Neild Mayor Bill Cox Councilman, Ward I Evelyn M. Lord Councilman, Ward II Wayne Turner Councilman, Ward IV Absent : Joseph D. Deshotel Councilman, Ward III Hugh Earnest Acting City Manager Lane Nichols Asst . City Attorney -000- The Invocation was given by the very Reverend C. Andrew Metham, pastor of St . Matthews Episcopal Church. The Pledge of Allegiance was led by Councilman Turner. -000- The following proclamations were issued : "Dog Bite and Awareness- Week in Beaumont" - May 23-28, 1983 and "Buddy Poppy Days in Beaumont" - May 27 & 28, 1983. Approximately 70 5th grade students from Dick Dowling Elementary School and their teacher, Mrs. Sandra Henderson, attended today' s session. Two students addressed Council : GWEN GARRETT: My name is Gwen Garrett and this is Michael Revia and we are going to tell you about the safety project we have been working on this year. We took the children out and showed them where to cross because mostly the Head- start through 5th graders have been having problems crossing the street because of the traffic . So, we have a safety project and it ' s been go- ing really good. MICHAEL REVIA: For the safety project , we've been teaching the Headstart through 5th grade where to cross and we are really concerned about them crossing when nobody' s there because when nobody' s there, they just run across the street without looking. And, we would like to thank Mr. Ternus and former Mayor Maury Meyers for making our school safety patrol possible. -000- The Consent Agenda was considered: Approval of the Minutes of the regular City Council session held May 17, 1983; Resolution 83-191 granting an underground electrical easement to Gulf States Utilities Company to provide service to Klein Park; and Resolution 83-192 accepting as completed the work performed under the hydraulic grass seeding contract for Babe Zaharias Park soccer fields and authorizing final payment to Gulf Coast Hydra-Turf in the amount of $1,430. 00 (total contract - $14 , 300. 00) . The Consent Agenda was approved on a motion made by Councilman Lord and seconded by Councilman Cox. Question: Ayes : All Nayes : None -82 May 24, 1983 An ordinance changing the zoning from R-3 and GC-MD to RS, NC, and RM-M for the area included in the South Park West Rezoning Study, Section III , bounded by Euclid, Park, Brockman, and the Southern Pacific Railroad was considered: AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES 01' BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM R-3 (MODIFIED TWO FAMILY - MULTIPLE DWELLING) DISTRICT AND GC-MD (GENERAL COMMERCIAL - MUL- TIPLE DWELLING) DISTRICT TO RS (RESIDENTIAL SINGLE FAMILY) DISTRICT; NC (NEIGHBORHOOD COM- MERCIAL) DISTRICT; AND RM-M (RESIDENTIAL MULTI- PLE DWELLING - MEDIUM DENSITY) DISTRICT FOR AN AREA DESCRIBED AS THE SOUTH PARK WEST SECTION III REZONING STUDY; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. After a brief discussion, Councilman Cox made a motion to approve the ordinance with an amendment to change the zoning for Lots 7, 8, 9, and 10, Block 18, Arlington Addition, from the recommendation of Planning Staff and Commission for RM-M to NC; motion was seconded by Councilman Turner. (RM-M zoning was eliminated from the Study area. ) ORDINANCE NO. 83-55 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM R-3 (MODIFIED TWO FAMILY - MULTIPLE DWELLING) DISTRICT AND GC-MD (GENERAL COMMERCIAL - MULTI- PLE DWELLING) DISTRICT TO RS (RESIDENTIAL SINGLE FAMILY) DISTRICT; AND NC (NEIGHBORHOOD COMMERCIAL) DISTRICT FOR AN AREA DESCRIBED AS THE SOUTH PARK WEST SECTION III REZONING STUDY; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. Question: Ayes : Mayor Neild Nayes : Councilman Lord Councilman Cox Councilman Turner -000- Ordinance No. 83-56 granting a specific use permit for a beauty shop at 1430 Prairie in an area zoned RM-H (.requested by Veraldine Lefebvre) was considered: ORDINANCE NO. 83-56 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO OPERATE A BEAUTY SHOP ON PROPERTY LOCATED AT 1430 PRAIRIE STREET. Councilman Lord made a motion to approve the issuance of .the specific use permit with the exception that the use of the sign in front of the house be eliminated; motion was seconded by Councilman Cox. Question: Ayes : All Nayes : None -000- -83 May 24, 1983 Ordinance No. 83-57 granting a specific use permit for a utilities ser- vice center in the 5200-5300 Blocks of Washington Boulevard in an area zoned GC-MD (requested by Southwestern Bell Telephone Company) was con- sidered : ORDINANCE NO. 83-57 ENTITLED AN ORDINANCE FOR THE ISSUANCE OF A SPECIFIC USE PERMIT TO ESTABLISH A UTILITIES SERVICE CENTER ON PROPERTY LOCATED IN THE 5200-5300 BLOCKS OF WASHINGTON. Councilman Lord made a motion to approve the issuance of the specific use permit with the additional condition that the landscapped buffer strip required for the western property line be set back to a distance of 200 feet because of abutting RS property; motion seconded by Councilman Cox. Question: Ayes: All Nayes : None -000- Ordinance No. 83-58 granting a specific use permit for an office and ware- house for a construction contractor at 1520 S. Major Drive in an area zoned GC-MD was considered: nE ORDINANCE NO. 83-58 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR AN OFFICE AND WAREHOUSE FOR A CONSTRUCTION CONTRACTOR'S BUSINESS ON PROPERTY LOCATED AT 1520 S. MAJOR DRIVE. Councilman Cox made a motion to approve the ordinance; motion seconded by Councilman Turner. Question : Ayes: All Nayes : None -000- An ordinance abandoning a portion of a 20-foot-wide utility easement across property in Lots 7 and 8, Block 37 , Dowlen West , Unit XXI , at 1330 Galway (request made by Kohler and Kohler, Engineers, for the developer of Lot 8 to complete construction of a residence on that lot) was considered: AN ORDINANCE ENTITLED AN ORDINANCE ABANDONING THE SOUTH 1 . 