCE NO. 83-86
ORDINANCE AUTHORIZING, RATIFYING, APPROVING AND
CONFIRMING PUBLICATION OF NOTICE OF INTENTION
TO ISSUE AND SELL CERTIFICATES OF OBLIGATION.
The ordinance was approved on a motion made by Councilman Deshotel and
seconded by Councilman Turner. .

Resolution 83-274 accepting the bid of Neptune Water Meter. Company in the
amount of $91 ,498 . 74 for furnishing water meters for inventory as needed
over a one year period was approved on a motion made by Councilman Lord
and seconded by Councilman Cox.

Resolution 83-275 authorizing the purchase of 50, 000 general offense re-
ports for the Police Department from Doyle Business Forms in the amount
of $3 , 115. 00 was approved on a motion made by Councilman Deshotel and se-
conded by Councilman Turner.

Resolution 83-276 accepting the work performed under a contract with
Galaxy Building Corporation for construction of a restroom/shelter and a
storage shed at Klein Park and a restroom/shelter facility and concession
' stand at Babe Zaharias Park and authorizing final payment of $16, 649. 00
to the contractor was approved on a motion made by Councilman Lord and
seconded by Councilman Cox.

Resolution 83-277 accepting street improvements on Westchase Drive from
Washington Boulevard north approximately 585 feet , then west approximately
280 feet ; Winter Lane from Westchase Drive west for approximately 225 feet ;
and water and sewer improvements in Lots 1-31 , Block 1 , Westchase Subdivi-
sion and street improvements extending Howell Street approximately 1.69 feet
north to Drainage District 6 easement and water and sewer improvements in
Lots 1-8 , Howell Courts Subdivision was approved on a motion made by Coun-
cilman Cox and seconded by Councilman Deshotel .

Mr. Milton Palmer, Director of Code Enforcement , told Council that all the
below-listed structures are in violation of Article III , Sections 14-50
and 14-51 of the Dangerous Structures Ordinance of the City of Beaumont ,
that all notification procedures have been met and that all structures are
vacant :
1172 BROADWAY - Alvaro Aguirre, owner (16 violations) , recommendation to
raze within 30 days; 1186 BROADWAY (Front with 14 violations and Rear with
9 violations) - Alvaro Aguirre, owner, recommendation to raze within 30
days ; 2550 BROOKLYN (GARAGE) - James J. Edwards Estate, c/o D. M. Flynn,
owner (5 violations) , recommendation to raze within 30 days; 1542 CABLE
(REAR) - Carlean Jenkins, owner (23 violations) , recommendation
to raze within 30 days; 3575 DELTA STREET - Doris E. Davis (9 violations)
recommendation to raze or repair within 30 days; 1186 LAMAR - Sam Paradice,
owner (16 violations) , recommendation to raze within 30 days; 1842 LIBERTY
Wilbur J. Bergeron, owner (21 violations) , recommendation to raze or repair
within 30 days; 1400 LINCOLN (old Charlton-Pollard High School Band Room

ST. HELENA (REAR) - Dover Investment Corporation selling to Orina Simms
on deed of contract (23 violations) , recommendation to raze within 30 days;
3885 ST. HELENA - Leon Chambers, owner (25 violations) , recommendation to
raze or repair within 30 days and 3515 WASHINGTON - Sidney B. Williams,
owner (17 violations) , recommendation to raze within 30 days.
; Mayor Neild called the public hearing for the above-listed structures :
3575 Delta Street - Ms. Stellina Perez, East Texas Legal Services Para-Legal
representing Mrs. Doris E. Davis, owner, told Council that the back of the
house has been boarded up and trash is in the process of being removed.
She said that the structure could not qualify for Block Grant funds for
rehabilitation because the damage exceeded allowable loan limits . She fur-
ther said Mrs. Davis is living with her son who is out of work and trying
to repair the house whenever funds are available. Mrs. Davis plans to
live in the house when it is repaired. Ms. Perez told Council that she
had been advised by Mr. Gardner, Director of Urban Rehabilitation, that
all that was needed to bring the structure into compliance with the ordi-
nance was to board up the back and clean up the surrounding area.
1542 Cable - Mr. Palmer told Council that Mrs. Jenkins had requested the
recommendation be changed to raze or repair so that the structure, a gar-
age apartment , could be rehabilitated. No one representing the structure
addressed the hearing.
1179 North - Mr. Joe M. Mikesic, Jr. , owner , addressed Council to say that
he is presently working on the structure to bring it into compliance. He.
told Council that he received his first notice from Urban Rehabilitation
on July 14th. He asked that he be allowed to rehabilitate the structure.
3515 Washington - Sidney B. Williams, owner (deceased) . L. E. Williams,
representing his mother , addressed Council to request that he be given
opportunity to raze most of the structure (because of termite infestation
in all but two rooms) and repair and remodel so that his mother can move
back into the structure.
There being no one else wishing to addressed the hearing, it was closed.
1542 Cable (Rear) - Councilman Turner made a motion to add repair (raze
or repair) to the staff recommendation; motion was seconded by Councilman
Lord.

1179 North - Councilman Deshotel made a motion to add repair to the staff
recommendation (raze or repair) and to change the time given to 45 days;
motion was seconded by Councilman Lord.

3515 Washington - Councilman Turner made a motion to add repair to the
staff recommendation (raze or repair) and to change the time given to 90
days; motion was seconded by Councilman Deshotel .
Council members expressed concern for Mr. Williams expending time, energy
and money for a structure that may not be capable of rehabilitation. Fur-
ther discussion disclosed that the property is located in a commercial zone
and the possibility of a zoning violation if the structure is totally de-
molished and a new residential structure built .
Councilman Turner withdrew his motion and asked for a one week deferral
to give Mr. Williams and his mother the opportunity to work with the Plan-
ning and Urban Rehabilitation staffs to know what can be done -- options,
alternatives, etc. -- before Council action is taken.
Ordinance No. 83-87 declaring certain dilapidated structures to be public
nuisances and requiring their repair or removal was considered :

ENTITLED AN ORDINANCE FINDING CERTAIN STRUC-
TURES TO BE PUBLIC NUISANCES, AND ORDERING
REPAIR OR DEMOLITION; PROVIDING A PENALTY;
AND PROVIDING FOR SEVERABILITY.
Councilman Lord made a motion to approve the ordinance with amendments in
staff recommendation for 1542 Cable (Rear) and 1179 North and to withdraw
$515 Washington and defer action for it for one week; motion was seconded
by Councilman Deshotel .

Councilman Turner requested that consideration for an ordinance changing
the zoning from RM-H to CM for property at 3698 Glenwood be placed back
on the City Council agenda for Council action August 9, 1983 .

Mr. Bakmir Lukar (sp) , 5265 Parkview, addressed Council to request consider-
ation of naming another street after Dr . Martin Luther King, Jr . if the
proposition to rename M. L. King Drive back to 4th Street is approved on
the Special Election to be held August 13, 1983 .
Mr . A. B. Bernard, 2160 Ratcliff , addressed Council to complain about
high weeds and a dead tree on property in back of his and also to complain
about poor trash pickup.

There being no further business, the meeting was recessed before continu-
ing with the City Council Workshop Session.
