HELD APRIL 12, 1983
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas , met
in regular session this the 12th day of April , 1983 , with the following
present :

The Invocation was given by the Reverend Stephen Sampson, Praise Christian
Center.
The Pledge of Allegiance was led by Councilman Lord.

Cub Scouts from Den 5, Pack 20, from Rox'7 Guess Elementary School - Den
Mother , Mrs. Bill (Reggie) Cox - were welcomed to today' s meeting.

The following proclama.tions were issued : "Shriners ' Hospital Day in
Beaumont" - April 16th; "Jobathon Day in Beaumont" - April 15, 1983 ; "Coin
Week in Beaumont" - April 17-23, 1983 ; "National Consumer Credit Education
Week in Beaumont" - April 24-30, 1983 ; "1st Annual Auction for the American
Cancer Society" - April 15, 1983 ; "Gene & Mr. Lonnie ' s 5th Annual Chili
Cook-Off Da- in Beaumont" for the American Cancer Society - April 16, 1983
and "Golden Gators Baseball Week in Beaumont" - April. 18-24 , 1983 .
Mayor Neild presented a poster drawn by Texas artist , Jack Boynton , to
Mr . Bob Boudreau, Director of the American Wind Symphony Orchestra, as a
remembrance of Beaumont . The orchestra is scheduled to perform for the
opening of the Riverfront Park, tonight , 7 :30 p.m. in the park.

The Minutes of the regular City Council. sessions held March 29, 1983 and
April 5, 1983 , were approved on a motion made by Councilman Lord and se-
conded by Councilman Deshotel .

Ordinance No. 83-37 adopting the Project Plan for the Downtown Reinvest-
ment Zone was considered:
ORDINANCE NO. 83-37
ENTITLED AN ORDINANCE APPROVING THE PROJECT
PLAN FOR REINVESTMENT ZONE NUMBER ONE, CITY
OF BEAUMONT, TEXAS; AND PROVIDING FOR SEVERA-
BILITY.
The ordinance was approved on a motion made by Councilman Turner and se-
conded by Councilman Cox.

An ordinance annexing 75. 03 acres of land on the south side of Washing-
ton Boulevard west of the city limits (requested by Washington West . for
development of 352 residential lots) was considered :
AN ORDINANCE
ENTITLED AN ORDINANCE ANNEXING THE HERE-
INAFTER DESCRIBED TERRITORY TO THE CITY
OF BEAUMONT, JEFFERSON COUNTY, TEXAS , AND
EXTENDING THE BOUNDARY LIMITS OF SAID CITY
SO AS TO INCLUDE THE SAID PROPERTY WITHIN
THE CITY LIMITS AND GRANTING THE SAID TER-
RITORY AND TO ALL FUTURE INHABITANTS THEREOF
ALL OF THE RIGHTS AND PRIVILEGES OF OTHER
CITIZENS AND BINDING SAID FUTURE INHABITANTS
BY ALL OF THE ACTS AND ORDINANCES OF SAID
CITY.
The ordinance was passed to its second and final reading on a motion made
by Councilman Deshotel and seconded by Councilman Turner.

Resolution 83-135 authorizing the execution of a contract with BoMac Con-
tractors , Inc . , for construction of the Corlet Street TIP Project in the
amount of $980, 991 . 50 was approved on a motion made by Councilman Deshotel
and seconded by Councilman Cox.

Resolution 83-136 accepting the work performed under the contract with
Greer Construction Company for construction of the Prince Street Outfall
and authorizing final payment in the amount of $22 , 51-1 . 59 to the con-
tractor (funded by CDBG - project completed at total. cost of $450, 231 . 74 ,
a savings of $59 , 993 . 13 of original contract cost ) was approved on a mo-
tion made by Councilman Lord and seconded by Councilman Cox.

An ordinance amending Chapters 6 and 10 of the City Code relating to fee
schedules in code enforcement was considered :

CITY OF BEAUMONT, TEXAS; PROVIDING FOR
FEES; PROVIDING FOR SEVERABILITY; PROVID-
ING FOR REPEAL; AND PROVIDING A PENALTY.
The ordinance was deferred for further review.

Resolution 83-137 letting a contract with Keown Supply for the recycling
of 1 , 500 cubic yards of street base material in the amount of $6, 000. 00
was approved on a motion made by Councilman Lord and seconded by Council-
man Cox.