8 FEET OF A 20-FOOT UTILITY EASEMENT LO- CATED IN LOT 7 AND 8, BLOCK 37, DOWLEN WEST, UNIT XXI , BEAUMONT, JEFFERSON COUNTY, TEXAS. A motion to deny passage of the ordinance was made by Councilman Lord; motion seconded by Councilman Turner. Question: Ayes: Councilman Cox Nayes : Mayor Neild Councilman Lord Councilman Turner -000- Resolution 83-193 accepting as completed the work performed under the construction contract by Russ Miller Construction Company for the EPA Grant #C 48-1254-04, Contract 12A - the Segment 36 Interceptor, and authorizing final payment to the contractor in the amount of $63 ,835.24 (total project cost - $1 , 179,746. 00) was approved on a motion made by Cpuncilman Turner and seconded by Councilman Cox. Question : Ayes : All Nayes : None -000- -84- May 24, 1983 Resolution 83-194 awarding a one-year maintenance contract for 175 elec- tric typewriters with Precision Office Products, Inc . in the amount of $8,750. 00 was approved on a motion made by Councilman Lord and seconded by Councilman Cox. Question : Ayes: All Nayes: None -000- Resolution 83-195 amending the FY 83 budget of the Beaumont Convention and Visitors Bureau to $188, 770. 00 was approved on a motion made by Councilman Turner and seconded by Councilman Cox. Question: Ayes : All Nayes : None -000- Resolution 83-196 amending the FY 83 budget of the South East Texas Arts Council to $48, 208. 00 was approved on a motion made by Councilman Turner and seconded by Mayor Neild. Question : Ayes : All Nayes : None -000- Resolution 83-197 authorizing execution of a contract with Traffic En- gineers, Inc. , consulting engineers, to provide professional services for traffic signal timing design, in an amount not to exceed $20,500.00 was approved on a motion made by Councilman Lord and seconded by Coun- cilman Turner. Question : Ayes : All Nayes : None -000- Resolution 83-198 approving an amendment to the 1983 CDBG Statement and a change in the program guidelines to allow $250,000 to be used for re- habilitation loans outside the Community Development Strategy Area was approved on a motion made by Councilman Cox and seconded by Councilman Lord. Question : Ayes: All Nayes : None -000 Ark ordinance granting ,a specific use permit for a tavern in a neighbor- hood shopping center on the southeast corner of Calder and Juncker Road (requested by Mrs. Mary Sakso) was considered: AN ORDINANCE ENTITLED AN ORDINANCE FOR THE ISSUANCE OF A SPECIFIC USE PERMIT FOR AN ESTABLISHMENT FOR THE SALE AND CONSUMPTION OF ALCOHOLIC BEVERAGES. The ordinance was denied on a motion made by Councilman Turner and secon- ded by Councilman Cox. Question : Ayes : All Nayes : None -000- Councilman Turner reported to Council on a recent meeting of the E.M. S. Board of Directors. He said the hospitals are currently meeting to develop a billing system for E.M. S. at the hospital sites for more effec- tive billing and collections. In addition, he said alternative funding, such as subscription rates, etc. , is being actively sought . Councilman Lord said several constituents had sent a letter about Neder- land' s handling of cases concerning dogs-at-large with increased fines, etc. , and asked staff to report on possibility of "making it more prohib- itive to disregard our ordinances on leashing and things like that" by increasing minimum fines. She asked for information on what the City of Nederland has done and how successful it has been with this problem. -000- -85- May 24, 1983 Mayor Neild recognized Judge LeBlanc in attendance at the session : JUDGE RICHARD LEBLANC, Jefferson County Commissioners Court : Thank yu very much, Mayor and Council members. I apologize for not get- ting on the agenda today but I thought it was imperative that I come and publicly thank Chief "Pete" Shelton for the outstanding job that he and his firefighters did in the disaster that we had out at the airport this past Friday. It is without a doubt in my mind, yu have one of the most professional firefighting forces anywhere in this part of the country and possibly the Nation; but I am also confident that without the leadership that Chief Shelton provides that would not be possible; nor would it be possible without your consent in condoning the purchasing of equipment and training of these professionals that we would have the type of team we evidently do have in the area. And, I would like to thank you and publicly thank Pete Shelton and all of his firefighters for the work that they did in averting any additional disaster and applaud them in their efforts . We thank you. -000,- City Manager Earnest told Council an indepth report on the proposed E.M. S. FY ' 83 Budget and projected revenues and a report on the Civic Center should be completed within the next two weeks. -000- Mr. Chris Pallone, 6340 Arrowhead, addressed Council to express apprecia- tion for the action taken in now allowing the issuance of a specific use permit for a tavern in a neighborhood shopping center on the southeast corner of Calder and Juncker Roads. Mrs. Catherine Dollinger , 630 22nd Street , addressed Council to request that "all citizens' complaints concerning a violation or alleged viola- tion of a City ordinance be made a matter of public record.