Ordinance No. 83-38 amending the Industrial Waste Ordinance was considered :

ENTITLED AN ORDINANCE AMENDING CHAPTER 28 OF
THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT
BY REPEALING ARTICLE VI , SECTIONS 28-100 THROUGH

28-106, REGULATING THE DISPOSAL OF INDUSTRIAL
WASTE IN THE CITY OF BEAUMONT; THE USE OF PUB-
LIC AND PRIVATE SEWERS AND DRAINS; THE REMOVAL
AND DISPOSAL OF WASTEWATER FROM HOLDING TANKS;
PROVIDING A PENALTY; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH; AND PROVIDING SEVERABILITY.
and
Resolution 83-138 supporting the pretreatment program and declaring
intent to support the administration of the amended industrial waste
ordinance and to provide the funding required for the implementation
of the pretreatment program
were approved on a motion made by Councilman Lord and seconded by ,Coun-
cilman Turner.

Resolution 83-139 granting a 10-foot-wide easement to Gulf States Utilities
Company for an underground electric service line to the new restroom faci-
lities on Babe Didrickson Zaharias Park was approved on a motion made by
Councilman Lord and seconded by Councilman Cox.

Ordinance No. 83-39 amending FY 83 city budgets and Ordinance No. 81-105
the annual appropriation ordinance was considered :

ENTITLED AN ORDINANCE AMENDING ORDINANCE
NO. 82-105 AND THE BUDGET FOR THE FISCAL
YEAR BEGINNING OCTOBER 1 , 1982 ; REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH AND PROVIDING FOR SEVER-
ABILITY.
The ordinance was approved on a motion made by Councilman Turner and se-
conded by Councilman Lord.

Resolution 83-140 authorizing the appropriate city official to contract
with Billy J . Howell , consulting engineers, for field survey work for capi-
tal projects was approved on a motion made by Councilman Lord and seconded
by Councilman Cox.

COUNCILMAN COX:
I think as most of you probably know, Larry Williams, the former president of
the Firefighters Association, suffered a heart attack recently and has since
had surgery. I spoke with him yesterday and he said he is doing fine and
was supposed to go home this morning. He is going to have to be off work
about three months but everything looks good at this point . I believe I
speak for the Council and the City in wishing him a speedy recovery.

Councilman Lord mentioned receipt of a letter from the State Board of In-
surance concerning Key Rates and requested a Workshop discussion and re-
view of the information. Mrs. Lord also questioned the status of the
Cable Television report . City Manager responded it should be completed
within two weeks. In addition , Mrs . Lord questioned the weekend closing
of the Landfill saying citizens trying to cleanup trash, etc. , had no way
of disposing of the items, Landfill is closed on Sundays. Suggestions

such as placement of dumpsters, etc. were made. City Manager said dif-
ferent solutions to the problem were being considered such as a possible
specific area clean-up with the Landfill being opened for that specific
weekend.
Councilman Deshotel asked that the City Attorney prepare for a future
Workshop review a report concerning the question of a single member .dis-
trict as opposed to at large districts system and how this would be
emplemented by the Council if the Council so chose; what statutory limi-
tations are involved for expanding or changing the make-up of City Coun-
cil .

Mr . W. M. Gould, 7050 Donna, Woodland Acres , again addressed Council to
request special permission to burn leaves by the residents of Woodland
Acres. City Attorney Kenneth Wall responded that the regulations of the
Texas Air Control Board prohibit any open burning and cities are not per-
mitted to make any exceptions to state law.
Mr. Raymond L. Fontenot , 2860 Sarah, addressed Council to complain about
unfair treatment by the code enforcement department in cutting of weeds
on property owned by him.
Mr. John Dugan , Route 4 , Box 33B, Beaumont , representing the American
Federation of State, County and Municipal Employees Union, Local 385,
.addressed Council to thank Council for not cutting city personnel as a
means of helping the City budget and also spoke against contracting out
for services.
Mr. J. C. Leggett , 1849 Washington Blvd, addressed Council to complain
about the ditch along Chamberlin Drive from Washington Blvd. to College.

There being no further business, the meeting was recessed before continu-
ing with the City Council Workshop Session.
